Quick Guidelines for Successful Parking on the UNCW Campus
•
Parking regulations are enforced 24 hours a day - every day (365 days per year).
•
If you drive and park on campus, you need a parking permit.
•
Student parking spaces are outlined in white paint. Faculty/staff parking spaces are outlined in yellow.
•
You can buy a temporary parking decal for $10.00 a week, if you live outside the one-mile radius of
UNCW.
•
A ticket for not having a permit is $50.00 each time you are ticketed.
•
Between the hours of 4 p.m. and 7 a.m., students with a permit can park in staff spaces as long as the
spaces are NOT restricted 24-hour staff spaces.
•
Resident students are restricted to their assigned color zones from 7 a.m. to 4 p.m.
•
Resident students may park from 4 p.m. to 7 a.m. in commuter lots between white lines.
•
Night parking permits are available for parking between the hours of 4 p.m. to 7 a.m. only in commuter
lots; such permit is not valid for residential and/or deck parking.
•
All unpaid parking fines for students are charged to their student account.
•
Visitor permits can be obtained from Auxiliary Services/Parking and Transportation Office, Monday
through Friday from 8 a.m. - 4:30 p.m.
•
Commuter students are not allowed to park in residential lots.
•
Lack of space or lack of a convenient space is not a valid excuse for violation of parking regulations.
•
Permits are not transferable to another person. A new permit will be issued for damaged permits or new
vehicles when the old permit is brought to the Auxiliary Services/Parking and Transportation Office.
•
University faculty/staff and students cannot park at parking meters or any designated visitor parking
spaces or areas. Students are to park ONLY in the white outlined parking spaces within their assigned
commuter zone or resident lot.
•
Parking permits must be removed from registered vehicles and returned to the Auxiliary
Services/Parking and Transportation Office for the following reasons:
o Change in vehicle owners
o Change of parking assignment
o Refund
•
Parking permits are the property of UNCW.
•
Temporary parking permits are hung from the rear view mirror. If you do not have a rear view mirror, the
permit should be placed on the dashboard on the driver’s side.
•
If your car needs repairs and you have to borrow someone else’s car, you will need to go to the Parking
Office and register the borrowed vehicle. A temporary pass will be issued to that vehicle. If you bring a
car on campus and the Parking Office is closed, register the borrowed vehicle with the UNCW Police.
•
Even if you will have your car here for only a month, you will need to purchase a temporary parking
permit weekly for $10.00, and furnish proof of liability insurance.

PART I: GENERAL INFORMATION
Providing adequate parking facilities is a continuous concern of University of North Carolina
Wilmington. Through the enforcement of vehicle regulations and the expansion and improvement
of campus parking facilities, the university is working to alleviate parking and traffic problems in
an efficient manner. Environmental concerns are closely monitored in the process to protect the
natural resources of the university.
In all of these efforts, the university attempts to keep parking fees at a minimum, despite the fact
that the cost of constructing parking spaces is approximately $5,500 per space.
Students and employees of the university are responsible for the registration of their respective
vehicles and for compliance with rules and regulations governing the operation of these vehicles
on university property. In the interest of fairness and legality, these rules and regulations apply
equally to the university employees and students. The cooperation of vehicle operators in the
administration and enforcement of traffic and parking regulations enhances the convenience,
safety and general welfare of the university community.

SECTION 2. REFUND POLICY
Parking permits must be returned to the Auxiliary Services/Parking and Transportation Office to obtain a
refund.
The annual registration fee (less $10.00 Administrative Fee) is refundable in accordance with the
following schedule:

The special summer school registration fee is not refundable.
SECTION 3. APPEALS PROCEDURES FOR TRAFFIC AND PARKING CITATIONS
Individuals receiving parking citations may appeal their fine to the Parking and Traffic Citation Board.
Moving Violations may be appealed to the Director of Auxiliary Services.
The following steps should be taken in the appeals process:
A. Persons wishing to appeal a parking or traffic citation should initiate an appeal by filing a Parking or
Traffic Citation Appeal Form with the Auxiliary Services/Parking and Transportation Office. These
appeal forms can be obtained at the Parking and Transportation office or by printing the Parking or
Traffic Citation Appeal form (PDF) from the Parking and Transportation Web site. All appeals must
be initiated within seven (7) days of the citation issue date.
Parking or Traffic Citation Appeals will NOT be considered for the following reasons.
• Fire lane violation
• Not knowing or lack of knowledge of Parking Regulations
• Inability to find a proper convenient parking space
• Financial hardship caused by the fine
• Someone else driving your car
Persons appealing for reasons (i.e., disabled vehicle or temporary medical problem) other than those
listed above may complete the form. Complete the form in as much detail as possible, attach the
citation and any supporting documentation (i.e., repair bill, doctor’s note, police report, etc.) to the
form and return it to the Auxiliary Services/Parking and Transportation Office (located in Warwick
Center). All appeals must be submitted to the parking office within seven (7) days of the citation
issue date. The appellant may request permission from the Director of Auxiliary Services to present
an appeal in person. The Parking and Traffic Citation Board will review policies and documentation
associated with the violation and consider any circumstances you describe.
Appellants will be notified by letter of the Board’s decision. Those appeals denied must be paid at the
University Cashier’s Office within seven (7) days of the letter’s mailing date.
B. Persons wishing to appeal a moving violation should initiate an appeal by filing a Moving Violation
Appeal Form with the Auxiliary Services/Parking and Transportation Office. These forms can be
obtained at the Parking and Transportation office or by printing the Moving Violation Appeal form
(PDF) from the Parking and Transportation Web site.
Complete the form in as much detail as possible, attach the citation and any supporting
documentation to the form and return it to the Auxiliary Services/Parking and Transportation Office
(located in Warwick Center). All appeals must be submitted to the parking office within seven (7)

days of the citation issue date. The appellant may request permission from the Director of Auxiliary
Services to present an appeal in person. The Board of Trustees has determined that the Director of
Auxiliary Services should review all moving violation appeals and serve as a Hearing Officer for all
moving violations. The Director of Auxiliary Services will consider an appeal based on the written
material submitted. The Director of Auxiliary Services may also call appellants for clarification or ask
that they appear for a hearing with the officer who issued the moving violation. Appellants may also
request a hearing with the officer present.
Appellants will be notified by letter of the Director of Auxiliary Services decision. Those appeals
denied must be paid at the University Cashier’s Office within seven (7) days of the letter’s mailing
date.
SECTION 4. DISPOSITION OF PARKING TICKETS
The individual in whose name the vehicle is registered with the university is responsible for
clearing parking tickets and paying assessed fines.
Parking tickets are cleared in accordance with the following procedures:
A. Parking tickets must be taken to the University Cashier's Office for disposition within seven (7) days
of the citation issue date.
B. If the ticket is not cleared within seven (7) days, a written reminder is mailed to the registrant.
C. If there is no payment within seven (7) days, the assessed fine is subject to established debt
collection procedures. Until such time as the fine is paid, the registered owner/operator (student)
cannot enroll for future courses or obtain a transcript of academic work completed at UNCW. If
you are a registered student, unpaid fines will be added to your student account.
PART II - TRAFFIC AND PARKING REGULATIONS
Through the resolution which follows, the Board of Trustees of University of North Carolina Wilmington
has adopted the Rules and Regulations set forth herein: BE IT RESOLVED. Pursuant to authority vested
in it by the State of North Carolina General Statute Chapter 116, Article 1, Part VI, that the Board of
Trustees of University of North Carolina Wilmington hereby rescinds all provisions of all previous
regulations governing traffic, parking, and registration of motor vehicles for University of North Carolina
Wilmington, and adopts and records in its proceedings the following regulations governing parking, traffic,
and the registration of motor vehicles on the campus of University of North Carolina Wilmington in lieu
thereof. These regulations are intended only to supplement the statewide motor vehicle laws, all
provisions of which, under the terms of Chapter 116, Article 1, Part VI now apply to the campus of
University of North Carolina Wilmington. From the date of filing a copy of these regulations in the office of
the Secretary of State and providing the appropriate signs, said regulations shall apply to and be in effect
on the streets, roads, alleyways, sidewalks, walkways, parking spaces, parking areas, and parking lots on
all parts of the campus of University of North Carolina Wilmington.
ARTICLE 1: GENERAL REGULATIONS AND DEFINITIONS
SECTION 1. DEFINITIONS
The definitions of terms in these regulations shall be those provided in G.S. 20-38 and other
applicable sections of Chapter 20 of the General Statutes of North Carolina insofar as they are
provided. The meaning of other terms shall be as follows:

A. ACADEMIC YEAR: From the beginning of one fall semester to the beginning of the next fall
semester.
B. CAMPUS: All property which is owned or leased by the State of North Carolina and which
is under the supervision of the Board of Trustees of University of North Carolina Wilmington.
C. CHANCELLOR: Chief Administrative Officer of University of North Carolina Wilmington.
D. CROSSWALK: The portion of a roadway ordinarily included within the prolongation of the
lateral lines of sidewalks at intersections or any portion of a roadway distinctly indicated for
pedestrian crossing by lines or other markings on the street surface.
E. CHIEF OF UNIVERSITY POLICE: The person designated by the Vice Chancellor for
Business Affairs to be responsible for enforcing the provisions of these regulations.
F. EMERGENCY VEHICLES: Vehicles used by the Department of the University Police.
G. INTERSECTION: The area embraced within the prolongation of the lateral curb lines of two or
more streets that join one another at any angle whether or not one such street crosses the other.
H. MOPED: Vehicle having two or three wheels and operable pedals and equipped with a motor
which does not exceed 50 cubic centimeters piston displacement and which will not propel the
vehicle at a speed greater than 20 miles per hour on a level surface.
I. OPERATOR: The word "operator" as used in this regulation means any individual who
operates a vehicle or is in physical control of that vehicle.
J. PARK: The standing of a vehicle, whether occupied or not, except while actually
engaged in loading and unloading.
K. PARKING AREA: Any place set aside and marked for parking of vehicles, either
permanently or temporarily.
L. QUEUE PARKING - A parked vehicle awaiting a turn for a legal parking space.
M. AUXILIARY SERVICES/PARKING AND TRANSPORTATION OFFICE: The office
responsible for the management and administration of parking resources, facilities, policies
and procedures, vehicle registration and parking enforcement.
N. REGISTRANT- The individual in whose name a vehicle is registered with the Auxiliary
Services/Parking and Transportation Office.
O. SIDEWALK: Any area designed for or marked by proper authorities for the exclusive use of
pedestrians.
P. STOP: Complete cessation of movement of the vehicle.
Q. STREET: Any way or place designated or marked by proper authority for vehicle, bicycle
and moped traffic.
R. STUDENT: Any individual enrolled or participating in academic activities at the
University other than University employees.
1. Full-time: Any student enrolled in a minimum of 7 hours of coursework.
2. Part-time: Any student enrolled in 6 hours or less of coursework.
S. STUDENT SECURITY: Any student who is assigned duties involving the safety,
security, traffic control and enforcement of parking regulations on campus.

T. UNIVERSITY: Unless otherwise provided, University of North Carolina Wilmington.
U. UNIVERSITY EMPLOYEE: Any individual employed by the University.
V. VEHICLE: Any device in, upon, or by which person or property is or may be transported or
drawn upon the campus, except devices moved by human power. The terms "motorcycle",
"motorbike", or "motorscooter" in these regulations apply to any two-wheeled or three-wheeled
motor-propelled vehicles.
W. TRAFFIC AND PARKING OFFICER: Any person appointed by the Chief of University
Police to enforce traffic and parking regulations and direct traffic on campus.
X. SERVICE VEHICLE: Any clearly marked vehicle owned by the University or contractor of
the University who is providing maintenance or making deliveries to the various buildings on
campus.
Y. CONSTRUCTION PARKING AREA: Any area designated by appropriate signs or barriers
as reserved for construction contractors on the campus.
Z. VISITOR: Any person on the campus of the University who is neither a student nor
faculty/staff member.
SECTION 2. PUBLICATION
Regulations governing parking and traffic on University of North Carolina Wilmington campus are
in effect twenty-four (24) hours a day, 365/366 days a year. The Auxiliary Services/Parking and
Transportation Office is responsible for the publication of amendments to these regulations as
approved by the Board of Trustees of University of North Carolina Wilmington. This information
is published and revised periodically to keep students and others advised of changes.
Regulations governing parking and traffic or changes thereto are announced on official bulletin
boards, in the Seahawk, and other campus publications.
SECTION 3. GENERAL PROVISION
The driver of a vehicle, bicycle and other human powered device shall obey the lawful
instructions of University Police, official traffic signs or traffic control devices placed in
accordance with the provisions of these regulations.
SECTION 4. REMOVAL OF SIGNS
No person shall, without lawful authority, attempt to or in fact alter, deface, injure, knock down,
or remove any official traffic or parking control sign or device or any inscription, shield, or
insignia thereon, or any part thereof.
SECTION 5. LIABILITY
The University does not assume responsibility for any vehicle or its contents, parked or
operated on the campus.
SECTION 6. REPORT OF TRAFFIC ACCIDENTS
Traffic accidents occurring on the University campus must be reported immediately to the
University Police in addition to any other reporting required by law.
SECTION 7. ADMINISTRATION OF REGULATIONS
The Chancellor, acting pursuant to the authority vested in him/her as Chief Administrative Officer
of the University of North Carolina Wilmington and by these regulations, shall exercise his/her

