31.51 - Fees Established by Regions
31.51a - Regional Minimum Fees
It is the responsibility of the Regional Forester to establish and maintain a Regional minimum
fee for special uses (FSM 2715.04b).
The regional minimum fee does not apply to special use authorizations that have established
national or regional fee schedules or systems in place (for example Graduated Rate Fee System,
Outfitter and Guide, and still photography/commercial filming). Consult the appropriate Forest
Service Manual or Handbook for further clarification of minimum fee requirements for these use
types.
Except for uses with established national fees schedules or systems, the Forest Service
Intermountain Region minimum for any special use authorization is $75.12 for calendar year
2014. This regional minimum fee shall be updated annually using the U.S. Department of Labor
Cumulative Implicit Price Deflator – Gross Domestic Product (IPD). The Special Uses Database
System (SUDS) will be updated annually to reflect the indexed minimum. For any uses not
covered by this directive, please contact the appropriate Regional Office program manager.
The minimum fee shall be charged in its entirety; do not pro-rate for a portion of the year.
Unless otherwise directed by a national fee schedule or system, the regional minimum fee will be
assessed regardless if a land use fee calculated under existing schedules or systems may indicate
a lower fee.
For minor ancillary Linear Rights-of-Way, refer to FSH 2709.11, Ch.30, sec 36.42.
When more than one use is included in a single authorization, the regional minimum fee applies
separately to each use designation for which the land use fee is not exempt (sec. 31.21), waived
(sec. 31.22-31.22c), or is considered ancillary pursuant to Linear Rights-of-Way (sec. 36.42).
For example, consider a single authorization includes two separate use designations (e.g. private
road and fiber optic line); the land use fee for each use designation is calculated at less than the
regional minimum fee. In the above example, assess the regional minimum fee separately for
each use and bill for two minimum fees under a combined bill for the authorization.
36.7 – Commercial Filming and Still Photography
Charge a fee on a per-day basis according to the following schedule:
