I, the undersigned, if called as a witness would testify to the following facts
upon my personal knowledge.
My name is Michael R. Mitchell. I am an attorney duly licensed to practice law
in the State of California and in this United States District Court. I am not
representing any party in this action in this court. I have assisted the plaintiff in
various aspects of this action and have represented her in the Ninth Circuit Court of
Appeals in this action.

I have a BA and MA degree in mathematics and I have been practicing civil
2 rights law in the Central District of California for more than 30 years. I am
3 competent to make the statements set forth below.

In or about 1996, I made a California Public Record Acts request on the County
5 of Los Angeles for settlement agreements in civil rights actions against the Count
6 and/or its employees, including cases involving assault and battery by a peace officer,
7 civil rights, false arrest and false imprisonment. The County produced records for the
8 years 1993, 1994, and 1995.
I have supplied these documents to the attorneys for
9 the defendants – to wit, Deputy LA County Counsel Lauren Black, – in this case who
10 represented to me that she has copied them.

In the instant case, Deputy LA County Counsel Lauren Black presented me and
12 my assistant, law student Guillermo Arevalo-Farias, with what she represented to me
13 were original documents reflecting all settlements of all lawsuits between mid-1998
14 and mid-2005 against the County. Myself and and Mr. Arevalo-Farias spent two days
15 culling out from these settlement documents those which appear to involve cases
16 claiming violations of civil rights, assault and battery by a peace officer, false arrest
17 and false imprisonment. Mr. Arevalo-Farias and I tagged those documents for
18 copying. The County copied those documents and delivered one set of copies to me.
19 I paid to have the documents copied.

The documents consisted of case-specific stapled sets of Office of County
21 Counsel, Fiscal Services Section Payment Vouchers which reflected Payees Name and
22 Payment Amount, Judgment & Settlement Memorandum requesting issuance of a
23 check made payable to specific persons/entities, Judgment and Settlement Information
24 sheets specifying court, court settlement, claim judgment settlement, as well as case
25 type, often requests from outside counsel for disbursement of settlement funds,
26 Reports of Actions Taken by the Board of Supervisors During Closed Sessions, emails
27 regarding provisions of funds by wire transfer or otherwise; and occasionally wire

1 funds transfer authorizations. Most of the documents were accompanied by
2 evaluations of the cases by County Counsel setting forth facts about the cases,
3 evaluations of witnesses, expectations of awards (including amounts for statutory
4 attorney’s fees) and recommendations for settlement amounts. My best estimate is
5 that each settlement was commemorated by an average of five sheets of paper. There
6 was a total of approximately 789 settlements. Thus there are approximately 3945
7 sheets of paper which fill about 5 storage boxes. These writings are so voluminous
8 that they cannot be conveniently examined by the court. Accordingly, I have prepared
9 tables summarizing the contents of the documents for admission under F.R.E. 1006.
10 Of course, plaintiff will produce the actual documents to the Court if so ordered.

I have spent more than 100 hours reviewing the County settlement
12 documentation for the 10-year period described above. These include settlements
13 which occurred pretrial, after arbitration, during trial, after trial, and after appeal.
14 They do not include cases which were dismissed sua sponte for various reasons nor do
15 they include all cases dismissed upon County motions to dismiss or for summary or
16 other judgments in favor of the County.

For each year I made tables showing (Col. 1): the date of the Payment Voucher,
18 (Col. 2): the name of the attorney, (Col. 3): the title of the case, (Col. 4): the case
19 number, (Col. 5) a column entitled “Dept” that may be ignored, and columns for
20 claims made: (Col. 6): assault and battery, (Col. 7): civil rights, (Col. 8): false arrest,
21 (Col. 9): false imprisonment, (Col. 10): amount of Payment Voucher, and (Col. 11)
22 that may be ignored. At the end of each year, I noted cases which had gone to trial or
23 verdict and noted those which resulted in an attorney fee application or award. The
24 tables for the ten years of settlements is attached hereto, marked pages 6 through 73,
25 and incorporated herein by reference.

ALL COUNTY CIVIL RIGHTS SETTLEMENTS

FOR THE TEN-YEAR PERIOD

The tables show that the County settled approximately 789 civil rights cases
6 over this ten-year period for $58,717,547.91. Of these, 748 (or 95%) were settled
7 prior to trial. In none of these cases settled prior to trial is there any evidence that
8 there was an application, much less an award of, statutory attorney’s fee. In other
9 words, they were “lump sum, including all attorney’s fees” settlements because the
10 settlement warrants or checks were made payable jointly to the plaintiff and his or her
11 lawyer with no evidence that there was any post-merits settlement payment of any
12 attorney’s fee award made upon any application for statutory attorney’s fees.

