Master Degree by Research Regulations Made by the Academic Board Version incorporating amendments as at 29 November 2013 1. Degrees The master’s degrees by research listed in schedule 1 may be undertaken pursuant to these regulations and the candidature progress management regulations. 2. Interpretation 2.1 In these regulations unless the contrary intention appears academic staff means teaching or research staff of the University; Associate Dean Research Training means the person holding the position of Associate Dean Research Training in a faculty or the closest equivalent, or nominee; candidate means a candidate for a degree; committee means the graduate research committee established under Statute 2.5 – Graduate Research Committee; days does not include a Saturday, Sunday or any university holiday; degree means a master’s degree by research listed in schedule 1; external candidate means a candidate who the committee deems to be an external candidate; faculty means the faculty through or in which the person concerned is seeking or pursuing candidature; faculty board means the faculty board of the faculty; Gippsland campus means the campus located at Northways Road, Churchill in the state of Victoria which will transfer to the University of Ballarat on 1 January 2014 and from that date will operate under the name of Federation University Australia; head means (a) the head of a department or school in a faculty; (b) where a faculty is not divided into departments or schools, the dean of the faculty; or Master Degree by Research Regulations (c) in the case of a centre acting in conjunction with a faculty for the purposes of these regulations, the director of the centre – through or in which a person is seeking or pursuing candidature; main supervisor means the person appointed as a main supervisor under paragraph 15.1.1 or paragraph 15.4.1; months in relation to candidature, means months of full-time candidature or the equivalent in part-time candidature; supervisor means the main supervisor, or where the main supervisor is unable or unwilling to act, an associate supervisor or the head (or nominee); study program means a study program for a degree prescribed by or under these regulations; unit means a unit in the coursework or training component of a study program; year means a calendar year. 3. 4. 2.2 A research unit within a hospital or institution, affiliated to the University under Statute 10.1 - Affiliation and recognised by the committee, is deemed to be a part of the University for the purposes of these regulations. 2.3 These regulations apply to the Monash Injury Research Institute and Monash Sustainability Institute as if they were each a faculty and each of their directors a head. 2.4 In relation to a candidate admitted as at 1 January 2014 or anytime thereafter in a degree being undertaken at the Gippsland campus, any reference in these regulations to the ‘University’ as a physical location is a reference to the Gippsland campus. Delegation 3.1 The committee may delegate any power or function conferred upon it under these regulations to any other person or body. 3.2 A head may, with the written consent of the member of staff concerned, in writing delegate any of the powers and duties of the head under these regulations to a senior member of the academic staff in the department, school, faculty or centre concerned. Application for admission to candidature An applicant for admission to candidature must lodge with the committee 4.1.1 an application for admission in the form approved by the committee; and 4.1.2 a statement of the applicant's proposed study program, approved by the head. Admission to candidature 5.1 5.2 The committee may admit an applicant to candidature for a degree if it is satisfied that 5.1.1 the requirements for admission to candidature for the degree prescribed by or under these regulations have been met; 5.1.2 adequate supervision facilities are available; 5.1.3 the applicant has adequate training and ability to pursue the proposed study program; 5.1.4 the proposed thesis will be held in the university library and made available to any person for consultation or copying in accordance with these regulations; 5.1.5 any other requirements or conditions of the committee have been met. For the purpose of paragraph 5.1.1 – 5.2.1 5.2.2 5.2.3 an applicant for admission to candidature for a degree must have 5.2.1.1 qualified for an award in a relevant field with an honours mark of at least 65 (upper H2B) or equivalent; and 5.2.1.2 satisfied any other requirement approved by the committee; where a degree is specified in schedule 2, to satisfy the requirement of subparagraph 5.2.1.1 an applicant for admission to candidature for a degree must have – 5.2.2.1 qualified for the award specified in schedule 2 with an honours mark of at least 65 (upper H2B) or equivalent; or 5.2.2.2 qualified for an award determined by the committee to be a satisfactory substitute for the award specified in subparagraph 5.2.2.1; where a degree is specified in schedule 2, to satisfy the requirement of subparagraph 5.2.1.2, an applicant for admission to candidature for a degree must have – 5.2.3.1 satisfied any other requirement specified in schedule 2; and 5.2.3.2 satisfied any other requirement approved by the committee. Page|3 Master Degree by Research Regulations 5.3 In subsection 5.2 relevant field means a field of study relevant to the degree into which admission is sought, as determined by the committee. 