As far as network goes, can SFA give an idea of the network to each building? Answer: All buildings are served with 1 gig and some with 10 gig. 2. The buildings that don’t have service today are they requesting to have service? Answer: Not necessarily, SFA wanted potential vendors to be aware some buildings don’t have service and at some point SFA might want service provided to those areas. There are no current expectations or requests to provide such service. 3. There were a couple of different channel line-ups included in the RFP, is this strictly analog or does it have high definition capability? Answer: SFA is all digital and there are over 100 high definition channels. Residents can purchase expanded packages and expanded packages can be added to any of the buildings with existing service now. Right now residents request converter boxes from the vendor. 4. Vendor saw there is hard-line coaxial. Is this provided at all locations? Is there single-mode fiber available at all locations at this time? Would you say 70%? On the RFP it looked like each individual building was laid out. On the question of which building does or does not have singlemode fiber, can that be answered? Answer: Some locations are fed by coax and others by single-mode fiber based on the install provided by the current vendor. Single-mode is available at most locations, but not all. Are there video-on-demand movies currently available through web portals or through channels like HBO, etc? Answer: Video-on-demand is available through premium and local programming. 6. What percentage of resident’s upgrade their converter boxes? How many students are getting upgrades? Answer: Residents go directly to the vendor for this service. While SFA does not have a student breakdown, the information provided from the current vendor regarding additional services is included. 7. rd The RFP indicates the Contractor shall provide for 3 party testing. Is this at the head-end location only or at each individual location? The RFP reads like it’s only the head-end? Answer: What was tested in the past was at the head-end and a sampling at other locations to verify signal was reaching multiple sites. 8. Is the current mass notification system just on one channel or broadcasting on all channels? Does UPD go to a computer or do they go directly to the head-end? If it is on all channels is it like a banner across the screen or does the message replace the entire screen? Answer: Confirmed with UPD, the notification does take over all channels. Also, on older TVs the banner message will take over the whole screen which is what is preferred. However, the new digital signal from the current vendor runs just a smaller banner message. 9. What is the make/model of the Emergency Response system? Is UPD on a computer to create personalized own messages? Or does UPD have options to push across campus? How is the message implemented? Answer: As indicated in the RFP, UPD currently uses Rave Mobile Safety for emergency notifications. UPD works from a localized office computer working directly through a website entering the desired message and hits enter. It takes approximately 90 seconds for the TVs to turn black and the message to appear. 10. How is the current wireless capability in the Residence Halls? Is it more centered around the IPTV delivery, curious what is currently there and what it can handle? What is their user experience? What kind of hardware? Answer: There are areas that are good and bad depending on the location. SFA is in the process of increasing access points by approximately 60% this fiscal year. This started 09/01/2015. SFA has completed about 4 of the buildings so far and has another 8-9 areas remaining. SFA uses Cisco access points. Stephen F. Yes, POE is available in almost every building. There is 100% coverage in the Residence Halls but saturation is an issue. Every other academic building and administrative building SFA has covered. Parking garages are not covered. A few outdoor spaces are covered, mainly the few gathering points. SFA has adequate coverage where students need coverage. Right now, SFA is trying to fix a load issue. 12. How much bandwidth goes to students right now? Is that capacity maxed? If SFA brings in more IPTV relating things, does SFA expect the load to increase? Or is it a concern that it will burden the network? Answer: The current bandwidth is approximately 2 gig. Yes, if SFA opens the capacity the students will use it. Yes, SFA expects the load to increase for IPTV related things and it is a concern right now. SFA is working to increase internet links. SFA has a 10gig link to Houston. SFA has a 1gig link to Dallas and is working to increase that to 10 gig. SFA has a 1 gig link to Tyler. SFA is working to beef up those links. SFA is also part of a consortium out of Houston called SET working on correctly routing to our cache services that SFA has out there. 13. Has there been any indication from the current provider regarding Channel 2? Vendor recalls 5 years ago this was a sticking point. Will they continue to carry the channel or provide service to the university? Answer: SFA has not discussed Channel 2 with the current provider. There has been no indication from the current provider regarding Channel 2. 