Summer Housing License Agreement
American University (hereinafter “University”) enters into this Housing License Agreement (hereinafter “License Agreement” or “Agreement”) with student
(hereinafter “Licensee”). This License Agreement is effective as of the date Licensee’s signed License Agreement and housing application form is received
by Housing and Dining Programs.
1.
GENERAL: The purpose of this License Agreement is to establish certain financial and other relationships between University and Licensee
relating to Licensee's occupancy in university residence halls. The relationship between University and Licensee shall be subject to the terms and
conditions in this License Agreement. THIS LICENSE AGREEMENT IS BINDING FROM REQUESTED ARRIVAL DATE TO
APPLICATION DEPARTURE DATE AS SPECIFIED IN THE RESERVATION CONFIRMATION, INCORPORATED HEREIN BY THIS
REFERENCE, AND CONSTITUTES AN OBLIGATION TO PAY THE UNIVERSITY THE PREVAILING ROOM RATE FOR THE RIGHT
OF OCCUPANCY IN THE UNIVERSITY RESIDENCE HALL FOR THAT PERIOD. This Agreement shall constitute only a license to use the
University’s housing and shall not be deemed to constitute a lease or to create or transfer interest or a lien on real estate. The University reserves
the right to terminate such license at its discretion.
2.
OCCUPANCY OF SPACE: Licensee has a right of occupancy in and access to an assigned space in a university residence hall; shared use of
common facilities in the residence hall in which the space is located; and use of a bed, springs, mattress, linens and towels as well as desk, chair,
drapes, and dresser, to be furnished by the University. Unless otherwise specified, desk lamps and other accessories shall be furnished by the
Licensee. The Licensee with a vacancy in his/her room should anticipate having a roommate assigned to said vacant space, unless the room has
been purchased as a single. The Licensee who inhibit or dissuade others from moving into their room, and/or physically occupy the vacant space
or furnishings within their room are in violations of the terms and conditions of this Agreement and submit themselves to administrative, financial
and or other judicial action up to and including administrative moves and/or termination of this Agreement.
3.
SPACE ASSIGNMENT: UNIVERSITY RESERVES ALL RIGHTS CONCERNING ASSIGNMENT, REASSIGNMENT AND
ADJUSTMENTS, IN ACCOMMODATIONS IT MAY CONSIDER NECESSARY. CONSEQUENTLY, LICENSEE’S OCCUPANCY IN A
UNIVERSITY RESIDENCE HALL MAY REQUIRE SHARING THE SPACE WITH ONE OR MORE FELLOW LICENSEES. Licensees must
move into their designated spaces on the dates specified by University Conference & Guest Services. In order to accommodate your preference,
your room may contain additional furniture that cannot be removed. Discounts will not be provided for having additional room furniture.
4.
NON-REFUNDABLE DEPOSIT: Upon acceptance of an executed License Agreement, the University requires a NON-REFUNDABLE
deposit of Two Hundred Dollars ($200.00), which will be applied to your balance upon final payment. The entire deposit shall be forfeited if the
Licensee cancels his/her reservation at any time. The deposit shall be applied to the total room charges. Upon completion of the application you
will also be charged a fifteen ($15.00) dollar non-refundable registration fee.
5.
ROOM CHARGES: The Licensee may only be checked in once the total housing/dining balance has been paid in full. Total room charges are
based on the selected days or weeks of stay, as indicated on the application, (hereinafter “minimum stay period”) as specified in Licensee’s
reservation confirmation and are due at check-in. No refunds will be given for departures made prior to the minimum stay period. Reductions to
the original requested stay period will only be accepted in writing and must be received no less than fourteen (14) days prior to the original
check-in date. Any changes made less than fourteen (14) days’ notice prior to the original check-in date will not be approved and the full payment
for the “stay period” will be due in full. Should any discrepancies or inconsistencies arise from literature published by the University, the
information in this Agreement shall prevail. Cancellations must be received in writing no less than fourteen (14) days prior to the requested
check-in date. All cancellations must be made in writing to University Conference & Guest Services. Oral notification of cancellation will be
deemed ineffective.
6.
REFUNDS: Refund requests are requests only and are not a guarantee that a refund will be granted. Requests are reviewed on a caseby-case basis and are subject to approval by the Director of Operations. There are NO refunds on meals or Eagle Bucks.
7.
LICENSEE OCCUPANCY OF SPACE: Only the Licensee bound by the terms of the Agreement may occupy the space assigned to the
Licensee by the University. The Licensee is prohibited from assigning his/her rights or responsibilities under this Agreement to a third party
without prior written consent of the University, nor shall the Licensee knowingly permit any unauthorized person(s) to occupy the space. The
licensee must be 18 years of age by the selected date of check-in. Anyone under 18 years of age may not register.
8.
