Independent Contractor or Employee Services can be obtained from an independent contractor when the University of Montana requires special skills for a limited period of time. The individual providing the independent contractor services must satisfy the requirements for an independent contractor as outlined in the checklist at: http://www.umt.edu/bussrvcs/files/Independent_Contractor_Checklist.pdf An individual cannot be both an employee and an independent contractor for The University of Montana and be performing the same types of duties in each position. A six-month break in service is required before a former employee can be considered as an independent contractor. It is necessary for this person to be established as an independent service provider as well as having the required break in service. If there is a question as to whether an individual is an employee or an independent contractor, the HRS Payroll Manager should be contacted before a contractual arrangement is established with the person providing services.
