PREAMBLE The Faculty Senate, having been d e s i g n ated b a r g a i n i n g representative of fac ulty members, and the Board and Senate having v o l u ntaril y e n d o rsed the practices and procedures of coll ective barga i n i n g as a fair a n d ord erly way of cond ucting certain relations between them, and the intention of the parties to this Agreement being to provide for an appro p riate salary schedul e , fri n g e benefits, and orderl y and expeditious grievance procedure and certain c o nditions of employment of facu lty members, all as set forth herein, the parties therefore a g ree to the follo w i n g: 1 ARTICLE I. A. RECOGNITI O N The Board o f Trustees o f Community College D i strict N o . 5 1 2 recognizes the Facu lty Sen ate, a c h apter of the C o o k Cou nty College Teachers U n i o n , as the e x c l u sive bargaining representative for all regularly employed f u l l-time faculty members ( i n c l u d i ng department c h a irpersons a n d coordinators), provided as used herein " fa c u lty members" shall not i n c l u d e any c l assified staff, student aides, c ustod i a l , o r any employee of the College who has admin istrative responsibilities (other t h a n department c h airpersons or c o o r d i n ators) o r who has the responsibil ity for m a k i n g meaningful recommend atio n s for the h i r i n g , assign ment, transfer, promotio n , d i s c i p l i n i n g o r dismissal of other employees. Administrative duties shall not be added to any position in the barga i n i n g u n i t if s u c h s h a l l have the effect of removing s u c h position f r o m the b a r g a i n i n g u n it without prior negotiation and a g reement with the Senate. B e g i n n i n g with the 1 9 9 1 /92 academic year, all faculty members employed o n a full-time b a s i s a t t h e C o l l e g e f o r two ( 2 ) con secutive semesters s h a l l , n o later than the b e g i n n i n g of the second semester, receive all ben efits of this Agreement irrespective of the type of employment contract u n d e r which t h e y were h i red . B. As used herein, the term "facu lty membe r " shall refer to those persons i n c l u ded i n the bargaining u n it described above. (Article I ) 2 ARTICLE I I. A. U N I O N-BOARD RELATI ONS No Discrimination The Board ag rees not to i nt e rfere wit h t h e r i g ht of facult y members to become members of the Faculty Senat e , and t here s h a l l be n o d i scriminat i o n against any facu lt y member because of such members h i p . The parties l i kewise acknowledge t h e r i g ht of any facult y member not t o become a member of t h e Facult y Senate. B. U s e of Facilities a n d Equipment The Senate may uti liz e C o l l e g e meet i n g room facilities, i n c l u d i n g c l assrooms not t h e n in use but not a l ready set u p for an antici pated use w h i c h c a n n ot reason a b l y be d ist u rb e d , provided t h e Senat e s h a l l prompt l y reimburse t h e Board t h e f a c i l it i es u s a g e c h a rge as prescribed i n t h e Board Facilit ies Usage M a n u a l a n d for any a d d it i o n a l expense o r any d a mage occasio ned b y such use. S u c h use s h a l l i n n o respect interfere with any activity o r funct i o n of the C o l l e g e . This sect i o n shall not be a p p l i c a b l e t o any meet i n g of more t h a n t wenty ( 2 0 ) persons i f less t h a n fifty percent ( 50 % ) o f t hose i n att e n d a n c e are employees of the C o l l e g e . C. Information to the Faculty Senate The B o a rd s h a l l make available public informat i o n necessary to t h e c o n d u ct of n e g ot i ations or processing of a grievance or for t h e enforcement of t h e t erms of t h i s Ag reement . This s h a l l i n c l u d e relevant f i n a n c i a l st at i st i c s . S u c h mat e rial s h a l l be provided wit h i n t e n ( 1 0) working days, whenever possible, following a written requ est by the Senate President o r designee. This sect ion shall not be co n st rued as req u i ring t h e Board to research or compile d at a. D. Review of Forms The l a n g u a g e of any forms ut i l ized to implement t h i s Agreement s h a l l conform t o t h i s A g reement . The Board shall make a reasonable effort t o secure t h e c o n c u rrence o f t h e Senat e President a s t o t h e l a nguage of s u c h forms p r i o r t o t h e i r introd uct i o n . E. Bulletin Board and Mailboxes The Senat e s h a l l be provided with reasonable bul let i n board space for t h e post i ng o f n ot ices and materials relat i n g t o Senat e activities. S u c h materials shall be i d e nt ified with t h e name of t h e Senat e and sig ned by a n appropriate officer t h ereof. Such materials s h a l l not be derogatory of any person associated wit h the C o l l e g e and s h a l l n ot i n c l u d e items which are primarily endorsements of c a n d i dates for p o l it i c a l office ( ot h e r t h a n offices of t h e Senat e o r of A FT L o c a l 1 600) . The Board s h a l l permit t h e Senat e t o d istribute offi cial Senat e ( A rt i c l e I I ) 3 materials to faculty members through College mail service s u bject to reasonable Board r e g u l ations. This authorization shall termi n ate forthwith if any governmental agency or c o u rt of com petent j u risdiction shall determine such mail services c a n not b e utilized without the affixation of postage or payment of fee. F. Reassigned Time for Senate The Board a g rees to provide up to a maximum of twenty-one ( 2 1 ) contact hours total reassigned time per year to the U n i o n . No more t h a n six (6) c o ntact hours reassigned time may b e assigned to any s i n g l e facu lty member during a semester. For faculty members who are part of the Student Development o r L R C faculty, reassigned t i m e s h a l l be e q u ivalent t o one ( 1 ) c l o c k h o u r e q u a l i n g . 7 5 c o ntact h o u r s . For faculty members i n t h e Development E d u c ation Labo ratory, reassigned time shall be e q u ivalent to one ( 1 ) clock hour e q u a l i n g . 50 c o ntact hours. The President of the S e nate s h a l l advise the appropriate Vice Presid e nt and Dean in writing thirty ( 30) d ays prior to the b e g i n n i n g of each semester as to how these h o u rs w i l l be d istribute d . G. Leaves of Absence for Union Officers Facu lty members elected as d e l egates to the a n n u a l c o nventions of the I l l i n ois Fed e ration of Teachers or the American Federation of Teachers shall be rel eased from their assigned d uties o n the days of such conventions, provided this sec­ tion s h a l l not be applicable to more than three ( 3 ) s u c h delegates and that the U n i o n shall promptly reimb urse the Board for the cost of any substitute who may b e emp loyed u n l ess s u bstitutes are arranged for b y faculty. Written notice of the persons atte n d i n g such conventions shall be filed with the Vice Presi dent of Academic Affairs, o r designee, at least three ( 3 ) days (excl usive of Saturdays, S u n d ays or observed holid ays) in advance. H. Meetings of House of Representativ_�� The Board s h a l l seek to avoid regularly assig n i n g cl asses which end after 3:00 p . m . o n Friday to facu lty members who are d e l e g ates to the H o use of Represe ntatives of Local 1 600, provided the i d e ntity of such facu lty members i s furnished i n writi n g to the Vice President of Academic Affairs o r designee at least t h i rty ( 30) c a l e n d a r d ays prior to the onset of each semester. I. Meetings of the Faculty Senate The Board s h a l l make an effort to avoid sched u l i n g c l asses on Thursdays between 1 2 : 1 5 p . m . and 2 : 00 p . m . for facu lty members who at the time of s u c h s c h e d u l i n g are el ected senators of the Harper C o l lege Facu lty S e nat e . ( A rticle I I ) 4 J. Board Meetings A copy of the Board a g e n d a , n o n-confidential exh i b its a n d mi nutes shall be made available to the Senate President or desig nee at the same time as it is made available to a d m i n istrators. A copy of materi als furnished to represen­ tatives of the press and other orga n i zations s h a l l c o n c u rrently be made available to the Senate President or designee. K. Printing of Agreement The Board s h a l l be responsible for the repro d u ction of the Agreement. S u c h reproduction s h a l l b e i n s u c h f o r m as shall be mutually agreed u p o n , provided that i n the absence of s u c h Agreement the form, size a n d type of reproduction of the prece d i n g Agreement shall be uti l i zed . The cost of s u c h reproduction shall be shared e q u a l l y by the Board and the Senate. L. Office for Senate The Board w i l l provide the Senate with office space. furnished appropriately. (Arti c l e I I ) 5 The space w i l l be ARTICLE Ill. A. C O N DITIONS O F EMPLOYMENT Academic Freedom E a c h facu lty member s h a l l e n g a g e in those activities which s h a l l at no time be d et riment a l t o the C o l l e g e . A faculty member s h a l l be free to present i n structi o n a l m aterials w h i c h are pert inent to the subject and l ev e l taught a n d s h a l l be ex pected t o present all facets o f c o nt rov ersial issues i n a n u n bi ased manner. Academic freedom i s defined i n t h e following Statement of Principl es established by the American Association of U n iv ersity Profe ssors, which is set forth herein, amended to have greater a p p l i c a b i l it y to H arper College, as an expression of which the parties find a g reement as a st atement of general objectives a n d g u ideli nes. 1. The teacher i s ent itled t o fu l l freed o m i n research a n d i n t h e publi c ation of resu lts, subject to the adequat e perform ance of h i s/her d ut ies, but research for p e c u n i ary return s h a l l be based u p o n an u n d erst a n d i n g wit h the a ut h o rities of t h e i n st itut i o n . T h i s g u i d e l i n e s h a l l not be co nstrued as l i miting t h e app l i c ation of Board pol icy and procedu res affect ing C o l l e g e-supported i nv e nt i o n s and m aterials, provided such policy s h a l l not be altered as to dep rive any facult y member of benefits previously assu red by s u c h policy with respect to work beg u n u n d e r the same and for w h i c h proper n ot i c e has been g iv e n by the facult y member. 