On 01/04/2009 the government had a defeat in the House of Lords on an
amendment to the Borders, Citizenship and Immigration Bill [HL]: To ensure that
the Administrative Court has discretion to decide whether an application refers to
a fresh claim, and to remove the power of the Lord Chancellor to restrict the
grounds for appeals from the Upper Tribunal in immigration cases.
This was defeat number 6 in the parliamentary session.