Of the remaining 41 cases which settled during or after trial or under other
14 circumstances, the tables reflect that there payments of attorney’s fees in at most 21
15 cases,1 although it appears that on only at most 10 of the cases was there an
16 application for and award of attorney’s fees which the County either paid or
17 compromised.

Thus, over ten years, in settling 789 cases, the County paid attorney’s fees in at
19 most 21 cases (2.6%), but has been subject to applications for statutory attorney’s fees
20 in only at most 10 cases (1.3%), and all of those applications and awards were made
21 after verdicts at trial against the County or other judicial defeats of the County. 97.3%
22 of all settlements were “lump-sum, including attorney’s fees” settlements.

1 trial for a total amount of $38,105,799.3 (Not included in these figures settlement of
2 one set of class action cases for strip searches and over-detention for which
3 documentation is lacking. See P. 78) In none of these cases is there any evidence that
4 there was any application for statutory attorney’s fees, much less any award of such
5 fees. In other words, they were “lump sum, including all attorney’s fees” settlements.
POST TRIAL SETTLEMENTS

Over this ten-year period, the County has settled 20 civil rights cases after trial
8 for a total amount of $17,273,474.90.4
In at most 9 of these cases there was a
9 payment of attorney’s fees, although it appears that in only at most 7 of these cases
10 was there an application for and award of attorney’s fees which the County either paid
11 or compromised.
OTHER SETTLEMENTS

Over this ten year period, the County has settled 21 civil rights cases which do
14 not fit into the above categories for a total amount of $3,338,274.01.5 In at most 12
15 of these cases there was a payment for attorney’s fees, although it appears that in only
16 at most 3 of these cases was there an application for and award of attorney’s fees
17 which the County paid or compromised.

In Peterson v. Co., BC 032847 there was a “$247,000 verdict” compromised by
10 payment 2-1-93 of one warrant for $170,000 payable to the plaintiff and his attorney,

Johnnie L. Cochran, Jr.
In Sanchez v. Co., C 757 576, there was a trial and, on Nov. 3, 1993, judgment for
12 plaintiff, represented by attorney Edward A. Torres, in the amount of $349,130. There
was an apparent compromise because on November 24, 1993 the County satisfied that
13 judgment by issuing two warrants, one for $242,000 and one for $38,880.
14 In Buttram v. County, 89-6973-AWT there was a “verdict” for plaintiff which the
County “compromised” 3-1-93 by payment of one warrant for $245,000 payable to
15 plaintiff and his attorney, Scott F. Craig.

15 In Moreno v Shriver, 92-3444-GHK, there was a four-day jury trial resulting in
judgement for the plaintiff of $5000 followed by an attorney fee application and
16 award of $60,880.80 in attorney’s fees and $3155.43 in costs. The County
compromised these judgments by issuing one warrant 9-6-94 in the amount of
17 $50,000 payable to plaintiff and his attorney, Hugh Manes, with plaintiff “waiving
punitive damages.”

19 In Moorer v. Co., 92-3267-LGB, there was a four-day jury trial in February 1994 that
resulted in an undisclosed verdict for plaintiff followed twenty days later by a
20 settlement that provided for payment of $10,500 to plaintiff and $16,500 to his
attorney, Anthony Willoughby.

In Kraus v. County, (case no. unknown) there was a jury verdict and a court award of
22 attorney’s fees and costs which was satisfied 10-12-94 by issuance of a warrant
payable to the plaintiff and his attorney, Johnnie L. Cochran, Jr. in the amount of
23 $213,615.51.

17 *On April 22, 1999, the County settled Hughley v County, TC 010 281 after a $9,500

arbitration award in favor of Hughley.
On Nov. 4, 1998, in the case styled Nieves v. County of Los Angeles, BC 149491,
19 after a non-jury trial, judgment was entered in favor of plaintiff and against the
County in the amount of $45,000 plus $1,537.56 costs for shooting plaintiff in
20 violation of 42 U.S.C. Section 1983. The County paid plaintiff $46,537.56 on January
28, 1999 by warrant payable to plaintiff and his attorney. Plaintiff’s attorney, Edi M.
21 O. Faal applied for statutory attorney’s fees under 42 U.S.C. Section 1983. On
January 19, 1999, the Court awarded $99,770 in attorney’s fees and on April 14, 1999,
22 the County paid attorney Edi M. O. Faal $99,770.

12 A settlement agreement was entered into between the County and, inter alia, Natural
Resources Defense Council in the case styled Natural Resources Defense Council v.
13 County, USDC No. 94-5978 which provided plaintiffs with the right to seek costs
incurred enforcing compliance with the settlement, including reasonable attorney’s
14 fees. By letter dated May 12, 1999, plaintiffs sought reimbursement of $8,595
attorney’s fees incurred to enforce the settlement agreement. A compromise was
15 reached whereby the County on January 12, 2000 paid $5000 to Natural Resources
16
Defense Council.
17 In the Scott cases above, the court ordered (presumably pursuant to retainer
agreements) payments to attorneys Manes & Watson sums equal to 1/3 and 50% of
18 the amounts paid two of their clients.

In Golden v. Co, 97-6140-TJH the jury hung after a three week trial. Ellen H. Ellison
20 was plaintiff’s counsel. On 5-12-00 the County settled the case by issuance of a
21
single $275,000 warrant.
Valentin v County, C 529 739 involved claims that four plaintiffs were unlawfully
22 arrested and incarcerated for alleged child molestation. The case was tried three times
over 16 years. The first trial, which was a bench trial, resulted in a verdict for all four
23 plaintiffs totaling about $3.75 million in compensatory damages and $20,000. That
verdict was reversed on appeal for wrongful denial of a jury trial. The second trial – a
24 jury trial – resulted in a verdict for all four plaintiffs of approximately $7.4 million in
compensatory damages and $7,000 in punitive damages. The jury awarded
25 approximately $3.7 million to Jose Valentin and Myrna Malave in damages and the
court awarded them attorney’s fees in excess of $2 million. On appeal, the finding of
26 liability was affirmed, but the award of damages was reversed based on an intervening
California Supreme Court case and the case was remanded for a trial on damages and
27 costs. Jose Valentin and Myrna Malave settled with the County for $2 million each,
28
including all costs and attorney’s fees, which the County paid Nov. 13, 2000 by

warrants payable to “Jose Antonio Valentin and [his attorney] Eduardo M. Madrid”
1 and “Myrna Malve and [her attorney] Robert Roman.” (On October 6, 2000, a jury

brought in a verdict of $13.5 million in favor of the two non-settling defendants.)
Navarro v County, 90-03679 RMT involved a claim of deputies failing to give
3 domestic violence calls the same priority as other emergency calls. Four deaths
ensued. The case was twice dismissed by the district court and twice reversed by the
4 Ninth Circuit. The case settled August 25, 2000 for $450,000 payable to “Claudia
navarro, Raymond Navarro, Jr., Denise Navarro, and their attorney of record, Eric
5 Honig.”

15 In Hawkins v. County, 98-5605, the plaintiff obtained a preliminary injunction against
certain uses of an electronic belt on defendants in court. On appeal, the Ninth Circuit
16 affirmed. The case then settled. On Dec. 13, 2001 the County issued two warrants in
payment. One was for $200,000 payable to plaintiff’s counsel Yagman & Yagman &
17 Reichmann” (sic) and one was for $75,000 payable to “Yagman & Yagman &
Reichmann and Ronnie Hawkins.”

19 In Shihrer v. County, BS 06728, plaintiffs claimed a male deputy sheriff molested a
minor female. In about September 2001, the parties agreed to a $450,000 settlement -
20 apportioned $350,000 to the minor and $100,000 to her mother, Karol. On Nov. 16,
2001, the County paid a warrants to plaintiffs’ attorneys, Mazursky, Schwartz and
21 Angelo, in the amount of $92,500 for attorney’s fees and costs, $10,000 in trust for
the minor, $247,500 for an annuity for the minor, and $100,000 payable to “Karol
22 Shihrer and her attorneys Mazursky, Schwartz and Angelo.”

In Valentin, et al. v County, C 529 739, judgment after jury trial (deliberations took
24 more than six weeks) was for plaintiffs and judgment was entered for $7,213,860.70
plus interest at 7% per annum. Statutory attorney fee application resulted in a fee
25 award of $3,670,371 plus interest at 7% per annum. At a subsequent mediation, the
parties agreed to a total settlement of $9,913,695.70 which the County paid jointly to
26 the plaintiffs and their attorneys May 14, 2001.

