I.
Call to Order
Following the welcome, Pledge of Allegiance and introductions, President Gayle C.
Manchin called the meeting of the West Virginia Board of Education (WVBE) to order at 10:04
a.m. on July 9, 2014, in the Capitol Room, Capitol Building 7, Charleston, West Virginia.
The following members were present: President Manchin, Vice President Michael I.
Green, Secretary Robert W. Dunlevy, Thomas W. Campbell, Tina H. Combs, Lloyd G.
Jackson II, L. Wade Linger Jr., and William M. White, and ex officio Charles K. Heinlein, State
Superintendent of Schools. Members absent were ex officios Paul L. Hill, Chancellor, West
Virginia Higher Education Policy Commission, and James L. Skidmore, Chancellor, West
Virginia Council for Community and Technical College Education.
II.
Introduction of Future State Superintendent of Schools,
Dr. Michael J. Martirano
President Manchin introduced Dr. Michael J. Martirano, West Virginia's future State
Superintendent of Schools. Dr. Martirano provided remarks regarding galvanizing the state
around student achievement and having one voice, one mission, and one focus to improve
academic achievement for all students.
III.
Recognition
The Board recognized Ms. Rebecca King, WVDE Coordinator of HIV Prevention
Education, recipient of the 2014 National School Nurse Consultant of the Year award from the
National Association of State School Nurse Consultants, Inc.
IV.
Delegations
Patsy Holliday, member of the Fayette County Board of Education, addressed the Board
regarding a number of school and community programs and the Fayette County Comprehensive
Educational Facilities Plan; Brent Sturm, Jobs for West Virginia Graduates, provided
information regarding the class of 2013; Kim Buckley, James Dean (distributed information),
Cathy Siman, Christine Kannon, David Nester, Cathy Evans, Lucy Kimble, Susie Fields, and
Pamela Mitchell, citizens of Hampshire County, addressed the Board regarding West Virginia
Schools for the Deaf and the Blind child care worker positions. (Copy appended to Official

V.
West Virginia STEAM and West Virginia Learning Media
Mr. Scott Finn, Executive Director, West Virginia Educational Broadcasting Authority,
provided a video presentation (available from the West Virginia Learning Media website)
-2regarding West Virginia STEAM (science, technology, engineering, arts and math) and West
Virginia Learning Media.
VI.
Approval of Agenda
President Manchin called for a motion to approve the agenda. Dr. White moved that the
agenda be approved. Mr. Campbell seconded the motion and upon the call for the question the
motion was carried unanimously.
VII.
Update - WVBE Response to Governor's Education Agenda
Ms. Donna Hoylman Peduto (distributed information), WVBE Director of Operations,
members of the Board, and WVDE staff, provided an update (PowerPoint presentation attached)
regarding progress toward accomplishing the Governor's education agenda including the key
provisions of the Governor's request of the WVBE; Commission on School District Governance
and Administration (Mr. Campbell); Project 24 (Mr. Green, Sterling Beane, WVDE Chief
Technology Officer, and Judge Dan O'Hanlon, Vice Chancellor for Technology/Director,
WVNET, West Virginia Higher Education Policy Commission, and Chair of State Broadband
Deployment Council); require every career center to add at least one career pathway to meet
SREB requirements for Preparation for Tomorrow; use RESAs more efficiently for cooperative
purchasing and local professional development delivery; teacher certification/teacher preparation
and educator evaluation; professional development; early literacy to support reading on grade
level by end of third grade; accountability and accreditation/West Virginia school grading model;
and, WVBE Re-imagining Instructional Time Committee. (Copies appended to Official

VIII.
Chancellor Reports
Chancellor Hill and Chancellor Skidmore were unable to attend the meeting.
IX.
RESA Liaison, Office of Institutional Education Programs and
West Virginia Schools for the Deaf and the Blind Reports
Ms. Jane Lynch (distributed information), Executive Director of RESA 8 and WVBE
RESA Liaison, provided a report regarding a number of RESA initiatives. Mr. Jacob Green,
Special Assistant to the Associate State Superintendent, Division of Technical and Adult
Education, WVDE Office of Institutional Education Programs, provided an update regarding
summer school activities, school calendars for the upcoming year, and provided information
regarding an upcoming statewide conference. Dr. K. Lynn Boyer, Superintendent, West Virginia
Schools for the Deaf and the Blind (WVSDB), provided information regarding the child care
worker positions and other activities taking place at the WVSDB. Dr. White addressed the
Board regarding WVSDB facility needs.