discretion and authority in such a manner as to insure the proper conduct of the necessary
business of the University and the effective utilization and control of the available parking areas
and facilities on the campus of the University for the benefit and maximum convenience of
students, visitors and employees. The Chancellor has delegated to the Vice Chancellor for
Business Affairs the responsibility for the implementation of these regulations.
ARTICLE II: REGISTRATION
SECTION 1. REGISTRATION OF VEHICLES
Students and employees of the University who operate or park a vehicle on the University
campus must register their vehicle at the Auxiliary Services/Parking and Transportation Office.
Registration of vehicles operated on campus by contractors, vendors and participants in special
programs, conferences, and other events is determined on a case-by-case basis by the Auxiliary
Services/Parking and Transportation Office.
SECTION 2. TIME OF REGISTRATION
All student vehicles must be registered annually at the beginning of the fall semester or within 48
hours after the first class of the fall/spring semester and both summer sessions. Vehicles of
students who register for classes after the beginning of the fall/ spring semesters and both
summer sessions must be registered within 48 hours of that date. Faculty and staff vehicles must
be registered by October 1. New employees must register their vehicles within 48 hours after
beginning work.
SECTION 3. DISPLAY OF PERMITS
Permits for vehicles must be affixed and clearly visible on the outside bottom left rear
windshield. Vehicles without permanent rear windows should display their permit on left rear
bumper. Permits on motorcycles must be affixed in a manner so as to be readily visible.
SECTION 4. REPLACEMENT OF PERMITS
If a permit is defaced or removed, the registrant is responsible for replacing the permit.
Replacement permits may be obtained from the Auxiliary Services/Parking and Transportation
Office. Stolen permits must be reported to University Police immediately, as a police report is
required to obtain a replacement permit. Lost permits may be replaced with an affidavit of loss.
SECTION 5. EXPIRATION OF PERMITS
All permits will expire as designated on the permit. All faculty and staff permits,
regardless of the date of issue, will expire annually on September 30.
SECTION 6. REGISTRATION RESTRICTIONS
A. All undergraduate students living within a one-mile radius of the center of campus are
prohibited from buying or displaying a daytime (7 a.m. - 4 p.m.) parking permit during the fall and
spring semesters of the academic year. Undergraduates living within the one-mile radius may
purchase a nighttime only permit, valid between 4 p.m. and 7 a.m., Monday through Friday, and
on weekends. All students must provide proof of vehicle liability insurance by providing name of
insurance company and policy number as required by NC General Statutes, G.S. 116-44.4 (d)
and G.S. 20-279.1 (11).
B. To register a vehicle, the individual must complete a vehicle registration form with a current
license tag number, make and model of car, and insurance information.

C. An individual may not register more than one vehicle without the approval of the Auxiliary
Services/ Parking and Transportation Office. Only one vehicle, registered to the same person,
may be parked on campus at a time.
D. The individual in whose name the vehicle is registered is responsible for all parking tickets
issued to that vehicle.