14. Is there a pathway from the roof? Answer: rd The roof will have to be penetrated. Once done, there is a pathway from the 3 floor wiring closet to the Cold Room. 15. Is the University open to all IT solutions? Answer: Yes, SFA is open to all solutions including pros/cons. Answer: If a student is unable to access services provided by the University, a converter box is provided at no additional charge. Pricing for boxes as part of an upgrade is negotiated by the student directly with the vendor. 4. Does SFA share revenue with SuddenLink on Premium Programming? Answer: No. 5. Can the Existing Cable Company feed from the SFA Head End to the Cable Company Head End for Channel 2 be reused? Answer: Please refer to sections 2.3.4 and 2.3.5 of the RFP. 10. CH2 Originates in the Boynton Building, it appears to be modulated out. Where does that modulated signal go, and how does that get back to SuddenLink? Answer: The signal is carried over SFA owned fiber to the head end equipment in the Cold Room and is then carried to SuddenLink over vendor owned fiber. 11. Will SuddenLink still carry Channel 2 to the Community free of charge? Answer: As discussed in the pre-proposal meeting and as answered for question 13 of Addendum No. 1, SFA has not discussed Channel 2 with the current provider. 12. Does the Emergency Alert feed all of Nacogdoches or just the SFA Campus? Answer: The Emergency Alert feeds only SFASU 13. Where is the Rave Emergency Alert Equipment located? Answer: Rave has five (5) redundant sites which house the necessary servers and equipment to provide service to the University should a single or multiple sites go down as the result of an emergency. Answer: Yes, all rooms have a cat5 drop, though it is not reserved for IPTV. The network is laid out using star topology. 15. Do all TVs require a set top box or is a set top box only required for premium channels? Answer: All TV’s do not require converter boxes. If a valid TV connection is unable to receive services provided by the University a converter box is provided at no additional charge. Austin State University RFP #TVPROGSRV-2015 SECTION 1 INTRODUCTION 1.1 SCOPE OF PROPOSAL Stephen F. Austin State University, hereafter referred to as “SFA” or “the University”, is seeking proposals for television programming services. Proposers may submit a turn-key solution for all services or may propose to fulfill only parts; i.e., television programming delivery through existing coax, IPTV delivery through existing network, both, or other delivery methods. 1.2 AGREEMENT TERM The Agreement Term shall be from September 1, 2016 through August 31, 2021. The university reserves the right to renew the Agreement for five (5) additional 1-year periods, subject to mutual agreement of both parties. Contracted rates will be negotiated annually in January to be effective the following August 1 of each year. Annual increases shall never exceed the annual rate of increase proposed in Exhibit C. 1.3 RESPONDENT QUALIFICATIONS Each Respondent must include information that clearly indicates the Respondent meets each of the following minimum qualification requirements: a. Respondents shall be authorized by law and regulatory authorities, where applicable, to provide television programming services in the State of Texas. b. Respondent must have minimum five years’ experience in installing and maintaining the proposed system or service. c. Respondent shall ensure that agents, distributors and partners responding to this RFP are be authorized by the underlying manufacturer to sell and support the systems and/or services being proposed. 1.4 SFA INFORMATION 1.4.1 SFA is an institution of higher education operated as an agency of the State of Texas. SFA employs approximately 1600 full and part-time faculty and staff members. SFA had an enrollment of 12,801 full and part-time students during the fall 2014 semester. Most staff positions are based on a 12-month appointment coinciding with the fiscal year (9/1-8/31). Contracts are executed only for faculty members, and limited other appointments. A ninemember Board of Regents is appointed by the governor of Texas, with each regent serving staggered six-year terms. 1.4.2 Currently, television programming service is provided by the local cable television provider, Suddenlink. The current agreement expires August 31, 2016. SFA currently pays $5.75 per cable drop plus approximately 8% per drop for FCC fees and taxes. In addition, SFA TV-2 is transmitted to the community headend and broadcast to the local community at no cost to the university, and cable television services are provided at no cost to the SFA public Charter School th serving K-5 grades. SFA anticipates that these 2 services will continue at no charge due to SFA TV-2 being a public education channel, and the SFA Charter School being a public K-12 education entity. Austin State University RFP #TVPROGSRV-2015 1.4.3 All programming feeds into headend equipment in the Human Services/Telecommunications Building and is redistributed via broadband cable feed to the campus using fiber and coaxial trunk that runs underground in the conduit systems on campus. 