XII.
Capacity Building for Priority Schools and Intervention Counties
Ms. Michele Blatt, Assistant State Superintendent, Division of Educator Quality and
System Support, provided information regarding support services provided to schools. Dr.
Boyer addressed the Board regarding the accreditation of the WVSDB by AdvancEd; Ms.
Brenda Nash-Mason, AdvancED West Virginia Director, presented Dr. Boyer plaque in
recognition of the schools' accreditation. Mr. Ted Mattern, System Support Liaison, Office of
the State Superintendent, provided information regarding support services provided to the

Office of Education Performance Audits (OEPA) Director’s Information
Dr. Gus Penix, Director, OEPA, provided brief remarks regarding OEPA initiatives.
XV.
Preston County School System Education Performance Audit Report
Dr. Penix presented the Preston County School System Education Performance Audit
Report for the Board's consideration. A Progress Review of the Preston County School District
was conducted May 21-23, 2014, to ascertain progress of the county in improving student
achievement, reducing the financial deficit, stabilizing personnel practices, and facility
improvement. A report of the Education Performance Audit was reviewed by the WVBE
November 2012. The WVBE returned partial control to the Preston County Board of Education
in 1. policies and 2. the establishment and operation of a school calendar. All other areas of
intervention remained in place and the WVBE continued the county’s Nonapproval status. The
OEPA conducted a second progress review of the Preston County School System May 21-23,
2014. The purpose of the audit was to ascertain the degree of compliance and progress Preston
County has made in correcting the findings of noncompliance from the November 2012 report.
Dr. Penix (distributed information) provided the following recommendation for the
Board's consideration.
The Office of Education Performance Audits recommends that the West Virginia Board of
Education return local control of the county school system to the Preston County Board of
Education effective August 1, 2014, subject to the following conditions: That,
1. The current superintendent remain in the position for two years, unless the superintendent
and the Preston County Board of Education agree mutually to terminate the contract, and
the county show continued progress in eliminating the financial deficit.
2. Transition to local control be provisional for two years.
3. Transfer of control of the following areas to the Preston County Board of Education be
executed with a Memorandum of Understanding between the West Virginia Board of
Education and the Preston County Board of Education.

to statutory provisions and West Virginia Board of Education policies.
Mr. Linger moved that the OEPA's recommendation be approved. President Manchin
requested Superintendent Rick Hicks, Superintendent of Preston County Schools, address the
Board regarding the OEPA's recommendation. Superintendent Hicks introduced members of the
Preston County Board of Education who were present (Kathy McNeill, Ann Robb, Crissy Estep,
-6and Mac McCrum) and addressed the Board regarding the OEPA's recommendation and strides
made by Preston County in response to OEPA reports. President McNeill also addressed the
Board regarding the return of control. Mrs. Combs seconded Mr. Linger's the motion and upon

Initial Education Performance Audit Report for
Boone Career Technical Center, Boone County
Dr. Penix presented the Initial Education Performance Audit Report for the Boone Career
Technical Center, Boone County, for the Board's consideration. An announced on-site review
(five days in advance) was conducted at Boone Career Technical Center May 14, 2014.
Upon recommendation of the OEPA, Dr. White moved that the Boone Career Technical
Center and Boone County revise the school’s Five-Year Strategic Plan within 30 days and
correct the finding(s) noted in the report by the next accreditation cycle. Mr. Dunlevy seconded
the motion and upon the call for the question the motion was carried unanimously. (Copy

John J. Cornwell Elementary School, Hampshire County
Dr. Penix presented the Initial Education Performance Audit Report for John J. Cornwell
Elementary School, Hampshire County, for the Board's consideration. An announced on-site
review (five days in advance) was conducted at John J. Cornwell Elementary School April 3,
2014.
Upon recommendation of the OEPA, Mr. Dunlevy moved that John J. Cornwell
Elementary School and Hampshire County revise the school’s Five-Year Strategic Plan within
30 days and correct the finding(s) noted in the report by the next accreditation cycle. Dr. White
seconded the motion and upon the call for the question the motion was carried unanimously.

April 2, 2014 and Fountain Primary School April 1, 2014.
Upon recommendation of the OEPA, Mr. Linger moved that Burlington Primary School,

Upon recommendation of the OEPA, Mr. Green moved that Ridgedale Elementary

Rock Cave Elementary School, Upshur County
Dr. Penix presented the Initial Education Performance Audit Report for Rock Cave
Elementary School, Upshur County, for the Board's consideration. An announced on-site review
(five days in advance) was conducted at Rock Cave Elementary School May 1, 2014.
Upon recommendation of the OEPA, Mrs. Combs moved that Rock Cave Elementary
School and Upshur County revise the school’s Five-Year Strategic Plan within 30 days and
correct the finding(s) noted in the report by the next accreditation cycle. Mr. Linger seconded

