Since transaction evidence appraisals do not appraise Special Forest Products, these standard rates may be used for any size sale as long as the product is not a sawlog or houselog. The minimum charge for commercial and personal-use sales per contract or permit is described in FSM 2431.31c. These minimum charges are for product values. The minimum charge for personal use of a Christmas tree is $10. Public Law 108-108, Title III, Section 335, 117 Stat. 1312 provides for a pilot program for harvest and sale of forest botanical products that grow on National Forest System lands (reference WO June 23, 2005 6500 letter to RFs). Under the provisions of the Act, Forest Service retains the fees collected from the sale of botanical products (mushrooms, fungi, flowers, seeds, roots, bark, leaves, and other vegetation, or portion thereof) and expands them to finance the activities pertaining to the botanical products and their sale. Receipts for botanical products (product codes 29 through 55) will be deposited into Fund Code TPBP (Treasury symbol 12X5264). Exhibit 01 shows standard rates for Convertible Timber Products. Exhibit 02 shows standard rates for Nonconvertible Timber Products. Exhibit 03 shows standard rates for Nonconvertible Nontimber Products.