5.4 Where, in relation to an applicant, the committee is satisfied under paragraphs 5.1.1 and 5.1.2 but not under paragraph 5.1.3, the committee may specify particular work or a preliminary examination that, if satisfactorily completed, will qualify the applicant for admission to candidature. 5.5 Where an applicant for admission to candidature is, at the time of application, under examination for a degree relevant to the application, the committee may, in circumstances it deems exceptional and if otherwise satisfied as to the matters referred to in subsection 5.1, admit the applicant to candidature conditionally upon the applicant's qualifying for that degree at a standard required, and within a time specified, by the committee. 5.6 Without limiting subsection 5.1, the committee may – 5.6.1 refuse a person’s application for admission to candidature for a degree or enrolment in degree; 5.6.2 cancel a candidate’s admission to candidature for a degree or enrolment in degree; if the committee is of the opinion that the person or candidate’s admission to candidature for a degree or enrolment in a degree may place the University in breach of a law. 5.7 6. The committee may impose a condition on a candidate’s admission to candidature for a degree or enrolment in a degree, where the committee is of the opinion that the condition is necessary to ensure the University’s compliance with a law or legal requirement. Additional work The committee may, in any particular case, require a candidate to undertake particular work additional to work in the candidate's study program and, in this event, the candidate must, within the time specified, complete the additional work to the satisfaction of the committee. 7. Confirmation of candidature The candidate must satisfactorily complete any period of probationary candidature applicable to the degree and confirm candidature in accordance with Part II of the candidature progress management regulations. Where candidature is not confirmed, the candidate will be excluded from candidature. 8. Enrolment 8.1 A candidate may be enrolled as a full-time or part-time candidate. Page|4 Master Degree by Research Regulations 9. 8.2 Unless authorised by the committee in circumstances it deems exceptional, a candidate may not be concurrently enrolled in a course of study or unit for any other degree or diploma of the University or any other educational institution. 8.3 A candidate may be permitted to transfer from part-time to full-time candidature or vice versa provided any conditions determined by the committee have been met. Where candidature is not continuous 9.1 10. A candidate may apply to be readmitted to candidature, where he or she has – 9.1.1 failed to re-enrol in a study program as required; 9.1.2 allowed his or her candidature to lapse; 9.1.3 withdrawn from candidature; or 9.1.4 had his or her candidature terminated under the candidature progress management regulations. 9.2 Where readmission is sought within four years of the date of the event described in subsection 9.1 occurring, the committee shall only allow a candidate to be readmitted to candidature in circumstances it deems exceptional. 9.3 Where readmission is sought after four years of the date of the event described in subsection 9.1 occurring, the committee may allow a candidate to be readmitted to candidature at its discretion. 9.4 Readmission to candidature under this section 9 is subject to any conditions specified by the committee, including duration of candidature. External candidates 10.1 Unless otherwise provided in schedule 3, a candidate may, on the recommendation of the head, be authorised by the committee, subject to any conditions specified, to 10.1.1 undertake candidature as an external candidate; or 10.1.2 transfer from regular to external candidature or vice versa. 10.2 In respect of an external candidate, the committee may 10.2.1 determine special attendance requirements, being in no case less than 5 days a year, or equivalent over the period of candidature; and 10.2.2 require the appointment of one or more associate supervisors. 11. Study program 11.1 The study program for a degree shall be determined by the committee and Page|5 Master Degree by Research Regulations 11.1.1 must include a thesis or the alternative research component prescribed by schedule 4; and 11.1.2 may include units and practical work comprising no more than 34% of the study program. 