2. The teacher i s entitled to freedom i n t h e c l assroom i n d isc ussing h i s/her subject, but he/she s h a l l attempt to be careful not t o i nt roduce i nt o h is/her teac h i n g cont r ov ersial matt ers w h i c h have n o relat i o n t o h i s/her subject . L i m it at i o n s of academic freedom because of aims of the i nsti­ t ution should be c learly stated in writ i n g at the time of the appoint me nt . 3. The College teacher is a citizen, a member of a learned profession, and a n offi cer of an educational institutio n . When he/she speaks o r writes as a c it iz e n , he/she s h o u l d be free from i n stitut i o n a l censorship or d is c i p l i n e , but his/her special posit i o n in t h e commu n it y im poses special o b l igati o n s . As a person of learn ing a n d a n educat i o n a l officer, he/she s h a l l att empt t o remember t h at t h e p u b l i c may judge h is/her profe ssion and his/her institut i o n by h is/her utterances. H e n c e , he/she shall attempt at all time to be acc urate, shall attempt to exercise approp riate restraint , s h a l l attempt to show respect for t h e opinions of others, a n d s h a l l at­ t e mpt to make every effort to ind icate that he/she is not an i n st it utional spokesman. (Art i c l e I l l ) 6 B. C. Faculty Personnel Records 1. A l l eval uative material relating to a facu lty member s h a l l be retained i n h is/her offic ial perso n n e l file i n the Pers o n n e l Offi c e . 2. When eval uative mate rial is placed i n the facu lty member's offi cial perso n n e l file (here i n after described i n this section as "file " ) , a copy of s u c h material s h a l l c o n c u rrently be provided to the facu lty member. The faculty member shall acknowledge receipt of s u c h copy by signing it for the file but s u c h a c k n o wledgement s h a l l not sig n ify anything other than receipt of the material. Should the faculty member refuse to sign the mate r i a l , the a d m i n istrator shall write o n the material that the fac ulty member refused to s i g n , date it and s i g n h i s/her name to the mate r i a l . 3. The faculty member shall have the right to resp o n d to any material placed i n his/her file by submitti n g the response i n writing within a reasonable time of the f i l i n g of the original materi a l . S u c h response shall be attached to the file copy. 4. A facu lty member s h a l l have t h e r i g h t to e x a m i n e his/her file. S u c h re­ q u est shall be h o nored without u n d u e delay if made d u r i n g nor mal b u s i n ess h o u rs . A designee of the College admi nistrati o n may be present d u r i n g such revi e w . Noth i n g s h a l l be permanently removed from the file without the consent of the faculty member and the College. A faculty member may repro d uce mater i a l from his/her file at the customary cost. 5. N o materi al from a faculty member's perso n n e l file s h a l l b e made available to perso n n e l or agencies u n c o n n ected with the College without the faculty member's co nsent, except as req u i red by law or as necess ary purs u a nt to the regular operation of the College, provided this does not prec l u d e verification of employment. Facu lty Facilities The B o a rd s h a l l provide approp riate office space, a n d i n structional mate rials for facu lty members. Decisions related to i n structional materials, i n structional e q u i pment or instructi o n a l technology shall be made by the appropriate Dean i n c o n s ultation with the appropriate department faculty. D. Calendar Prior to the adoption by the Board of the academic calendar for any year, the C o l l e g e President o r designee will meet with the Senate President or d e s i g nee to d i s c u s s and examine i n good faith any sugg ested revisions that the Senate may have regarding the structure, recesses, and h o l id ays of the proposed academic calendar. ( A rticle I l l ) 7 E. Definition and Determination of Seniority As used in t h i s Agreement , " se n i orit y " s h a l l mean t h e l ength of cont i n u o u s employment from t h e d at e of h i r e a s a f u l l t i m e facult y member o f t h e College. If it s h a l l be necessary t o resolve conflict s of seniorit y as between faculty members with the i d e nt i c a l l ength of employment , ( 1 ) prior part-time e m p loyment at t h e C o l lege, ( 2 ) d at e of execut i ng a faculty c o nt ract, or finally ( 3 ) l ot , will be ut i l iz e d i n t h at order. Seni orit y , where applicable, shall be a p p l ied wit h i n a depart ment or program. F a c u lt y must meet t h e credent i a l q u al i ficat i o n s as defined i n t h e St atement o f F a c u lt y Credent i a l s d o c ument . Senio rity i s determinat ive i n t h e funct i o n i n g of t h e C o l l e g e as applicable to assign ment of c l asses, select i o n of overloads, n o n -t e a c h i n g facult y assign­ ment s , summer s c h o o l t e a c h i n g assign ments except w h e n amended by t h e vote of fu l l-t ime facult y wit h i n departments. F. Class a n d Assignment Schedules F a c u lt y s h a l l be c o n s u lt e d in the sched u l i n g of c l asses and/or assign ment s . G. Class and Assignment Selection Appro priate facult y a n d t h e appropriat e s u pervisor or designee s h a l l develop a program for t h e assig n ment of c lasses, and/or ot her profess i o n a l d uties s u bject to t h e approval of t h e appropriat e vice president . Ful l -t i m e facult y members s h a l l have the right of first refusal i n select i n g v o l u nt a ry overload c l a sses in d iscipl ines in w h i c h t hey have fully sat isfied appropriat e t e a c h i n g credent ials, except as t h e needs of t h e College shall ot herwise. c l early req u i re . Faculty members may not select an overload i n a d i s c i p l i n e u nt i l all ot her facult y members satisfying t ea c h i n g credent i a l s f o r t h at d i s c i p l i n e have b e e n assigned t o a normal workload. " Te a c h i n g Credent i a l s " as used above refers t o t h e St atement of F a c u lt y Credent i a l s docu ment w h i c h i s issued e a c h academic year. H. Class Size The Board s h a l l cont i n u e its pract ice of maint a i n i n g reasonable c l ass size c o n s istent wit h t h e n at u r e of t h e course offering and t he financial resources of t he College. I. Workload 1. ( A rt icle I l l ) The n ormal workload s h a l l be t h i rt y ( 30 ) cont act h o u rs requi red per academic year except as ot herwise specifi c a l l y provided here i n . The normal workload w i l l also require a minimum of four (4) u n i q u e course 8 sect ions per academic year except as ot herwise spec ific a l l y prov i ded h e re i n . A c o nt act h o u r i s defined a s a m i n i m u m total of fift e e n ( 1 5) fifty ( 5 0 ) m in ut e periods o f i n st ruct i o n p e r semest e r o r e q u ivalent . Faculty may satisfy u p t o four (4) h o u rs of t h e workload defined herein by t e ac h i n g Cont i n u i n g Educat i o n c o urses t h at are a p p roved by t h e I l l i­ nois Co mmunit y C ollege Board as reimbursable courses. Request s for approval t o ut i l iz e s uc h c o urses as part of the yearly workload requirement must b e m a d e by Nov ember 1 for c o u rses t o be t a u g ht in t h e spring semest e r a n d J u n e 1 5 for c o u rses t o be t a u g ht i n t h e s u bse­ q u e nt fall semest e r . These d ates s h a ll be waived w h e n a fac ulty member needs t h ese c o u rses t o fulfill h is/her n o rmal t e ac h i ng load . Faculty members ut i l iz i n g t h e waiv e r are not eligible for ov erloads d u r i n g t h e semest e r or term. Up t o four (4) c o ntact hours of C o nt i n u i n g E d uc at i o n c o u rses may be acc u m u lated t o be appl ied t o w ard any yearly load wit h i n o n e ( 1 ) year aft e r c o m pl et i n g the c o u rse or the last of the c o u rses. 2. If a fac u lty member t eac hes i n excess of t h e n o rmal workload, he/she shal l be c o mpensated as ot h e rwise prov ided i n t h i s A g reement . 3. Open la boratory and indivi d u a l l e a r n i n g c o ntact h o u r assign ments i n d ev el opmental e d uc at i o n , math l a b , E n g l i s h a s a S ec o n d L a n g u a g e a n d A d ult Educat i o n a l Development will be o n a t w o ( 2 ) h o u rs f o r o n e ( 1 ) h o u r of load eq uivalenc y . 4. Faculty members assigned t o teac h E N G 098, E N G 1 00, E N G 1 0 1 , E N G 1 02, E N G 1 03 , E N G 1 30, E N G 20 1 , and E N G 2 2 0 , sh all have a normal workload of t wenty-fo u r ( 24) c o nt act h o u rs per year. As part of t h i s l o a d , faculty normally credent i a led t o t e ac h LIT c o u rses m a y s u bstitute any c o u rse with a LIT prefix for not more t h a n t h ree ( 3 ) c o nt act h o u rs per semester. 5. Dental Hygiene faculty t e ac h i n g only c l i n ical c o u rses ( D H Y 1 00, 1 0 1 , 2 50, 2 5 1 ) s h a l l have a normal workload of t h i rt y-six ( 3 6) c o ntact h o u rs required per academic year. 6. For faculty members who do not have t e ac h i n g respo nsibilities, t h e i r n o r­ mal workload s h a l l be t h i rty-five ( 3 5 ) cloc k h o u rs weekly, exc l u d i ng l u nc h . This prov i sion includes LRC fac u lty a n d Student Development facult y . Faculty members assigned a s c h a i rpersons o f LRC services, E n g l i s h as a S ec o n d Language and A d u lt E d ucation Devel o pment departments may ( Art ic l e Il l ) 9 b e given full reassig ned time fr om their n or m a l wor k l o a d . When full reassig ned time i s appr oved, the n or m a l wor k week w i l l be thirty-five (35) c l o c k h o urs, exclud i n g l u n c h . S u c h faculty mem bers s h a l l have t h e r i g h t t o submit t o their immediate s u pervisor r e c o m m e n d ations with respect to their s c h e d u l i n g for the p ur pose of e n h a n c i n g the College's a b i l ity to serve students. 7. A facu lty member has the r i g ht to refuse assignments i n excess of the n or m a l wor kload u n l ess an overload would be needed to assure that the n or m a l wor kl o ad r e q u ir ement for that year would be met. 8. A facu lty member assigned to s u pervise students i n inter n s h i p e x p er i e n c e s ( i n ter n s h i p s /c l i n i c a l /wor k - s t u d y / c o o p er a t i v e wor k ­ exper i ences/supervised-occupation exper iences as d e f i n e d by I C C B ) s h a l l r eceive one-fourth ( 1 /4) contact h o ur credit per student to a maximum of nine (9) co ntact h o ur s per semester. 9. Extr a c urr i c u l ar assignments s h a l l b e v o l untary, provided once assu med the faculty member s h a l l have full r esponsibi lity for their completi o n , a n d pr ovided s u c h may be assigned o n a n i nv o l u ntary b a s i s i n an emergency or when c o ntin uation of such activity is contingent upon s u c h as­ signment. U p to five (5) h o urs of office time may be used by faculty members to assist students in such lear n ing settings as the tutor i n g center, developmental labs, or other open l a b s . 1 2. Dismissal o f Non-ten u red Fac ulty for C ause If the President shall recommend the termination of a n o n-tenured facu lty member d u r i n g an academic year, the procedure described in Section 4 of this Arti c l e s h a l l be applicable, prov ided any suspension of the facu lty member s h a l l be without pay, but s u c h pay s h a l l be restored to the facu lty member if the final decision is that there is not cause for dismissa l . N. Layoff Procedure (Reduction in Force) 1. W h i l e o n s u c h leave, a fac u lty member s ha l l b e a l l owed to participate i n the C o l l e g e g r o u p h ea lt h , dental a n d life i n s u ra n c e programs, provided the faculty member sha l l make timely a d va n c e payment of all premiums due for s u c h i n s u ra n c e t o the d e s i g nated C o l l e g e office. B. Family Hardship Leaves A faculty member may request a leave of a bsence without pay or other benefits for a period not exceeding o n e semester because of serious i l l ness of a member of his/her i mmed iate fa mily o r for other good and suffic ient ca u s e . Such leaves may b e exte n d e d , within the sole d i scretion of the Boa rd of Trustees. W h i l e o n such leave, a fac ulty member sha l l be a l lowed to participate i n the C o l l e g e g r o u p health, denta l a n d life i n s urance programs, provided the fac u lty member sha l l make timely a d va n c e payments of a l l premiums d u e for such i n s u ra n c e to the designated College office. C. Funera l Leave In t h e event of the death of a member of a fac u lty member' s immediate fa mily, the faculty member sha l l be entitled to u p to three c o n sec utive i n structiona l days leave o f a bsence without loss o f salary o r d e d u ction o f a c c u mu late sick leave. The term " fa c u lty member' s immediate fa m i l y " sha l l be defined as the fac u lty member' s pa rents, spouse, c h i ldren, or g ra n d c h i l d ren. I n t h e event of the death of a n y member of a fac u lty member' s fa mily, the fa c u lty member sha l l be entitled to u p to three con secutive days leave of a bs e n c e without loss of sa lary for the p u rpose of atte n d i n g the funera l , i n c l u d i n g s u c h related events as the wa ke o r visitat io n . S u c h leave sha l l be d e d u cted from a c c u m u lated sick leave. If a d ditiona l days a re nec essary a n d a re a p proved by the a p p ropriate Vice President o r designee, the fa cu lty member may b e granted leave without pay. The term " fa c u lty mem ber·'s fa m i l y " is defined a s the fa cu lty member' s grandparents, moth er-in-law, father- i n­ law, b rother, sister, brother- i n - la w, siste r-in-la w , spouse's g ra n d pa re nts, (Arti c l e IV) 20 spouse's c h i l d re n o r g ra n d c h i l d r e n , o r a n y other relative l iv i n g i n the fac u lty member's immediate househol d . D. Jury Duty/Court-Related Leave All fac u lty members ca lled/subpoenaed as witnesses or j ur o rs w i l l notify the a p p ro p riate a d m i n i strator as soon as possible after being ca l l ed/subpoenaed. Ca lled/sub poenaed faculty members req u i red to serve as jurors or a ppear as witnesses d u r i n g a working day on which they otherwise would have been schedu led to work, will be paid their n o rmal salary d u r i n g this period, prov ided the fac u lty member sha l l promptly reimbu rse the College any monies paid for such serv i c e (other than payments for meals, trav e l o r other expenses ) . S u c h t i m e w i l l not be ded ucted f r o m a c c u m u lated s i c k leave o r persona l l eave . This section sha l l not be a pp li ca bl e to any matter when the fac u lty member, the Senate, o r the C o l l e g e sha l l be a party. This section sha l l not be a p p l ica b l e to any proceeding c o n d u cted p u rs ua n t to Article V of this Agreement. E. Parental Leave A fa c u lty member sha l l be eligible for parental leave with o ut pay o r other benefits ,except those benefits specifica l l y id entified in this Arti c l e , s u bject to the following c o nditions: (As used herein, "faculty member" mea n s a ten u red fac u lty member except i n Section 6, which is a pp l ica b l e only to n o n-te n u red fa c u lty members, a n d in Section 8 which is a p plica b l e to a l l fa c u lty members) . 1. Appl ication for such leave sha l l be made i n writing to the appropriate Vice Pre sident or designee at least n i nety ( 90) ca l e n da r days prior to the a nticipated b i rth of the c h i l d . 2. The fac u lty member a n d t h e a p p ropriate V i c e President o r designee sha l l a gree u p o n a plan f o r t h e c o mmencement a n d termination of s u c h leav e, ta k i n g into consideration maintena n c e of continu ity of i nstructio n a n d medica l factors to t h e maximum possible degree a n d the perti nent time factors related thereto. The l eave shall not exceed the bala n c e of the Aca d e m i c year in which it c o mmences a n d one ( 1 ) a d d itional a cademic yea r . Every effort s ha l l b e made to have s u c h leave terminate immedi­ ately prior to the start of a new academic year. S u c h leav e s ha l l commence u p o n o n e o f t h e followi n g: 1 ) t h e date a g reed upon by the Vice President a n d facu lty member, 2) for fac u lty members who tea c h , n o t later than the end o f t h e semester prece d i n g t h e semester d u r i n g which the fa cu lty member i s expected t o become u na b l e to work, 3) the actual date of d e l iv ery/a d option, 4) the date o n w h i c h the fac u lty member is required to leave employment because she is u nable to perform h e r d uties, w h i c h ev e r sha l l first o c c u r . Such leaves which commence d u r i n g the summer recess sha l l begin no later than J uly 1 . The Vice President may waive a n y of the req u i rements o f this secti o n at ( A rticle IV) 21 h is/her sole d iscretion ; any such waiv e r shall not b e precedential i n any respect. 3. Sick l e av e shall not be applicable d u r i n g any period of the parental leav e , except a s e l i g ib l e u n d e r the F a m i l y M e d i c a l Leave A c t o r a s mutually a g reed to between the facu lty memb e r and the appropriate Vice President o r designee a s a result of a medically requ ired reduced work load. Any accumulated sick leave av a i l ab l e at the commen cement of the l e av e shall be av a i l ab le to the facu lty member upon return to employment at the C o l l e g e . 4. The facu lty member may maintain g r o u p health, dental a n d l i fe insurance b e n efits by m a k i n g timely payments of a l l premiums w h i c h may b e d ue to the Admini strative Serv ices office o r pursuant to its d i rectio n . 5. Any facu lty member desiring parental leave a s a result of becoming a n adoptive parent s h a l l notify the appropriate Vice President o r designee i n writing upon t h e i n itiation o f such proceed i n g s . Leave s h a l l b e g ranted u p o n satisfactory written notification to the Vice President or designee of the d ate the child i s expected to b e received. It s h a l l b e the responsi­ b i lity of the applying faculty member to keep the Vice President o r d e s i g n e e informed o f t h e status o f t h e proceedings, a n d as s o o n a s k n o w n , t h e expected d ate o f d e l iv e ry of t h e c h i l d . T h i s section s h a l l not be applic able if the adopted c h i l d is six ( 6) o r more years of age at the time the child is receiv e d . H o wever, the age req u i rement may be waived by the appropriate Vice President o r d e s i g nee if the c h i l d has a medical c o n d ition which w o u l d require the leav e . 6. A parental leave may b e granted t o a n o n-te n u red facu lty member u n d e r u n u s u a l circu mstances b y t h e acti o n of t h e Board of Trustees, subject to a l l of the conditions applic able to a tenu red faculty memb e r . Any such leave shall include provision for the n u mber of years that the faculty member must b e employed i n conti n u o u s full-time serv i c e at the C o l l e g e after s u c h leave t o attain tenured stat u s . T h e granting of parental leave to any n o n -ten u red facu lty member s h a l l not con stitute a precedent for the granting or withholding of leave to any other facu lty memb e r . Each req uest shall b e judged o n its own merits and shall b e within the sole d i scretion of the Board . Additi o n a l conditions or restrictions may be estab l i s h ed for any such leave, prov ided nothing h e rein shall be c o n strued as req u i ring any non-tenu red faculty member to apply for such leave o r accept the c o n d itions estab lished therefore. 7. A faculty member who has been granted a parental leave and who d u r i n g s u c h leave o f ab sence shall a g a i n b e come pregnant o r adopt s h a l l be el igib l e for an exten s i o n of o n e ( 1 ) academic year of s u c h parental leave of ab s e n c e . Application for such extension of leave s h a l l be i n writing to the appropriate Vice President o r designee at le ast one h u n d red (Article IV) 22 twenty ( 1 20 ) ca l e n dar days prior to the a nticipated birth of the c h i l d or a s soon as possible a fter notification of a d optio n . 8. F. Noth i n g i n this Article s ha l l b e c o n str ued a s r e q u ir i n g a n y faculty member to a p p l y for a parental l eave. A fac u lty mem ber not e l i g i b l e for or not desir i n g parental leave may utilize a c c u m u lated s i c k leave d ur i n g a n y period of i l l n ess r e lated to pre g na n c y a nd/or to t h e d e l ivery o f the c h i l d . Such fac u lty member s ha l l return to employment immediately f o l l o w i n g the ter m i nation of such i l l ness. Military Leave Fac u lty members invol u n tar i l y called to active m i l itary d uty s ha l l be granted a leave of a bsence without sa lary for u p to thirty ( 3 0 ) ca l e n dar days which may be extended by the Board upon written a p p l icatio n . G. Personal Business Leave Eac h fac u lty member shal l be granted two ( 2 ) days without loss of salary each a ca d emic year for personal busin ess l ea v e . Such leave shal l b e for the p ur pose of completi n g matters w h i c h ca nnot r ea s o na bly be atte nded to or postponed to days or h o urs o n which the fac u lty member is not req uired to be on campus. If u n used, s u c h leave s ha l l a c c u m u late as sick leave. Per so na l business leave sha l l not be ava i la ble for p urp oses of recreation or to participate in a n y work stoppage or job protest. Notice of pla n n e d util ization of personal business leave sha l l be given i n wr iting to the immediate a d m i n istrative s u pervisor or designee at least forty-eight (48) h o urs i n advance, except i n an emer g e n c y, w h e n such notice s ha l l be given oral l y a s soon a s possible, and ther eafter promptly con firmed in wr iti n g together with a brief expla nation of the emergency. Per s ona l b u si n ess days sha l l be ta ken i n u n its of o n e- ha l f ( Y,) days. It s ha l l be an a p pr o pr iate use of personal busin ess leave to attend to matters related to the a d option of a c h i l d or for matters related to the birth of a c h i l d by a fac u lty mem ber ' s spou se, d ur i n g the first five i n str uctional days following such a d o ption or birth. I f persona l busi ness leave has been exhau sted, the fa c u lty mem ber sha l l be granted leave without pay, notice of such utilization to be given as provided i n the preceding paragra p h . H. Professional Meeting Leave Leaves of a bsence without loss of pay or other benefits may be gra nted by the a ppr o pr iate supervisor for a fac u lty member to attend professional meetin gs. If s u c h has been approved for reimbursement, s u c h r e i m b ursement sha l l be within the g u ideli nes of the Board of Tr ustee's policy ma nual . ( Article IV) 23 I. Religious Leave A fac u lty member may uti l i z e up to t h ree ( 3 ) days without loss of pay or d e d uction of persona l leave to observ e recognized religious hol idays of h i s/her fa ith if such observa nce reasona b l y r e q uires such l eav e . Notice of i ntention to uti l i z e s u c h l eav e sha l l be given i n writing at least fifteen ( 1 5 ) ca l e n da r days i n adva n c e . Add itiona l days o f leave f o r s u c h observa nce may be g ranted at the d i s c retion of the a pprop riate a d m i nistrator prov i ded such a d d itiona l days s ha l l b e without pay o r s ha l l be made u p o n some other date o n which t h e fac u lty member is not sched u led to work, a n d prov ided further no s u c h a d ditiona l leave s ha l l be granted if the fac u lty member has u n u sed persona l busine ss leav e . J. Sabbatical Leave 1. The Board sha l l g ra nt a sabbatica l leave to a n y e l i g i b l e fu l l-time tenu red fa cu lty member who sha l l have a p p ropriately a p p l i ed, prov id e d that, i n the judg ment o f t h e Sa bbatical Leav e Rev i e w Committee a n d con c u rrence o f t h e Board o f Trustees by its resolution, s u c h leave w i l l c learly a d d t o the effectiv e n ess of the fac u lty member i n the performa n c e o f h i s/her respo nsibilities at the C o l lege a nd/or c learly a c c r u e t o the benefit of the C o l l e g e . 2. A tenured fac u lty member i s e l i g i b l e to seek a sabbatical leave after hav i ng comp leted six ( 6 ) years of f u l l-time serv i c e as a fa cu lty member of the C o l lege, prov i d ed a fa cu lty member sha l l not be e l i g i b l e for such leave i n a n y a cademic year next following an a cademic year i n which he/she was o n leave of a bsence for sixty (60) days or mo re. 3. The fa c u lty member sha l l make a p p l i cation for sabbatical leave i n writing to the a p propriate Vice President o r designee pu rsuant to a reasonable timetable w h i c h sha l l be esta b l ished . S u c h a p p l i cation s ha l l i n c l u d e a l l t h e data perti nent t o s u c h leav e . 4. Sa bbatical leave sha l l b e f o r a period of o n e ( 1 ) a ca d e m i c semester o r o n e ( 1 ) a cademic yea r . 5. a) D u r i n g the period of sabbatical leave, the fa cu lty member sha l l receive o n e-ha l f o f his/her salary for a n entire a cademic year, a n d a l l o f his/her salary for a leave o f o n e semeste r . b) I f d u r i n g the period o f the sa bbatical leave, the facu lty member ea rns taxa b l e remuneration from some other orga n i zation, agency, i nstitution, o r person, the salary paid by the C o l l ege sha l l be reduced a c c o rd i n g l y ; prov i d ed if the sabbatical leave is for one academic yea r, no red uction i n sa lary s ha l l be made u n less the tota l of the regula r sa lary and such taxa b l e remuneration exceeds the amount equa l to the sa lary that would have been pa id to the fa c u lty member (Article IV) 24 i f he/she were not o n sabbatic a l leav e, a n d prov id e d f u rther, such taxable remun eration shall not i n c l u d e royalties, d iv id e n d s , interest or l i k e i ncome n ot d e rived from w o r k performed d u r i n g the period of the sabbatical leav e . c) 6. K. As used herein " sa l a r y " means t h e amount set forth i n Article V I l- A a n d s h a l l not i n c l u d e a n y additional amou nts for summer scho ol, extra-duty stipends, overloads, or the l i k e . A l l i nsurance benefits s h a l l conti n u e and sick leave s h a l l accrue d u r i n g the term o f the leav e . A s a c o n d ition precedent to sabbatical leave, the facu lty member shall agree to return to the College as a f u l l-time facu lty member for at least one ( 1 ) academic year immediately following the c o n c l u s i o n of such leave (or at least two (2) years i f the sabbatical leave is for an entire academic year), and shall execute a promissory note assuring restitution of all salary paid d u r i n g s u c h leave i f he/she does not return, such to be payable i n bimonthly i n stallments over a term not to exceed twice the length of the leav e . Alternative Work Load Leave A tenu red facu lty member is e l i g ible for a share-time o r reduced load leave by first m a k i n g application to h is/her Dean for this leav e . Faculty may s h a re the leave o r the leav e may be a portion o f the load for one facu lty member. Benefits are determined by the percentage o f the leave to the full time load . For example, one-half leave prov i d e s o ne- h a l f ben efits "per contract " . I f facu lty share a position, the ben efits package c a n be applied as i n stitutionally determined . While o n s u c h leav e , a facu lty member shall be a l l o wed to partiCipate i n all C o l l e g e insurance programs, prov ided the faculty member s h a l l make timely adv a n c e payments to the designated College office o f all premiums due for their portion of the i n surance not covered by this leav e . L. Sick Leave A facu lty member s h a l l have the right to utilize s i c k leave because of perso n a l i l l n e ss o r d isabi lity o r because o f a medical emergency which c o n fronts the facu lty member's immed i ate family which is defined as the emp loyee's natural o r step parents, spouse, c h il d r e n , g r a n d c h i l d re n , grandparents, o r parent- i n-law, brother, o r siste r . S i c k leave shall be twenty ( 2 0 ) d ays the first year and ten ( 1 0) d ays per year after the first year u p to four h u n d red (400) days. No payment for u n used sick time accrued will be made. ( A rticle IV) 25 The total benefits received u n d e r a n y college o r state s upported i n come protectio n plan (d isability i n su ra n c e , worker's compensation, etc . ) a n d s i c k leave s ha l l n o t exceed the i n d iv id ua l ' s c u rrent da ily salar y . As u s e d h e r e i n , " i l l ness o r d i sa b ility" s ha l l n o t i n c l u d e cosmetic s u rgery o r a n y procedure w h i c h t h e fac u lty member's physicia n states may b e rea s o na b l y a n d safely deferred t o t h e s u m m e r o r other recess o r vacation period . No later than thirty ( 3 0 ) cal e ndar days after the beg i n n i n g of ea c h a ca d e m i c yea r, the Board sha l l f u r n i s h each fac u lty member a statement of t h e n u m ber of u n used sick leave days a c c u m u lated as of the b e g i n n i n g of such a ca d e m i c yea r . M. Family Medical Leave Act D u r i n g the time period that the fac u lty member is eligible for benefits u n d e r the Fa m i l y M e d i ca l Leave Act, g ro u p h ea lth, d e nta l , life a n d a c c i d e nta l death a n d d i smemberment i n s u ra n c e benefits sha l l b e mainta i ned u n d e r t h e same c o n d itions as if the fac u lty member were actively employed . N. Nonprecedential Effect of Leaves Any leave of a bsence hereunder which by its terms is not mandatory, s ha l l be within the sole discretion of the Boa rd of Trustees o r the appro priate a d m i n istrato r . The g ra nting or d e n ia l of s u c h leave sha l l be n o n p reced ential with respect to any other a p p lication for s u c h leave, provided s u c h gra nting or d en ia l s ha l l not be based u p o n any factor dee med discriminatory here i n . 0. Reemployment at Conclusion of Leave of Absence A n y fac u lty member granted a leave of a bsence s ha l l be a ssured of employment by the Board upon terminatio n of such leave i n the sa me ma nner a s though s u c h fa cu lty member had nofbeen o n leave of absence, prov ided only that all of the c o nditions of s u c h leave have been complied with by the fac u lty member. A leave of absence without pay sha l l not constitute a break in serv i c e o r s e n iority. P. Unemployment Compensation As a c o ndition precedent to a l l leaves of a bsence, the fac u lty member a g rees to waive any cla i m of whatsoever nature for u n employment compe nsation d u r i n g the period of s u c h leav e . 0. Notice o f Intention t o RetiJrtJ. In a l l i nsta nces where a fa culty member is granted a leave of e i g ht ( 8 ) months or more, as a condition thereof, the Boa rd sha l l notify s u c h fa cu lty member by (Article I V ) 26 certified m a i l one h u n d re d and fifty ( 1 50 ) c a le n d a r d ay s prior to the be g i n n i n g of the next se meste r after the faculty me mbe r ' s leave e x p ires that the faculty member must return to work. F a i l u re of the faculty member to advise the appropriate Vice President o r de s i g nee a t least n i nety ( 90) c a le n d a r d ays ( o r M ay , w h ichever o c c u rs first) prior to the beg i n n i n g of the next seme ste r (afte r e x p i ration of leave) as re q u ired herein shall be treate d as an e lection not to return to e m p loyment a n d as a re sig nation from the C o l lege. (Article IV) 27 ARTICLE V . GRI EVANCE PROCEDURE It i s the purpose o f this proce d u re to re so lve as promptly and as e x ped itiously a s possible alle gati ons by the bargaining agent and/or members of the b a r g a i n i n g u n it of misinte rpretation of this a g reeme n t . A. B. C. Definitions 1. A g r iev ance s h a l l me an an alle g ation by the Senate o r by a n affected facu lty member that the re h a s been a v iolation, misi nte rpretation o r misapplication o f any prov ision of this A g reeme nt. 2. As used i n this article, " d a y " s h a l l mean eve ry d ay o f the wee k whe n cl asses a re sche d uled e x ce pt Saturdays, S u n d ays and those school h o l idays a n d/or emerge ncy days when the Office o f the Vice Pre s ident o f Acade m i c Affairs s h a l l be closed . Provisions 1. A facu lty member may be re presented at any meeting, he aring or appeal re lating to a g r iev a n ce . A re presentative o f the Se n ate s h a l l have the right to atte nd s u c h meeti n g , he aring o r appe a l . 2. The Pre s ident of the Senate o r de signee of the Sen ate s h a ll be advised of any meeting, he aring or appe a l re lating to a g rievance which has bee n formally prese nte d . 3. The f a i l u re o f the grievant to act o n any griev a n ce with i n the p rescribed time l i mits w i l l act as a bar to any further appe a l with i n the grievance proce d u re o r otherwise . I f the de signated re prese ntative o f the Board of Tru stees shall neglect to proceed o r rende r a de cision with i n the time l i m its, the griev a n ce may be advanced to the next ste p o f the griev a n ce proce d u re . Time l i mits may, howeve r, be extended by mutual written a g reement. Informal Resolution Procedure Tho parties a re e n couraged to utilize the i n formal re solution proce ss. The party asse rting a griev ance s h a l l atte mpt to resolve the problem through informal c o m m u n i cation with the appropriate superv isor. The i n formal re solution process s h a l l be completed with i n fiftee n ( 1 5 ) d ays of the d ate of the occu r re n ce g iv i n g rise to the griev a n ce o r from the date when the grievant might re asonably have be c o me aware o f the occ urre n ce . The President of the Senate o r de signee may accompany the facu lty me mber to assist in the i n formal re solution proce s s . If, h o weve r, such i nformal processes fail, a griev a n ce may be processed as follows: ( A rticle V) 28 D. Formal Grievance Procedure Step I 1. The f i l i n g of the formal written grievance at this step must be within ten ( 1 0 ) d ays of the completion of the i nformal resolution process. The grievance must be formally presented in writing to the same a p p ro p ri ate s u pervisor. 2. The formal written grievance s h a l l clearly i d e ntify a l l grievants, summarize a l l relevant facts, identify all provisions of the a g reement allegedly v i o l ated, describe the remedy which is requested, and must be presented formally i n writi n g to the appropriate s u pervisor who w i l l arrange for a meeting t o be h e l d with i n t e n ( 1 0 ) d ays t o review the g rievance. 3. The sup ervisor s h a l l provide a written answer to the grievant (with a copy to the S e n ate if the Senate i s not the grievant) with i n ten ( 1 0 ) days of the meeti n g . The answer shall i n c l u d e the reasons for the decision. Step I I 4. If the grievance is not resolved at the preced i n g step, the S e n ate o r d e s i g n ee m a y refer i t to t h e Presid e n t o r d e s i g nee by f i l i n g t h e s a m e i n writing within t e n ( 1 0) d ays of receipt o f t h e answer from t h e approp riate s u perviso r. The President or designee w i l l arrange for a meeti n g to be held within ten ( 1 0) days of such referral to review the grievance. Each party shall have the r i g ht to i n c l u d e i n its representation such witnesses and co u n selors as it deems necessary to develop facts pertinent to the g rievance. A written answer i n c l u d i n g reasons s h a l l be provided to the g r i evant (with a copy to the Senate if the Senate is not a party to the grievance) within ten ( 1 0) d ays of the meeting provided for i n this paragra p h . 5. If the grievance arises from a d e c i s i o n a t the President's level, the g rievance may be i n itiated at the preced ing step, provided s u c h is filed with i n the time l i mits prescribed in the second preceding parag r a p h . Step I l l 6. (Article V) I f the grievance i s not resolved at the President's level, the Senate may s u b mit it to arbitration, providing written notice ind i c ating such i s filed with the President o r designee with i n fifteen ( 1 5) days of the answer at the Preside nt's level, or if no answer is filed within fifteen ( 1 5) d ays of the l ast day on w h i c h s u c h answer was d u e . The Senate s h a l l promptly requ est of the American Arbitration Association that it provide panel(s) of q u a lified arbitrators from which the parties may make a selection 29 p u rs u a nt to t h e practices of that Association w h i c h s h a l l also serve as the a d m i n istrator of the proceed i n g s . T h e decision o f t h e arbitrator s h a l l b e b i n d i n g a n d s h a l l b e submitted to the Board o f Trustees for its consideration n o l ater than thirty ( 3 0 ) days following receipt o f the arbitrator's recommendati o n . In m a k i n g his recommendatio n , the arbitrator s h a l l not add to or e n l a rg e upon this Agreement, and any sug gested remedy, if appro p riate, shall conform to I l l i n o i s l a w . The fees a n d expenses o f the arbitrato r a n d of the American Arbitration Association s h a l l b e s h ared e q u a l l y by the Board a n d the Senate. The parties l i kewise s h a l l share the expense o f any transcript(s) w h i c h they may jointly req uest, but a l l other expen ses which may be i n c u rred by either party s h a l l be borne by that party. E. Non-discrimination The Board s h a l l not d iscriminate o r take any reprisals against any faculty member as a consequence of the f i l i n g o f any g r i ev a n c e h e r e u n d e r . ( Article V) 30 ARTICLE VI. D U ES CHECKOFF A. One facu lty member shall be e lected to the co mmittee by each d ivision each year. During this c o ntract the Promotions Com mittee s h a l l fo l l o w the proced u res for the evaluation of applicants as outli ned i n the Contract Promotions Committee proced ure. 3) To be promoted to assistant professor, a facu lty member must meet these c o n d itions: The faculty member (a) has received tenure; (b) has comp leted five ( 5 ) years of Harper service as an i n structor; and (c) meets the requirements for the new rank as set forth i n Secti o n B, 2 , a or b of this article. 