Patients(coming(from(Nunavik(are(often(accompanied(by(escorts(who(are(caregivers.(These( escorts(are(often(family(members(or(people(who(live(in(the(same(community(as(the(person(who(will(be( receiving(medical(care(in(Montreal.(One(out(of(three(patients(has(such(an(escort.(These(escorts(are( lodged(in(the(same(room(at(the(M.N.Q.(and(their(role(includes(translating(remarks(into(Inuktitut(and( providing(basic(care.(The(“Regional(Policy(for(user(transportation(for(all(institutions(in(Region( 17((Nunavik)”(states(that(the(escort(must(speak(“Inuktitut(and(English(or(French.”( (( [26]( According(to(Ms.(Bichara,(when(the(Module(was(spread(across(several(different(locations(in( Montreal,(nobody(spoke(Inuktitut.(English(served(as(the(language(of(communication(with(the(residents.( She(estimates(that(about(2%(of(these(people(speak(only(Inuktitut.(These(are(usually(the(elderly,(who( make(up(between(10(and(20%(of(the(residents(at(the(Module.(Ms.(Bichara(says(that(young(Inuit( generally(speak(English(and(sometimes(French.( (( [27]( Ms.(Lisa(Mesher(has(served(as(associate(director(of(the(Northern(Quebec(Module.((She( explained(that(English(is(the(second(language(of(the(Inuit,(but(that(several(of(them(cannot(speak(it(or( only(speak(it(more(or(less.(She(believes(it(is(essential(for(the(Module(to(have(employees(who(are(able(to( communicate(with(the(Inuit(in(their(own(language.(This(is(the(role(of(Attendants(in(Northern(Institutions,( who(must(among(other(things(be(able(to(explain(in(Inuktitut(the(operating(rules(of(the(Northern(Quebec( Module(and(provide(interpretation(services(to(the(patients.(Attendants(in(Northern(Institutions(also(look( after(the(country(food(brought(by(patients(and(their(escorts.((( ( [28]( Ms.(Mesher(added(that(in(Montreal,(the(residents(of(the(M.N.Q.(and(their(escorts(find( themselves(in(an(environment(that(is(very(different(from(Nunavik,(which(can(lead(to(problems(with( alcohol(and(drugs.(Those(lodged(at(the(Northern(Quebec(Module(may(leave(the(building.(Some(of(them( come(back(intoxicated.(They(are(sometimes(violent.(( ( [29]( The(Module(aims(to(help(those(it(accommodates(when(they(find(themselves(in(an(environment( that(is(foreign(to(them.(Heads(of(living(units(are(asked(to(be(accompanied(by(a(Northern(Institution( current(Attendants(in(a(Northern(Institution(are(able(to(speak(French(and(French(is(the(language(of(work( at(the(Northern(Quebec(Module.( (( [31]( Ms.(MarieUPierre(Bergeron,(human(resources(advisor(at(the(M.N.Q.,(noted(the(difficulties(the( Module(has(had(in(recruiting(Attendants(in(a(Northern(Institution.((It(would(become(virtually(impossible( to(do(so(if(those(holding(the(positions(were(required(to(speak(French(on(top(of(Inuktitut(and(English.(( ( [32]( Mr.(Pierre(Coriolan(was(hired(by(the(Northern(Quebec(Module(as(a(Beneficiary(Attendant( in(2005.(He(speaks(to(the(clients(in(English.(The(average(age(of(the(patients(varies(between(25(and(30( years(old.(However(it(sometimes(happens(that(elderly(patients(do(not(understand(English.(According(to( Mr.(Coriolan,(there(is(always(another(patient(around(who(can(translate.(Mr.(Coriolan(believes(there(is(no( difference(between(a(Beneficiary(Attendant(and(an(Attendant(in(a(Northern(Institution.(They(are(called( upon(to(replace(each(other.(( ( [33]( Mr.(Bogdan(Gavrilescu(worked(at(the(Northern(Quebec(Module(from(2006(to(2013,(first(as(a( Beneficiary(Attendant.(Mr.(Gavrilescu(replaced(Ms.