1.4.4 The current contractor owns the fiber Node Distribution System to the Demarcation point in the Human Services/Telecommunications Building Cold Room, including the headend equipment. SFA owns the passive distribution system; i.e., fiber, coax, taps, hardline trunk, feeder cable, etc., behind the demarcation point. The current contractor owns the active distribution system; i.e., amplifiers, power supplies, receivers, transmitters, fiber nodes, etc. behind the demarcation point. 1.4.5 Exhibit G includes the following drawings and data: a. Campus Map b. Human Services/Telecommunication Building Drawing c. Current distribution system d. Building inventory 1.4.6 New headend equipment was installed by the current contractor in 2005. SFA took ownership of the existing coax cable in 2000. There are no other records as to when the existing cable television system was first installed. 1.4.7 Television programming service is distributed to the residence halls, university apartments, academic buildings and administrative buildings as well as the president’s house, all of which are located on the main campus. 1.4.8 The University currently has 3776 cable drops on campus in the locations identified in Exhibit E: 3509 – residence halls and apartments 239 – academic and athletic areas 25 – student center 3 – president’s house NOTE: In the Residence Halls, the drops equate to approximately 2441 service locations or student room doors (excludes common areas). In the other areas, the drops equate to approximately 70-75 service locations. NOTE: Three buildings currently receiving service, University Woods, Gibbs Hall and Todd Hall, are scheduled for demolition prior to 9/1/16. Two new building are in schedule for construction; information about the two new buildings is shown in Exhibit E. 1.4.9 Currently only the basic and expanded basic entertainment channels are provided to students. Students are required to contract directly with the contractor for upgraded services. The contractor will be permitted 2 weeks per year for on-campus solicitation (1 week each semester). For other areas of the campus the University purchases the basic and expanded channels, with the President’s House and Student Center receiving some optional premium channels. The services currently provided to the locations are shown on Exhibit E. 1.4.10 Some cable drops are in historical buildings, which are marked as such. 1.4.11 Current internet service is delivered by Stephen F. Austin State University. The Ethernet equipment and the cabling infrastructure is owned and managed by the University. 1.4.12 SFA TV-2 which is broadcast as channel 2 on the present cable system serving Nacogdoches is an extension of the University into the community. This educational access channel is operated by the Department of Mass Communication serving many purposes and constituencies. SFA TV2 originates in the Boynton Building on campus and is fed to the community headend of the local Page 4 of 25 Stephen F. The channel is used by students as an outlet for their work as they produce and showcase local programs of interest to the university, the community or both. In addition to publicizing campus events and showing the work of students studying television production, the channel has been used in recent years to provide information to the community about hurricanes and campus threats. 1.4.13 The University currently has the functionality to disconnect from the Contractor’s feed and substitute a feed from SFA to distribute over all channels to all SFA locations in the case of emergency. 1.4.14 SFA IT Tech Support currently maintains cold room connectivity and works with the contractor on feed adds and changes to the cold room or wiring closets. The SFA Physical Plant is responsible for wiring associated with new construction, adds and changes. Austin State University RFP #TVPROGSRV-2015 1.7.1 Each respondent is required to make a good faith effort to subcontract with historically underutilized businesses and shall submit a HUB Subcontracting Plan using the HUB Subcontracting Plan documents provided in Exhibit H. 1.7.2 Stephen F. Austin State University is committed to making a good faith effort to increase business with historically underutilized businesses (HUBs) by contracting with HUBs either directly or indirectly through subcontracting opportunities. Respondents are encouraged to actively seek to subcontract or partner with HUBs in an effort to create an environment that actively acknowledges and values diversity. 1.7.3 The University has determined that subcontracting opportunities are probable under this contract. 1.7.4 The University’s HUB goal for this procurement is: 26.0% for Other Services 1.7.5 Each HUB subcontracting plan will be evaluated independently of the response. If the HSP does not reflect a good faith effort to subcontract with HUBs, the entire response will be disqualified. 1.7.6 All questions regarding the HUB Subcontracting Plan may be directed to the Vendor Relations Manager, Manny Guerrero, 936-468-4529, guerreromg@sfasu.edu. Failure to submit the HUB Subcontracting Plan will disqualify the entire response from consideration. 1.8 PERFORMANCE BOND 1.8.1 A Performance Bond is to be provided by the awarded Contractor annually in the amount of 100% of the yearly agreement amount. This bond is to be made payable to SFA, is to be drawn on a surety authorized to do business in the State of Texas, and is to be on forms acceptable to the University. 1.8.2 The required bond is to be delivered to the SFA Purchasing Department within fourteen (14) days of finalizing the Agreement. Failure to submit the bond within the required timeframe will be considered breach of contract, and any contract awards, either verbal or in writing will be considered null and void. 1.9 INSURANCE REQUIREMENTS 1.9.1 The Contractor shall not commence work under this Agreement until he has obtained all the insurance required hereunder and certificates of such insurance have been filed with and reviewed by SFA. Acceptance of the insurance certificates by SFA shall not relieve or decrease the liability of the Contractor. 1.9.2 If policies are not written for the amounts specified below (except Worker’s Compensation and Employer’s Liability), Contractor shall carry Excess Liability insurance for any difference in amounts specified. If Excess Liability insurance is provided, it shall follow the form of primary policy. 1.9.3 This insurance shall not be canceled, limited in scope of coverage, or non-renewed until after thirty (30) days prior written notice, or ten (10) days for non-payment of premium, has been given to the University. 1.9.4 Contractor’s insurance shall be deemed primary with respect to any insurance carried by Stephen F. Austin State University for liability arising out of operations under this Agreement. Page 6 of 25 Stephen F. Austin State University RFP #TVPROGSRV-2015 1.9.5 Stephen F. Austin State University, its officials, directors, employees, representatives and volunteers shall be named as additional insured. This is not applicable to the workers’ compensation policy. 1.9.6 The workers’ compensation and employers’ liability policy will provide a waiver of subrogation in favor of the University. 1.9.7 The workers’ compensation insurance coverage must include the responsibility of the Contractor to provide coverage for every worker either under the Contractor’s policy or under the policy provided by a subcontractor. The Contractor’s policy shall provide that, in the event that a subcontractor’s policy fails to provide worker’s compensation coverage of a worker, that such insurance coverage is provided by the Contractor’s policy. 1.9.8 Unless otherwise provided for herein, the Contractor shall provide and maintain, until the Work covered in this Agreement is completed and accepted by SFA, the minimum insurance coverage as follows: TYPE OF COVERAGE LIMITS OF LIABILITY a. Comprehensive Automobile Liability $1,000,000 combined single limit Page 7 of 25 Stephen F. Austin State University RFP #TVPROGSRV-2015 SECTION 2 STATEMENT OF WORK 2.1 SCOPE OF WORK 2.1.1 Stephen F. Austin State University, hereafter referred to as “SFA” or “the University”, is seeking proposals for television programming services and the delivery of SFA TV-2 to the campus and the local community. The University is open to consideration of all options available to deliver television programming services to the campus community, including single or combined solutions using direct broadcast satellite, cable, or any other available option. 2.1.2 In addition the university wants to consider options for IPTV delivery of the television programming signal provided above, utilizing the existing campus network. The university anticipates considering IPTV in addition to a coax drop, but reserves the right to implement IPTV only in some areas. Digital IPTV content should be viewable on personal computers, mobile devices and TV where possible. This “live” TV content delivered via IPTV may be supplemented with other services including, but not limited to, DVR (digital video recorder) recording/time shifting capabilities, Video on Demand (VoD) or other capabilities. 2.1.3 If required, the most desirable location for a satellite would be the roof of the Human Services/Telecommunications Building where the headend equipment is located. However, should it be necessary, the Contractor would be responsible for the penetration under the guidance and direction of the Physical Plant. Contractor shall be responsible for an engineered solution approved by the Physical Plant, and all work must be completed by an approved roofing contractor. There would be no roof or chase access fees associated with this location. A pdf drawing of the Human Services/Telecommunications Building is attached in Exhibit G. 2.1.4 Television programming services shall be distributed to all residence halls, university apartments, president’s home, academic buildings, and administrative buildings identified in Exhibit E. Locations or services may be added or dropped throughout the term of the agreement at the rates in effect at the time of the change. 2.1.5 Although the university desires to enter into a 5-year agreement, the Contractor shall consult with the university year by year to determine what services best meet the needs of the university in terms of both service and price; i.e., using more IPTV and dropping coax; pick and choose coax drops to be utilized and paid for during peak and non-peak use; implementing new technology that becomes available, etc. 2.1.6 SFA has some locations not currently receiving service that may desire service in the future. These locations are listed in Exhibit E. 2.1.7 Each Respondent is encouraged to propose options offering the maximum benefit to the University in terms of services to the University and total overall cost to the University. 