PRESENTATION OF THE GOLD AWARD FOR THE PUBLIC RELATIONS CATEGORY AT
THE CHARTERED INSTITUTE OF PUBLIC RELATIONS EAST ANGLIA PRIDE AWARDS
TO PETER BATTRICK, PETER FREW AND ROB YOUNG
The Head of Coastal Strategy, Peter Frew, said that the award was in recognition of the work
done in bringing the Government’s attention to the plight of those living in coastal areas. North
Norfolk District Council had successfully secured £3m from the Coastal Change Fund. He
thanked officers and Members for their support during the campaign.

PRESENTATION – THE CITIZEN’S ADVICE BUREAU
Fiona Hunter, Chief Officer of Citizen’s Advice, North Norfolk gave a presentation on the work
of Citizen’s Advice across the district. After the presentation, questions were taken:

a) The Chairman asked whether it was difficult to get people to volunteer. Mrs Hunter replied
that they were very fortunate to have a lot of willing volunteers but she acknowledged that
the Fakenham office needed more.
b) A Member pointed out that Holt, Dereham and Watton operated separately from the
Fakenham and North Walsham branches. He felt this was confusing and would prefer one
group across the District. He acknowledged that there was no evidence that the set-up
impacted negatively on customers. Mrs Hunter responded that it was purely for historical
reasons that the division occurred. They operated as two completely independent
charities and it would be very difficult to merge them.
c) The work of the outreach centres was praised, particularly in Stalham. Mrs Hunter agreed
that Stalham was a very popular unit but stressed that the outreach centres relied on the
availability of experienced advisers as they often worked alone.
d) The issue of donations by Parish Councils to Citizens Advice was raised. A Member felt
that it would help if Citizens Advice could suggest a donation rather than simply relying on
the goodwill of parish councils. Mrs Hunter said that she would be willing to do this if
requested. She added that they were always willing to attend Parish Council meetings to
discuss the work of Citizens Advice and answer questions.
e) A Member commented that he felt those receiving advice should be asked to donate. Mrs
Hunter replied that it was within their constitution not to request payment from customers.
There were collection boxes in the interview rooms and people regularly donated to them.

The Chairman reminded Members that an additional recommendation would be considered at
Agenda Item 12. She thanked everyone who had attended the Pantomime. £4000 had been
raised and divided between two charities: SSAFA and North Norfolk Families First.

Minute 104 NORTH NORFOLK SITE SPECIFIC PROPOSALS DEVELOPMENT PLAN AND
CONVERSION AND RE-USE OF RURAL BUILDINGS AS DWELLINGS POLICY REVIEW
Mr K Johnson, Ward Member for Cromer Town stated that he had been asked to speak on
behalf of Cromer Town Council and several local residents regarding concerns about the
conduct of the Examination Hearings and the conclusions of the Inspectors Report in relation
to site C04.
The Strategic Director – Communities read out the following statement in response:
Background:The Council’s position in allocating site C04 within the Site Specific Proposals Plan,
notwithstanding the objections which had been raised during 2009 and previous stages of
consultation, was agreed at the meeting of Full Council on 24th Feb 2010 when the DPD was
approved for submission. The DPD was subsequently submitted to the Planning Inspectorate
on 25th March 2010. The Plan has since been the subject of detailed consideration by
Planning Inspector Paul Dobsen during the period 25th March to 1st December 2010, when the
Inspector issued his binding report. This process involved the consideration of all key issues
raised by objectors to individual allocations, both in respect of their written submissions and
attendance at the public hearing sessions.
The outcome of the Examination was that all allocations proposed by the Council, bar one at
Holt where the Inspector proposed the allocation of an alternative site, were endorsed by the
Inspector.
Issues for consideration based on matters raised by objectors to allocation C04:The concerns of objectors to the allocation of site C04 are now understood to relate, in
addition to issues of merit, to the process of the Examination Hearing, particularly their view
that the issues of concern were not adequately considered and debated by the Inspector.
At Examination Hearings the Inspector has a wide degree of discretion around how he/she
wishes to conduct each session and there is flexibility in the administration of the process
within the context of there being an overall expectation of ‘fairness’. Concern was and

