INCLUSION OF BO-KAAP & SCHOTCHEKLOOF INTO A HERITAGE PROTECTION OVERLAY ZONE The City of Cape Town Municipal Planning By-Law (2015) (MPBL) was enacted by the City of Cape Town from 1 July 2015. Included in this By-Law is the concept of overlay zonings. This provides a mechanism to designate either citywide or localised development management rules to deal with specific concerns, over and above the provisions of a base zoning. One such overlay zoning that already exists is the Heritage Protection Overlay Zoning (HPO). In terms of Schedule 3 of the MPBL in Chapter 20 (item 163): The HPO provides a mechanism for the protection of heritage places the City considers to be conservation-worthy in terms of its heritage strategies. The HPO enables the designation of such heritage places and heritage areas on the zoning map. The Cape Town Heritage Strategy (2005) (approved by the Executive Mayor and members of the Mayoral Committee 19/10/2005) is the policy and framework for the management and protection of the cultural heritage resources of the City of Cape Town. The key cultural heritage objective of this strategy is the identification, assessment, conservation, management and enhancement of the heritage resources, structures and landscapes of all the people of Cape Town and to ensure that the memories and values associated with such resources are appropriately represented. It is proposed to include all the properties indicated on the map below into the HPO. The broad implication of this will be to permit the City to approve any land use application as a consent in terms of item 161(1) that the City determines to be appropriate to provide the owner of land with an incentive to preserve the heritage resource. Development rules in terms of the HPO may be either more or less restrictive than the base zone development rules. The City may be required to give its approval for alterations affecting any structure, demolition and alteration to historical landscape or landscape feature.