SECTION 7. CARPOOLING AND MULTI-VEHICLE REGISTRATION
A. In order to qualify for reduced rates for carpooling, a minimum of two (2) persons who have
registered vehicles on campus must submit a written statement of intent to carpool to the
Auxiliary Services/Parking and Transportation Office. Information submitted must include the
carpooler's names, makes of vehicles, and tag numbers. If approved, riders will equitably share
the full price of the permit and each person receives a carpooling sticker which must be displayed
on the left rear window. Only one vehicle of the carpool may be parked on campus at any one
time.
B. Multi Vehicle/Single Driver Registration.
When more than one vehicle will be used by a single faculty, staff or student for commuting
purposes, the following conditions apply:

A permit will be issued and must be displayed on the vehicle being parked on campus.
Violation of this policy will result in suspension of this privilege and a citation and fine.
SECTION 8. TEMPORARY PARKING PERMITS
A. A student, faculty/staff member, or visitor may obtain a temporary permit to operate an
unregistered vehicle on the campus.
B. If an individual has registered a vehicle on campus, the temporary permit is issued without
charge. Permit holders are not entitled to obtain a temporary permit if the vehicle displaying the
original permit is parked on campus.
C. If an individual has not registered a vehicle on campus, a fee of $10.00 per week will be
charged, for those individuals living outside the one-mile radius.
D. Students are not allowed to obtain temporary permits for a vehicle, unless the student,
spouse, parent or legal guardian owns the vehicle. A valid registration document must be
presented to obtain a temporary permit.
E. Temporary employees may receive a free temporary permit for one (1) month from the date of
employment. If employment is longer than one (1) month, a temporary permit must be purchased
for $10.00 per week, or purchase a permit at the part-time staff rate.

ARTICLE III: PARKING REGULATIONS
SECTION 1. GENERAL PROVISION
Parking of vehicles is prohibited in all campus areas except those areas designated for vehicle
parking.
SECTION 2. DESIGNATION OF PARKING SPACES AND LOTS

SECTION 3. DESIGNATED PARKING AREAS
A. Resident students are assigned permits by zones within their residential area. They may not
park in another residential zone at any time. Resident students may park in commuter zones
between the hours of 4 p.m. to 7 a.m. Monday-Friday and on weekends.
Resident students may park in faculty/staff or commuter student lots between 4 p.m. and 7
a.m. on weekdays and on weekends unless the lot is otherwise reserved.
All other rules such as service vehicle parking, handicapped, 24-hour reserved, and fire lane
must be observed at all times.
B. Commuter students are assigned permits by zones within the commuter area. They are
restricted to their commuter zone Monday through Friday, 7 a.m. to 4 p.m. Commuter
students cannot park in residential zones at any time. Commuter students may park in
other commuter zones Monday through Friday, 4 p.m. to 7 a.m., and on weekends.
Commuter students may park in faculty/staff spaces between 4 p.m. and 7 a.m. on
weekdays and on weekends unless the lot is otherwise reserved. All other rules such as
service vehicle parking, handicapped, reserved, and fire lane must be observed at all times.
C. Registered vehicles of employees at the Physical Plant Complex, University Police,
Purchasing Office, Printing Services, and Warehouse/Central Receiving will be restricted to
the following parking.