continues to be expressed in relation to the Cromer session around departure from the
published agenda, the order of speaking, and the absence ‘cross examination’ and of a right of
reply. The Council understands that a number of objectors raised these concerns with the
Inspector at the time and that some wrote to the Inspector following the hearing further stating
these concerns.
Notwithstanding these concerns the Inspectors Report shows that he carefully considered the
issues involved at site C04 ie - extent of development proposed in the AONB, coastal erosion
risk, sustainability of the site, type and quantum of development, access and traffic generation
and effect on nearby residential properties in paras 71 – 76 of his report. He concludes in
para 77 that these representations and other matters “do not go to the soundness of the
proposed allocation”.
Recommendation:As part of the process of adoption, the Plan can be the subject of Judicial Review in the six
weeks following the decision to adopt. As this is a formal part of the LDF process and officers
are of the view that the Inspector conducted a robust examination of the issues raised by
objectors and promoters of site allocations, members are invited to endorse the
recommendation from Cabinet of 10th January 2011.
RESOLVED
To adopt the Site Specific Proposals Development Plan, amended Proposals Map and Single
Policy Review.

RECOMMENDATIONS FROM JOINT STAFF CONSULTATIVE COMMITTEE 10 JANUARY

RESOLVED
That the revised Attendance and Authorised Absence Policy and Procedure be adopted
subject to the following amendments:
a) Exam leave and requests for time off for training, 9.1 to read: “If you are studying for a
qualification that is supported by the Council and covered by a training indemnity then you
are eligible for one day off to study per examination or time off to complete a key
assignment, subject to a maximum of 3 days per annum, plus time off for the examination
itself.
b) Dealing with long term absence, 7.12: the last sentence should read “An extension to
contractual pay for any period beyond the four weeks has always been subject to the
approval of the Organisational Development Manager.”
c) Medical appointments, 12.3 should read: “Managers should, in consultation with HR,
authorise paid time off (this will be subject to regular review to ensure continuing eligibility)
when specialist, hospital or prolonged treatment is required and for appointments made as
a result of a specific recommendation at an SAR meeting, for cancer screening, with
Occupational Health or in connection with injuries/sickness that meet the definition in 11.3
or have been specified as work related on a medical certificate. This will be subject to
regular review. In such cases the manager should seek advice from the HR team in the
first instance to ensure consistency.

AGENDA ITEM 9: 2011/12 BASE BUDGET AND PROJECTIONS FOR 2012/13 TO 2014/15
The Portfolio Holder – Financial Services read out a statement in support of the report
(attached as Minutes Appendix A). He thanked Officers for the amount of work which they
had put into the report.
Members commented on the report:
1. The Conservative Group Leader said that she was very pleased with the proposed 0% rise
in the District element of the Council Tax and had advocated this for several years.
2. Mrs L Walker had recently attended a meeting of the Norfolk Anti-Social Behaviour Action
Group (ASBAG) and they had asked her to express to the Council the continued need to
support the Community Safety Team
RESOLVED
To agree:
a)
The 2011/12 revenue account budget as outlined at Appendix A to the report and that
the surplus of £58,064 be allocated to the restructuring reserve;
b)
The demand on the Collection Fund, subject to any amendments as a result of final
precepts be:
(i)
£5,736,464 for District purposes
(ii)
£1,447,722 (subject to confirmation of one final precept) for Parish/Town
precepts;
c)
The movement on the reserves as detailed at Appendix E to the report;
d)
The updated Capital Programme and it’s financing for 2010/11 to 2012/13 as detailed
at Appendix F to the report;
e)
The new capital bids as detailed at Appendix G to the report;
f)
Members note the current projections for 2012/13 to 2014/15.

COUNCIL TAX 2011-2012
The report presented for approval the budget for 2011/12, made statutory calculations in
accordance with the Local Government Finance Act 1992 and set the Council Tax for 2011/12.
It also included the Chief Financial Officer’s report on the robustness of the estimates and
adequacy of reserves. In addition, it presented for information only the current budget
projections for 2012/13 to 2014/15.
Following the Comprehensive Spending Review 2010 (CSR 2010), the headline cash
reduction in government grant for the Council in 2011/12 was £1,167,504 and represented a
reduction of 14.2% in the year, with a further 11.8% reduction in 2012/13 based on the
provisional figures issued on 7 February 2011.
It was the opinion of the Chief Financial Officer that the budget for 2011/12 had been set within
a robust framework. She stressed that achievement of the budget was subject to the
successful delivery of a number of savings along with additional income and grants across
various service headings.
RESOLVED
To approve the following:
a) The General Fund Revenue Budget for 2011/12;
b) The Policy Framework for the Earmarked Reserves and the Optimum Level of the
General Reserve 2011/12 to 2014/15 (Appendix D);
c) The level of the General Reserve maintained at a minimum of £950,000;
d) The General and Earmarked Reserves are employed as shown in the Reserves
Statement (Appendix C).
It was further RESOLVED
That Members undertake the council tax and statutory calculations set out at section 4, and
set the Council Tax for 2011/12.
a) 41,228 being calculated by the Council, in accordance with regulation 3 of the Local
Authorities (Calculation of Council Tax Base) Regulations 1992, as its Council Tax base

