MINUTES WEST VIRGINIA BOARD OF EDUCATION Board Conference Room Capitol Building 6, Room 353 1900 Kanawha Boulevard, East Charleston, West Virginia March 9, 2011 I. Call to Order President Priscilla M. Haden called the meeting of the West Virginia Board of Education (WVBE) to order at 10:00 a.m. on March 9, 2011, in the Board Conference Room, Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia. The following members were present: President Haden, Vice President Jenny N. Phillips, Secretary Robert W. Dunlevy, Michael I. Green, Lowell E. Johnson, L. Wade Linger Jr., Gayle C. Manchin, William M. White and ex officios Jorea M. Marple, State Superintendent of Schools, and James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education. Student representative in attendance was Quinton Hinzman of West Union, West Virginia, who attends Doddridge County High School. Members absent were Burma Hatfield and ex officio Brian E. Noland, Chancellor, West Virginia Higher Education Policy Commission. II. Delegations Ms. Susan Gillette, Ms. Karen Nance, Ms. Barbara Thomas, and Mr. Victor Wilson, citizens of Cabell County, and Mr. Bill Smith, Superintendent of Cabell County Schools, addressed the Board regarding the former West Virginia Colored Children's Home and its selection as the future site for a new consolidated middle school. III. Recognitions Ms. Betty Jo Jordan, Executive Assistant to the State Superintendent, presented Global21 Moments, spotlighting Cabell, Boone, and Braxton County Schools for the Board’s information. Dr. Kathy D’Antoni, Assistant State Superintendent, WVDE Division of Technical, Adult and Institutional Education, provided remarks and presented a video entitled West Virginia CTE - WOW for the Board’s information. Mr. Mark Moore, Coordinator, WVDE Office of Instructional Technology, provided information regarding Thinkfinity and the 21st Century Learning Resources Contest and introduced two of the ten contest winners: Mr. Robert Lyons (Chemistry/Physics Teacher), Westside High School (Wyoming county) Soundproofing Project ~ Melinda Hatfield, a student participant in the project, provided a brief overview of the project; and, Mrs. Beverly Stern (1st grade teacher), Ruthlawn Elementary (Kanawha County), Hillside Erosion Project ~ Douglas Means and Kaden Thomas, student participants in the project, provided information regarding the project. -2Mr. Chuck Nichols, Executive Director, RESA 3, provided remarks regarding a RESA project entitled Arts-Integrated Learning! and introduced and Ms. Linda Andreson, Administrative Assistant, RESA 3, who distributed information regarding the project and introduced Ms. Maria Byrd, principal, and Ms. Sharon Adkins, teacher, Flinn Elementary, who provided brief remarks regarding the project’s evolution at Flinn Elementary. Following remarks, Mr. Nicholas presented members with a copy a book that resulted from Flinn Elementary’s participation in the project entitled The Three Little Pigs Visit West Virginia. Review of Accountability and Technical Assistance Processes [West Virginia Board of Education (WVBE) and Office of Education Performance Audits (OEPA)] Dr. Jack McClanahan (distributed information), Deputy State Superintendent of Schools, provided an overview of the accountability and technical assistance processes that are prescribed by W. Va. Code. Ms. Kelli D. Talbott, Esq., Deputy Attorney General – Education, Office of the Attorney General, provided an overview of the WVBE’s statutory and regulatory responsibilities (PowerPoint presentation attached), and Dr. Kenna R. Seal, Director, OEPA, provided an overview of the OEPA’s statutory and policy responsibilities and procedural process (PowerPoint presentation attached). Chancellor Skidmore departed the meeting. Call to Order President Haden called the meeting back to order at 1:13 p.m. Dr. White joined the meeting. VII. Approval of Agenda Upon motion by Mr. Dunlevy, seconded by Ms. Phillips, the Board unanimously approved the agenda. VIII. Initial Individual School Education Performance Audit Reports for Central City Elementary School and Huntington Middle School, Cabell County Dr. Seal reported that announced on-site reviews (five days in advance) were conducted at Central City Elementary School and Huntington Middle School January 26, 2011. Dr. Johnson issued concern regarding the audit report for Huntington Middle School. Mr. Chuck Heinlein, Executive Director, WVDE Office of School Improvement, provided information regarding support services provided to Huntington Middle School. Following discussion, it was determined that each school would be taken up under a separte motion. Upon the recommendation of Dr. Seal and a motion by Ms. Phillips, seconded by Mr. Dunlevy, the Board unanimously directed that Central City Elementary School revise its -3Five-Year Strategic Plan within 30 days and correct the findings noted in the report by the next accreditation cycle. Upon the recommendation of Dr. Seal and a motion by Ms. Phillips, seconded by Dr. White, the Board, with seven members voting yes and