1. Parking Lot AA and BB - Physical Plant, University Police, Motor Pool and University
employees visiting these facilities.
2. Parking Lot CC - Purchasing Office, Printing Services and University employees visiting
these facilities.
3. Parking adjacent to Warehouse/Central Receiving – Moving Services, Warehouse
Services, Postal Services and University employees visiting these facilities.
D. Visitors are issued permits to park in visitor spaces designated by striping or signage, or to
park in lots or spaces designated on the permit for specific dates. Other spaces designated
for visitors shall be metered or otherwise controlled. Visitors are restricted to designated
spaces or metered/controlled spaces 24 hours per day.
SECTION 4. PROHIBITED VEHICLE PARKING
A. Stopping or parking so as to block the movement of a properly parked vehicle.
B. Parking so as to obstruct the flow of traffic or endanger life and/or property.
C. Parking of a vehicle in an area reserved for a special event as designated by signs or traffic
enforcement personnel.
D. Using a designated parking place for dormant storage.
E. Parking on a sidewalk.
F. Parking within an intersection or crosswalk or in front of a driveway.
G. Parking on the grass or landscaped areas unless directed by a Traffic and Parking Officer.
H. Parking on the approaches or other portions of a parking area which are not clearly marked
for parking.
I.
Blocking fire hydrants, trash receptacles (dumpsters), fire lanes and service entrances.
J. When a particular angle or manner of parking is indicated in a parking area or parking lot by
signs or markings, no person shall park a vehicle except at the angle or in the manner so
indicated, and no vehicle shall be parked in such a manner as to occupy more than one
space indicated by lines, signs or markings for one vehicle.
K. Parking in a space or along a curb for a period of time longer than allowed by signs or other
markings.
L. Parking in a space designated for handicapped parking without a proper permit.
M. Parking in a space reserved for visitors without being a visitor to the campus. (Students or
faculty/staff parking in visitor spaces is prohibited.)
N. Parking of a vehicle in an area reserved for construction parking as designated by signs
or barriers.
SECTION 5. PARKING HOURS IN ASSIGNED SPACES
Unless specified by signs indicating 24-hour enforcement, students with parking permits may park
in staff spaces between 4 p.m. and 7 a.m. daily. Faculty/staff may park in white-lined spaces
when designated employee spaces are unavailable. Spaces designated for the handicapped,
loading zones, reserved spaces and visitor spaces are enforced twenty-four (24) hours a day.
Permit enforcement is twenty-four (24) hours per day.

SECTION 6. VEHICLE RESTRICTIONS
Vehicles shall not be parked upon any street, parking space, parking lot, parking area, alley or
driveway for the principal purpose of:
A. Displaying the vehicle for sale.
B. Washing, greasing, or repairing the vehicle except in the case of repairs necessitated by an
emergency and except when permission is granted by the Chief of University Police.
C. Storage that is not incident to the bona fide use and operation of the vehicle.
D. Storage of any detached trailer or semi-trailer when the towing unit has been
disconnected, except when permission is granted by the Chief of University Police.
SECTION 7. UNIVERSITY & MAINTENANCE VEHICLES
The foregoing regulations shall not apply to University or other service vehicles while
performing necessary services.
ARTICLE IV. SPECIAL EVENTS
SECTION 1. SPECIAL EVENTS
The University Police Department and Auxiliary Services/Parking and Transportation Office shall
take appropriate action to control unusual traffic and parking conditions resulting from athletic and
other special events conducted on campus. Sponsors of these events shall notify Auxiliary
Services/Parking and Transportation Office four (4) working days in advance of scheduled events
so that special traffic control and parking plans may be implemented.
ARTICLE V. OPERATION OF VEHICLES
SECTION 1. GENERAL
Chapter 20 of the North Carolina General Statutes governs the enforcement of moving traffic
regulations on the campus of UNCW except as otherwise provided for in these rules and
regulations.
SECTION 2. ENFORCEMENT
The Auxiliary Services/Parking and Transportation Office and the University Police Department
share the responsibility to enforce all Traffic and Parking Regulations approved by the Board of
Trustees. Questions concerning these regulations should be directed to the Auxiliary
Services/Parking and Transportation Office.
SECTION 3. SPEED LIMIT
The maximum speed on the University campus is 25 miles per hour unless otherwise posted.

SECTION 4. RESTRICTED OPERATIONS
Vehicular traffic is restricted to paved streets and paved parking areas. Vehicles shall not be
driven or ridden upon any sidewalk or walkway, or within any area identified by posts, signs, or
other markings indicating that vehicles are prohibited.
SECTION 5. ONE-WAY STREETS
Vehicles shall not be driven or ridden in a direction opposite to that indicated by
appropriate signs or markings.
SECTION 6. UNIVERSITY & MAINTENANCE VEHICLES
The foregoing regulations shall not apply to University or other service vehicles while
performing necessary services.
SECTION 7. STOP SIGNS
Vehicles must stop at erected stop signs or marked stop lines painted upon intersecting streets
except when otherwise directed by a Traffic Control Officer or signal.
SECTION 8. YIELD SIGNS
Vehicles must yield the right of way to other traffic at intersections marked by a yield sign except
when otherwise directed by a Traffic Control Officer or signal.
ARTICLE VI: RESTRICTED ACTS
SECTION 1. ADVERTISING
Individuals, firms or corporations shall not use the campus of the University for the purpose
of advertising any article, commodity or service without the approval of the Chief of
University Police.
SECTION 2. SELLING
Individuals, firms or corporations shall not use the campus of the University for the purpose
of selling or offering for sale any article commodity, or service without the approval of the
Chief of University Police.
SECTION 3. SOLICITING
Solicitations on campus must be approved in advance by the appropriate Administrative Office.
ARTICLE VII: CLOSING OF TRAFFIC AREAS
SECTION 1.
The Chief of University Police has the authority to close any street, roadway, alley, driveway,
parking lot, parking area, or any portion thereof, on the campus of the University for the purpose
of construction or maintenance work or for the protection of pedestrians.

ARTICLE VIII: VIOLATION PENALTIES
SECTION 1. APPLICABILITY
This schedule of penalties is applicable to all persons operating vehicles on University
property.
SECTION 2. DISTRICT COURTS
Vehicle operators will be charged in the District Courts of the General Court of justice for all
violations of Chapter 20 of the North Carolina General Statutes that are misdemeanors or
felonies.
Vehicle operators who commit violations of infraction offenses from North Carolina
General Statute Chapter 20 will be cited on a University ticket and subject to this
ordinance or may be charged in District Court.
SECTION 3. CIVIL PENALTIES
The traffic and parking violations listed below are considered civil offenses and applicable fines
are assessed and collected through established University Debt Collection Procedures. Fines
may be paid at the University Cashier's Office.

B. Individuals committing five (5) or more traffic and/or parking violations or found displaying an
altered or lost/stolen parking decal within an academic year may have their vehicle “booted.”
First, the individual will receive a Boot Warning. If they do not contact the Auxiliary
Services/Parking and Transportation Office and continue to violate they will receive a Boot
Ticket with the applied boot. The applied boot will be removed after meeting with the Auxiliary
Services/Parking and Transportation Office. Continued violations will result in booting/towing.
Disciplinary action will be administered by the Dean of Students office.
C. Revenues received pursuant to Article VII are remitted to the K-12 North Carolina Public
Schools.
SECTION 4. TOWING
The Department of University Police or the Parking and Transportation Office is authorized to
remove from the campus, to a storage area, at the owner's expense any vehicle parked in
violation of these Traffic and Parking Regulations. As a matter of enforcement policy, Parking and
Transportation Enforcement Staff will not tow a vehicle except in the following circumstances,
without specific approval from the Chief of University Police.

1. The operator's authorization to operate a vehicle on campus has been revoked and the
operator has been duly notified of this revocation by personal service, campus mail, or
first class mail.
2. The vehicle is blocking a curb cut designed for wheelchairs.
3. The vehicle is parked in a fire lane or other area marked with appropriate signs.
4. The vehicle does not have a permit, has remained unmoved for a period of 72 hours and
the owner cannot be contacted or refuses to remove the car after being contacted.
5. The vehicle is blocking traffic or another car and the operator of the other car wishes to
leave.
6. The vehicle is parked in a non-parking area, reserved space, or blocking a trash
dumpster.
7. The vehicle has been booted twice and the driver continues to violate.
The vehicle is considered towed once the tower has been called and the owner or
operator must pay the towing fee to the tower before the vehicle can be released.
Towing and storage fees constitute a lien against the vehicle enforceable in the manner
prescribed by law for enforcement of mechanics and materialmen's liens.
Whenever a vehicle is towed, the officer authorizing the tow shall conduct an inventory inspection
of the contents of the vehicle to record anything of value. Contraband, evidence of a crime, or
evidence of the identity of a person committing a crime found while conducting this inventory
inspection shall be admissible in University Administrative Judicial Hearings or the General Court
of Justice as allowed by law.
Whenever a vehicle with a valid registration plate is towed, the officer authorizing the tow shall
immediately notify the last known registered owner of the vehicle of the following:
1. A description of the vehicle.
2. The place where the vehicle is stored.
3. The violation with which the owner is charged, if any.
4. The procedure the owner must follow to have the vehicle returned to him.
5. The procedure the owner must follow to request a probable cause hearing on the towing.
This notice shall, if feasible, be given by telephone. Whether or not the owner is reached by
telephone, notice shall be mailed to his last known address unless he or his agents waive this
notice in writing.
The owner or any other person entitled to claim possession of the vehicle may request in writing a
hearing to determine if probable cause existed for the towing. The request shall be filed with the
Magistrate of New Hanover County at the New Hanover County Law Enforcement Center. The
Magistrate shall set the hearing within 72 hours of his receiving the request. The owner, the
person who requested the hearing if someone other than the owner, the tower and the person
who authorized the towing shall be notified of the time and place of hearing.
The owner, the tower, the person who authorized the towing and any other interested parties may
present evidence at the hearing. The person authorizing the towing and the tower may submit an
affidavit in lieu of appearing personally but the affidavit does not preclude that person from also
testifying.

