Sultan Road, Peshawar Cantonment is held on lease in Schedule VIII of the CLA Rules, 1937
for commercial purpose by Mr. Abdus Salam. Mr. Abdus Salam sold the said Shop to M/S
Ajmal Khan, Taza Gul, Farhad Khan & Muhammad Arif Ss/o Umer Gul by way sale vide
registered sale deed No. 27, Bahi No. I, volume No. 45 dated 07-01-2014. Now M/S Ajmal
Khan & others applied for mutation/transfer in respect of the subject property in their
names. Proclamation notices were published in “Daily Pakistan, Peshawar” and “Daily
Akhbar”, Peshawar“ both dated 04-06-2014 for inviting objections but no one has objected to
the proposed transfer/mutation of above mentioned property.

As per GLR, House No. 1356/B, Survey No. 542/1642, situated at Tipu Sultan Road,
Peshawar Cantonment held on Old Grant terms for residential purposes by M/S K. Abdul
Wali Khan & K. Abdul Ghani Khan.
Mr. K. Abdul Ghani Khan S/o Qazi Muhammad Khan surrendered his share in the subject
property to his real brother Mr. K. Abdul Wali Khan vide Affidavit/Declaration dated 06-061952 duly notarized.
After the expiry of Mr. K. Abdul Wali Khan subject property inherited by his legal heirs M/S
Qazi Ahmed Khan, Qazi Muhammad Anwar Khan & Mst. Shaheen Qazi Ss & D/o Late K.
Abdul Wali Khan. Qazi Ahmed Khan also reported to have died leaving behind Mst. Ruqia
Begum as her only legal heir. Remaining legal heirs of K. Abdul Wali Khan (Qazi
Muhammad Anwar Khan & Mst. Shaheen Qazi) sold their share in the subject property to
Mst. Ruqia Begum D/o Qazi Ahmed Khan vide registered sale deed document No. 513,
Volume No. 1293, pages 154-156 dated 09-03-1978.

Mst. Ruqia Begum also reported to have died on 10-07-1996. After her expiry his son Syed
Khalid Masood Bukhari vide his application alongwith Affidavit/Declaration dated 15-092012 applied for mutation/transfer of the subject property in his name. Proclamation Notices
also got published in Daily “Akhbar” and Daily “Pakistan” dated 21-06-2014 for inviting
objection, but no objection till date received to this office.

It is submitted that House No. 89/11/12(Ground Floor+1st Floor) Survey No. 573, held on lease in
Schedule VIII of the CLA, Rules, 1937 was held by evacuee in the record of this office. The same
was allotted to Mst. Fatima Begum & Mst. Gulzar Begum Wd & D/o Rasool Bhai Fangat vide
PTO No. 325159 dated 31-01-1963. Mst. Fatima Begum & Mst. Gulzar Begum sold the Ground
Floor of property No. 89/11/12 to Mirza Afzal Baig S/o Mirza Saeed Baig vide sale deed
registered as document No. 1650, Bahi No. I, volume No. 1139 dated 03-10-1969 & No. 823, Bahi
No. I, volume No. 297, dated 18-04-1978. The same was mutated in the name of Mirza Afzal Baig
S/o Mirza Saeed Baig & he got renewed the lease for a term of 30 years w.e.f. 14-01-1966 &
further 30 years w.e.f. 14-01-1996 & registered vide deed No. 2312, Bahi No. I, volume No. 1732
dated 08-07-1999. Mst. Fatima Begum was reported to have died on 13-01-1997 & her daughter
Mst. Gulzar Begum applied for transfer/mutation in her name of 1st Floor of the property No.
89/11/12 vide application dated 28-01-2000 alongwith Affidavit/Declaration dated 26-11-1998.
Proclamation Notices were got published in Daily Aaj Peshawar dated 04-10-2000 but could not
process further. Mst. Gulzar Begum is also reported to have died on 01-10-2002 & following

persons claimed to be her legal heirs vide Affidavit/Declaration dated 20-06-2011:

through attorney Mr. Mushtaq Ali Shah also submitted affidavit/Declaration dated 22-04-2014
regarding to be demolished the un-authorized construction carried out by them. In this
connection, ML&C Deptt: GHQ Rwp, letter No. 18/10/L/DS/C-67/1823-L dated 26-08-1971
guided that as per condition 1(8) of lease in Schedule VIII of the CLA Rules, 1937 (condition 1(6)
of the CLA Rules, 1925) the Govt: has recognized the rights of the lessee regarding transfer of the
property as whole or any part thereof. It is his statutory right and cannot be withheld with other
issues. Proclamation notices were published in “Daily Pakistan”, Peshawar “Daily Khyber”,
Peshawar” each dated 10-05-2014 for inviting objections but no one has objected to the proposed
transfer/mutation of above mentioned shop.

sold their shares or otherwise. In response the applicant vide Affidavit dated 03-12-2013 duly
attested from Oath Commissioner, Peshawar stated that all the legal heirs sold their shares,
and there is no legal heirs except them. Proclamation Notices got published in daily
“Pakistan” and daily “Akhbar” both dated 14-02-2014 & 15-02-2014 respectively for inviting
objection, but no one has objected to the proposed mutation/transfer of the subject

To consider application dated 28-8-2014 submitted by Mr. Muhammad Pervaiz
Akhtar requesting for execution of lease deed & withdrawal of action regarding
composition of un-authorized construction.
In this connection it is stated that the subject properties are held on Old Grant
Terms for commercial purposes in the name of Mr. Muhammad Pervaiz Akhtar in
this office record. The grantee applied for merger & conversion of Old Grant rights
into regular lease in Sch: IX-C of the CLA Rules, 1937 for commercial purposes.
The staff reported that no approved building plan is in the record. The same was
approved by the Board & a proposal was sent to RHQ Peshawar for approval of
merger & conversion. The same was sanctioned vide RHQ Peshawar letter
No.20/1120/DPR dated 20-5-2014 & conveyed to the grantee vide letter
No.6/908/lands/33363 dated 22-5-2014 for deposit of premium etc and vide para
2(viii) of above said letter also directed to submit building plan for composition.
In response the grantee vide application dated 28-8-2014 submitted site line plan
duly issued by the Settlement Deptt:. As per site the subject property is as per said
site plan and the original copy of the same is also placed in file at page No.1.
Moreover, as per General Land Register the subject properties & balakhana also
exists which cannot be considered as un-authorized, moreover, the same was
allotted to applicants by the Settlement Deptt: accordingly.
All relevant papers are placed on the table for Board’s consideration.

Considered. The Board allowed the withdrawl of action regarding composition of
unauthorized construction owing to the availability of site / line plan duly issued