one member, Dr. Johnson, voting no, directed that Huntington Middle School revise its Five-Year Strategic Plan within 30 days and correct the findings noted in the report by the next accreditation cycle. Initial Individual School Education Performance Audit Reports for Athens School, Spanishburg School, Bluefield Intermediate School, and Lashmeet/Matoaka School, Mercer County Dr. Seal reported that announced on-site reviews (five days in advance) were conducted at Athens School, Spanishburg School, Bluefield Intermediate School, and Lashmeet/Matoaka School February 2-3, 2011. Upon the recommendation of Dr. Seal and a motion by Ms. Phillips, seconded by Mrs. Manchin, the Board unanimously directed that Athens School, Spanishburg School, Bluefield Intermediate School, and Lashmeet/Matoaka School revise their Five-Year Strategic Plans within 30 days and correct the findings noted in the reports by the next accreditation cycle. Initial Individual School Education Performance Audit Reports for East Lynn Elementary School, Fort Gay Elementary School, and Wayne Middle School, Wayne County Dr. Seal reported that announced on-site reviews (five days in advance) were conducted at East Lynn Elementary School, Fort Gay Elementary School, and Wayne Middle School January 27, 2011. Upon the recommendation of Dr. Seal and a motion by Mrs. Manchin, seconded by Ms. Phillips, the Board unanimously directed that East Lynn Elementary School, Fort Gay Elementary School, and Wayne Middle School revise their Five-Year Strategic Plans within 30 days and correct the findings noted in the reports. Capacity Building for Low Performing Schools Mr. Chuck Heinlein, Executive Director, WVDE Office of School Improvement, provided a brief summary of support services provided, in response to OEPA findings, to Mason County and the West Virginia Schools for the Deaf and the Blind. Mr. John T. Mattern, WVDE System Support, provided information regarding assistance provided to Fayette County, McDowell County and the West Virginia Schools for the Deaf and the Blind. -4XII. Consent Agenda Upon motion by Ms. Phillips, seconded by Dr. Johnson, the Board unanimously approved the Consent Agenda. (Copies appended to Official Minutes, Attachments D through I.) XIII. Revised Five-Year Strategic Plans for 18 Temporary Accreditation Schools Updated for 2010-2011 School Year (Attachment D) Revised Individual School Strategic Plans for Gilmore Elementary School (Jackson County), Watts Elementary School (Kanawha County), McNinch Primary School (Marshall County), and Sistersville Elementary School (Tyler County) (Attachment E) Meeting minutes of February 9, 10 and 14, 2011 (Attachment F) Notification, per Senate Bill 227, W. Va. Code §18A-4-7a, Transfer of Teachers After Five Days Prior to Starting Instruction, from Doddridge County Schools (Attachment G) Quarterly Updates - Fayette, Grant, Lincoln, Mingo, McDowell and Preston Counties and West Virginia Schools for the Deaf and the Blind (Attachment H and addendum) Employment of Substitute Teachers and Retired Teachers as Substitutes in Areas of Critical Need and Shortage Policies for Boone, Brooke, Cabell, Fayette, Harrison, Lincoln, Logan, Mercer, Mingo, McDowell, Putnam, Wetzel, and Wyoming Counties and the Office of Institutional Education Programs (Attachment I). Board Reports Common Ground: Education and the Military Committee. President Haden (distributed information) provided information regarding the committee meeting that took place on February 11. Agenda items included Project PASS, WV ASVAB Testing, update – legislative action on bill for the Interstate Compact for Children of Military Families, Memorandum of Understanding among WVBE, WVDE and branches of the military (to be brought before the Board in April for approval), and communication plan. The next committee meeting will take place on March 10 at 1 p.m. (Copy appended to Official Minutes, Attachment Q.) WVBE Innovation Zone Selection Committee Annual Report of Progress for 2010 Innovation Zones. Mr. Linger provided a brief overview of the annual report of progress for the 2010 Innovation Zones. Dr. Johnson moved that the report be approved. Ms. Phillips seconded the motion and it was carried unanimously. (Copy appended to Official Minutes, Attachment J.) Preston County Visit/Meeting. Mr. Linger and Mr. Green provided information regarding the Board’s visit to Preston County on February 14. Mr. Green also provided -5information regarding a tour of University High School in Monongalia County; tour participant were Mr. Green, President Haden, Mr. Linger and former State Superintendent John T. Mattern. WVBE Student Representative. Mr. Hinzman addressed the Board regarding his expectations as student representative to the Board during the months of March, April and May. Board Member Reports. Mr. Green attended a meeting of the Broadband Council and will be attending a future meeting in connection with Globaloria. Mrs. Manchin provided a report regarding a NASBE congressional briefing regarding the educator of the future. President Haden