The only issue at this hearing is whether or not probable cause existed for the towing. If the
Magistrate finds that probable cause did not exist, the tower's lien is extinguished.
Any aggrieved party may appeal the Magistrate's decision to District Court.
If the Magistrate or Judge finds no probable cause existed for the towing, the Department of
University Police shall provide compensation to the tower.
SECTION 5. NOTIFICATION
The Auxiliary Services/Parking and Transportation Office notifies the vehicle registrant within
seven (7) working days of any parking violations. This communication includes the place, time,
fine and nature of the offense.
ARTICLE IX: BICYCLES, MOPEDS, SKATEBOARDS AND ROLLERBLADES
SECTION 1. REGISTRATION
Bicycle and moped registration is provided by the Department of University Police.
SECTION 2. SPECIAL REGULATIONS
A. Bicycles and mopeds may not be operated on sidewalks except on the pedestrian mall at
the front of campus.
B. Bicycles or mopeds may not be chained or otherwise secured to handrails or traffic signs, or
placed in any manner which may create a safety hazard by obstructing passageways, stairs,
entrances or exits.
C. Skateboards and rollerblades may be used as a form of transportation on campus. They may
only be utilized on sidewalks and/or roadways.
D. Skateboarding and rollerblading are prohibited from all other areas of the campus including,
but not limited to, the following areas:

E. Violators of this policy will:
1. Be issued a campus citation for $25.00;
2. Be charged restitution for any damages;
3. Have their skateboards or rollerblades confiscated until the fine and restitution for
damages are paid in full.
E. All underage non-university individuals found in violation of this policy are required to have a
parent or legal guardian present to obtain their confiscated property.
SECTION 3. GENERAL REGULATIONS
Operators of bicycles and mopeds must abide by the rules of Article V when riding on campus
streets. Bicycle regulations are in effect at all times. Bicycles impeding pedestrian traffic
including access for the disabled may be impounded without prior notification and an
impoundment fee of $25.00 will be charged.

SECTION 4. ENFORCEMENT
Bicycles and mopeds parked or operated in violation of Article IX, Section 2, are subject to a
$25.00 fine. Fines are collected in accordance with Article VIII, Section 3. The Department of
University Police has the authority to use whatever means necessary to impound illegally parked
bicycles and mopeds; locks and chains are removed at the owner’s expense. The university will
not be held liable for bikes or securing devices (locks) which are damaged during impoundment.
Proof of ownership is required to claim impounded bicycles or mopeds. Unclaimed bicycles and
mopeds are disposed of in accordance with the North Carolina General Statutes. Violators of this
policy will be issued a campus citation set at $25.00 plus any damages.
Bicycle parking is located throughout the campus and is designated by the presence of racks or
designated bicycle parking areas.
ARTICLE X: PEDESTRIANS
SECTION 1. PEDESTRIAN RIGHT OF WAY
Pedestrians shall be given the right of way by any operator of a motor vehicle, moped, bicycle,
skateboard or rollerblades.
SECTION 2. PEDESTRIAN RESPONSIBILITIES
Pedestrians shall use sidewalks and crosswalks whenever they are provided, pedestrians shall
walk on the left side of a street, alleyway or driveway facing oncoming traffic. Pedestrians shall
not walk or run more than one abreast when sidewalks are not provided.
SECTION 3. SPECIAL EVENTS
This article shall apply to all athletic teams, physical education classes, ROTC activities and
other like groups unless proper notification is made to the Department of University Police
pursuant to ARTICLE IV: SPECIAL EVENTS.
