To: Debra Mathews, Special Agent in Charge This letter authorizes USDA Forest Service Law Enforcement Officers (LEO), assigned or detailed, within the Intermountain Region to fly as passengers on Army National Guard, State Highway Patrol, other Federal Agency, Washoe County Aviation Unit, and Las Vegas Metro Aircraft in support of Drug Over Flights, Interdiction, and Surveillance missions. This authorization is in accordance with FSM 5712. 34. The aircraft and pilots identified above meet the level of safety and mission effectiveness comparable to contract aircraft. Forest Service Law Enforcement Officers will follow each Memorandum of Understanding and Agreement when performing any Law Enforcement Mission for each of the States located within the Intermountain Region, which includes Utah, Idaho, Wyoming, Nevada, and California. All Forest Service Law Enforcement Officers shall complete the B-3 Combination Helicopter/Airplane Safety training online at the Interagency Aviation Training site, https://www.iat.gov/Training/logon.asp, and prior to participating in any flights on National Guard, State Highway Patrol or other Federal Agency Aircraft involved in Law Enforcement activities. In addition to completing the above training, all Forest Service Law Enforcement Officers involved in any helicopter operations will wear the required Personal Protective Equipment; which includes helmet, leather boots, gloves (leather or nomex), nomex flight suit or nomex trousers, and shirt. A copy of this letter should be maintained by each Forest Service Law Enforcement Officer and each detailed LEO within the Intermountain Region. Field-level LEI employees are required to notify the Regional Special Agent-in-Charge when working under this authorization.
