Exhibitors can only enter the CIEC by showing their Exhibitor Badges. Badge holders must pass in and out of entrances through the ticket checker; otherwise no entry is possible. These contractors work with their local equivalent and pay commissions or taxes as required to the halls, Association or Government as notified. 2.3 Visitor Ticket According to the regulations of the CIEC, visitors can only enter the CIEC by means of a pass. Those without them can obtain visitor passes by showing their business card at the ticket office. OUTSIDE STAND CONTRACTOR In some circumstances it is possible for two or three supervisors from another contracting firm in the field of stand fitting to be admitted but they must employ local labor provided by the authorities and requisitioned through the Official Contractor. Pass holders must enter and exit through the ticket checker; otherwise no re-entry is possible. If an exhibitor or national group employs another such contractor, he is personally responsible for applying for prior approval, Construction Passes and paying the construction & power administration fee levied by CIEC. No responsibility will be accepted by the organizers unless the official appointed contractor is employed. Due to the strict arrangement of working hours in CIEC, Exhibitors who, for any reason, require overtime work in the exhibition hall should be aware that additional charges will be incurred. 2.1.3 At least a 3 meters wide aisle or passageway between rows of stands is required. 2.1.4 All stand contractors, other than the appointed Official Contractor, must fax their construction plans to the Construction Administration Office, CIEC and circuit diagram & total power requirements to the Power Administration Office, CIEC. Moreover they must settle the on-site construction management fee directly to Construction Administration Office and power supplying and management fee directly to Power Administration Office before they move in. All exhibitors must adhere to these rules to ensure smooth operations on site. All overtime applications should be submitted before 15:30 of the same day. All the overtime charges are required to be settled by the applicants on-site at the exhibit producer reception, in the lobby between Hall 2 and Hall 3. The maximum permitted volume is 70db. Singing and dancing performances are forbidden. The Exhibitors shall bear the responsibility for any and all consequences arising . The price for overtime work: 17:00 - 24:00 RMB 2,500 per hour 00:00 - 08:30 RMB 5,000 per hour 2.9 Force Majeure 2.5 Liabilities and Insurance The exhibition may be postponed, shortened or extended due to any cause whatsoever beyond the control of the Organizers. The Organizers shall not be responsible for any loss sustained by the exhibitors directly or indirectly attributable to the elements or nature or Force Majeure including orders or directives imposed by any governmental authority. In the event of such circumstances, the money paid by the exhibitors is refundable at the sole discretion of the Organizers. The Organizers will not accept liability for loss of, or damage to, any exhibits at any time. Exhibitors are advised to insure their exhibits against theft, loss or damage, including the risk of fire, throughout the exhibition, including building up and dismantling periods. 2.6 Fire Precautions Use of any materials likely to cause ignition or combustion is strictly prohibited. Exhibitors are responsible for keeping all such materials out of the exhibition premises. Exhibitors who, because of the nature of their exhibits, require a special type of fire extinguisher, must make arrangements at their own cost for the provision of such equipment. 2.10 Authority on Premises The Organizers shall be responsible for and be entitled to act as the owner of the premises during the exhibition, including build up and dismantling periods. Any person who knows of an outbreak of fire, however slight, must take immediate action to use the fire alarm system, and subsequently use every endeavor to extinguish the fire or to confine it by the use of extinguishers and/or removal of goods in the vicinity. 2.11 Demonstrations and Working Exhibits An exhibitor intending to demonstrate equipment on his stand must: 2.7 Censorship 2.13.1 Provide the Organizers with full details in writing of any working exhibits involved. Exhibitors can take the bus in front of Hall 4 (CIEC) everyday after closing by showing their badge or other valid documents to staff. 2.12 Hall Damage Exhibitors are responsible for the cost of making good, restoring or renewing in all cases of damage to the exhibition premises or any part thereof, whether caused by themselves, their agents or contractors or by any person or persons employed or engaged on behalf of any such agent or contractor. Before construction the builders shall undergo the procedures of registration of their construction qualifications, construction blueprints for approval, etc. in accordance with the relevant rules and regulations of CIEC Group Corporation, and pay the related fees. Any booth contractor must obtain Passes before entering the exhibition center. These can be obtained by submitting the materials listed below to the Construction Management Office at least 7 days in advance: A “Responsibility Agreement for Construction Security” should be signed between the legal person of the booth construction contractor and the exhibitor. 