accordance with Sections 32 to 36 of the Local Government Finance Act 1992 and the
relevant regulations and directions as follows:a)
£60,501,997 being the aggregate of the amounts which the Council
estimates for the items set out in Section 32(2)(a) to (e) of
the Act.
£46,256,173 being the aggregate of the amounts which the Council
estimates for the items set out in Section 32(3)(a) to (c) of
the Act.
£14,245,824 being the amount by which the aggregate at (a) above
exceeds the aggregate at (b) above, calculated by the
Council, in accordance with Section 32(4) of the Act, as its
budget requirement for the year.
£7,070,270 being the aggregate of the sums which the Council
estimates will be payable for the year into its general fund
in respect of redistributed non-domestic rates and revenue
support grant, increased by the amount of the sums which
the Council estimates will be transferred in the year from its
collection fund to its general fund in accordance with
Section 97(3) of the Local Government Finance Act 1988
(council tax surplus - £11,132).
£174.0456 being the amount at (c) above less the amount at (d)
above, all divided by the amount at 4.3(a) above, calculated
by the Council, in accordance with Section 33(1) of the Act,
as the basic amount of its Council Tax for the year.
£1,450,222 being the aggregate amount of all special items referred to
in Section 34(1) of the Act.

dividing the amount at (f) above by the amount at 4.3 (a)

NORTH NORFOLK ASSET MANAGEMENT PLAN
The Asset Management Plan (AMP) provided the strategic framework within which the Council
managed its property assets and ensured that decisions taken in respect of investment,
acquisitions and disposals reflected the Council’s strategic and operational objectives. The
Asset Management Plan drove the capital programme and operational activities within the
Property Services Team in order that the work could be planned and prioritised. It included a
review of activity undertaken during 2010/11 and outlined the capital projects being
progressed in 2011/12. The AMP identified key risks and linked them to the corporate risk
register.
The coalition Government’s Localism Bill identified a number of initiatives which would impact
on the way that the Council managed its Asset Portfolio. These included the proposed
‘Community Right to Buy’ which would require local authorities to maintain a list of assets of
community value. This could require a revision to any future disposals policy.
RESOLVED that
1. The Asset Management Plan be approved as the basis for the strategic framework for
asset management in North Norfolk District Council and to provide the property input to the
Council’s Capital Strategy; and
2. Members note the changes to the Capital Programme arising from the Asset Management
Plan, recommended in the Budget Report on this agenda.

NEW GOVERNMENT POLICY UPDATE
The Leader provided a brief update:
a) The referendum on the Alternative Vote would now go ahead on 5 May 2011.
b) The Local Enterprise Partnership (LEP) had been moving forward and it was hoped that
the Leader and the Deputy Chief Executive would attend a meeting soon.

COMMUNICATIONS FROM THE LEADER OF THE COUNCIL AND PORTFOLIO HOLDERS
Mrs H T Nelson
a) Mrs H Nelson, Mrs P Bevan Jones and Mr E Seward had attended ‘Cost in the
Countryside’ an event organised by VCS Together. It had been well attended and had
highlighted the costs and challenges of delivering services in rural areas.
b) She reminded Members that there were a lot of festivals during the coming months. A
guide would be published shortly and would also include dates and details for carnivals in
the District.
c) It had been intended that the following Notice of Motion should go before Full Council:
“North Norfolk is blessed with splendid and ancient woodlands which are greatly appreciated
by residents and visitors alike. It is of paramount importance that these woodlands remain
accessible and carefully maintained. The Coalition’s intent to allow woods and forests to be
sold is extremely worrying and flies in the face of Localism. For example, our Green Flag at
Holt Country Park represents the amount of care put in by our officers and their teams of
volunteers and we are rightly very proud of their work and hope for more flags in the future.
The Coalition Government should be made aware that any sell off of our woodlands must be
avoided at all costs”.
The Government had since changed it’s stance on the sale of forests and woodlands and it
was felt that a Motion was no longer necessary.
Mr G Jones
a) The National Employers had informed local government trade unions that there would be
a 0% increase in pay for 2010/11.
b) The ongoing programme of restructuring continued across all North Norfolk District
Council departments.
Mrs P Bevan Jones
a) 12 affordable homes had been built in Southrepps. Eleven had already been allocated.
b) A recent meeting of the Judicial Board had highlighted the housing problems faced by
some military personnel returning to Norfolk after active service overseas. It was hoped
that more support could be put in place in the future.
c) The Griffon Area Partnership had launched a new adult carers group – Caring4Carers.
The group would meet fortnightly at the Saddlers Shop to the rear of St Nicholas Church
Hall.