(Joyce(Cogdale,(who(was(supposed(to(occupy(the( [53](((((The(Northern(Quebec(Module(therefore(receives(the(Inuit(who(come(to(Montreal(for(medical( treatment(that(is(not(available(in(Nunavik.(These(Inuit(speak(Inuktitut.(Some(of(them(are(unilingual;( some(speak(English(that(ranges(from(basic(to(good.(Few(of(them(speak(French.(In(Montreal,(they(are( referred(to(the(McGill(University(Health(Centre,(where(the(primary(language(is(English.(( (( [54]( As(is(also(the(case(in(Nunavik,(English(serves(as(the(language(of(communication(between(the( Inuit(who(are(staying(at(the(M.N.Q(and(their(healthcare(providers.(The(same(applies(to(staff(at(the( Module(and(the(Inuit(staying(there.(This(is(why(the(knowledge(of(“a(language(other(than(the(official( language,”(which(in(this(case(is(English,(is(part(of(the(requirements(for(the(position(of(Beneficiary( Attendant.(There(is(no(evidence(that(the(Union(has(challenged(this(reliance(by(the(Employer(on(the( provisions(of(section(46(of(the(Charter%of%the%French%Language.( (( [55]( Under(one(of(the(establishment’s(policies(on(this(topic,(some(of(the(Northern(Quebec(Module’s( clients(are(accompanied(during(their(travel(and(during(their(stay(in(Montreal.(This(is(the(case(for( younger(patients,(the(elderly(and(pregnant(women.(Their(escorts(are(generally(from(the(same( community(as(the(patients(and(there(are(specific(criteria(for(who(is(chosen.(The(escorts(are(especially( useful(when(there(are(communication(difficulties(or(problems(arising(from(culture(shock.(The(result(is( that(a(third(of(those(staying(at(the(Northern(Quebec(Module(may(be(escorts.(This(does(not(solve(every( problem,(firstly(because(the(escorts(themselves(may(be(a(source(of(problems(and(also(because(they( have(had(no(training(or(experience(in(the(healthcare(field(and,(finally,(because(not(all(of(the(Module’s( patients(have(an(escort.(( (( physicians(or(other(medical(staff,(to(explain(the(information(in(their(own(language.(They(are( trained(for(this(purpose.( ( They(are(all(from(Nunavik(and(speak(Inuktitut.”(( (( [58]( Nevertheless,(problems(remain(that(can(be(attributed(in(particular(to(the(consumption(of(drugs( or(alcohol(that(are(apparently(easily(available(when(clients(venture(beyond(the(Module’s( accommodations(in(the(YMCA(building(on(Tupper(Street,(near(Atwater(Park.( (( [59]( There(are(some(similarities(and(some(distinctions(between(the(job(descriptions(for(an(Attendant( in(a(Northern(Institution(and(a(Beneficiary(Attendant.((Both(job(titles(fall(under(Category(2:( ParaUtechnical(personnel,(auxiliary(services(and(trades(personnel,(as(well(as(under(subUcategory(21( (“Beneficiary(Attendant).(Their(salary(scale(is(similar([2].( (( [60]( The(primary(function(of(a(Beneficiary(Attendant(is(to(see(to(“the(hygiene,(wellUbeing(and( supervision(of(beneficiaries,”(while(for(the(Attendant(in(a(Northern(Institution,(it(is(to(“receive,(inform,( beneficiaries.”(Similarly,(they(both(provide(“basic(care,”(but(in(the(case(of(the(Attendant(in(a(Northern( Institution,(only(“if(necessary.”(A(Beneficiary(Attendant(“informs(the(nursing(team(about(beneficiaries’( state(of(health(and(behaviour.”(This(makes(him(or(her(part(of(the(healthcare(staff.(The(same(cannot(be( said(for(the(Attendant(in(a(Northern(Institution.(On(the(other(hand,(the(latter(must(be(“capable(of( translating(what(is(said(by(resource(people(and(Native(beneficiaries(in(the(course(of(their(duties,”(hence( the(requirement(they(speak(Inuktitut.