2.1.8 Identify options related to being able to disconnect from the Contractor’s feed and substitute a feed from SFA to distribute over all channels to all SFA locations in the case of emergency. The message would originate from the University Police Department campus emergency notification system. This message needs to have the ability to be updated and removed with slight to no delay by the SFA Police Department without interference from the cable provider. The message may be in the form of a banner overlay at the top or bottom of the television screen or it may replace the entire channel. The alert needs to work as much as possible similar to the EAS Emergency Alert System required by all television systems to have in place by the FCC. This includes both an auditory alert and the ability to place text on the screen. Currently, SFA Page 8 of 25 Stephen F. Austin State University RFP #TVPROGSRV-2015 contracts with Rave Mobile Safety for campus emergency notification and this is where the message would originate from through a CAP protocol. 2.1.9 It is the desire of the University to have all equipment and the programming feed in place, tested and accepted on or before August 1, 2016* so that SFA can be in full operation with service redistribution on August 15, 2016*. In order to meet this deadline, we anticipate an agreement date no later than March 31, 2016*. *Dates are subject to change. 2.1.10 Respondents are encouraged to include value added programs, service options and/or discounts that can be offered to students living off-campus and to university employees. 2.1.11 The University desires that proposals include value added programs such as scholarships, internships, etc. that promote the academic mission of the University. The university’s mission statement can be found at http://www.sfasu.edu/strategicplan/. 2.1.12 Any agreement negotiated as a result of this RFP shall not be considered exclusive. 2.2 PRICING 2.2.1 Proposed pricing shall be all-inclusive for hardware, software, licenses, training, travel and lodging, etc. necessary to implement, provide and maintain uninterrupted service. However, the University makes no commitment to purchase any minimum or maximum quantity or dollar volume of services from the selected supplier. Service locations may be added, dropped or changed at any time during the Agreement Term. 2.2.2 Proposed pricing should consider that on an annual basis the residence hall space is only occupied 75% of the year. Respondents may offer pricing options to reflect this occupancy rate, or the university is interested in considering options to turn service on and off at specified locations during peak/non-peak use. 2.2.3 No payment for services will begin until September 30, 2016 or until final acceptance has been made by the University representative identified in Paragraphs 2.3.7 and 2.5.1, whichever is later. 2.2.4 Responses must include a detailed channel listing and applicable pricing, including any pricing options to reduce or expand channel lineups and including bundling of channels or services. 2.2.5 SFA TV-2 qualifies as a public education channel. Any cost associated with sending the signal to the local cable provider for rebroadcasting the SFA channel to the local community must be itemized along with the legal cite allowing for such cost. It is the Respondent’s responsibility to contact the local cable provider to determine if any costs apply. 2.2.6 The SFA Charter School is a K-12 public education school. Any cost associated with providing services for the Charter School must be itemized along with the legal cites allowing for such cost. 2.2.7 Respondents are encouraged to offer a variety of payment options that represent the best value to the University, including but not limited to annual, monthly, semester, quarterly, early payment discount, etc. 2.3 EQUIPMENT 2.3.1 The Contractor shall provide all equipment necessary; i.e., receivers, modulators, amplifiers, mux, etc., to provide a functioning system. Austin State University RFP #TVPROGSRV-2015 2.3.2 It shall be the Respondent’s responsibility to identify sites where equipment and/or cabling may be located, and to ensure that sufficient space exists for such equipment and/or cabling. A university representative from Telecommunications and Networking must approve all locations. 2.3.3 Respondents shall ensure that the proposed system will work with the existing infrastructure that belongs to the University or shall be prepared to demonstrate how the proposed system will provide equal or better service without using the existing infrastructure. 2.3.4 Contractor shall design, furnish, install, align and certify the headend portion of the proposed system that interconnects the programming portion of the system to SFA’s distribution portion of the system. 2.3.5 Respondent shall provide detailed information, drawings, and specifications for the headend design including equipment manufacturer, model numbers, protocols, standards, and interfaces. Detailed information and specifications shall be provided for all other equipment including the protocols, standards used, and interfaces. 