Corrections
• Regulations found in MCAPCO originate from either of two sources:
• most are adopted by reference from State rules.
• some are developed locally by Mecklenburg
County.
• The 2015 revisions are all regulations adopted by reference from the state.
• Proposed adoption by the Board of County
Commissioners on December 15, 2015.
• June 23, 2014 United States Supreme Court ruling:
– Rejected EPA’s definition of “Major Source” based solely on GHG emissions for Prevention of Significant
Deterioration (PSD) and Title V permitting,
– Facilities would not be permitted for PSD or TV solely on the basis of GHG emissions, but
– For sources subject to PSD or TV permitting for another pollutant – so-call “anyway” source – GHG emissions will be evaluated
• MCAPCO Regulations Revised:
– 1.5502 – “Applicability”
– 2.0544 – “PSD for GHGs”
• Transportation facility permitting was part of the county’s carbon monoxide maintenance plan
• The State determined permitting of transportation facilities:
– no longer provides an environmental benefit, and
– is no longer federally required.
• MCAPCO Sections Repealed:
– 1.5600 – “Transportation Facility Procedures”
– 2.0800 – “Transportation Facilities”
– Various other regulations revised to remove references to transportation facility permitting
• On December 14, 2012, EPA revised the
National Ambient Air Quality Standard
(NAAQS) for PM2.5:
– The annual arithmetic mean concentration revised from 15.0 to 12.0 micrograms per cubic meter, and
– The 24-Hr average concentration remains 35 micrograms per cubic meter
• Revised: MCAPCO 2.0410 – “PM2.5 Particulate
Matter”
• Previously required by state law – the “A6” form.
• State Session Law 2014-120 repealed the requirement for facilities to submit these plans.
• MCAPCO Regulations Revised:
– 1.5212 – “Applications”
– 1.5507 – “Applications”
• In 2014 NC established new Toxic Air Pollutant
Permitting Emission Rates (TPERs) for facilities where all stacks are vertical and un-obstructed
• Revision corrects the TPERs for two pollutants:
– Methyl Isobutyl Ketone (MIBK): 31.59 lbs/hour
– Toluene: 197.96 lbs/year
• Revised: MCAPCO 1.5711 – “Emission Rates