Del Gatto v. County, BC 219 893 was a civil rights action which arose when a

mentally ill inmate was handcuffed and placed into the same cell with a gang member
1 who stabbed him. The parties agreed to settle the case for $875,000. On June 25,
2001, the County issued two warrants: one for $650,000 payable to “John Del Gatto
2 as guardian for Patrick Del Gatto,” and one for $225,000 payable to “Donald Prichard
3
and Regan Braun Law Offices.”
4 Young v County, 94-4582 involved a claim that deputies failed to protect a jail inmate
from a stabbing attack by another inmate. The matter went to trial September 5, 2000
5 and a partial verdict returned. The jury found one deputy liable for damages, two
deputies not liable, and could not reach a verdict as to the fourth deputy. Before the
6 trial concluded, a settlement was reached which called for the County to pay plaintiff
$30,000 and to pay his attorneys, McDermott, Will & Emery, $17,807.43 for fees and
7 costs. These amounts were paid by separate warrants April 23, 2001.
8 Moses v County, 96-4867 SVW involved a claim that an arrestee was bitten by a
police dog and subjected to excessive force after being handcuffed. County’s motion
9 for summary judgment was granted. Plaintiff appealed and the Ninth Circuit affirmed
in part and reversed in part. The reversal involved whether the deputy used force after
10 plaintiff was taken into custody. The case settled and on January 26, 2001, the
County paid by warrant $5000 payable to “Adam Moses (plaintiff) and the Law
11 Offices of Robert Mann and Donald W. Cook.”

On Dec. 23, 2002, the County paid $150,000 in attorney’s fees to The Alliance for
18 Children’s Rights, a non-profit public interest law firm, and $100,000 in attorney’s
fees to their co-counsel, Horvitz & Levy. In August 2000 the two law firms applied
19 to Juvenile Court for a blanket order requiring children’s social workers to visit foster
children monthly in all cases notwithstanding state regulations permitting less
20 frequent visitation. The County opposed but lost, then appealed. The Court of
Appeal affirmed and the California Supreme Court denied review. The law firms
21 demanded $450,000 in attorney’s fees. The County negotiated the $250,000
compromise settlement. This is one of the rare instances when a civil rights case did
22 not settle.

In Streit v County, 98-09575-WJR, one of the plaintiffs was Michael Roerich.
24 Roerich entered into a settlement agreement with the County in August 2001 which
provided, inter alia, for settlement of his claim based on the outcome of a pending cert
25 petition to the U.S. Supreme Court. The settlement agreement also called payment of
his reasonable attorney’s fees and costs of defending the decision of the Ninth Circuit
26 (Streit v County, 236 F.3d 552 (9th Cir., 2001). Cert was denied (122 S.Ct. 24, 151
L.Ed.2d 1). Plaintiff’s attorneys made a fee demand of $49,493. The County’s
27 lawyers negotiated a 20% reduction of the fee. On Feb. 19, 2002, the County paid
28
$39,595 in attorney fees, $1282.71 in costs, and $20,000 to Michael Roerich.

Patricia Guitierrez and Lupita Gutierrez v County, BC 137 155 involved claims of
1 false arrest and improper investigation of citizens complaints. It was tried two times.
The first trial mistried. The second resulted in a verdict in favor Patricia for
2 compensatory damages of $600,000 and punitive damages of $500,000. Lupita was
awarded $500,000 compensatory and $375,000 punitive damages. After the trial, the
3 court awarded attorneys’ fees to Patricia in the amount of $240,000 and to Lupita in
the amount of $200,000. Following post-trial motions the court reduced the punitive
4 damages to $10,000 each. The court then issued a remittitur which required plaintiffs
to accept the reduced punitive damages or a new trial would be ordered. Patricia
5 accepted the remittitur and judgment in her favor was entered for $850,000. Lupita
did not timely accept the remittitur so a new trial was ordered as to her. The County
6 appealed and Lupita cross-appealed seeking to have the entire jury award reinstated.
On May 22, 2002 the case settled with the County paying $440,000 to “Lupita
7 Gutierrez and Jorge Gonzalez, attorney at law and M. Irene Daniel, attorney at law,”
and paying $460,000 to “Patricia Gutierrez and Jorge Gonzalez, attorney at law and
8 M. Irene Daniel, attorney at law.”

