A recent Title III monitoring conducted by the U.S. Department of Education determined that the current collection process was not adequate for capturing the required data needed in order to issue Title III Immigrant and Youth subgrants to LEA’s. ESEA section 3301(6) defines the term “immigrant children and youth” to mean individuals who(A) are aged 3 through 21; (B) were not born in any State; and (C) have not been attending one or more schools in any one or more States for more than three full academic years. • Issue: The current Basic Tab contains some direct language that could be viewed adversely from an OCR perspective in that immigrant status is directly called out in the acquisition of enrollment data.
