31.51 - Fees Established by Region
31.51a - Regional Minimum Fees
The CY12 minimum fee for any special use authorization is $56.21, except as described in a
National minimum or indexed R5 minimum. This fee is intended to reflect market value of the
rights and privileges authorized. Adjust all special use authorizations to require the annual
minimum fee consistent with Exhibit 1. Where necessary, amend existing permits in accordance
with FSM 2714 to provide for the new fee and periodic adjustment.
This new minimum fee will apply to:
1.
All new, transferred, or reissued land use authorizations not covered by another fee
schedule; and
2.
All existing land use authorizations that:
a. Utilize the current minimum fee,
b. Are a Linear Rights-of-Way (LROW) use whose fee under the national schedule
is less than the fee to be calculated under the land value schedule,
c. Are not covered by a national fee schedule or a site specific appraisal.
Charge the minimum fee in its entirety; do not pro-rate for a portion of the year. The minimum
fee is by authorization, not by use. For authorizations with more than one use code, charge only
the minimum fee if the total combined rent is less than the minimum. Ensure procedures at
section 36.42 of the parent text regarding use of a fee schedule for secondary uses.
Unique Attractions. Certain structures, such as the Mt. Wilson Pavilion, are sufficiently unique
to be filmed as attractions. Allow this where it will not unduly hinder administrative or public
use; charge an additional $311.60 fee per day.
Update the minimum fee annually using the U.S. Department of Labor Cumulative Implicit Price
Deflator-Gross Domestic Product (IPD). Review the minimum fee every five years, and adjust
the minimum fee accordingly to reflect current market value.
Exhibit 1 displays the CY12 R5 indexed minimum fees from their respective previous R5 fee
schedule.
