ISSUED BY: Office of Pers Oper Policy on Transfer of Faculty 1. Definition. A transfer is a change of location, within the same faculty class or to another faculty class. 2. Basic Policy a. A faculty member earns tenure only in an entrance-level class in the District. The classes of instructor special assignment and consulting instructor are not entrance level classes. Tenure rights do not extend to any particular assignment or location. Requests for transfer of location will be considered when vacancies occur, but administrators are under no obligation to select employees who have requested transfer over other eligible candidates when filling vacancies. b. The District reserves the right to make any reasonable assignment, reassignment, or transfer of a certificated employee to any position in any field covered by the employee's credential or qualifications. c. The filing of a Request for Transfer is without prejudice to the employee. It does not jeopardize his/her present assignment. A Request for Transfer may be withdrawn by the employee at any time prior to the official confirmation that the requ6sted transfer has been effected. d. Voluntary transfers are limited to employees with permanent status. Probationary employees in their final probationary year who have served 75% of the days or hours the school is maintained during that academic year may submit a Request for Transfer for the following year. (See EC 87468, 87469) 3. Transfer Requests a. An eligible employee has the privilege of requesting a permanent or temporary transfer to another college, subject to the following conditions: (1) The employee must submit a Request for Transfer, form C287 or Request for Temporary Transfer or Exchange form C774 to the Vice Chancellor, Division of Human Resources. Transfer requests are accepted on a continuous filing basis. Request for Transfer forms are available at each college and from the Office of Personnel Operations. (2) The Division of Human Resources will issue an acknowledgment to the applicant and, if approved for consideration, send copies of the Request for Transfer to each of the colleges included on the request and to the Office of Personnel Operations for filing along with applicants in the eligible pool. b. A master list of employees who have been approved for consideration for transfer will be distributed to each college by May I of each year, with an indication whether the requested transfer is permanent or temporary. -1- PG B435 (Continued) c. Transfer applicants will be considered along with candidates in eligible pools. Transfer applicants must be offered an interview each time interviews are scheduled to fill a position at a location where they have requested a transfer. Applicants for permanent transfer are entitled to mandatory interview in the filling of contract positions; applicants for temporary transfer are entitled to mandatory interview in the filling of temporary positions. d. The particular requirements of the educational program at the college where a vacancy exists will be the only basis for determining the selection of an eligible candidate. e. Requests for Transfer properly submitted and approved will be given consideration. Except under special circumstances, consideration will not be given to the transfer request of any employee until he/she has served a minimum of two years at any college to which he/she was transferred at his/her own request. f. Voluntary transfers of employees are normally made effective at the beginning of a semester. g. Requests for transfer are valid for a period of two school years, immediately following the school year in which the application is filed. A new application must be filed in order to be considered after this period. -2-