XXII.
Policy 5310, Performance Evaluation of School Personnel
Ms. Blatt presented Policy 5310 for the Board's consideration. Policy 5310 was revised
in order to better accommodate the change in the use of student growth data. Beginning in
2014-2015, fifteen (15) percent of the evaluation for RLA and Math teachers shall be based upon
student growth determined by the results of the state summative assessment. In April 2014, the
suggested revisions were placed on public comment for a period of 30 days. At the conclusion
of that period, 139 comments were received.
-8Mr. Jackson moved that Policy 5310 be approved with amendments (see addendum) to
allow a one year pilot for the implementation of using student performance data for teacher
evaluation purposes and the alignment with assessments and, beginning school year 2015-2016,
fifteen (15) percent of the evaluation for reading language arts and mathematics teachers be
based upon student growth determined by the results of the state summative assessment. Mr.
Campbell seconded the motion and upon the call for the question the motion was carried

XXIII.
Policy 3236, Education Innovation Zones
Ms. Blatt presented Policy 3236 for the Board's consideration. Policy 3236 is being
revised as a result of H.B. 4619 to incorporate language of the "Innovation School District Act."
Mr. Dunlevy moved that the revisions to Policy 3236 be placed on public comment for a
period of 30 days. Dr. White seconded the motion and upon the call for the question the motion

Policy 1230, Freedom of Information Requests
Mr. Jackson moved that Policy 1230 be laid over until August. Mr. Campbell seconded
the motion and upon the call for the question the motion was carried unanimously. (Copy

XXV.
Policy 1340, Rules of Procedure for Administrative Hearings and Appeals
Ms. Hutchens presented Policy 1340 for the Board's consideration. Revisions to Policy
1340 were made to codify procedural requirements for the reinstatement of a teaching certificate
that was suspended or revoked and to establish formally the sanction of permanent revocation.
On May 15, 2014, the suggested revisions were placed on a 30-day public comment. At the
conclusion of that period, one comment was received, suggesting that a reinstatement application
be considered an initial application, thereby subjecting the applicant to a criminal background
check by fingerprinting. [This is the process which the Office of Professional Preparation
currently uses for reinstated certificates that had been suspended.] The commenter also
suggested that an educator whose license is reinstated receive an initial teaching certificate; OPP
currently restores same certificate held before the suspension. In consultation with stakeholders,
revisions were made to address the comment; those revisions are submitted for consideration and
approval.
Dr. White moved that Policy 1340, as amended, be approved. Mr. Dunlevy seconded the

XXVI.
West Virginia Board of Education's Response to the
2014 Annual Report of the West Virginia Advisory Council
for the Education of Exceptional Children
Mr. Robert E. Hull, Associate State Superintendent, Division of Teaching and Learning,
assisted by Ms. Patricia Homberg, Executive Director, WVDE Office of Special Programs,
presented the WVBE's response to the 2014 Annual Report of the West Virginia Advisory
-9Council for the Education of Exceptional Children for the Board's consideration. The West
Virginia Advisory Council for the Education of Exceptional Children (WVACEEC) is a state
level committee mandated by the state code and federal law. Members include parents,
administrators and representatives from a variety of related agencies. The WVACEEC is
interested in the quality of education received by exceptional children and youth. The 2014
Annual Report identifies the unmet needs of children with exceptionalities in West Virginia. The
West Virginia Board of Education annually provides a response to the WVACEEC's Report.
Dr. White moved that the WVBE's response to the 2014 Annual Report of the
WVACEEC be accepted. Mrs. Combs seconded the motion and upon the call for the question

XXVII.
Policy 2512, Instructional Supports for Third and Eighth Grade
Students to Achieve Critical Skills
Mr. Jackson moved that Policy 2512 be laid over until August. Dr. White seconded the
motion and upon the call for the question the motion was carried unanimously. (Copy appended

XXVIII.
Policy 2520.1A, Next Generation Content Standards
and Objectives for English Language Arts in West Virginia Schools
Mr. Hull presented Policy 2520.1A for the Board's consideration. Senate Bill 359
§18-2-39(e) states, "The state board shall develop a twelfth-grade transitional course for both
English/language arts and math for those students who are not on track to be college and career
ready …" A transitional course for twelfth-grade entitled Transition English Language Arts for
Seniors has been developed by the WVDE in collaboration with the Southern Regional
Education Board and needs to be added to Policy 2520.1A. Additionally, the Lexile ranges
aligned to college and career readiness expectations have changed and will also need to be
updated in the policy.
Mr. Linger moved that Policy 2520.1A be placed on public comment for a period of 30
days. Dr. White seconded the motion and upon the call for the question the motion was carried