JOINT RESPONSIBILITY: If the space is assigned to more than one licensee, each shall be responsible for his/her own housing payments; but
all shall be responsible jointly and severally for such damage beyond reasonable wear and tear, and cost of repairs as may be assessed.
9.
CARE AND USE OF SPACE: Licensee shall use the space exclusively as residence hall lodging.
LICENSEE SHALL:
A.
Care of Space: Take care of the space and surrender the same at the end of term of License Agreement in good order and in as good
condition as when received, reasonable wear and tear excepted. To insure that proper care is being taken of the space, the University's
authorized agents and employees shall have the right after having first given reasonable notice, to enter and/or to inspect the space from
time to time, provided, however, that such entry for purposes of inspection, except in case of emergency, shall be made at reasonable times.
Notice having been posted and/or given, rooms may be entered for inspection by University's authorized agents and employees only,
whether or not licensees are present.
B.
Compliance: Conform and comply with all laws, regulations and ordinances of the District of Columbia and the United States of America.
C.
University Regulations: Abide by university regulations for conduct in university residence halls, regulations adopted and published by
governing bodies recognized by the University within the residence halls, and those regulations set forth in official university brochures and
notices, including university regulations concerning residence hall alcohol, smoking and illegal drug policies, all of which are made a part
of and specifically incorporated into this License Agreement. Residence Hall and University policies may be found at:

D.
Liability: Save and hold harmless, indemnify and defend the University, its trustees, agents, employees, and subcontractors from and
against any liability to Licensee or his/her invitees and guests resulting from property damage or personal injuries sustained by them in the
space, except where such property damage suffered or personal injuries to Licensee or his/her invitees and guests result directly from
negligent acts of University's agents or employees.
E.
Furnishings: Room charges are bases on the number of occupants assigned to a room, not the number of beds. Some rooms will contain an
extra set of furnishings due to academic year occupancy needs. Extra furniture may not be removed from residence hall rooms at any time
for any purposes. Licensees who remove furniture from their rooms will be charged for the replacement costs associated with each item
removed and may have their agreement with American University terminated.
LICENSEE SHALL NOT:
A.
Violation: Violate published rules governing university residence halls, nor use the space for any disorderly purpose, or in such
manner as to interfere with the rights of others. Violations of university published regulations or the rules governing university
residence halls, as set forth in the provisions of this License Agreement, may subject students of American University to
administrative judicial action or referral to the University's Conduct Council, except as provided for in paragraph 9B. For more

B.
Damages: Damage the space or furnishings (including common areas), aside from reasonable wear and tear. If such loss or damage
does occur, Licensee will be billed for repair or replacement costs. In the event of willful and/or reckless damage to the common areas
located in the immediate vicinity of the Licensee's space (and/or to the furnishings and facilities located therein), and in the event the
responsible individuals of such damage cannot be identified, all licensees served by the immediate common area may be assessed for
such repairs and/or replacement costs.
C.
Late Departure: Failure to vacate upon 12noon check out will result in an improper check out fee of $200 per night.
10. TERMINATION: This License Agreement may be terminated in the following manner:
A. If Licensee violates any of the terms and conditions of this License Agreement, and in particular, those set forth in paragraph 9B, C, E,
Licensee may be given written notice by University to vacate university residence hall. Such notice to the Licensee shall be by registered mail to
the Licensee’s address or by hand delivery to the Licensee. In these cases, no cancellations of room charges will occur.
B. Licensee Behavior: If Licensee exhibits behavior or mode of living by which, in the judgment of the Director of University Conference &
Guest Services, the Dean of Students, the Vice President of Campus Life (or designee of the foregoing) it would be in the best interest of the
Licensee, other licensees, or the university community for the Licensee to leave the university residence halls, then this License Agreement may
be terminated unilaterally by University by notice referred to in “A” above.
C. Failure to Vacate Space: If the License Agreement is terminated as provided in A or B above, Licensee must vacate the space on the
effective date of termination. Upon Licensee's failure to vacate, University shall be entitled to immediate possession of the space and to take all
summary action to secure possession without any other or further notice of any kind to Licensee under applicable law or otherwise, and take all
summary action, such notice being expressly waived. University may then, without notice to Licensee, enter, take possession of, and re-license
space. University is further irrevocably authorized on behalf of Licensee to remove and to store Licensee's belongings without any liability on the
part of the University for damage or loss. In that event, University will make no charge for the first week of storage; but thereafter storage
charges shall accrue at the rate of Two Hundred and Fifty Dollars ($250.00) per week for the next three (3) weeks; and at the end of this eight (4)
week period University is irrevocably authorized on behalf of Licensee to dispose of these belongings in any manner which it shall see fit without
any obligation to make payment of any kind to Licensee resulting from such disposition, damage or loss. In connection with disposition of such
property by University, it is expressly agreed by Licensee with the University as a condition of this License Agreement that the value of
Licensee's belongings is One Hundred Dollars ($100.00) or less.