(( (( [61]( Two(distinctions(emerge(from(a(comparison(of(the(wording(of(the(two(job(descriptions:(one(is( the(emphasis(on(patient(“hygiene,(wellUbeing(and(supervision(of(users”(for(the(Beneficiary(Attendant( compared(to(the(emphasis(on(the(Northern(Institution(Attendant(“receiving,(informing(and( accompanying(beneficiaries”;(on(the(other(hand,(the(Northern(Institution(Attendant’s(role(is(to( “translate(what(is(said(by(resource(people(and(Native(beneficiaries(in(the(course(of(their(duties.”(In(fact,( the(posting(of(these(positions(notes(that(“the(candidate(must(speak(Inuktitut,(French(and/or(English.”(( ((( [62]( But(moreover,(the(presence(of(Attendants(in(a(Northern(Institution(who(can(receive(Inuit(in( Inuktitut,(help(them(fill(out(the(required(forms,(inform(them,(accompany(them(to(the(hospital(explain( what(medical(staff(are(saying(in(French(or(English,(all(simply(makes(good(sense.((Every(language(has(it( nuances,(its(subtleties.(By(dealing(with(the(Inuit(staying(at(the(M.N.Q,(in(English,(which(is(often(the( second(language(for(both(parties,(these(nuances(and(subtleties(may(be(lost.(Moreover,(the(evidence( and(of(safety.(According(to(the(evidence(heard,(the(Attendants(in(a(Northern(Institution(are(the(only( members(of(staff(at(the(M.N.Q.(who(can(speak(the(language(of(the(Inuit.(For(the(time(being,(the( Employer(wants(to(have(two(Northern(Institution(Attendants(present(for(each(shift.(( (( [69]( One(can(hardly(blame(the(Employer(for(wanting(to(ensure(that(Inuit(who(must(travel(to( Montreal(for(medical(purposes(are(welcomed(in(their(own(language(and(that(the(Northern(Quebec( Module(employs(staff(who(can(understand(them(and(offer(them(support(during(their(stay.(Naturally,(the( measures(taken(for(this(purpose(must(be(in(accordance(with(the(law.( (( [70]( The(Union(does(not(challenge(the(Employer’s(prerogative(to(create(the(position(of(Attendant(in( a(Northern(Institution,(but(rather,(the(number(of(such(positions.(It(demands(that(the(Employer(respect( the(criteria(of(necessity(and(proportionality(established(by(the(case(law(on(language(issues(whenever( knowledge(of(a(language(other(than(the(official(language(is(required(in(order(to(occupy(a(position.(( (( [71]( positions(with(those(of(Attendant(at(a(Northern(Institution(contravenes(the(provisions(of(the(Charter( because(it(introduces(an(abusive(and(discriminatory(linguistic(criterion.(The(Union(believes(that( employees(who(occupied(positions(for(several(years(were(deprived(of(their(jobs(in(favour(of(people( newly(hired(on(the(basis(of(a(language(criterion.( (( [72]( The(Employer’s(view(is(rather(that(the(Charter%of%the%French%Language(does(not(apply(to(the( Innuulitsivik(Health(Centre,(of(which(the(Northern(Quebec(Module(is(a(component.((It(contends(that( under(paragraph((b)(of(section(95,(the(Innuulitsivik(Health(Centre(is(exempt(from(application(of(the( Charter(and(that(this(exemption(applies(to(its(component,(the(Northern(Quebec(Module,(in(Montreal.( According(to(the(Employer,(section(95(must(be(interpreted(by(referring(to(the(health(centre(and(not(to( each(of(its(components,(otherwise(we(could(find(ourselves(in(the(absurd(situation(that(individuals(could( be(dealt(with(in(Inuktitut(while(in(Nunavik(“but(lose(this(right”(if(they(are(at(the(Northern(Quebec( Module(in(Montreal.( (( [73]( The(Union(answers(that(the(three(exemptions(created(by(paragraphs((a),((b)(and((c)(of(section( 95(apply(only(“in(the(territories(referred(to(in(said(Agreement,”(in(other(words(in(Nunavik,(and(not(in( the(territory(located(south(of(the(55th(parallel,(which(includes(the(region(of(Montreal.