St~te Drug Abuse Prevention Plan and Proqram. There being a great need for a co-ordina ted Sta-te program .tor planning, establishing, conducting, and co-ordinating projects III 15 for the development of more effective drug abuse prevention 16 functions in the State and for evaluating the conduct of such functions in co-operation with the Federal drug abuse prevention program enacted by Public Law 92-255; 8 Stat.• 65; the plan and II 19 I program for the State of Texas is ;lereby established. 20 Section 2. D<:fini tioD and purpos~.. The term "drug abuse 21 prevention function" means any program or activity relating to 22 drug abuse education, training, treatment, rehabilitation, or 23 research, and includes any such function even \vhcn p.3rforr"ed by 24 an organization whose primary mission is in the fiel~ of drug 25 traffic prevention, or is unrelated to drugs. 1he purpose is 26 to assure the co-ordination of all State and local drug abuse 27 prevention functions and to co-operate with and co-ordinate such 28 State and local functions with those of the Federal drug abuse 29 prevention program set forth in Public Law 92-255; 86 Stat. 65. 30 131 .. Duties of the Texas D~J?:1.rtrnent of Community Affairs. . rrhe Texas DeparJcn:ent of CommuniJcy Affairs is hereby designated as the single State agency responsible for the 3~ 35 preparation and administration o~ ~he State plan and progra~and 36 for co-ordinating all drug abuse prevention functions in this 37 ' Sta.te, with full authority to prepare and administer, or super38 vise the preparation and administration of, such plan and program 39 in conformity with this Executive Order and with subsection (e) 1.;0 of 5409 of Public Law 92-255. 1.;1 42 Section 4. State Drug Abuse Advisorv Council. There is l.l3 hereby established a State Drug Abuse Adv[~ory Council, hercin44 after referred to as "Council", which shall serve in an advisory . capacity on matters relating to the purposes of this Executive '~Drder, and which shall advise and consult. with the ,Texas Depart~ ment of Conununity Affairs in its administration of the plan and I program·above set forth. The Council shall serve solely in 'an advisory capacity and shall not be delegated any administrative authority or responsibility, and membership thereon shall not constitute an "office" for any purpose whatever. Section 5. Council MembershiE.. The Council shall consist of the_~overnor as chairman and not more than thirty members who .' 1 2 shall be appo~nted by the Governor for terms of ~wo years, with vacancies to be filled by the Governor. It shall include interested citizens and representatives of non-governmental organizations or groups, and of public agencies concerned with the prevention and treatment of drug abuse and drug dependence, from different geographical areas of the State. 3 4 gl 71 81 9. Section 6. Meetings and Compensation_of the Council. The Conncil shall meet, at the call or request of the Governor, 10 I to hear evidence and make recommendations with respect to over11 all state planning and activities in carrying out drug abuse 12 prevention functions in the State. The Council members shall 13 serve without compensation; but, shall be reimbursed for actual 1~ and necessary expenses incurred in connec~ion with their 15 service. Meetings of the Council shall be held at least four 16 1 times each year, and the Governor may designate a seven member 17 ex,ecutive committee of the Council to represent and act for 18 the Council between regular meetings of the full membership. The E:xe<.~utlveb-frecto-r of the 'l'exas DepartmeDt of Community Affairs shall report directly to the Governor and shall be responsible for: (1) Conducting, with the aid and assistance of local authorities, a detailed survey of State and local problems and nel~ds for the prevention and treatment of drug abuse and drug dependence, including, but not limited to, a survey of health facilities needed to provide services for drug abuse and drug dependence, and a plan for the development and distribution of such facili~ies and programs throughout the State. (2)' Identification of all funds, programs, and resources available in the State and from the Federal Government, the State Government, local governments, public and private agEmcies, ,foundations, and other sources, which are currently being used and those Which could in the future be used to implement drug abuse prevention functions in the State; (3) Development of, or provision for development of, . objective devices or methadologies for the evaluation of all dru~ abuse prevention functions within this £tate; 44 (4) Establishment of a clearinghouse for development of and maintenance of a centralized drug abuse dpta collection and dissemination system for all drug abuse prevention functions, consistent with the confidentiality safeguards of 48, federal. and State law; including assessment of an unduplicated count ot chronic drug abusers. 