Background: The SEA is required to accurately collect data on immigrant
children and youth from all of the state’s LEAs. A recent Title III monitoring
conducted by the U.S. Department of Education determined that the current
collection process was not adequate for capturing the required data needed
in order to issue Title III Immigrant and Youth subgrants to LEA’s. ESEA
section 3301(6) defines the term “immigrant children and youth” to mean
individuals who(A) are aged 3 through 21;
(B) were not born in any State; and
(C) have not been attending one or more schools in any one or more
States for more than three full academic years.
•
Issue: The current Basic Tab contains some direct language that could be
viewed adversely from an OCR perspective in that immigrant status is
directly called out in the acquisition of enrollment data.

The date that an ELL student successfully meets exit criteria. A student has met the criteria after (1) scoring 5 for two consecutive years
on the English language proficiency assessment and (2) scoring at Mastery level or above on the Reading Language Arts section of the
general assessment. A student should only receive an exit date when both of these requirements have been fulfilled.

during the past school year, including student’s enrollment
at the county for any length of time during the school year.
• Title III Former –reflect students who exited LEP status
– Students will appear in the Title III Former for two years
after successfully exiting the program