12. 13. 11.2 Before a unit or practical work is included in a study program for a degree it must be approved for the degree by the committee. 11.3 A candidate must pursue the study program for his or her degree, subject to any changes approved by the committee, on the recommendation of the head and with the agreement of the candidate. 11.4 Where an alternative research component is prescribed by schedule 4, the thesis provisions of these regulations shall apply to that alternative research component as if it were a thesis, subject to any adaptations or variations deemed necessary by the committee. Credit 12.1 A candidate shall not be granted credit in respect of a thesis or an alternative research component. 12.2 Where the committee is satisfied that a candidate has satisfactorily completed work equivalent to any particular unit included in the study program for a degree, the committee may grant the candidate credit towards the degree in respect of that work. 12.3 Notwithstanding subsection 12.2, credit must not be granted in respect of work completed more than 10 years before admission to candidature, unless the committee, in circumstances it deems exceptional, otherwise determines. 12.4 A candidate granted credit in respect of units in a study program must complete the study program in the time specified by the committee. Time limits 13.1 Unless otherwise provided in schedule 5, a study program must be completed in 13.1.1 a minimum of 12 and a maximum of 24 months of full-time candidature; or 13.1.2 a minimum of 24 and a maximum of 48 months of part-time candidature. 13.2 In relation to a particular candidate, the committee may extend the time limit prescribed for a degree by – 13.2.1 6 months of full-time candidature; or 13.2.2 12 months of part-time candidature, Page|6 Master Degree by Research Regulations or such longer period as the committee, in circumstances it deems exceptional, otherwise determines. 13.3 14. Notwithstanding section 13.2, where the committee allows a candidate to transfer from part-time to full-time candidature or vice versa under subsection 8.3, the committee shall determine the period within which the candidate must complete the degree. Leave of absence The committee may, from time to time and subject to any conditions specified, grant a candidate leave of absence, but for no more than one year in total unless the committee, in circumstances it deems exceptional, otherwise determines. 15. Supervisors 15.1 Subject to sub-section 15.4, the committee, after consultation with the head, in respect of each candidate 15.1.1 must appoint a main supervisor, being a member of academic staff; and 15.1.2 must appoint one or more associate supervisors, being persons of recognised standing in the field concerned, whether or not members of academic staff. 15.2 Where a supervisor is to be absent from the University for more than six consecutive weeks, the committee, unless satisfied that adequate supervision can be maintained during the period of absence must, after consultation with the head, appoint an acting supervisor. 15.3 A supervisor, associate supervisor or acting supervisor must not be a candidate for a higher degree by research unless the committee, in circumstances it deems exceptional, otherwise determines. 15.4 Notwithstanding sub-section 15.1, in the case of candidates admitted as at 1 January 2014 in a degree being undertaken at the Gippsland campus, the committee, after consultation with the head, in respect of each such candidate, must appoint a supervision team comprised of: 15.4.1 a main supervisor, being a person of recognised standing in the field concerned, whether or not a member of academic staff; 15.4.2 one or more associate supervisors, being persons of recognised standing in the field concerned, whether or not members of academic staff, and 15.4.3 the Associate Dean Research Training. 16. Supervision and attendance Page|7 Master Degree by Research Regulations 17. 16.1 A candidate must maintain effective contact with his or her supervisor. 16.2 The committee may, on the recommendation of the head and subject to any conditions specified including attendance at the University, permit a candidate to undertake specified study and research away from the University. Thesis 17.1 A thesis must 17.1.1 be prepared under supervision; 17.1.2 be the original work of the candidate, except where due reference is made in the thesis; 17.1.3 demonstrate a thorough understanding of the subject matter of the thesis; 17.1.4 contribute to knowledge and understanding in the field of study concerned; 17.1.5 demonstrate the capacity of the candidate to carry out research; and 17.1.6 subject only to a determination of the committee under subsection 25.3 or 25.4, be made available for consultation or copying, in whole or as a substantial portion, through the university library. 