31.5 – Fees Established by Field Units
31.51 – Fees Established by Regions
Minimum land use fees shall not be prorated nor refunded for authorizations issued or cancelled
within a calendar year.
If a fee is adjusted for an existing authorization due to a scheduled rate redetermination or as
specified in the authorization, notify the holder in advance of the adjustment. Notification of
ninety (90) days or more is recommended. Annual fee adjustments applying the IPD (linear fee
schedule) and CPI-U (communication sites) are not considered a fee adjustment requiring
notification.
If a land use fee is partially or fully waived, calculate the full fee; then document it and the facts
and rational supporting the full or partial waiver in the case folder and in the Special Use Data
System (SUDS). Cite the applicable subsections from the Regulations 36 CFR 251.57(b) and
FSH 2709.11, 31.2.
1. Payment Procedure. Use SUDS to prepare all bills for land use fees. Send all bills
for calendar year land use fees to holders prior to December 1.
2. Periodic Review of Fees.
a. Notice of Fee Adjustment. Any fee adjustment will be effective on January 1 of
the following calendar year, unless the special use authorization specifies otherwise.
Make fee adjustment by amending the special use authorizations.

Regional minimum fees effective January 1, 2016 rounded to the nearest dollar.
If a regional minimum fee is not listed for a particular use, use the WO minimum fee identified
in the Use Code Library of the SUDS library.

32.2 - Payment of Fees
Use authorizations shall normally identify January 1 as the due date for receipt of calendar year
payments. For fees based on revenues, the due date shall coincide with the holder's fiscal year.
32.3 - Billing Procedure
Holders must be billed at least 30 days before payment is due, unless authorization terms direct
otherwise. Since use authorizations normally identify January 1 as the due date for receipt of
calendar year payments, land use fees for most existing authorizations must be billed by

Whenever possible when billing for new authorizations, make all bills due either the first or
fifteenth of the month, even if this gives the Holder more than 30 days to pay. Making bills due
only on the first or fifteenth of the month will make it easier to track any late payments and
process dunnings.
36 – FEE SYSTEMS AND SCHEDULES
36.41 – DETERMINATION OF FEES FOR LINEAR COMMUNICATION USES
For linear communication uses that may be authorized on National Forest System (NFS) lands
refer to Washington Office Forest Service Handbook 2709.11, Chapter 40 and Region 9
Regional Office FSH 2709.11, Chapter 40.
All single-owner, metal wired telephone (821 and 822), fiber optic (823), and cable television or
other wire-line telecommunications systems that provide a communication service solely by
wire-line (809*, 831 and 832) that are co-located within the same right-of-way shall be charged
only one land use fee (see Exhibit 02: April 24, 2015 Washington Office memo). To qualify for
a single land use fee, an applicant or special use holder must provide clear documentation that
the facilities are owned by a single entity and are co-located within the same right-of-way (e.g.
buried alongside one another, on poles adjacent to one another, attached to the same poles, or
above and below ground line within the same right-of-way width).
A single land use fee shall not be charged if an owner of co- facilities is subleasing excess
capacity to a third-party entity. In cases where subleasing is occurring, the holder must be
charged an additional land use fee for each third-party use. Charge based on the established
linear right-of-way fee schedule (see FSH 2709.11, Chapter 40, Section 48.23c).
See R9 RO Forest Service Handbook 2709.11, Chapter 40 for the information that applicants and
holders must provide before their existing fees may be changed. Units may, at their discretion,
use and/or modify the sample letter in Exhibit 03 and/or the sample spreadsheet in Exhibit 04 to
obtain necessary information from existing permit holders.
All new special use authorizations for co-located 809*, 821, 822, 823, 831, and/or 832 uses must
be consistent with the WO letter shown in Exhibit 02. Existing special use authorizations should
be modified to be consistent with the WO letter when annual land use bills are completed,
provided the required information has been obtained.
If required information is received in calendar year (CY) 2015, the holder’s bill will be updated
in CY16. If the information is received in CY16, the bill will be updated in CY17, and so forth.
Bills will not be updated retroactively. Data for all 809*, 821, 822, 823, 831, and/or 832 uses
must be entered and tracked in SUDS, regardless of whether only a single fee is charged for colocate lines.
*Applicable to 809 uses only when the fee method is linear.

Sample Letter to Owners of Linear Communication Facilities Regarding Fees
Dear (Name of Holder):
National fee policy for use of metal wired telephone (use codes 821 and 822); fiber optic (use
code 823); and other wire-line telecommunications systems that provide a communication
service solely by wire-line (use code 809*, 831 and 832) on National Forest System lands was
recently clarified.
Rather than charging a fee for each co-located metal wired telephone, fiber optic, and other wireline telecommunications use on National Forest System lands, lines that are owned by a single
entity and are co-located within the same right-of-way (within the same or different conduit
within the same right-of-way, and/or attached to poles within the same right-of-way), will be
assessed a single land use. The single land use fee will be based on linear right-of-way
occupancy at the widest portion of the shared right-of-way.
A single fee will not be assessed if the owner of co-located metal wired telephone, fiber optic,
and other wire-line telecommunication facilities is subleasing excess capacity to a third-party
entity. When subleasing is occurring, holders will be assessed an additional land use fee for each
third-party use. The established linear right-of-way fee schedule will be used to assess fees.
To determine if your fees should be modified, we need to confirm that all the wired telephone,
fiber optic, and other wire-line telecommunication facilities that you own and operate on
National Forest System lands have been identified and documented in your special use
authorization. Please provide the following information for all your lines and certify where any
co-location is occurring:
 Location description of all facilities on National Forest System lands (at a minimum:
Forest; District; County; State; US Tract or Township/Range/Section)
 Type of uses (809*, 821, 822, 823, 831, and/or 832)
 Whether uses are within separate right-of-ways or are co-located within one right-of-way
 Length (in miles and feet) of each line within a right-of-way
 Width (in feet) that each line occupies; and, if multiple lines are co-located in one rightof-way, the total width of the occupied right-of-way (Note: the minimum right-of-way
width that can be authorized is 10 feet)
 Whether the lines are buried, and if so, how deep
 Whether the lines are aerial, and if so, does the holder own the poles? If the holder does
not own the poles, the name of the entity who owns the poles
 Which, if any, lines are subleased; and if subleased, to whom
*Applicable to 809 uses only when the fee method is linear.

Electronic Geographic Positioning System (GPS) data or Geographic Information System (GIS)
data also is requested for each line. You may provide this spatial data, or cost recovery funds
may be collected from you to fund a Forest Service employee or a contractor to produce it.
If changes in fees are warranted, they will be modified the calendar year (CY) after which you
provide the information. For example, if information is provided in CY15, fees will be modified
in CY16; if information is provided in CY16, fees will be modified in CY17; and so forth. Bills
will not be updated retroactively.

36.7 – Commercial Filming and Still Photography Fees
A land use fee shall be charged for all commercial filming activities and for all still photography
activities authorized under permit unless the holder to the activity qualifies for a fee waiver as
provided in FSH 2709.11, 31.2.
A fee is required for the professional use of still photography equipment, motion picture
equipment, or other videotaping equipment on National Forest System lands under the following
circumstances:
1. If the use involves the use of models, sets, or props that are not a part of the natural or
cultural resources or administrative facilities of the site when the activity is taking place.
2. When additional administrative costs are incurred as a direct result of the still
photography activity or when the activity takes place at a location where members of the public
generally are not allowed.
3. All commercial filming activities.
