2703.1 - Review of Proposed Use
The Regional Forester shall review permits for the following types of special uses prior
to issuance by the Forest Supervisor:
1. Commercial public service uses (except temporary and priority outfitter and
guide uses).
2. Airfields.
2703.3 - Authorization of Use
FSM 1500 provides direction related to the use of agreements. Agreements do not
authorize cooperators to occupy National Forest System lands or facilities. The
privilege of occupancy and use of National Forest System lands is allowed by a special
use authorization.
2704 - RESPONSIBILITY
2704.22 - Forest Supervisor
It is the responsibility of the Forest Supervisor to:
7. Ensure the holder of special use authorization complies with applicable State
and/or Federal waste quality and effluent discharge standards. When deemed
necessary by authorized officer, consult with the Director of Engineering for review of
special-use designs to assess probable effects on health and safety of National Forest
users and personnel, and for impacts on National Forest resources. Refer to standards
listed in FSM 7400.
2704.3 - Delegation of Authority for Issuance and Approval of Special Uses
Authorizations
2704.32 - Regional Forester
The Director of Recreation, Lands and Minerals has the authority to approve and issue
the following uses:
1. Water Conveyance System Easements issued under the Colorado Ditch Bill,
P.L. 99-545;
2. All easements issued under the Federal Land Policy and Management Act.

2704.33 - Forest Supervisor
Forest Supervisors have the responsibility and authority to:
1. Approve and issue all special-use authorizations as delegated in 2704.32.
2. Approve and issue all 1906 Act Permits, Non-Disturbing Use Permits and
Disturbing Use Permits Heritage Resource Permits other than those issued regionwide.
Forest Supervisors may re-delegate the authority to approve and issue permits to
District Rangers.
3. Approve and issue inter-forest and inter-district (between districts on adjoining
forests) special-use authorizations. This authority may be re-delegated to a lead forest
or district following agreement between Forest Supervisors on a case-by-case or typeof-use basis.
4. Approve, issue, suspend, or terminate Road Use Permits, (form FS-7700-41);
Forest and Private Road Special-Use Permits pursuant to the Federal Land Policy and
Management Act; and License Agreements and Rights-of-Way Reservations as
provided in the current Bureau of Land Management/Forest Service Interagency Rightof-Way and Road Use Agreement.
5. Issue permits for terms longer than five-years, except as provided in FSM
2704.33 and FSM 2704.34.
6. Administer permits, term permits, leases, or easements issued by the
Regional Forester within their respective Forests.
7. Forest Supervisors may amend, revise, or terminate those permits and term
permits originally issued by the Regional Forester for uses that are now within the
authority delegated to Forest Supervisors.
The Regional Forester for the Rocky Mountain Region has determined that certain
National Forests have sufficient lands staff expertise to permit the delegation of
authority to Forest Supervisors of those Forests to approve, issue and transfer standard
form easements and reservations pursuant to the Federal Land Policy and Management
Act of 1976, where no reciprocal rights-of-way are involved. This authority includes the
termination of an easement on the occurrence of fixed or agreed-upon conditions,
event, or time when the easement, by its terms, provides for such termination, or with
the consent of the holder. This authority may not be re-delegated.
This authority has been delegated to the Forest Supervisors of the following National
Forests:

1. Arapaho-Roosevelt National Forests and Pawnee National Grasslands
2. Black Hills National Forest
3. Grand Mesa, Uncompahgre, and Gunnison National Forests
4. Medicine Bow-Routt National Forests,
5. Pike - San Isabel National Forests and the Cimarron and Comanche National
Grasslands
6. White River National Forest
2704.34 - District Ranger
Permits signed by District Rangers for longer than five years, except standardized
authorizations (parent text, paragraph 2), are invalid and are not in full force and effect.
Such invalid permits must be countersigned or reissued by the Forest Supervisor to
make them valid. Do not substitute short-term permits (occupancy not to exceed five
years) for longer term permits in order to expedite the signing of permits. Consult the
Special Uses Authorization and Permit Tenure Guide for recommended or maximum
lengths of term associated with specific uses.