17.2 A thesis may 17.2.1 be based on published or unpublished papers; and 17.2.2 contain conjointly authored papers, provided the papers are prefaced with a statement signed by the authors disclosing their respective contributions. 18. Representations to the committee A candidate may make written representations to the committee at any time on any matter outside the control of the candidate that may adversely affect the candidate. 19. 20. Submission of thesis 19.1 After completing a study program a candidate must submit a thesis embodying the results of the candidate's work. 19.2 A former candidate who completed a study program for a degree but did not within the period of candidature submit a thesis, may, if authorised to do so by the committee, submit the thesis within a period of three years after candidature, and in this event, subject to any conditions imposed by the committee, the relevant regulations apply to and in relation to that person and thesis as if the person were a candidate. Submission requirements Page|8 Master Degree by Research Regulations 20.1 To submit a thesis a candidate must lodge with the committee, in any form approved by the committee, four copies of the thesis including a summary of approximately 500 words and any supporting publications, unless otherwise determined by the committee. 20.2 A candidate may submit in support of a thesis any relevant publications of which the candidate is the sole or joint author, provided that, unless the committee in any particular case otherwise determines, the work must have been published after the commencement of candidature. 20.3 Except where the committee in any particular case otherwise determines, a candidate must not present in or in support of a thesis any work 20.3.1 which the candidate, or any student supervised by the candidate, has presented, or which the student intends to present, for an award of the University or any other tertiary institution; or 20.3.2 prepared by or in conjunction with a person for whom the candidate is or has been a supervisor. 21. 20.4 A candidate must state in the thesis the sources of information and the extent to which the candidate drew on the work of others. 20.5 A candidate must submit with a thesis a signed statement affirming that, to the best of the candidate's knowledge and belief, the thesis contains no material previously published or written by another person except where due reference is made in the thesis. 20.6 After submitting a thesis a candidate may not withdraw it from examination unless authorised to do so by the committee. Main supervisor's statement At the time a candidate submits a thesis for examination, the main supervisor must supply to the committee a statement certifying 21.1.1 whether, to the best of the supervisory team’s knowledge, the thesis is the original work of the candidate; 21.1.2 whether, in the supervisory team’s opinion, the thesis is properly presented and worthy of examination; and 21.1.3 where units or practical work constitute a component of the study program, the nature, duration and assessment of that component. 22. Thesis examination 22.1 After consideration of the main supervisor's statement and any other matter determined by the committee, including but not limited to compliance with section 17, the committee must determine whether or not the thesis is to be examined. Page|9 Master Degree by Research Regulations 23. 24. 22.2 Where the committee has decided that a thesis is to be examined, the committee must, on the recommendation of the head, appoint two thesis examiners, at least one of whom must be from outside the University. 22.3 Each thesis examiner must make a separate report on the merits of the thesis and any supporting publications and may, before completing the report, request through the committee written clarification from the candidate of specific points in the thesis or publications. Where examiners disagree 23.1 Where there is a difference of substance between the recommendations of the thesis examiners, an advisory panel must be constituted under subsection 26.2 to assist the committee in the assessment of the thesis and any supporting publications. 23.2 An advisory panel may, in any case it thinks appropriate, appoint an adjudicator to assist in its deliberations for the purposes of this section. Satisfactory completion 24.1 The committee, after considering 24.1.1 the results of the examination or assessment of any units or practical work; 24.1.2 the reports of the thesis examiners; and 24.1.3 the report, if any, of an advisory panel – must determine whether or not a candidate has satisfactorily completed the requirements of the degree concerned. 24.2 Where the committee determines that a candidate has satisfactorily completed the requirements of a degree, the candidate is qualified for the award of the degree. 