Compliance with Rules and Regulations, Assumption of Risk, Release for Use of Recreational Facilities at
Queensborough Community College
I, the parent or legal guardian of (child's name)___________________________________________, on behalf of
____________________________(child) and his/her parent(s) and legal guardian(s), in return for my child's voluntary use of the recreational facilities at Queensborough Community College, including the Robert Fitzgerald Kennedy
Gymnasium ("recreational facilities"), represent and agree as follows:
1.
My child will abide by all rules and regulations of the recreational facilities, the Athletics Department, and
Queensborough Community College, whether written or oral, and if at any time my child fails to abide by the rules and regulations, I understand that he/she may be ejected from the recreational facilities.
2.
I am familiar with and recognize the risks associated with my child's use of the recreational facilities and freely and voluntary consent to assume those risks.
3.
I hereby release Queensborough Community College, the City University of New York, the City of New York, the State of New York, the Dormitory Authority of New York, their directors, officers, members, agents, employees, and all persons associated or affiliated with them directly or indirectly, and all units, divisions and departments administered by such entities or persons, hereinafter referred to as the "Indemnified Parties", from any liability of any nature, whatsoever, and from any claims or causes of actions for damages to, or loss of, personal property, or from personal injuries sustained by child, except for intentional torts or acts of gross negligence, regardless of how such claim may arise and regardless of which party, if any, may be at fault, arising out of, directly or indirectly, in any manner whatsoever, my child's use of recreational facilities (hereinafter
"Released Claims"). I further agree not to assert or maintain any claim, complaint, cause of action, lawsuits or legal proceeding concerning any Released Claim against the Indemnified Parties.

I agree to indemnify and hold harmless the Indemnified Parties from any claims, complaints, causes of actions, lawsuits or legal proceedings which in whole or in part arise as a result of my child's negligent or intentional acts during or as a result of my child's use of the recreational facilities.
5.
I grant permission to Queensborough Community College/CUNY and/or Athletics Department personnel to obtain and consent to emergency medical treatment for my child, and I agree to be fully responsible for all costs of such treatment. Please contact the emergency contact person in the event of an emergency situation involving my child.
6.
I understand and agree that this agreement to comply with rules and regulations, assumption of risk, release/covenant not to sue and to indemnify will be bonding to the fullest extent permitted by law. If any provision of this agreement is held to be invalid, that provision will be limited only to the minimum extent necessary to comply with applicable law, and the validity of the remaining provisions will not be affected in any way.