XXIX.
Policy 2520.2, 21st Century Mathematics Content Standards
and Objectives in West Virginia Schools
Mr. Hull presented Policy 2520.2 for the Board's consideration. The current version of
Policy 2520.2 became effective September 14, 2009, these standards have gradually been phased
out over the last three years. Policy 2520.2B, Next Generation Content Standards and Objectives
for Mathematics in West Virginia Schools, will become effective July 1, 2014, for all grade
levels. Grade 9-12 sections of Policy 2520.2, 21st Century Mathematics Content Standards and
Objectives must remain effective until July 1, 201,7 to allow current cohort groups to complete
their requirements for graduation.
Dr. White moved that the removal of the grade 3-8 sections of Policy 2520.2 on public
comment for a period of 30 days. Mr. Campbell seconded the motion and upon the call for the

Policy 2520.2B, Next Generation Content Standards
and Objectives for Mathematics in West Virginia Schools
Mr. Hull presented Policy 2520.2B for the Board's consideration. Senate Bill 359

entitled Transition Mathematics for Seniors was revised by the WVDE in collaboration with

preparedness of students for college and career. Additionally, objectives are identified for
technical readiness Math III and Math IV within the Math III course.
Mr. Dunlevy moved that Policy 2520.2B be placed on public comment for a period of 30
days. Mrs. Combs seconded the motion and upon the call for the question the motion was

XXXI.
Policy 1471, Education in West Virginia's Correctional Institutions:
Mission and Goals
Mr. Jacob Green, presented Policy 1471 for the Board's consideration. Policy 1471 was
placed on comment until June 16, 2014. One comment was made and accepted. The changes
reflected in attachment one represent a substantive change. The change will require county
boards of education to biannually report information to the WVDE regarding transferring
institutional youth. Also, language was added that prohibits a county board from placing a
transferring student in an education program solely based on their status as a student transferring
from an institutional setting.
Mr. Green moved that the previously proposed editorial corrections to Policy 1471 be
accepted that section 5.2 be placed again on public comment for a period of 30 days. Dr. White
seconded the motion and upon the call for the question the motion was carried unanimously.

XXXII.
WVBE Personnel Matters inclusive of Hiring of
RESA 7 Executive Director and RESA Executive Director Salaries
President Manchin introduced Dr. F. Joseph Super, Superintendent of Barbour County
Schools, and Chair of the RESA 7 Regional Council, who presented Ms. Kathy Hypes as the
RESA 7 Regional Council's recommendation for employment as the Executive Director of
RESA 7 effective July 11, 2014, at an annual salary of $94,832.00.
Mr. Green moved that Ms. Kathy Hypes be employed as Executive Director of RESA 7
effective July 11, 2014, at an annual salary of $94,832.00. Dr. White seconded the motion and
upon the call for the question the motion was carried unanimously.
President Manchin called for a motion regarding RESA Executive Director salaries.
Mr. Linger moved that the salary of all RESA directors be increased by $1,305.00 annually
effective July 9, 2014. Mrs. Combs seconded the motion and upon the call for the question the
motion was carried unanimously.

XXXIII.
Items for Future Consideration
Dr. White requested a discussion be placed on a future agenda regarding how to assist in
improving Kanawha County's west side schools. President Manchin reported that West Virginia
University is visiting Mary C. Snow School on July 17, 2014. Superintendent Heinlein stated
that Paula Fields has been working with Kanawha County's west side schools. (Copy appended

XXXIV.
Future Meetings
The next regular meeting of the WVBE will be held August 13, 2014, in Greenbrier
County, West Virginia. The meeting will continue on August 14, 2014, if the agenda is not
completed on August 13, 2014. Mr. Campbell and Ms. Peduto provided information regarding
the meeting and visits to the State Fair. President Manchin suggested discussing the balanced
calendar and the scheduling of extracurricular events such as the State Fair with officials while
participating in Fair activities.

Election of Officers
President Manchin called for nominations. Mr. Jackson nominated Mrs. Manchin to the
office of President, Mr. Green to the office of Vice President, and Mrs. Combs to the office of
Secretary. Mr. Campbell seconded the motion and upon the call for the question the motion was
carried unanimously. President Manchin thanked Mr. Dunlevy for his many years of service as
Secretary and also as member of the Board (Mr. Dunlevy completes his nine year term in
November 2014).

Adjournment
Mr. Campbell moved that the meeting be adjourned. Dr. White seconded the motion and
upon the call for the question the motion was carried unanimously. The meeting was adjourned
at 2:48 p.m.