4) To be promoted to associate professor, a facu lty member must meet these c o nditions: The facu lty member ( a ) has received tenure; (b) has com pleted five ( 5 ) years of H a rper service as an assistant professor; and ( c ) meets the requirements for the new rank as set forth i n Section B , 3, a or b of this arti c l e . 5) T o b e promoted t o professor, a faculty member m u s t meet these c o nditio n s : The facu lty member ( a ) has received tenure; (b) has completed five ( 5) years of Harper service as an associ ate professor; ( c ) meets the requi rements for the new rank as set forth i n Secti o n B, 4, a or b of this articl e ; (d) h as demonstrated exceptio nal qual ifications and i n structional leadership; a n d (e) has been recommended by the Instituti onal Promotions Committee and approved by the Board of Trustees. 6) Horizontal movement, when it occurs, w i l l be d o n e as follows: Such movement shall be made to a sal ary step i n the next vertical lane at the level n u mber that is one g reater than the level n u mber the faculty member was assigned the previous contract year. 40 7) b) A facu lty member who otherwise q u alifies for h o rizontal movement shall as a c o n d ition for advancement in any academic year file with the appropri ate Vice President or desig nee written evidence of fulfillment of all tra i n i n g and experience r e q u i rements described in Section B of this Article by October 1 of each academic year. Vertical movement of the salary schedule s h a l l occur at the rate of o n e ( 1 ) step per year u n less the Board s h a l l otherw ise advise the faculty member by April 1 . Pay Periods F a c ulty members shall h ave the option of receiving their s a l ary payments in twenty ( 20) o r twenty-six ( 2 6 ) i n st a l lments. All payments will be made only upon submission of the appropriate reimbursement form and appropriate evidence i nd i c at i n g successful comp letion o f the e d u cati o n a l activity. B. 2. Professi o n a l expense benefits for approved travel and meeti ngs or conferences may be d isbursed in advance for amou nts over three h u n d re d and twenty-five d o llars ( $ 3 2 5 ) provided faculty members sub mit to their immediate sup ervisor d o c u mentati o n s u pporting the advance request. In this case vouchers for expenses a n d appropriate evidence of payment (cash, c h e c k , or c h arge receipt) must be sub mitted with i n sixty ( 6 0 ) d ays from d ate of advancement. 3. A l l d i s b u rsements for professional expense benefits for expenses already i n c u rred must be s upported by appropriate evidence of payment. All requests for reimb ursement must b e approved by the facu lty member's immediate supervisor. Any profess i o n a l travel expense must be preapproved. All vouchers for expenses i n c u rred d u r i n g the fiscal year must be s u bmitted by J u n e 1 5 , except that professional expenses i n c urred d u ring J u n e may be a llocated to the following year. Aggregation. of Professional Expe ns e s A n y faculty member may assi g n u p to one h u nd red percent ( 1 0 0 % ) of h is/her professional expense funds p u rsuant to Section A above to other facu lty provided s u c h assignment shall be in writi n g a n d submitted with the approved voucher of the assignee . C. Group Insurance 1. The Board s h a l l pay the total premi u m not to exceed thirty- n i n e cents ( 3 9 ¢ ) per one thousand d o l lars ( $ 1 , 000) for g ro u p term life insurance e q u a l to twice the faculty member's annual salary to the nearest thousand d o l lars, but not to exceed o n e h u n d red seventy thousand d o l l a rs ( $ 1 7 0 , 000) . I n a d d ition the Board will pay the e ntire premium for Accidental Death a n d Dismemberment Ins urance e q u a l to twice their annual sal ary to the nearest thousand d o l l a rs, but not to exceed one h u n d red seventy thousand dollars ( $ 1 70, 000) . 2. The Board s h a l l also pay the total premium necessary to provide a monthly disability benefit of sixty percent ( 6 0 % ) of salary not to exceed three thousand five h u n d red d o l l a rs ( $ 3, 500) per month for l o ng-term d i sa b i l ity i nsurance. ( A rticle V I I I ) 47 3. The Board s h a l l also pay the full premium for the facu lty member f o r the d e ntal coverage as provided d u r i n g the 1 988/90 A g reement. 4. T h e health/major m e d i c a l i n s u r a n c e premium f o r the facu lty member u n d e r Harper's self- i n s u red plan w i l l be paid at the rate of n i nety percent ( 90 % ) b y the Board and ten percent ( 1 0 % ) by the facu lty membe r . The Board shall pay one h u n d red percent ( 1 00%) of the premium for a faculty member who elects a H a rper approved H M O p l a n , except that, if the premi u m for the H M O p l a n equals o r exceeds n i nety percent ( 9 0 % ) of ' the premium u n d e r the H a rper self-insu red p l a n , the premium s h a l l be paid n inety percent ( 9 0 % ) by the Board and ten percent ( 1 0 % ) by the facu lty member. 5. The health/major medical i nsurance premium for spouse, c h i l d r e n , or spouse and c h i l d r e n u n d e r the Harper self-insu red plan will be paid at the rate of seventy percent ( 70 % ) by the Board and thirty percent ( 3 0 % ) by the faculty member. The Board s h a l l pay one h u n d red percent ( 1 0 0 % ) of t h e p r e m i u m for a facu lty m e m b e r who elects a Harper approved H M O p l a n , except that, .if the premium for the H M O p l a n equals o r exceeds seventy ( 70 % ) of the premium u n d e r the H a rper self-i n s u red p l a n , the pre m i u m shall be paid seventy percent ( 7 0 % ) b y the Board and t h i rty percent ( 3 0 % ) by the faculty member. 6. The nature of the benefits shall be governed by the terms of the applicable g r o u p policy and the rules a n d regul ations of the carrier. If facu lty members elect any dependent coverage, all premiums d u e thereafter n o t covered by t h e Board s h a l l be d e d u cted from the appropriate paycheck of the faculty member. The hea lth/major medical insurance shall be n o less comprehensive than that w h i c h prevailed d u r i n g the 1 9 8 9/90 fiscal year provided s u c h coverage m a y be altered as provided by t h e n e x t s u c c e e d i n g su bsection (7). 7. ( A rticle V I I I ) D u r i n g the term o f this Ag reement, the parties s h a l l evalu ate the existing h e a lth/major medical/dental insurance programs. Such evaluation shall b e c o n d u cted by a committee co mposed of a n e q u a l n u mber of faculty members to b e appoi nted by the President of the Senate and other persons to be appoi nted by the President of the College not to exceed e i g ht (8) i n total n u mber. Other recog n ized or established employee g roups at the College may each appoint an individual n o n-voting member of the c ommittee as a representative of such other employee g r o u p . The com mittee shall have the authority to all ocate monies i n the employee medical insurance fund and to alter any applicable provision of this section (C) and as such to be effective from and after such date established by the committee through the expirati o n d ate of this A g reement, provided at least six ( 6 ) vot i n g members of the committee 48 affirmatively approve such c h a n g e a n d provided that the Senate a n d the Board of Trustees approve any alteration of the program. D. 8. The Board agrees t o assume the f u l l cost o f a l l government m a n d ated i ncreases to i nsurance costs herein d uring the term of this Agreement. D u r i n g the term of this Agreement the Board a g rees to make available a l l monies n o w set aside a n d i n t h e future set a s i d e i n t h e employee medical i nsurance f u n d a n d all interest therefrom, plus a l l net revenues ( i f any) accruing from t h e applicable provisions of this section (C) to the committee. Net revenues shall mean the d ifference between the amount a l l o c ated for premiums under t h i s sectio n (C) a n d the amount actu a l l y paid f o r i n s u r a n c e benefits. 9. A s used i n t h i s section ( C ) , t h e term 'fiscal year' s h a l l mean the twelve ( 1 2) calendar months commencing October 1 . 1 0. The parties s h a l l return to the l a n g uage of section ( V I I I ) i n the 1 9 88/90 Agreement, except for any c hanges in the d ates and premi u m amo u nts, if either party is d i ssatisfied with the functio n i n g of the committee. Such return shall be effective at the expiration of this A g reement. 1 1. The Board s h a l l m a ke available to faculty members an I R S Section 1 2 5 sa lary reduction program for i nsurance premiums, and e l i g i b l e non­ reimbursed medical and dependent care expenses. The maximum reimbursement for n o n-reim bursed medical expenses s h a l l be two thousand five h u n d red d o l l ars ( $ 2 , 500) and the maximum reimbursement for n o n-reimbu rsed dependent care shall be five thousand d o l l a rs ( $ 5 , 000) . 