Right-of-Way Acquisition Handbook 31 - PAYMENT OF CONSIDERATION 1. When payment is made for an easement, a copy of the voucher or other payment document will be submitted to the Regional Forester as evidence that transaction has been completed. 2. State, Local Government and Other Federal Agencies. Advance payments to State, local Government and other Federal agencies have been considered in a number of Comptroller General decisions. Generally, such decisions have held that advance payments be allowed when these Government agencies are prohibited law from furnishing supplies or services without payment in advance. In these situations, advance payment may be made for easements upon OGC approval of a preliminary title assembly containing: a. The unsigned easement and exhibits in the approved format b. A letter from the grantor indicating intent to execute the easement upon receipt of payment. c. Preliminary title evidence. d. Curative documents already obtained. e. Certification of Inspection and Possession prepared about the date submitted for Preliminary Title Opinion. f. Certificate of the Use and Consent prepared about the date of submission for Preliminary Title Opinion. g. Any other pretinent information that would assist the reviewer to determine the nature, extent, and seriousness of title defects. R - 1 SUPP 5 EFFECTIVE 12/07/90