reported that she will participate in a congressional briefing on Monday regarding education and the military. Ms. Phillips reported that it has been determined that there will be no evaluation of the State Superintendent in June (not enough time will have elapsed to perform an evaluation as the State Superintendent did not being her position until March 1), there will be no evaluation of the Superintendent of the West Virginia Schools for the Deaf and the Blind as she has tendered her resignation effective upon the identification of a new Superintendent, that evaluations will take place in June with the Director of OEPA and Board’s secretary, and that a new evaluation tool for the State Superintendent will be developed in consultation with the State Superintendent. Mrs. Manchin suggested that the State Superintendent meet with the Evaluation Committee when the new evaluation instrument is designed. Dr. Johnson attended a tutorial meeting in Lewisburg regarding Policy 2419, counselor evaluation task force meeting, teacher evaluation task force meeting, CPD meeting regarding the Master Plan for Professional Development, and a meeting of the WVBE Professional Development Committee’s Sub-committee on Advanced Placement (recommendation to the brought to the Board in April; communication plan needs to be developed regarding AP courses). President Haden (distributed information) attended meetings of the counselor evaluation task force, West Virginia School Boards Association, and will be attending a meeting of the NASBE Governmental Affairs Committee during the March Legislative Conference (visits to Capitol Hill, that normally take place during the Legislative Conference, will take place in June). Call to Order President Haden called the meeting back to order at 3:46 p.m. XVI. Designation of Recommended Applicants as Education Innovation Zones per Policy 3236 Mr. Heinlein reported that the committee reviewed six amended applications and presented the committee’s recommendations (three applications) for the Board’s consideration for Innovation Zone status. Upon motion by Dr. Johnson, seconded by Mr. Linger, the Board unanimously approved the committee’s recommendations and granted Innovation Zone status to the applicants found in the attachment. Revision of WVBE Procedures for Requests for Policy Waivers Ms. Jordan presented the WVDE’s recommendation for a revision to the WVBE's procedures for waivers of WVBE policy. The revisions will establish a uniform timeline for the submission of first time and continuation waiver requests for Instructional Materials and high school courses to be used as substitutes for graduation requirements. Upon motion by Mr. Dunlevy, seconded by Ms. Phillips, the Board unanimously approved the revision of the WVBE’s procedures for requests for policy waivers. (Copy appended to Official Minutes, Attachment L.) XVIII. WVBE Personnel Matters President Haden called for a motion to approve the Board’s personnel attachment. Upon motion by Dr. Johnson, seconded by Mr. Green, the Board unanimously approved the Board’s personnel attachment. Dr. White questioned the interview process for the Superintendent for the Schools for the Deaf and the Blind. President Haden indicated that the interview committee may be a committee of the whole and that a special meeting may be called if deemed necessary by the search process timeline. State Superintendent’s Report Superintendent Marple (distributed information) presented Department personnel items for the Board’s information and spoke to the importance of personalized learning, highly qualified teachers, greater flexibility for teachers, and education being the responsibility of every stakeholder. Mr. Joe Panetta, Assistant State Superintendent, WVDE Division of Student Support Services, provided an update regarding the legislative session. It was requested that a letter be issued from the Board to the appropriate legislative contacts regarding Board initiatives. Update - Revision of Policy 2510, Assuring Quality of Education: Regulations for Education Programs. Mr. Robert E. Hull, Assistant State Superintendent, WVDE Division of Curriculum and Instructional Services, provided an update regarding the timeline for the review, revision and redesign of Policy 2510 (PowerPoint presentation attached). Update - Policy 4373, Student Code of Conduct. Ms. Pat Homberg (distributed information), Executive Director, WVDE Office of Special Programs, provided an update regarding the revision of Policy 4373. Update - Cyber Safety. Ms. Brenda Williams, Executive Director, and Ms. Kathy Boone, Assistant Director, WVDE Office of Instructional Technology, provided an update regarding cyber safety initiatives (PowerPoint presentation attached). Board Items for Future Consideration President Haden asked that items, inclusive of any requested during the meeting, that members wish considered for placement on a future agenda are to be provided to her as soon as possible. The meeting will continue on April 14, 2011, if the agenda is not completed on April 13, 2011. XXII.