( (( [74]( As(concerns(the(right(to(be(treated(in(Inuktitut(that(the(Inuit(would(lose(if(they(stayed(at(the( M.N.Q.(in(Montreal,(it(is(subject(to(the(following(qualification.((The(Charter%of%the%French%Language(does( not(affirm(the(right(of(Inuit(to(be(treated(in(Inuktitut.(It(excludes(the(persons(and(agencies(listed(in( section(95(from(the(application(of(the(Charter.(In(other(words,(in(Nunavik,(it(does(not(make(these( persons(and(agencies(subject(to(the(rights(and(obligations(and(the(rights(created(by(the(Charter.(The( purpose(of(the(Charter(is(not(to(create(a(right(to(treatment(in(Inuktitut.(( (( [75]( Moreover,(the(Inuit(do(not(necessarily(receive(treatment(in(Inuktitut(north(of(the(55th(parallel.(( The(lack(of(Inuit(doctors(and(nurses(obliges(Inuit(patients(to(use(medical(personnel(from(south(of(the( 55th(parallel(and(whose(knowledge(of(Inuktitut(is(generally(zero.(This(means(that(the(language(of( communication(between(healthcare(staff(and(the(Inuit(is(generally(English.(Such(are(the(vicissitudes(of( history.(We(may(regret(it,(we(may(find(it(unfortunate,(but(we(cannot(deny(the(reality.( (( [76]( Section(95(of(the(Charter%of%the%French%Language(exempts(from(the(statute’s(application:(those( “persons(qualified(for(benefit(under(the(Agreement(indicated(in(section(1(of(the(Act%approving%the% Agreement%concerning%James%Bay%and%Northern%Québec((chapter(CU67),(in(the(territories(envisaged(by( the(said(Agreement”;(“bodies(to(be(created(under(the(said(Agreement,(within(the(territories(envisaged( by(the(Agreement”;(and(the(“bodies(of(which(the(members(are(in(the(majority(persons(referred(to(in( subparagraph(a,(within(the(territories(envisaged(by(the(Agreement.”(It(does(so(pursuant(to(the(principle( set(out(in(the(Preamble(to(the(Charter,(according(to(which(“the(National(Assembly(of(Québec(recognizes( the(right(of(the(Amerinds(and(the(Inuit(of(Québec,(the(first(inhabitants(of(this(land,(to(preserve(and( develop(their(original(language(and(culture.”(Each(exemption(in(section(95(of(the(Charter(applies( specifically(“in(the(territories(envisaged(by(the(said(Agreement.”((( (( [77]( An(analysis(of(the(legal(status(of(the(Northern(Quebec(Module(shows(that(it(is(one(of(eight( departments(of(the(Innuulitsivik(Health(Centre.(Two(features(distinguish(the(MNQ:(it(is(regional(in(scope( and(it(is(located(in(Montreal.(The(Module(does(not(have(a(separate(legal(personality(from(the( Innuulitsivik(Health(Centre.(Like(the(Health(Centre’s(seven(other(departments,(the(M.N.Q.(reports(to(the( senior(management(of(the(institution(and(ultimately,(to(its(Board(of(Directors.%An(account(of(the( Module’s(activities(takes(up(part(of(the(Innuulitsivik(Health(Centre’s(Annual(Report.(Therefore,(whatever( applies(to(the(Health(Centre(also(applies(to(its(departments,(including(the(Northern(Quebec(Module,( even(if(it(is(located(in(Montreal.(( (( [78]( In(Nunavik,(the(healthcare(system(is(made(up(in(particular(of(two(health(centres,(which(are( located(in(Kuujjuaq(and(Puvirnituq.(The(Northern(Quebec(Module(is(an(integral(part(of(this(system,( along(with(the(other(departments(of(the(two(health(centres.(The(rules(governing(the(health(system( apply(to(all(its(components.(One(cannot(distinguish(a(single(department(from(the(whole(system,(even(if( for(practical(reasons(it(operates(outside(the(territory(of(Nunavik.(The(fact(that(the(Syndicat%des%employés% du%Module%du%Nord%Québécois(has(its(own(union(accreditation(does(not(confer(on(this(department(of( the(Innuulitsivik(Health(Module(a(distinct(legal(personality(from(the(Centre(itself.