Investigation Report - Outline Preliminary Information 1. Identify report as “CONFIDENTIAL” 2. If an attorney is involved, direct the report to the attorney. Otherwise, direct the report to the Superintendent. 3. State that all reasonably available evidence was collected or is forthcoming. 4. Identify the nature of the investigation. 5. Describe any delays or difficulties, including unavailability of evidence or failure to interview any witnesses. 6. Describe conflicts in evidence and provide an opinion on which evidence is considered most reliable, and why. 7. Identify items of evidence and indicate where items are maintained. 8. List the persons contacted and interviewed. Provide telephone numbers. 9. Provide other information that is necessary for a complete understanding of the case. Findings of Fact 10. Understand the difference between fact, opinion and recommendation. 11. Evaluate the evidence or lack of evidence. 12. When reciting fact, be specific as to times, places and events. 13. Reference any document that supports a finding of fact. 14. Make appropriate findings of fact for all relevant issues, including information already contained in the preliminary statement. 15. Make findings of fact in a chronological and logical order. 16. Be sure that the findings of fact tell the whole truth about the matter. 17. Be sure that the findings of fact flow well and are readable. Opinions Upon The Evidence (reasonable evaluations, inferences or conclusions based on the facts value judgments) 18. Be sure your opinions are not findings of fact or recommendations. 19. Be sure that each opinion is supported by reference to findings of fact. Recommendations (proposals made based upon your opinions) 20. Be sure that your recommendation are not findings of fact or opinions. 21. Be sure that your recommendations are logical and consistent with the findings of fact and your opinions. 22. Recommend appropriate disciplinary, corrective or administrative action. If findings of act and opinions do not warrant further action make such a recommendation. Sign and date the report.
