As parent municipality to the municipal entities we aim to keep our municipal entity boards of directors
and staff abreast of all current news, legislation and policies directly affecting the municipal entities.
This will enable directors to be continuously informed as well as ensuring that we meet the legislative
requirement as parent municipality to ensure that both the municipality and the municipal entity
comply with the Municipal Systems Act, the Local Government: Municipal Finance Management Act and
any other applicable legislation.

Companies Act, 2008 inconsistencies with MFMA
Section 5(4) of the Companies Act states that the provisions of the Act and the MFMA apply
concurrently and if it is impossible to apply with one without contravening the other then the MFMA will
apply.

LEGISLATION:
Guidelines in terms of the Protected Disclosures Act, 26 of 2000
The Department of Justice has published a useful guideline for employees in terms of the Protected
Disclosures Act. This Act is known as the Whistle Blowers Act.

Address by Deputy Minister of Finance Nhlanhla Nene, MP at the 2011
Institute of Municipal Finance Officers (IMFO) Annual Conference - 12
September 2011
Deputy Minister of Finance, Nalanhla Nene gave the Keynote Address at the annual IMFO conference at
CTICC on 12 September 2011. He highlighted the drive of the National Finance Department’s
Outcomes Approach to improve public financial sustainability. He also acknowledged the progress
made by municipalities in the area of access to municipal services, water supply, flush toilets and
sanitation.

Local Government Budgets and Expenditure Review: 2006/07 to 2012/13
National Treasury has conducted its Local Government Budgets and Expenditure Review. This is the
third time National Treasury has published this document. The Review covers municipal spending and
budgets for the period 2006/07 to 2012/13.
This Review builds on the 2006 Review which described the basic fiscal and financial position of the
local government system, and the 2008 Review which largely examined the impact that municipalities
have had on their socio-economic environment.
This Review:
a. Explores some of the contextual differences between rural and urban municipalities; and
b. Highlights the different kinds of development challenges they face and the need for the regulatory
and fiscal frameworks to respond to these differences.