14 In Suarez v. Baca, 00-03995 AHM, two County deputy sheriffs sued for violation of
their civil rights, including their right to associate with and to receive services of a
15 labor union and their right not to be compelled to be witnesses against themselves in a
criminal case. The deputies were represented by the law firm of Green & Shinee, a
16 law firm prominent for representing police unions and police officers. The County
agreed to a settlement which would pay each deputy a “tax free” $75,000 and would
17 pay Green & Shinee $145,000.
18 In Welch v. County, 02-07345 JFW, the Court approved a minor’s compromise of a
$95,000 settlement and ordered distribution of funds for the account of plaintiffs,
19 including a $25,000 fee to attorney John Burton.
20 In Lee Baca v. County, BC 246 518, the County’s newly elected Sheriff Baca sued the
County for various monies and benefits he claimed to be owed. Baca was represented
21 by Mathews & Rager, LLP. A settlement was entered into which provided, in part, for
“partial payment of plaintiff’s attorney’s fees” On 12-11-03, the County paid Mathews
22 & Rager, LLP $32,500.
23 In Katie A. v. Bonta, et al, 02-05662 AHM, the ACLU Foundation of Southern
California, the Center for Law and the Public Interest, and Heller, Ehrman, White &
24 McAuliffe sought to represent a class of minor children in the custody of the Los
Angeles County Department of Children and Family Services (“DCFS”) County
25 Counsel entered into a settlement agreement to improve care for the children that also
provided for payment of $525,000 for plaintiff’s attorney’s fees. On 9-30-03, the
26 County paid the ACLU Foundation of Southern California $525,000.
27 In County of Los Angeles v. Joanne Smith, California Court of Appeal Nos B 124218
and B 149774 and Joanne Smith v County of Los Angeles, BY 027 688, the LA

County District Attorney unsuccessfully sought to recover from Joanne Smith (an
1 attorney) costs of care provided to a ward of juvenile court. Attorney Joanne Smith
successfully defended the effort and sued the County for attorney’s fees. The County
2 negotiated a compromise of the fee claim and on 9-17-03, paid the attorney $275,000.

M., a minor, et al v County of Los Angeles, BC 268 034 was an a lawsuit brought on
18 behalf of 23 minor children dependent on the County Department of Children and
Family Services seeking damages for over-detention following judicial order for
19 release and seeking injunctive relief. Attorney Sanford Jossen represented the
children. A settlement was negotiated wherein the County agreed to certain injunctive
20 relief and agreed to pay $200,000. Of this money, attorney Jossen would receive
$50,000 and would have the option to apply for an additional $50,000 in fees. He
21 applied for the additional $50,000 fees; the court ordered them paid which the County
22
did 6-16-04.
In Morris v. County of Los Angeles, 03-3058 MMM, a lawsuit for excessive force on
23 a juvenile at Juvenile Hall, the County agreed to pay $17,000. The court approved the
24
25
minor’s compromise and ordered distribution of the amount as follows:

In Partnoy v Shelly, et al, 03-1460 BTM, the County’s Registrar-Recorder and others,
27 including to California Secretary of State were successfully sued for declaratory and
28
injunctive relief. Plaintiffs then moved for attorney’s fees under 42 USC Section

1988. The parties compromised the fee claim for $70,000 with the County to pay
1 $5,000 which it did on 2-3-04 to Shaun P. Martin, Esq.
2 Nelson v. County, BC 213 704 was a lawsuit about an in-custody death tried to a
downtown Superior Court jury in May 2002. The jury rendered a verdict in favor of
3 plaintiffs for $2 million. The County appealed. The Court of Appeals reversed the
damage award as excessive and returned the case to Superior Court for retrial of the
4 damages issue. Before retrial, the case settled for $495,000 including all attorney’s
5
fees and costs.

24 M., a minor, et al v County of Los Angeles, BC 268 034 was an a lawsuit brought on
behalf of 23 minor children dependent on the County Department of Children and
25 Family Services seeking damages for over-detention following judicial order for
release and seeking injunctive relief. Attorney Sanford Jossen represented the
26 children. A settlement was negotiated wherein the County agreed to certain injunctive
relief and agreed to pay $200,000. Of this money, attorney Jossen would receive
27 $50,000 and would have the option to apply for an additional $50,000 in fees. He
applied for the additional $50,000 fees; the court ordered them paid which the County

3 In Morris v. County of Los Angeles, 03-3058 MMM, a lawsuit for excessive force on
a juvenile at Juvenile Hall, the County agreed to pay $17,000. The court approved the
4 minor’s compromise and ordered distribution of the amount as follows:

7 In Partnoy v Shelly, et al, 03-1460 BTM, the County’s Registrar-Recorder and others,
including to California Secretary of State were successfully sued for declaratory and
8 injunctive relief. Plaintiffs then moved for attorney’s fees under 42 USC Section
1988. The parties compromised the fee claim for $70,000 with the County to pay
9 $5,000 which it did on 2-3-04 to Shaun P. Martin, Esq.
