Introduction
Target group
This Master Class is aimed at public officials from national
and sub-national administrations and other bodies awarding
and managing concession contracts (and their professional
advisers) in EU Member States, candidate countries and
beyond. It should also be of interest to policy makers in EU
Member States, auditors, private sector providers, personnel
in European institutions and organisations and international
organisations based in the EU and academics.
Description
The award of concession contracts in the EU has recently
changed with the enactment of Directive 2014/23/EU which
regulates the award of concession contracts.
Effective use of the concessions directive is key to realising
value for money in the award and execution of concessions
contracts. This is particularly the case in the current fiscal
climate where they can be used in conjunction with private
finance for the provision of infrastructure, such as European
transport and energy infrastructure, to modernise public
services.
The Master Class will explain the new rules and what they
mean for Contracting Authorities and Contracting Entities
awarding concession contracts, as well as assessing options
for how they can be best applied, taking into account legal,
economic, financial and operational considerations.
The emphasis of the Master Class is on the rules in Directive
2014/23/EU but the interactive style of the Master Class
means that issues related to the award of concession
contracts in the context of the current European rules
can also be addressed where participants are running
procedures launched prior to the application of the new
Directive.
The specific practical questions about the effective
implementation of Directive 2014/23 include:
• How in practice will awarding bodies demonstrate that the
conditions for the use of the concessions directive are met?
• How different are the rules for the award of concession
contracts as compared to those for public contracts and
what does this mean in practice for the award process?
• What do awarding bodies need to do to plan the effective
use of contracts awarded using the concessions directive?
• How can awarding bodies best use the flexibility which the
concessions directive provides?
Experience shows that not all methods of awarding and
managing concession contracts have so far been equally
effective in promoting value for money for the public sector,
and objective advice on when and how to award them is hard
to find.
This Master Class will give you the opportunity to receive
advice on your specific issues from our experts and to share
the experience of others in the public sector.
Objectives
Master Classes are intended for public officials and their
professional advisers with a good understanding of contract
award and management issues, aiming to improve knowledge/
skills in the award and management of concession contracts,
and to discuss practical issues relevant to concessions in the
award or execution phase or for which the award phase is
being prepared.
Learning methodology
Presentations and exchange of experiences. The approach
is based on a high degree of interactive discussion of
practical issues faced by participants. Numbers are limited
to a maximum of 20 participants to facilitate discussion and
maximise learning benefits

MASTER CLASS LEADERS
The Master Class will be led by:
Michael Burnett, a UK Chartered Accountant, who has led
EIPA’s activities in PPP and concessions for the past eleven
years and has more than 25 years of experience in PPP,
public procurement, contract management and public
financial management, and
Dr. Annette Mutschler-Siebert, a partner at K&L Gates LLP,
Berlin, Germany, who has extensive experience in advising
on public procurement, concessions and PPP schemes.