24.3 Where the committee determines that a candidate has not satisfactorily completed the requirements of a degree, it may 24.3.1 determine that the degree not be awarded; or 24.3.2 in relation to 24.3.2.1 units or practical work, recommend any further examination or assessment it thinks fit; or 24.3.2.2 the thesis, give the candidate leave to re-submit, subject to any conditions specified. Distribution and availability of thesis 25.1 Where a candidate qualifies for the award of a degree, of the four copies of the thesis lodged under subsection 20.1, one must be returned to the candidate, and the other three must be held as follows 25.1.1 one in a library of the University; 25.1.2 one by the relevant department, school, faculty or centre; and 25.1.3 one by the candidate's supervisor. 25.2 Subject to subsection 25.3, the copy of a thesis held in a university library may be made available to any person for consultation or copying. 25.3 After determining that a thesis has satisfied the requirements for the degree, the committee may determine a specified period or periods of time, not exceeding 12 years from the date the thesis is lodged under subsection 20.1, during which a copy of the thesis, in whole or in part 25.3.1 must not be made available to any person for consultation or copying; 25.3.2 may be made available for consultation or copying but only to a specified person or class of persons; 25.3.3 may be made available for consultation or copying but only with the written consent of the author. 25.4 The committee may, at any time before the expiration of a period of time specified under subsection 25.3, extend the period, but in no case shall the total period extend beyond the 12 year anniversary of the date the thesis was lodged under subsection 20.1. 25.5 Where a candidate fails to satisfy the requirements of a degree, whether or not the candidate is given leave to resubmit the thesis, of the four copies of the thesis lodged under subsection 20.1 25.5.1 one must be retained by the University for such period as the deputy vice-chancellor responsible for research determines; and 25.5.2 three must be returned to the candidate. 25.6 26. Notwithstanding any section of these regulations, upon the 12 year anniversary of the date the thesis is lodged under subsection 20.1, the copy of the thesis must be made available to any person for consultation or copying. The committee may determine, where required to do so by law, that part of the thesis will be redacted. Advisory panels 26.1 The committee may constitute an advisory panel to advise on any matter relating to a candidate. Page|11 Master Degree by Research Regulations 26.2 An advisory panel constituted to advise on any matter relating to an examination or assessment must consist of 26.2.1 the faculty’s representative on the committee or nominee, who shall be the convener and chair of the panel; 26.2.2 the relevant head, or the head’s nominee; 26.2.3 the main supervisor of the candidate concerned, or the main supervisor’s nominee; 26.2.4 a member appointed by the chair – and may, in any particular case, include additional members co-opted by the panel. 26.3 An advisory panel constituted to advise on any matter other than those provided for in subsection 26.2, must include 26.3.1 the chair of the committee or nominee, who shall be convener and chair of the panel; and 26.3.2 at least one member from outside the faculty concerned but from a cognate discipline. 27. 26.4 After an advisory panel has been constituted under subsection 26.3, the candidate must be advised in writing of the membership and allowed two rights of veto. 26.5 A right of veto under subsection 26.4 must be exercised by notice in writing to the chair within 10 days after receipt of the membership advice. 26.6 After an advisory panel hearing, the panel must make a recommendation on the matter concerned to the committee and the decision of the committee, after consideration of the recommendation, is final. Reversion Where a degree is listed in Schedule 6, a candidate for that degree who – 27.1.1 during the course of candidature satisfies the requirements of the related degree or award; and 27.1.2 subsequently withdraws from candidature for the degree, may be qualified for the related degree or award. 28 Compliance 28.1 Subject to this section, a candidate for a degree must comply with these regulations, as in force from time to time. Page|12 Master Degree by Research Regulations 28.2 Where the committee considers that a candidate has, since first enrolling for a degree, been unreasonably adversely affected by any change in regulations, the committee must permit the candidate to qualify for the degree under regulations in force at sometime during candidature, provided it is satisfied that the work so required to be completed is equivalent in standard to that currently required to complete the relevant study program.
