Additional corrective measures relating to cost recovery on satellite network
filings for those satellite networks subject to Decision 513*
The Council,
considering
a)
the revision of the methodology and scale of charges for cost recovery of the processing of
space notices established in Decision 482 modified by the Council at its 2002 session;
b)
that in Decision 513 the Council at its 2003 session agreed on the need to address this issue
on a temporary basis, pending a review of the charging methodology by the Council at its 2004
session;
c)
that the Council at its 2004 session did not adopt a new charging methodology,
further considering
a)
that for filings subject to Decision 513, which covered multiple categories, the fee was
calculated based upon the highest level of unit charge for the categories;
b)
that the application of Decision 513 still resulted in some invoices having values
significantly higher than CHF 100 000,
finally considering
a)
the further need to provide some additional corrective measures regarding the deviations of
the current charging methodology for processing space notices as set out in Decision 482 modified
for very complex networks, leading to large invoices that may not be in line with the amount of
work, which may not increase in a linear manner when the number of units is very large and/or the
filing covers multiple categories,

decides

to invite the Council, at its 2006 session, to transmit this decision to the 2006
Plenipotentiary Conference, for consideration of the implementation of the corrective measures set
forth in this decision for invoices issued for the 2002-2003 period, including:
• where the amount of an invoice relating to satellite networks subject to Decision 513,
but excluding those networks in Categories 7 and 8 of Decision 482, exceeded
CHF 100 000, the Bureau shall set the filing fee to be CHF 100 000;
• for those satellite networks affected by the first bullet above, and not nominated for the
free entitlement, the Bureau would issue revised invoices for these filings and shall
credit the responsible administration the difference in fees where payment has already
been received;
• any credits arising from the application of the second bullet above shall be applied by
the Bureau to currently issued but unpaid invoices or future invoices for satellite filings
of that administration;
• the affected administrations shall advise the Bureau which invoices shall have the
resulting credits applied to them;

to invite the Secretary-General to submit a report on this issue to the Council at its 2006
session.