(In(short,(the(accessory( follows(the(principal.((( (( [79]( The(Tribunal(is(therefore(of(the(opinion(that(the(exemption(created(by(section(95(of(the(Charter% of%the%French%Language(applies(to(the(operations(of(the(components((by(which(the(bodies(referred(to(in( the(provision(carry(out(their(mission(including(the(components(that(as(an(exception(and(of(necessity,(are( located(outside(of(Nunavik.( (( [80]( Moreover,(the(case(law(that(the(Union(submitted(focuses(largely(on(the(provisions(of(the( Charter%of%the%French%Language(concerning(the(need(for(a(language(other(than(French(in(order(to(hold(a( position.(Since(the(Charter(does(not(apply(to(the(Innuulitsivik(Health(Centre(and(its(departments(that( case(law(does(not(apply(in(this(case.(( (( [81]( Moreover,(that(jurisprudence(concerns(situations(very(different(from(that(of(the(M.N.Q.(In(the( case(of(Pierre%Pouliot%c.%Quality%Inn%et%Suites%Lévis,(the(issue(was(whether(the(employer(had(the(right(to( require(knowledge(of(English(for(the(position(of(‘head(of(maintenance.’(The(latter(was(rarely(in(contact( with(the(EnglishUspeaking(clientele(of(the(organization.(Thus,(Commissioner(Maryse(Morin(decided(that( the(employer(violated(the(Charter%of%the%French%Language,([TRANSLATION]“by(requiring(the(knowledge(of( English(from(a(candidate(trying(to(obtain(the(position(of(“head(of(maintenance”(at(its(hotel.”[3](( (( [82]( Similarly,(in(the(case(of(Université%de%Montréal%et%le%Syndicat%des%employé(e)s%de%l’Université%de% Montréal,%local%1244%SCFPNFTQ,(the(arbitrator,(Maître(André(Sylvestre,(ruled(that(the(requirement(to( speak(English(violated(the(Charter(because(there(had(been(only(ten(to(15(Anglophone(clients(over(ten( years.(By(contrast,(the(Attendants(in(a(Northern(Institution(at(the(M.N.Q.(are(in(constant(contact(with( clients(who(are(all(Inuit(and(whose(language(is(Inuktitut.( (( [83]( In(the(decision(rendered(on(November(20,(2008(in(the(case(of(Alliance%du%personnel% professionnel%et%technique%de%la%santé%et%des%services%sociaux%et%le%Centre%de%santé%et%de%services%sociaux% du%HautNSaintNFrançois,(the(arbitrator,(Maître(René(Turcotte,(ruled(that([TRANSLATION](“the(evidence( conclusively(demonstrates(the(existence(of(the(criterion(of(necessity(for(EnglishUlanguage(proficiency( required(for(the(Employer(to(be(able(to(invoke(the(exception(set(out(in(section(46(of(the(Charter(and( thus(deprive(a(worker(of(his(right(to(work(in(French.”[4](However:( (( line(of(cases(so(eloquently(set(out(by(arbitrator(JeanUMarie(Lavoie(in(the(excerpts(cited(above(from(the( decision(in(the(case(of(Syndicat%des%infirmières%et%infirmiers%de%la%ValléeNdesNForts%(F.I.I.Q.)%et%C.L.S.C.N C.H.S.L.D.%ChampagnatNValléeNdesNForts,((2003(A(176).(”( (( [84]( In(that(case,(as(in(the(case(of(Syndicat%des%infirmières%et%infirmiers%de%la%ValléeNdesNForts%(F.I.I.Q.)% et%C.L.S.C.NC.H.S.L.D.%ChampagnatNValléeNdesNFort,(which(the(Union(also(filed,(the(recourse(to(section(46( concerned(a([TRANSLATION](“limited(number(of(EnglishUspeaking(users(who(asked(to(be(served(in(their( own(language,”(so(that(it((was(“absolutely(imperative(that(the(employer(engage(in(this(process(and( determine(whether(there(are(no(other(solutions(that(would(allow(it(to(achieve(the(desired(objective( without(undue(hardship,(while(avoiding(making(knowledge(of(English(a(condition(for(access(to(the( The(decision(rendered(by(Maître(Harvey(Frumkin,(arbitrator(in(the(case(of(Hôpital%chinois%de% Montréal%et%Syndicat%canadien%de%la%fonction%publique,%section%locale%4490,(is(more(akin(to(the(situation( of(the(Northern(Quebec(Module.