TO ANSWER QUESTIONS ASKED PURSUANT TO STANDING ORDER No 23 AND OF
PORTFOLIO MEMBERS
A question had been received from Mr M J M Baker:
“During the life of the current LibDem administration £1,158,984 has been spent, to date, on
outside consultants. Whilst I appreciate there will be certain expertise which falls outside
normal staffing arrangements I am sure that Council tax payers will be shocked at such prolific
use of outside consultants. In particular in excess of £1/4 million has been spent on
consultants for advice on the Tesco Sheringham planning application.
Do you not feel that this reflects badly on the decision making process of the LibDem
Administration and the Planning Department, and further what lessons have been learnt and
what changes have been made so that such lengthy and acrimonious events can be avoided
in the future?
The appearance of a further £40,000 under the heading of Planning gives rise to more
concern as to the competence of our Administration. As this is in addition to the Tesco
expenditure please explain the detailed reasons why our staff cannot deal with the day to day
running of the department”
The Leader replied that it was always a matter of regret to pay for advice from outside the
District Council and that it was only done when absolutely necessary. She stressed that one
third of the total amount had been funded by grants and that often the grant providers
stipulated that professional advice should be sought.
a) The £40,000 relating to Planning issues was for a 4 year period and most of it was to pay
for a barrister. Specialist advice was sometimes required for complex planning issues and
could not be covered by Council staff.
b) £140,000 had been spent on property advice from architects, quantity surveyors and
structural engineers. Again, these posts were not covered at the Council and it was more
cost effective to outsource as necessary rather than employ such professionals on a fulltime basis.
c) With regards to the Tesco application in Sheringham, the Leader stressed that planning
applications were always non-political and the Council had to defend their decision to
refuse planning permission. If they had not then they would have had to pay Tesco’s costs
which would have amounted to a seven figure sum. The Council also had to counter the
Tesco case – to employ a retail consultant full-time would have cost at least £60,000 a
year. She reminded Mr Baker that the Council had won the case.
d) As far as the lessons that had been learnt, the Leader replied that although major
planning applications were rarer in North Norfolk, they were always controversial.
151.
NOTICE(S) OF MOTION
The following Notice of Motion was proposed by Mr H Lanham, Seconded by Mrs L Walker
“This Council recognises that under successive Governments North Norfolk has been
poorly served with regard to its transport and communication links.
This in turn has adversely impacted on its economic development and continues to
frustrate the Council's own economic development work. This Council therefore asks
the Government:
1) To give urgent priority to completing the dualling of the A11 at Elveden and not delay
the start of the road improvements until possibly 2015.
2) To accept that the transport links into the West of North Norfolk are poor and to

conduct an urgent review into what improvements can be made.
3) That in the investment programme for the rail network that priority is not given solely
to upgrading existing inter city lines to apparently make them quicker but that attention
is given to improving the local rail network. In North Norfolk this means investment in
improved services on the Bittern line from Norwich to Sheringham when the franchise
comes up for renewal in 2013 and restoring a rail link to Fakenham.
4) That Fast Broadband with full coverage is introduced as a matter of the highest
priority.
The Council also resolves to write to the leading mobile phone companies asking them
to improve the communications infrastructure in North Norfolk.”
The Motion was debated:
a) A Member felt that transport and communications should not be together in the same
Motion. He did not support the duelling of the A11 but did support improved Broadband
provision.
b) Although the aims of the Motion were admirable, given the current financial climate they
would be difficult to achieve and could take several years.
c) Bus services should be included – in particular County Council tendering of bus services
which were not consistent across the District. Mr Lanham responded that he was happy to
amend the Motion to include bus services.
d) The rail link to Fakenham was ambitious and may not be achievable.
RESOLVED
To support the Motion, subject to the following amendment:
“To review the procedures for tendering bus services across the District”.
Mr M Baker and Mr P High voted against the Motion. Mrs A Green abstained.
