Fox, Judy Hutchison, Walt A. Oppenheim, Bernard A. Poskus, and Dean Woodward, and sponsored by Senator Dottie Wham and Representative Jeanne Faatz. The Bill prohibits the health, group disability, and long-term care insurance industry from using, keeping, and seeking genetic testing information when underwriting present and potential clients. The Bill was signed into law by Governor Roy Romer on June 2, 1994. It is the result of deliberations by the Sub-Committee on Genetics and Insurance (which I chaired from December 1992 until June 1994) of the Colorado Governor's Commission on Life and the Law. The Commission has advised the Governor of Colorado on legislation regarding (1) medical durable powers of attorney for health care, proxy decisionmakers, and non-hospital do-not-resuscitate (DNR) orders (the Colorado "Patient Autonomy Act," which was passed in May 1992); (2) mandatory AIDS testing for Colorado health care practitioners; and (3) the privacy of genetic information.