1 2. The Cardiac Rehabil itation Ph ase I l l program at H a rper shall be available to faculty members. The faculty member shall pay for the Phase I l l program a n d then be reimbursed b y the Board . Secretarial Service I nsofar as practical a n d the budget permits, the services of student aides shall be m a d e availa ble to faculty members. Where feasible the reg u l a r secretarial staff may assist faculty members i n the preparation of i nstructi o n a l materials. E. Tax-Sheltered Annuity Salary d e d uctions fo r retirement a n n uity contacts (tax-sheltered a n n u ities) shall be available to all faculty. Contacts s h a l l be arranged i nd ividually through the Offi c e of the Vice Pres ident of Administrative Services or designee subject to reasonable reg u l ation by the Board . ( A rticle V I I I ) 49 F. Board Payment to Retirement System !SU RS) 1. From the Co mpensation S c h e d u l e , the Board s h a l l deduct for each facu lty member a sum e q u a l to eight percent (8%) of the a m o u nt due s u c h facu lty member p u rs u a nt to the Co mpensation S c h e d u l e s to the State of I l l i n o i s State U niversities Reti rement System, to be a p p l ied for the retirement account of s u c h facu lty member. It i s the i ntent of the parties b y this Agreement to q u a l ify these payments as " p i c ked- u p " c o ntributions within t h e m e a n i n g of Section 4 1 4 ( h ) ( 2 ) of t h e I n ternal Reve n u e C o d e so as to be e x c l u d a b l e from the g ross i n c o m e of all facu lty members. The facu lty members shall have n o right o r claim to the funds so remitted except as they may s u bsequently become available upon retirement o r resignation from the State U n iversities Retirement System. 2. N o facu lty member who i s a participant i n State U n iversities Retirement System s h a l l have the option of c h o o s i n g to receive the a mo u nts contributed by the Board d i rectly, a n d the assumption a n d payment of the facu lty members' requi red c o ntribution to the State U n iversities Reti rement System is a c o n d ition of employment made i n order to secure the facu lty members ' future services, knowledge and experience. 3. The b a l a n c e of the amount d u e each facu lty member p u rsuant to such Compensation Schedule s h a l l be payable to the facu lty member as salary i nsta l l ments as otherwise provided herein, provided the Board s h a l l d e d u ct therefrom a l l monies as req u i red by l a w o r as authorized by the faculty member p u rsuant to this Agreement, or as otherwise authorized by the Board . Such with h o l d i n g s h a l l i n c l u d e any and all a d d itional amounts requi red to be paid to the State U niversities Reti rement System for the a c c o u nt of s u c h facu lty member. 4. I nternal Reven u e Service Revenue R u l i n g s i n d i c ate that the amou nts paid the State U n iversities Retirement System are properly excludable fro m t h e gross i nc o me of t h e teacher for i ncome taxation p u rposes, a n d the Board w i l l not with hold Federal and State i n c o m e taxes on funds remitted to the State U n iversities Retirement System on behalf of teachers u n less and u ntil the I nternal Reven u e Serv i ce o r a c o u rt s h a l l determine that such amou nts are not properly e x c l u d a b l e . 5. The Board s h a l l promptly seek a letter o f o p 1 n 1 o n from the I nternal Reve n u e Service to confirm the tax status of the monies paid to the State U n iversities Retirement System pursuant to this secti o n . 6. The Senate a n d each faculty member w i l l defend, ind e m n ify, and h o l d h a rmless the Board of Trustees, its members, its age nts, a n d its employees from any a n d a l l c l a i ms , demands, actions, c o m p l a i nts, su its or other l i ab ility by reason of a faithful payment of contributions to the ( A rticle V I I I ) 50 State U n iversities Retirement System pursuant to the provision of this Section. N o such c l a im, demand, a ction, o r s uit may be settled or compromised by the Senate without the written consent of the Board of Trustees, i f such claim, demand, action, o r suit adversely affects the Board of Trustees, its members, its agents, and/or its employees. 7. The Board sh a l l prepare the W-2 statements for 1 98 1 reflecting taxable earnings w h i c h do not include the seven percent ( 7 % ) Board payment to SU R S after the onset of the 1 98 1 /8 2 academic year, provided this subsection shall not be applicable unless withholding of taxes on such Board payments h a s ceased by that date pursuant to a ll of the other provisions of this Section. G. Tuition Waiver Retired faculty as used herein shall include those retired under S U R S or the Har pe r p l a n as described i n Article I X . E a c h full-time faculty member, spouse, and child twenty-four ( 24) years o f age and under sh a l l have the right to enroll in c o u rses offered by the College without tuition charge. The participation of such faculty member, spouse, or child in any nonreimbursable c o u rse shall not permit such c o u rse to be cond ucted if it would otherwise be terminated for lack of sufficient enrollment. This section will also apply to the spouse and to c h i l d ren twenty-four ( 24) years of age or under of a faculty member deceased or permanently disabled prior to early retirement o r full retirement. ( A rticle V I I I ) 51 ARTICLE I X . EARLY RETIREMENT The Board s h a l l establish a n early reti rement program ( h ereinafter " pr o g ra m " ) s u bject to all of the followi n g : PLAN I . A. The program s h a l l be open to all faculty members who are at least 5 5 years of age on J u l y 1 of the year of retirement a n d who have been e m p loyed by the College as faculty members for the preceding 1 0 years on a f u ll-time basis. B. Application fo r p a rtic i pation i n the program shall b e s u b mitted i n writi n g to the appropriate Vice President o r designee n o later t h a n January 1 5 prece d i n g the academic year in which early retirement shall b e effective. C. E a c h a p p l ication s h a l l i n c l u d e a p l a n for the rend ition o f appropriate service to the College d u r i n g the period of early retirement. S u c h services shall not be i n a p propriate solely because they are rendered off c a m p u s . D. D u r i n g the first year o f early retirement, the retiree s h a l l receive a n amount equal to twenty-five percent ( 2 5 % ) of the base salary of the last year of full­ time teac h i n g at the College (exclus ive of overloads a n d any other stipends) . D u r i n g each succeeding year of participation i n the program the retiree shall receive a n amount equal to twenty-five percent ( 2 5 % ) of the base salary that the retiree would have received for full-time teaching at the College but for parti c i pation in the early-retirement program. Payments for services rend ered s h a l l b e made n o less often t h a n q u arterly. E. The p l a n shall terminate after five ( 5 ) years o f participation therein o r upon the reti re e ' s seventieth (70) b i rthday, o r upon death of the early retiree ( "the period of early retire ment " ) , w h i c h ever shall first o c c u r . In the event of the d e ath of an early retiree, the College will continue payments to the design ated benefic i a ry for the balance of the c u rrent year. The p l a n s h a l l also be termi n a b l e as to any retiree for f a i l u re to perform the services i n h is/her specific reti rement program o r for other good cause s h o w n . F. D u r i n g the period o f e a r l y retirement, t h e B o a r d s h a l l provide the early retiree with g ro u p medical, dental, life and accidental d e ath and d i smemberment i ns u r a n c e coverage as is available to facu lty members u n d e r this Agreement. Such i n surance coverage shall be reduced to the extent that M ed i c a i d , Medic are o r c o m parable benefits are otherwise available to the retiree o r as contractually required. D u r i n g t h e p e r i o d of e a r l y retirement, t h e e a r l y retiree shall h a v e t h e right to p u r c h ase dependent medical a n d dental i n s u rance coverage through the C o l l e g e ' s insurance program at the then prevailing rate for facu lty member d e p e n d ent coverage. Premium payments for the dependent coverage s h a l l be ( A rticle I X ) 52 paid by the retiree o n a timely basis, i n advance, to the Perso n n e l Office of the College. S h o u l d the early retiree o r dependent become eligible for M e d icare d u r i n g the period of early reti rement, the amount of premiums h e/she pays to the C o l l e g e s h a l l b e reduced by the retiree ' s o r d e p e n d e n t ' s M e d icare premiums. G. D u ri n g the period o f early retirement, the retiree s h a l l b e a n i n d e pe n dent contractor a n d not a n e m p loyee of the Board. H. The Board s h a l l approve a n early retirement p l a n w h i c h meets a l l o f the co nditi o n s of this artic l e if such shall have been timely submitte d . ( A rticle I X ) 53 PLAN I I . Anyth i n g i n this artic l e to the contrary notwithsta n d i n g , the faculty member who elects to partici pate in the early reti rement program prescribed by HB289 of 1 9 8 1 as enacted into law shall not b e e l i g i b l e to partici pate in the program provided herein except such faculty members may partici pate in the program provided herein at the compensation level described below: Age 5 5 - The C o l l e g e w i l l make a l u m p sum payment to S U R S of o n e h u n d red thirty-five percent ( 1 3 5 % ) of the base salary of the retiree determined as in Article IX, Plan 1 . , Section D. Age 5 6 - The College w i l l make a lump sum payment to SURS of o n e h u n d red eight percent ( 1 0 8 % ) of the base s a l a ry of the retiree determined as i n Arti c l e I X , P l a n 1 . , Sectio n D . The College w i l l also p a y five percent ( 5 % ) of the base s a l a ry for e a c h of five ( 5) years t o t h e reti ree. Age 5 7 - The College w i l l make a lump sum payment to S U R S of e i g hty-one percent ( 8 1 % ) of the base sa lary of the retiree determined as i n Article IX, Plan 1 . , Section D. The College w i l l also pay ten percent ( 1 0%) of the base salary for each of five ( 5 ) years to the retiree. Age 58 - The C o l l ege w i l l m a ke a lump sum payment to S U R S of fifty-four percent ( 54 % ) of the base salary of the retiree determined as i n Arti cle IX, P l a n 1 . , Section D . The C o l l e g e w i l l a l so p a y fifteen percent ( 1 5 % ) o f t h e base salary for each of five ( 5 ) years to the reti ree. Age 5 9 - The College w i l l make a lump sum payment to S U R S of twenty-seven percent ( 2 7 % ) of the base sal ary of the retiree determined as in Article IX, Plan 1 . , Section D. The College w i l l also pay twenty percent ( 2 0 % ) of t h e base salary f o r each of five ( 5 ) years to t h e retiree. As used h e r e i n , " a g e " shall mean the same a g e of the early retiree as is utilized to implement b enefits to the retiree pursuant to HB289 of 1 98 1 . Retirees participating in the program pursuant to this Plan II shall also be subject to a l l the other provisions of this Artic l e . ( A rticle I X ) 54 PLAN I l l . The specific details of P l a n I l l a r e i n c l ud e d i n a side letter to t h i s agreement. Post Retirement Medical Insurance After the period of early retirement, or after retiring and receiving S U R S benefits, a retiree o r the s u rviving spouse of a retiree s h a l l have the right to continue i ndividual o r dependent coverage under the existing g r o u p medical insurance p l a n by paying the full cost of the then prevailing cost of such coverage to the College on a timely basis. The option to p u r c h ase continuing retirement g r o u p medical coverage will term i n ate when the retiree o r s u rviving spouse become eligible for Medicaid, Medicare or comparable benefits otherwise available. If the retiree or s u rviving spouse has coverage for dependent c hildren, the option to continue depend ent c hildren medical insurance shall cease upon the retiree or su rviv i n g spouse becoming eligible for Medicaid, Medicare o r comparable b enefit otherwise available. Post-Retirement Employment Program A tenu red facu lty member who elects to retire from H a rper College u n d e r the State U nive rsities Retirement System, and who desire s to continue a professional affiliation with the College, may participate in the post-retirement employment program as outlined in the appropriate proced u re m a n u a l s . (Article I X ) 55 ARTICLE X . PRECEDENCE O F AGREEMEN T A. I f there i s any conflict between the written terms o f this A g reement a n d the terms of an individual contract of employment, the written terms of this A greement shall be c o ntrol l i n g . B. I f there i s a n y c o nflict between t h e written terms of this A greement a n d written Board policies or written Board rules a n d regu lations w h i c h may from time to time be in effect, the written terms of this A g reement s h a l l be control l i n g . C. I f a n y provision o r amendment o f this A g reement i s o r s h a l l a t a n y time be contrary to or u n authorized by l a w , then such provision s h a l l not b e applicable, except to the extent permitted b y l a w . In such cases all other provisions of this A g reement shall remain i n effect. D. The terms and conditions set forth i n this Agreement represent the f u l l a n d complete u n d e rsta n d i n g a n d c ommitments between t h e parties thereto . I. The purpose o f this study i s to e x p lore a lternatives i n c l u d i n g , but not l i m ited to: A) A flexible insurance ben efit progra m . B) M o d ificati o n s to the present benefit package. II. A second g o a l i s to provide the Board o f Trustees and the A d m i n i stration with a predictable total i n s urance benefit amount for budg eti n g purposes. It is u n derstood that the i ntent of this examination i s not to cut i n surance ben efits but rath er to g i ve more choice to participants and to provide greater a b i l ity to forecast future i n surance benefit costs . It i s recommended that a Committee be designated a s the Facu lty I n surance Benefit Study Committee to cond uct this expl orati o n with the g o a l that the study be completed within twelve ( 1 2 ) months. This Co mmittee will i n c l u d e f o u r ( 4 ) facu lty members appoi nted by t h e Senate President a n d f o u r ( 4 ) persons appointed by the President of the C o l l e g e . ( N ote: Repeats side letter from the 1 9 9 3/ 1 9 9 6 faculty agreement) 58 SIDE LETTER TO T H E 1 996/1 999 FACU LTY AGREEMENT RETIREMENT OPPORTUNITY #3 A faculty member who is at l e a st 5 5 years of age a n d who h a s been employed by the College as a facu lty member for the preced i n g fifteen ( 1 5 ) years on a ful l-time basis as of A u g ust 3 1 of the year of retirement, s h a l l have the option to e lect to have h i s/her s c h ed u led base salary e nh a n c e d b y 20 percent over the previous year's s c h e d u led base salary. T h is e n ha n ce m e nt shall be for a maximum of one ( 1 ) academic year a n d w i l l be d e d u cted from a n y i n c e ntives offered u n d e r A rticle I X - D . A faculty member w h o is a t least 5 5 years of age and who h a s b e e n employed by the College as a facu lty member for the prece d i n g twenty ( 20) years on a ful l-time basis as of A u g ust 3 1 of the year of retirement, shall have the option to elect to have h is/her scheduled base sal ary e n hanced by 20 percent over the previous year's s c h e d u l e d base salary. This e n h a n cement shall continue for a maxi m u m of two (2) c o n secutive academic years and w i l l be ded ucted fro m any i n centives offered u n d e r Articles I X - D . Fifty percent ( 50 % ) o f t h e e n h a n cement s h a l l be d e d u cted from t h e first year retirement i n centive identified i n Article IX-D a n d the remai n i n g fifty percent ( 50 % ) of the e n h a ncement shall b e ded ucted from t h e second year retirement incentive id entified in Article I X - D . The balance of the i n centive in Artic l e IX-D s h a l l be paid o ut over the remaining years of participatio n in the Early Retirement program. The amount paid out by the College shall not exceed the maxi m u m of that provided for i n Article I X - D or otherwise mand ated by I l l i n o i s State Law. To receive this e n h ancement for 1 9 96/97 or 1 9 97/98 o r a co mbination of two consecutive years, the faculty member must submit his/her retirement request by November 1 , 1 9 9 6 . T h e n u mber of faculty who will be permitted t o retire under t h i s retirement opportun ity at the end of the 1 996/97 academic year or summer sessi o n w i l l not be limited . The n u mber of faculty who w i l l be permitted to retire u nder this retirement opport u nity at the end of the 1 9 97/98 academic year or summer sessions will be determ i n e d by an a nalysis of the number of facu lty requesti n g retirement for the 1 9 96/97 and the 1 997/98 academic years or summer sessi o n s . This a n a lysis will be c o n d u cted by the A d m i nistration for the Board of Trustees and w i l l be c o mpleted by November 1 5 , 1 9 9 6 . I f t h e d i stribution of requested retirements between 1 9 96/97 a n d 1 9 97/98 is relativel y e q u a l , the resulting retirement request list shall be communicated to the faculty members requesting retirement and the Facu lty Senate. 59 I n the event of a great i m b a l a n c e i n the n umbers of fac u lty requesti n g retirement at the end of the 1 9 96/97 and 1 997/98 academic years or s u mmer sessions, the Admin istration o n behalf of the Board of Trustees shall equalize the n u mber of retirements e a c h year b y facu lty senio rity d ate. The resulti n g proposed retirement list, as revised, s h a l l b e c o m m u n i c ated to the facu lty members requesting retirement a n d the Facu lty Senate. Once the proposed retirement request l ist has been c o m m u n icated to those facu lty members requesting retirement a n d the F a c ulty Sen ate, a retir i n g faculty member will have u ntil December 1 5 , 1 9 96, to either accept any revision to h i s/her requested retirement d ate, mod ify h is/her retirement request or with d r a w h i s/her request for early retirement u n d e r this retirement o pportunity. After December 1 §., 1 9 96, t h e proposed retirement request list w i l l be forwarded to the Board of Trustees for final approv a l . I nsurance benefits u nder t h i s opport u n ity s h a l l be i n accordance with A R T I C L E I X . POST R ET I R E M E N T M E D I C A L I N S U R A N C E . T h e p l a n t o receive t h i s e n h an cement s h a l l be p u t forth i n a separate co ntract between the faculty member, in c o n s u ltation with the Faculty Senate, and the Board of Trustees. O n c e a retirement request i s accepted by the Board of Trustees, it may not be canceled, c h anged or used i n combinati o n with any other retirement p l a n except by mutual agreement between the faculty member, i n con sultation with the F a c u lty Senate, a n d the Board of Trustees. 60 SIDE LETTER TO THE 1 996-1 999 FACULTY AGREEMENT The Board shall a ll o c ate the amount of $ 2 5 , 000 per year d u r i n g the term of this contract to be available for t h e professional development of facu lty e n g a g ed i n d i s c i p l i n e specific a p p l i cations o f tec h n o l o g y .