D. Future Housing Obligations: A licensee who is dismissed from a university residence hall may be refused assignment of housing space at a
later date.
11. MAINTENANCE OF SPACE AND ACCESS: University shall provide general maintenance and upkeep of the space; and for the cleaning of
common areas by university employees and/or contract service providers at scheduled times. Cleaning schedules will be posted in a reasonably
prominent manner on each residence hall floor so residence hall staff and licensees shall be aware of the schedule. The Licensee shall inform the
University's agent or employee of any special maintenance or repairs required. A maintenance or repair request operates as a waiver of any entry
notice requirement to Licensee, provided; however, that entry for the purpose of making requested repairs or alterations shall be at reasonable
times. Facilities Management and University Conference & Guest Services will take care of such items as rapidly as can be accomplished.
However, it is usually not possible to give a precise time when such maintenance or repairs will be made. Authorized university agents or
employees shall have the right of access to the space without prior notice to Licensee in cases of emergency, personal injury, safety, health, or
casualty damage. In addition, authorized staff members of University Conference & Guest Services and/or Public Safety may access Licensee's
space in situations where there is probable cause to believe that a violation of law or university regulations has occurred. In such circumstances, if
an occupant of the premises denies a request for entry, authorized staff members of University Conference & Guest Services and/or the Public
Safety shall have the right of access to the space. Authorized staff members of University Conference & Guest Services may access resident's
space to conduct routine maintenance and/or prepare rooms for academic year residency. University Conference & Guest Services will provide
24-hour advance notice to licensees in advance of work to be done in their rooms. Absent notice from a licensee otherwise, licensees will be
deemed to have consented to such entry at the time and place designated by University Conference & Guest Services.
12. SERVICES AND UTILITIES: University maintains limited common cooking facilities within residence halls (provided, however, that
Licensee maintains sanitary conditions), and pay laundry facilities for Licensee use. University shall also provide electricity, heat during the cold
seasons, cooling during the warm seasons, hot and cold water, and shared sanitary facilities, all as adequate as necessary in the judgment of
University's agents. The University shall not be responsible for failure to provide these services for any reasonable period of time if and when
such failures are caused by accidents, riots, strikes, sources shortages, or any other conditions beyond university control. Any unauthorized
internet usage may result in discontinuation of service and any charges incurred by the University due to such unauthorized usage shall be billed
to the Licensee.
13. ALTERATIONS, FIRE HAZARDS, WASTE: Licensee shall not make any material alterations in the space without express written
permission from the Director of University Conference and Guest Services; shall not damage nor permit the damage of any part of the space;
shall not do or permit the doing of anything that shall constitute a fire or health hazard; and shall not permit the accumulation of waste and refuse
within the space. Violation of these terms and conditions by the Licensee may be considered sufficient reason for disciplinary action, including,
but not limited to, dismissal from the university residence halls.
14. DAMAGES TO PROPERTY OR PERSONS: University shall not be liable for any loss or damage to property resulting from fire, theft,
casualty, or any cause, or personal injuries occurring within the space.
15. LOST Access Card and Mailbox Key: A Twenty-Five Dollar ($25.00) charge will be made for each lost guest card. Guest cards may not be
mailed back after a check-out has occurred. Long term guests will be issued a mailbox key, A Twenty-Five Dollar ($25.00) charge will be made
for each lost mailbox key.
16. Parking is not included in the daily housing rate. You may park on campus at the posted daily rate. For more information please visit

17. SPACE CLEARANCE PROCEDURE: When leaving the university residence halls or when terminating the License
Agreement earlier, Licensee agrees to turn in the key(s) at the time of check-out, which is 12 noon unless otherwise specified
by Housing and Dining Programs. The Licensee agrees to leave his/her vacated space clean at the time of check-out, and if
upon inspection by university residence hall staff at or about the time of check-out, it is determined that the vacated space is not
in clean condition, the Licensee agrees to pay the University a departure of guests. Excessive cleaning is defined as removal of
more than one receptacle of trash from a room, rooms requiring carpet cleaning, and rooms requiring excessive realignment of
furnishings. In addition, there is a minimum of two hundred fifty dollar ($250.00) charge for apartments requiring excessive
cleaning in the living/bedroom area, plus a minimum of seventy five dollars ($75.00) for the kitchen and seventy-five dollars
($75.00) for each bathroom. The Licensee has the right to inspect all rooms for which additional charges are anticipated.
18. GOVERNING LAW: This License Agreement shall be governed by the laws of the United States and the District of Columbia.
19. The parties understand that this Agreement will be executed in English with a courtesy copy of the Agreement translated in
__________________. If there is a conflict between the executed Agreement and the translated copy, then the executed Agreement shall govern.