(The(dispute(before(the(arbitrator(concerned(the(organizational( structure(the(employer(had(adopted(and(which(provided(that(20(employees(in(the(Beneficiary(Attendant( position(had(to(speak(“the(Cantonese(or(Taishanese(dialect(of(the(Chinese(language.”(The(parties(to(that( dispute(agreed(that:(( (( [TRANSLATION]“10.(((When(a(beneficiary(is(hospitalized(and(the(nurse(team(leader(cannot( communicate(with(him(in(his(own(language(or(dialect,(the(Hospital(uses,(in(a(very(random( fashion,(one(or(another(staff(member(from(any(category(who(can(speak(his(language(or(dialect,( if(such(an(employee(is(available(somewhere(in(the(hospital;( (( 11.( The(Hospital’s(requirement(for(language(fluency(means(being(able(to(understand(and( express(oneself(fluently(in(the(language;(it(is(one(of(the(issues(in(dispute;( (( 12.( The(beneficiaries(admitted(to(this(hospital(for(roughly(the(past(fifteen((15)(years(have( been(exclusively(of(Chinese(or(Southeast(Asian(origin.”( (( [86]( The(Chinese(Hospital(defines(it(mission(as(follows:( (( [TRANSLATION](“The(Montreal(Chinese(Hospital('s(mission(is(to(provide(medical(care(and( accommodation(for(adults(and(seniors,(particularly(of(Chinese(or(Southeast(Asian(backgrounds,( who(suffer(from(a(permanent(disability(or(have(lost,(totally(or(partially,(their(functional( independence.((The(Hospital(provides(services(in(an(environment(adapted(to(the(values,( customs(and(socioUcultural(traditions(of(its(beneficiaries.(The(Hospital(also(offers(diagnostic( services(and(medical(consultations(in(its(outpatient(clinic.(In(addition,(the(Hospital(also(has(a(Day( Center(whose(services(are(exclusively(for(older(members(of(the(Chinese(and(Southeast(Asian( Unlike(the(M.N.Q.,(which(is(a(temporary(living(unit,(the(Chinese(Hospital(is(a(longUterm(care( residence(that(accommodates(people(who(“suffer(from(a(permanent(disability(or(who(have(lost,(totally( or(partially,(their(functional(independence.”(This(explains(the(importance(of(Beneficiary(Attendants,( who(are([TRANSLATION](“the(category(of(employees(who(work(most(closely(with(the(beneficiary(by( providing(basic(daily(care.”[6]( (( [89]( The(redefinition(of(the(mandate(of(the(Northern(Quebec(Module(in(2009(resulted(in(the( elimination(of(nursing(so(that(the(organization(could(focus(on(the(transportation(of(beneficiaries,( interpretation(services(and(social(support.(Beneficiary(Attendants(and(Attendants(in(a(Northern( Institution(are(therefore(the(two(categories(of(employees(who(work(most(closely(with(the(residents.( Since(they(are(required(to(speak(Inuktitut,(among(other(things,(the(Attendants(in(a(Northern(Institution( allow(the(Module(to(fulfill(the(part(of(its(mission(that(consists(of(providing(the(provision(of( interpretation(services(to(Inuit(staying(there.( ( [90]( The(importance(of(knowing(the(clients’(language(for(the(category(of(employees(who(work(most( closely(with(them(led(Maître(Frumkin(to(write:( (( [TRANSLATION](“[65](Finally,(the(Tribunal(cannot(agree(with(the(Union(when(it(suggests(that(the( category(of(Beneficiary(Attendant(was(unfairly(designated(as(the(group(for(whom(the(linguistic( requirement(would(apply(in(this(case.(As(he(explained,(the(Beneficiary(Attendant(occupies(a( crucial(position,(playing(a(central(role(in(the(care(provided(to(beneficiaries.(He(is(the(one( working(closely(with(beneficiaries(on(a(daily(basis.