Included are historical approaches to regulation, some present procedures, and some developing trends. The primary focus of the course is on programs of the New York State Department of Environmental Conservation. Particular emphasis is on NYSDEC permitting procedures established in the Uniform Procedures Act, and on statewide environmental impact review procedures established in the State Environmental Quality Review Act. In addition to NYS DEC programs, the course will introduce the student to other agencies’ regulatory jurisdictions at the federal, state, and local levels. While not discussed in depth, United States Department of the Army, Corps of Engineers and the United States Environmental Protection Agency programs will be explored as examples of federal environmental programs. At the New York State level, programs of the Departments of Health, Labor, Agriculture and Markets, State, Transportation, and the Office of Public Service Parks, Recreation and Historic Preservation will be touched upon. Finally, various local approvals will also be considered. The emphasis is one the interrelationship of programs, not the specific details of the programs themselves. Emphasis is also placed on how regulatory programs come to exist and be implemented through the passage of laws, the development of regulations, and the growing use of guidelines. Today’s climate of regulatory reform concludes the discussions. Trends in the use of general permits, performance standards, self-certification, and others will be examined. There will be discussion of the growing roles of the private in-house and consulting regulatory services which complement and, in some cases, may replace existing governmental regulatory programs. Course requirements include homework assignments, a paper and three examinations.
