PROCEDURAL ITEMS Chairman Macdonald opened up with a recap from the last meeting and a review of today’s agenda. The first procedural item was approval of the minutes from May 29, 2013 as amended. On motion duly made and seconded; it was VOTED: To approve the minutes of May 29, 2013 as amended. Next is approval of the July 15, 2013 minutes as amended. On motion duly made and seconded, it was VOTED: To approve the minutes of July 15, 2013 as amended. Chairman Macdonald announced the appointment of David Saltiel to the Commission by Treasurer Grossman. Mr. Saltiel was unable to attend today’s meeting. The next item on the agenda was the adoption of the By-Laws. The Chair announced that they will defer this item to give the Commission more time to comment on them. The Commission discussed creating Sub-Committees to address certain issues that come up in the meeting. It was discussed if one of the subcommittees could be created for the public to go to if they have ideas for unsolicited proposals of PPP project. The Commission agreed to look at subcommittee where they feel it might be needed. Mr. Levenson suggested the Commission create a Subcommittee be formed to come up with a methodology that works for them. The Commission asked KPMG to collect information to see if there are certain areas that would benefit from one. 2 Next Quentin Palfrey gave a presentation on Policy Considerations. MassDOT bases policy considerations around creating jobs and economic development with transportation. They want to build safe and reliable transportation system, meet the current and future transportation needs, and to manage transportation assets. Transportation funding falls far below MassDOT’s needs. The burden of the any new investment must be fair and appropriate by broadening the transportation network services to serve more and different users in more locations. There is a need for more and better access to our transportation system for people with disabilities and mobility challenges. There is also a need for a transportation system that is environmentally sustainable. Transportation investment needs to encourage development of sustainable, livable communities creating smart growth. Transportation is also bicyclists, pedestrians and vehicles; there is a need to find better ways to share our roadways through engineering, education and enforcement. The Commission asked if this is criteria they have to use. Mr. Palfrey wants to put the Commission in the same mindset as MassDOT when considering projects so they start off with shared policy decisions but the Commission has its own autonomy. KPMG presented the high level PPP suitability assessment summary. They began with a recap of the past couple of meetings. They identified six projects; South Station, Route 3 South, Highway Rest Stops, South Coast Rail, Blue and Red Line Connector and Blue Line extension to Lynn. The criteria for assessing the projects are public transportation needs and priorities in 3 plans provide opportunity for acceleration, innovation and efficiencies, requires funding and provides opportunity for revenue generation and capital raising and is the project ready for procurement. The possible delivery options are; Design Build, Design Build and Finance, Design Build Finance and Maintain/Availability Payment, Design Build Finance Operate and Maintain/AP, Design Build Finance Operate Maintain/Concession and other delivery option. There are five project features; public funding, self funding, ability to move quickly, potential for demand and risk transfer and potential for operate and maintenance risk transfer. The Commission discussed each of the six projects presented and the obstacles and probability of some of the projects being able to go forward. They discussed next steps on how to figure out what elements to use to put a project as a PPP. The Commission decided that the Route 3 North is a project that should be considered. The Commission also asked for more information on the PPP SR-91 in California for the next meeting. The Commission decided on three projects to go forward; the Route 3 South project, South Station and the highway rest stops. The remaining three; South Coast Rail, Blue Line Extension to Lynn and the Red and Blue Line connector need more work done on the MassDOT side.