(This(category(of(employee(is(on(the(front( lines(and(for(reasons(mentioned(above,(must(be(able(to(communicate(with(beneficiaries(and( even(with(their(family(members(and(when(this(communication(requires(knowledge(of(the( Chinese(language,(a(Beneficiary(Attendant(who(speaks(this(language(must(be(easily(accessible.( This(is(why(the(Tribunal(has(great(difficulty(objecting(to(the(approach(the(employer(intends(to( take(in(this(case.”(( (( [91]( One(of(the(differences(between(the(Montreal(Chinese(Hospital(and(the(Innuulitsivik(Health( Centre(is(that(the(former(is(subject(to(the(provisions(of(the(Charter%of%the%French%Language,(while(the( latter(is(not.(Moreover,(the(Charter(affirms,(in(its(Preamble,(that:(( “the(National(Assembly(of(Québec(recognizes(the(right(of(the(Amerinds(and(the(Inuit(of(Québec,( the(first(inhabitants(of(this(land,(to(preserve(and(develop(their(original(language(and(culture.”( ( [92]( Naturally,(the(Charter(makes(no(reference(to(the(Cantonese(or(Taishanese(dialects(or,(more( broadly,(the(Chinese(language;(that(is(not(its(goal.(The(acceptance(by(an(arbitration(tribunal(that(the( exception(provided(for(in(section(46(of(the(Charter(applies(to(the(situation(of(the(Montreal(Chinese( Hospital(justifies(all(the(more(the(Northern(Quebec(Module’s(initiative(to(replace(vacant(Beneficiary( Attendant(positions(with(Attendant(in(a(Northern(Institution(positions.(It(is(difficult(to(believe(that(the( Inuit(of(Québec,(“descendants(of(the(first(inhabitants(of(this(land,”(could(be(denied(what(the(courts( have(granted,(rightly,(to(other(persons(whose(presence(in(North(America(does(not(have(the(same( historic(scope.( (( [93]( Grievances(no.(159579,(159583,(159588,(159592,(159595,(159598(and(190057(and(190509,( which(contest,(without(further(detail,(the(posting(of(Attendant(in(a(Northern(Institution(positions(MNQ( 11U02,(MNQ(11U05,(MNQ(11U06,(MNQA(11U07,(MNQ(12U01(et(MNQ(12U03,(as(well(as(the(appointments( of(Sarah(Noavalinga(and(D’Allage(Sinnarapik(to(positions(as(Attendants(in(a(Northern(Institution,(are( therefore(denied.(( ( ([94]( Grievances(no.(159589,(159596,(190058(and(190060(contest(“the(requirements(for(the(position( of(Attendant(in(a(Northern(Institution”(and(demand(that(French(be(mandatory.(The(linguistic( requirement(in(posting(for(positions(as(Attendant(in(a(Northern(Institution(is(that(the(position( incumbents(must(be(able(to(speak(Inuktitut,(French(and/or(English.(The(Innuulitsivik(Health(Centre(is(not( subject(to(the(provisions(of(the(Charter%of%the%French%Language.(Therefore(the(Employer(is(not(violating( the(statute(by(requiring(the(knowledge(of(a(language(other(than(French,(in(this(case(Inuktitut,(in(order( to(obtain(employment(as(Attendant(in(a(Northern(Institution.(Grievances(159589,(159596,(190058(and( 190060(are(therefore(illUfounded.( (( [95](((((This(leaves(grievance(no.(159577,(in(which(the(Union(contests(the(elimination(of(the(position(of( Beneficiary(Attendant(and(demands(that(this(position(be(retained(and(that(“Joyce(Cogdale(be( recognized(as(the(incumbent,”(and(grievance(n(159578,(in(which(Mr.(Gavrilescu(contests(the( termination(of(his(assignment(as(the(replacement(for(Ms.(Cogdale.( (( [96]( Job(competition(no.(MNQ(08U96(was(posted(from(November(13(to(20,(2008,(in(order(to(fill(three( regular(fullUtime(“Beneficiary(Attendant”(positions.(The(Union(makes(a(link(between(this(job(posting(and( a(“grievance(settlement(agreement”(that(the(parties(signed(on(November(11,(2008.