2.3.6 Contractor shall provide all labor, tools, materials, insurance and incidentals necessary to install all required equipment; i.e., antennas, cabling, receivers, modulators, amplifiers, etc. for this project. Installation shall include, but is not limited to, F.O.B. destination, unloading, uncrating, setting in place, completing hook-ups and interfaces, etc. Any and all trash, containers, etc., are to be removed from campus by the Contractor and properly disposed. 2.3.7 The Contractor shall provide for 3 party testing of all equipment to ensure compliance with the specifications. Such testing shall be supervised by a University Representative and shall include, but not be limited to, feeds into and out of headend equipment, feeds associated with SFA TV-2, etc. Acceptance testing, any modifications and any additional re-testing is to be completed in time to meet the required contract start. If any discrepancies are found with the initial acceptance testing the Contractor will be notified of the discrepancy. The Contractor will then have 10 calendar days to rectify the problem. The Contractor and University Representative from ITS shall then repeat the acceptance testing. Please note that the wiring in place does not have to be validated. 2.3.8 During the first year of the agreement, Contractor shall update that distribution system map, Exhibit G, at no cost to the University, noting ownership of distribution as either Contractor or Stephen F. Austin State University, including those behind the demarcation point in the Human Services/Telecommunications Building. The mapping will not include inside wiring. The map must be provided as a CADD document. This “distribution map” shall be considered a work-forhire and become the property of Stephen F. Austin State University. 2.4 PROGRAMMING/SIGNAL 2.4.1 The Contractor is expected to provide uninterrupted, high quality, industry standard programming during the term of the agreement. 2.4.2 HD signal is not required in the residence halls at this time; however, it is highly desired in other locations of the campus. 2.4.3 Each channel will be capable of generating mono or stereo audio as provided by the service provider. rd Page 10 of 25 Stephen F. Austin State University RFP #TVPROGSRV-2015 2.4.4 The current channel line-up is shown in Exhibit F and is provided only as a reference. Please provide a proposed channel lineup that reflects SFA’s interest in providing a diverse education experience as well as providing the best in entertainment for our culturally diverse student body. 2.4.5 Any agreement negotiated shall not prohibit SFA from utilizing SFA TV-2 for programming by the Division of Mass Communications including the ability to redistribute such a signal 24/7 to the community through the local cable television provider. SFA desires to consider options to broadcast SFA TV-2 on campus. In addition, SFA shall not be prohibited from distributing the programming on SFA TV-2 on social media platforms. 2.4.6 Contractor shall deal directly with students for any service upgrades. No additional services such as broadband internet service, telephony (Voice over IP), or other services other than additional or upgraded television programming will be marketed to or be made available to the on-campus residence halls during the length of the agreement unless expressly approved by Stephen F. Austin State University. 2.4.7 IPTV must allow transmission of channels as unicast signals over Wi-Fi. 2.4.8 It is desirable for the IPTV service to authenticate and authorize using single sign-on or an authentication system that SFA can validate. 2.5 MAINTENANCE/SERVICE 2.5.1 SFA expects a 24/7 help desk solution. 2.5.2 Notwithstanding such testing and acceptance described in 2.3.7, any discrepancies in acceptable levels of service found or discovered during the term of the agreement shall be fixed, repaired, or replaced at the Contractor’s sole cost. 2.5.3 Contractor shall provide on-site personnel for maintenance, troubleshooting, etc. the first two weeks of each fall and spring semester during the term of the agreement. On-site personnel shall coordinate locations and services performed with a representative from Residence Life Operations. 2.5.4 The University wants to consider various options for maintenance, new installs, moves and changes. This may include, but is not limited to, new building installations, new outlets for service, moving existing outlets for service, repairing and maintaining SFA’s owned inside wiring, and activating/deactivating outlets for service. Options may be presented in various ways such as time and materials, monthly or annual fees, etc. 2.5.5 In addition, the university wants to consider options for the Contractor to maintain a current list of all outlets and services provided. Such list must be verified annually by each university department. Page 11 of 25 Stephen F. Austin State University RFP #TVPROGSRV-2015 SECTION 3 INSTRUCTIONS TO RESPONDENTS 3.1 MANDATORY PRE-PROPOSAL CONFERENCE 3.1.1 A MANDATORY pre-proposal conference and site visit is scheduled for 10:00am, Tuesday, January 5, 2016 in the Human Services/Telecommunications Building, Room 101, 2100 Raguet St. North, Nacogdoches, Texas on the campus of Stephen F. Austin State University. A site visit of the Human Services/Telecommunications Building Cold Room is scheduled after the preproposal meeting. 3.1.2 Failure to attend the pre-proposal conference and site visit will forfeit consideration of the Respondent’s response. 3.1.3 If needed, January 6 and 7, 2016 have been set aside to provide Respondents access to the various buildings currently receiving cable television services. Respondents should meet in the Physical Plant Conference Room at 8:30am, Wednesday, January 6. SFA representatives will conduct a tour of representative buildings. At the end of the day, the group will return to the Physical Plant Conference Room to discuss additional needs of the group. Thursday, January 7, respondents will meet in the Physical Plant Conference Room at 8:30am. A tour of buildings will continue as needed. Confirmation of facsimile or email responses is recommended but not required. 3.4.7 Proposals may be withdrawn at any time prior to the time and date set for proposal closing. 3.4.8 Stephen F. Austin State University reserves the right to accept or reject any or all proposals and to waive irregularities or technicalities provided such waiver does not substantially change the offer or provide a competitive advantage to any Respondent in the judgment of Stephen F. Austin State University. 3.5 PROPOSAL VALIDITY PERIOD Each proposal shall remain valid for the University’s acceptance for a minimum of one hundred, twenty (120) days after the Submittal Deadline, to allow time for evaluation, selection, and any unforeseen delays. 3.6 SUBMITTAL INSTRUCTIONS 3.6.1 All proposals must be submitted in the format prescribed in Section 3.9. 3.6.2 Each Respondent must submit at least one original proposal with original signatures on the Execution of Offer and Form of Proposal and seven (7) complete copies. 3.6.3 All proposals must be complete and convey all of the information requested to be considered responsive. If the proposal fails to conform to the essential requirements of the RFP, SFA alone Page 13 of 25 Stephen F. Austin State University RFP #TVPROGSRV-2015 will determine whether the variance is significant enough to consider the proposal susceptible to being made acceptable and therefore a candidate for further consideration, or not susceptible to being made acceptable and therefore not considered for award. 3.6.4 Each respondent, by submitting a proposal, represents that the respondent has read and completely understands the request for proposal documents and agrees to abide by the terms of this RFP and any resulting agreement. Failure of the selected contractor to fulfill the provisions of this request for proposal shall in no way relieve the obligation of the Contractor to furnish all services necessary to carry out the provisions of the agreement. 3.6.5 Proposals shall be signed by a legally authorized representative of the Respondent. Unsigned proposals (Exhibit A) will be rejected as a material failure. 3.7 ACCEPTANCE AND FORMATION OF AGREEMENT 3.7.1 The award of this Request For Proposal will be based on the best value to the University. The primary recipients of the services are students; therefore, the services must meet a high standard of quality. The University will be the sole judge of determining which proposal represents the best value to the University. 3.7.2 No recommendation for award will be made until Stephen F. Austin State University is fully satisfied that the Respondent is professionally competent and properly equipped to render the specified television programming service. 3.7.3 If terms of the Agreement cannot be agreed upon within 30 calendar days from the date a notice of award is issued, the University reserves the right to begin negotiations with the next successful respondent. 3.7.4 SFA reserves the right to enter into an agreement not based only on the cost to the University, but which, in the sole opinion of SFA, is deemed to represent the best value to SFA. 3.8 EVALUATION CRITERIA 3.8.1 Award will be based on a two-step evaluation process and negotiation of the proposal that best meets the needs of the University. Submission of a proposal represents concurrence with this method of evaluation and award. Furthermore, Respondents will not, under any circumstances, dispute any award made using this method. 3.8.2 Evaluation of the proposals will be performed by an evaluation committee representing Stephen F. Austin State University. A short list selection will be based on a comprehensive review and analysis based on a weighted value of averaged evaluation scores based on the short list evaluation criteria listed below in Section 3.8.4. Award will be made from the selected short list respondents based on the award evaluation criteria listed below in Section 3.8.5 The University reserves the right to request presentations and/or a Best and Final Offer from short-listed Respondents for consideration in the award evaluation criteria. Submission of a proposal represents concurrence with this method of evaluation and award. 