Jurisdiction
1.1.
North Norfolk District Council is the Licensing Authority under the
Licensing Act 2003 in respect of Premises licences for the sale of
alcohol or regulated entertainment. Where a valid application for a
premises licence or variation is received and relevant representations
are made, before determining the application, the authority must hold a
hearing to consider the case.
2.
Description and Location of Premises
2.1. A new purpose built 2 storey facility adjacent to the current school
buildings and the playing fields in a central location in the town. The
school campus is bounded by residential dwellings and the Memorial
Park.
3.
Licensing History
3.1.
The North Walsham and District Bowls & Snooker club which occupy
an adjacent part of the school site has the benefit of a Club Premises
Certificate for the supply of alcohol to club members between the hours

of 09.00hrs and 23.00hrs Monday to Saturday and 12 noon to 22.30hrs
on Sunday
3.2.
The North Walsham High School has the benefit of a Premises Licence
for the sale of alcohol at the premises Sunday to Saturday 16.30hrs to
22.00hrs.

The current application
4.1.
The application was made by the Board of Governors of the School as
a premises licence so the facilities can be operated for the benefit of
the school as well as providing a venue for use by the town generally.
4.2.
The application seeks the following permissions from Monday to
Sunday 08.00hrs to 24.00hrs

The provision of regulated entertainment including: plays; films; live
music; recorded music; facilities for making music; performance of
dance; dancing and similar entertainment
The application seeks the following permissions from Monday to
Sunday 07.00hrs to 24.00hrs

Sale of alcohol on and off the premises

The provision of late night refreshment
4.4.
Whilst the application is primarily concerning the new atrium building,
permissions are being sought for these activities external to the
building but within the boundaries of the school campus to enable such
permissions to be used during events organised by the school or other
bodies including farmers markets etc

Representations
5.1.
The application was received on 8 July 2011 deemed acceptable and
consultation started. .The application notice appeared in the North
Norfolk News 14 July 2011 and was posted around the perimeter of the
school site. The formal consultation period for this application is 9 July
to 5 August 2011.
5.2.

6.2.
When considering this application the Sub Committee will need to have
regard to the North Norfolk District Council Licensing Policy and to
statutory guidance under the Licensing Act 2003 issued by the
Secretary of State
6.3.
In determining this application the Sub Committee may take the
following actions:
o Grant the application
o Grant the application subject to conditions
o Refuse the application

This application must be determined and notified to the applicant within
5 working days from the conclusion of the hearing.
Appeals
There is a right of appeal to the decision of the Sub Committee to the
Magistrates court within 21 days.