(This(agreement( provided(for(the(posting(of(certain(positions(in(exchange(for(the(settlement(of(several(grievances.(Thus,( “three((3)(regular(fulltime(Beneficiary(Attendant((3480)(positions((Class(1(–(36.25(hours(per(week)”(had( to(be(created(at(the(Hampton(Residence.(The(Employer(does(not(dispute(this(connection.( (( [97]( Ms.(Joyce(Cogdale(had(been(disabled(within(the(meaning(of(the(collective(agreement(since( October(10,(2008.(One(of(the(three(Beneficiary(Attendant(positions(in(the(MNQ(posting(08U96(was( meant(for(her,(but(she(never(occupied(it.( (( [98]( According(to(the(Union’s(seniority(lists(as(of(April(11,(2009,(April(10,(2010,(and(March(26,(2011,( Ms.(Cogdale(was(a(fullUtime(“head(of(a(living(unit,”(at(“M.N.Q.(subservice(074064((lodging)”(a(position( under(“category(4((U(Technicians(and(professionals(in(health(and(social(services,”(where(the(salary(range( is(between($22.91(and($34.03((No(explanation(has(been(given(as(to(the(reason(Ms.(Cogdale(would(have( applied(for(a(position(as(a(Beneficiary(Attendant,(which(is(part(of(“category(2(–(ParaUtechnical(personnel,(( auxiliary(services(and(trades(personnel,”(where(the(salary(range(is(between($16.52(and($20.49.( (( [99]( In(any(event,(Ms.(Cogdale(never(passed(the(stage(of(the(initiation(and(trial(period(for(the( Beneficiary(Attendant(position.((Clause(7.14(of(the(local(provisions(of(the(collective(agreement(provides( that(the(maximum(duration(of(this(trial(period(is(“twenty((20)(working(days.”(This(period(is(crucial( because(it(allows(an(employee(to(assess(whether(a(new(position(suits(him(or(her(and(the(employer(to( ensure(that(the(employee(has(the(necessary(skills(for(the(job.( (( [100]( Pursuant(to(clause(1.11(of(the(national(provisions(of(the(collective(agreement,([TRANSLATION](“an( employee(who(decides(to(return(to(his(former(job([during(the(initiation(and(trial(period](or(who(is(called( upon(by(his(employer(to(return(to(his(former(position,”(“does(so(without(prejudice(to(his(acquired(rights( to(his(former(position.”(( ( [101]( An(employee(who(is(kept(on(in(his(or(her(new(position(at(the(end(of(the(initiation(and(trial( period([TRANSLATION](“is(presumed,(at(that(time,(to(have(satisfied(the(normal(job(requirements”( the(Beneficiary(Attendant(job(“as(you(have(been(unable(to(serve(your(20Uday(initiation(and(trial(period( within(a(reasonable(period(of(time.”( (( [103]( The(transfer(of(Ms.(Cogdale(from(a(“head(of(a(living(unit”(position(to(one(of(Beneficiary( Attendant(never(seems(to(have(occurred.((Keeping(her(on(the(seniority(list(in(her(positions(as(“head(of(a( living(unit”(may(have(entitled(her(to(higher(disability(insurance(benefits(during(the(first(24(months(of(her( disability.(( (( [104]( On(December(13,(2011,(the(Employer(terminated(the(employment(of(Ms.(Cogdale(since( October(10(marked(the(36th(month(of(her(absence(due(to(illness.(Ms.(Cogdale(did(not(contest(this( measure.( (( [105](((In(grievance(no.(159577,(the(Union(demand(among(other(things(that(the(position(of(Beneficiary( Attendant(be(maintained(and(that(“Joyce(Cogdale(be(recognized(as(the(incumbent.”(Recognizing(Ms.( Cogdale(as(the(incumbent(would(imply(that(she(had(satisfied(the(normal(job(requirements(without( having(passed(the(initiation(and(trial(period.(This(would(amount(to(changing(the(wording(of(clause(7.14( of(the(local(provisions(of(the(collective(agreement.(The(Union’s(demand(to(recognize(Ms.(Cogdale(as( incumbent(in(the(Beneficiary(Attendant(position(cannot(be(granted(without(her(having(completed(the(