3.8.3 Notwithstanding, the University reserves the right to further negotiate, after proposals are opened, with any Respondent that submits a proposal. SFA may award a contract(s) based on initial proposals received without any discussion of such proposals. Therefore, each proposal should be submitted on the most favorable and complete price and terms possible. 3.8.4 Short List Evaluation Criteria Page 14 of 25 Stephen F. Austin State University 3.8.5 RFP #TVPROGSRV-2015 a. 50% - Total anticipated 5-year cost including, but not limited to, the University’s cost, any perceived hidden or soft costs to the University, programming and maintenance costs, any additional costs to maintain the educational programming for the Division of Mass Communications, any costs to maintain integration with the university’s emergency warning system, and any optional costs selected by the university; b. 10% - Respondent’s experience, financial stability and resources for handling this project, and whether Respondent is in compliance with paragraph 1.3; c. 15% - Channel lineup; d. 5% - Timeliness of project implementation and required involvement of SFA personnel; e. 15% - Integration capabilities and equipment including, but not limited to, the type of solution proposed, the impact to the University in terms of aesthetic appeal of the solution, acceptance of the solution by the students, on-going requirements involving SFA personnel, etc.; f. 5% - Maintenance options as described in paragraphs 2.5.4 and 2.5.5. Award Evaluation Criteria a. 40% - All Costs for the initial 5-year period, including, but not limited to, any upgrade costs available to the university and students, and maintenance options; b. 20% - Integration capabilities and equipment including, but not limited to, the type of solution proposed, the impact to the University in terms of aesthetic appeal of the solution, acceptance of the solution by the students, on-going requirements involving SFA personnel, etc.; c. 20% - Value Added programs that support the mission of the University, and that may provide benefit to off-campus students and University employees; d. 20% - Options to distribute the educational programming provided by the Division of Mass Communications on campus. 3.9 PROPOSAL FORMAT 3.9.1 Proposals shall be prepared in a straightforward and concise manner, identifying clearly and concisely any deviations, enhancements and other differences that exist between the RFP and the respondent’s proposed services. Emphasis should be placed on responsiveness to the RFP requirements, completeness and clarity of content and conformance to the RFP instructions. Respondents shall organize their proposal in a point-by-point format according to Section 3.9.2. Failure to follow point-by-point presentation could be grounds for disqualification. 3.9.2 Proposal shall include the following information and be submitted in the following order: a. Company Profile to include the names of individuals that would be assigned to SFA's account, their experience, certifications and qualifications. Please identify these main contacts for the areas of technical assistance, hardware assistance, and accounting/billing assistance; ii. A brief history of the firm including information that supports the required qualifications outlined in Paragraph 1.3; iii. Describe all past or pending litigation or claims filed against Respondent that would affect its performance under an agreement with the University, if any. iv. Provide a list of no more than five (5) University/College organizations for which Respondent currently provides television programming services. At a minimum, include entity name, contact name, address, telephone number and e-mail address; v. Provide a list of no more than five (5) University/College accounts cancelled or terminated in the previous 24 months. At a minimum, include entity name, contact name, telephone number, email address and reason for termination; vi. Provide Respondent's standard form of agreement, including all terms and conditions. Presentations/Best and Final Offer Short-listed Respondents may be asked to make a presentation or submit a Best and Final Offer for consideration in Step 2, Award Evaluation Criteria. If required, the shortlisted respondents will be notified of the date and time for either presentations or a Best and Final Offer or both. The university reserves the right to work through the Step 1 and Step 2 evaluation criteria and make an award based on the initial proposals received without any discussion of such proposals. Stephen F. Austin State University reserves the right to check references prior to award. Any negative responses received may be grounds for disqualification of the bid. SFA reserves the right to enter into an agreement not based only on lowest cost to the University, but which, in the sole opinion of SFA, is deemed to represent the best value to SFA. Confirm that service to the SFA Charter School will remain at no charge, or provide the legal cite allowing for the charge. 13. Describe options for providing television programming service to the locations identified in Exhibit E that are currently not served. 14. Rev. 09/15 HUB Subcontracting Plan (HSP) In accordance with Texas Gov’t Code §2161.252, the contracting agency has determined that subcontracting opportunities are probable under this contract.