45 1+6 47 (5) Develop and maintain a management information system which provides an ongoing review of the State's drug abuse -problem indicators, drug abuse programs, and resources, rela-' tionsh~~ of resources to d~ug problem intensity, and analysis \ of problem ~ndicator dynamics to resource application and assist local, c'hief executive offices to build and maintain a, local management information system; 1 2 3 ~ (6) Formulation and administration of a comprehensive state plan for coordination of all drug abuse prevention functions (and to other state plans in related areas, especially, h~alth, education and criminal justice) within the State in accordance with regulations promulgated by the Federal Government, including local plans; - 5 6 7 8 9 10 11 (7) Coordination of the delivery of all funding from whatever source to state and local levels with regard to drug abuse prevention functions (including other state plans, especially the health plan developed under Section 314(d) (2) o.f the United States Public Health Service Act) and final review and con~ent within thirty days on all drug abuse prE~vention proposals to any funding or service agency for drug abuse prevention functions within this State; 12 13 1~ 15 16 17 18 19 2.0 21 22 (8 ) Require such information and reports as necessary from state and local agencies for planning, management, and evaluation and 'for otherwise carrying out the mandate of this Order; 1 23 24 25 26 (9) Review of all ,budgets, regulations, guidelines, requirements, criteria, and procedures for operation of all state agencies in terms of their consistency with policies, priorities, and objectives established, and provide policy direction to such agencies in making any changes which may be necess~ry to bring them into consistency with these policies; 27 28 29 30 31 32 33 (10) Assist in- the development and establishment of health, safety, and. professional standards for certifying, ~ .licensing or approving drug abuse treatment programs, facilities, and'personnel within the State by the legally designated state department or agency, inclUding standards to be followed in hiring individuals both subject to and not subject to goverrunent merit systems. 34 35 36 37 38 39 40 41 42 43 ~LI 45 '46 lj 7 I JUlj (11) Devise policies and prcoedures to foster greater cooperation and interaction between the treatment community and the criminal justice system, particularly in the local jurisdictions, through formulation of a long-term plan for cooperation. . (12) Coordination of all drug abuse education and training this State through cooperation with education, schools, and other p~blic and private agencies in establishing education programs for the prevention of drug abuse and for training in the ,treatment and rehabilitation of p~rsons affected by drug abuse and dr~g dependence. program~ conducted within s~ate and local boards of " ' 1 2 3 4 5 I (13) D~velopment of geographically distributed dl:ug abuse prevention and treatment facilities and programs throughout the State in order to assure ready access for all affected people within the State; 6 (14) Review, at least annually, of the State Plan for coord ina tion of drug abuse prevention functions \vi thin the State, annual submission to the Secretary to the United States 9 Department of Health, Educati~n, and Welfare of an analysis 10 . and evaluation of the effectiveness of the prevention and 11 I treatment programs and activities carried out. under the plan, 12 annual submission of modifications in the plan which it con13 siders necessary, and submission of any reports which the 1~ Secretary may require; 15 , . Dolph 1t1-iscoe Gove~r of Texas Office of Gove rnor Dolph Briscoe February 13, 1973 For Immediate ReleaSAt Governor Dolph Briscoe, by Executive Order, has designated the Texas Department of Community Affairs as the single State agency responsible for coordinating all drug abuse prevention functions in Texas. In signing the order, Governor Briscoe said: "Drug abuse is one of our m.ost pressing problems, one which affects the lives of thousands of Texans. If we are to properly combat the rise in drug abuse in our State, we must not only enact strong, workable drug laws, but we must coordinate actlvities related to drug abuse and improve communications between local and State agencies. By designating the Texas Department of Community Affairs as the single responsible agency, we w1l1 be able to p''rovide the coordination and more unified delivery of the services which are necessary in a program of this scope. " The Texas Department of Community Affairs, which has administered the State Program on Drug Abuse, is now charged with implementing programs in: drug abuse rehabilitation, treatment, education, research and prevention activities. The drug abuse prevention activities will be coordinated through the Interagency Health and Human Resources Council. The Council consists of agency heads having responsibilities in the service delivery areas. Governor Briscoe also announced he will establish an Advisory Council which will consult with TDCA and the Interagency Health and Human Resources Council on a continuing basis. The Governor will ask the advisory group to assist TDCA in preparing comprehensive regional and State plans suited to local needs, yet achieving State goals. The members of the Advisory' Council will include representatives from State a.gencies, the State Board of Education, the Attorney General's Office, crime commissions, the Board of Pharmacy, medical societies, regional planning councils, educational associations and private citizens.