3. The builders are responsible for safety and fire prevention in the construction sites and should appoint a person in charge of safety and fire prevention work. 8 Construction Guideline 4. The booth structure should be solidly and securely built. Before the building of two-storey booths or a booth with complex structures and the open-air booths, the construction units are required to provide a detailed plan of the structure of the booth bearing the stamp of approval by a recognized design institute with relevant qualifications and the stamp of a registered construction engineer at National Level 1 and an audit report. From design to construction the stand builders should take full account of Booth security, ensuring that all connections of the booth structures and the overall structure of the booth are secure. In the building of two-storey booths, fire extinguishers which have passed the annual inspection must be supplied. 10. Wind protection measures must be taken for outdoor booths to ensure the robustness and stability of the booth structures. 8. Booth structures in the exhibition hall shall not be allowed to block the fire facilities, electrical equipment, emergency exits or aisles. Floor structures must be within the boundaries of the booth and the structure edge should have a gentle slope leading to the aisles to prevent a step which might cause bodily harm. You must submit this form to Oriental-K-Trans without exception. Please use at least one page for each package of your exhibit. Try to make your declaration as detailed as possible, all items including catalogs, display materials, gifts must have exact quantity and bear a value. You will be fined if you put other things inside your case other than what you have declared. Souvenirs like clocks, watches and calculators are taxable in China. A relevant import license is required by the Customs as well, you are recommended not to send them to the exhibition. Other gift items may also be considered as taxable if their unit price is high or quantity is large. Starting from 1998, all alcohol and tobacco became taxable regardless of quantity, even if they are intended for self-consumption during the exhibition. When Taiwan or Hong Kong is to be mentioned on your catalogues or advertising materials, please avoid using any expression which may cause the Customs to misinterpret that they are in a position of an independent country. Shipment consists of wood packing material (WPM) should be treated with measures approved by the General Administration of Quality Supervision, Inspection and Quarantine of P. R. China (AQSIQ) and labeled with IPPC mark on two opposite sides of the wooden packing materials by manufactures certified by the plant quarantine authorities of exporting countries or regions. China Inspection and Quarantine (CIQ) authorities will inspect the WPM at the port of entry, any non-compliant WPM will be treated, destroyed or returned with the consignments together under supervision of CIQ. Original Fumigation Certificate is strictly required. If there is no wooden packing on the shipment, exhibitor/shipper should issue an original DECLARATION OF NON – WOOD PACKING MATERIAL. 4.6 Hand-carried Exhibits If you decide to hand-carry your exhibits to the show , please be prepared that your exhibits may be detained by the Customs at the airport .Should this happens ,please follow the below procedures in order us to assist you to clear your exhibits in a proper way: Customs will issue a detention receipt to you after they detain your exhibits. Please hand over this detention receipt together with your passport to our on-site representative as soon as possible. We will then arrange Customs formalities and pick up your exhibits from the airport. 23 Freight Guidelines A. Normally, Customs formalities take about 1-2 working days; we recommend you get the show earlier. Otherwise, we can’t guarantee to retrieve your exhibits from the airport before the opening. 4.9 Marking of the case Please ensure the following markings are printed on each case: B. Customs regulations state that all hand-carried exhibits should be returned overseas as a freight shipment. But if you decide to hand-carry them again when leaving China, Beijing airport is the only airport you can use. CBM 4.10 Customs Clearance in China The exhibition center is regarded as a Customs-bonded area. As the Official Freight Forwarder for the exhibition, we are responsible to the Customs for clearance of all the materials coming in and going out of the exhibition center. Thus you should not allow your exhibits to be taken away from the show site without prior arrangement with Customs through Oriental K-Trans Int’l logistics (Beijing) Co., Ltd. For all charges related to the above arrangements, please refer to point 6 of our REMARKS. 4.7 Heavy and Oversize Exhibits If you have heavy and oversize exhibits, you must be on-site early to direct the operation of uncrating and positioning. If a crane or forklift is required for installation of equipment, please send your requirements to us as early as possible so that we can arrange contracting such equipment in advance. A quote will be given after receiving your inquiry. 4.11 Uncrating and Recreating of Exhibits Oriental K-Trans Int’l logistics (Beijing) Co., Ltd. will provide labor and equipment to assist you in uncrating and positioning of exhibits. You must be onsite and available during move-in to supervise and be responsible for these operations since they will be performed at your own risk. In some circumstances, however, the Customs at the ports or fair site may inspect cases without you being present. 4.8 Packing Specifications Please note that as the exhibits are repeatedly loaded and unloaded, they must be professionally packed to suit long distance transportation. Measures must be taken to protect the exhibits against damage and adverse weather conditions. We suggest that all exhibits should be securely packed in sturdy waterproof crates suitable for return shipments after the exhibition. Cartons are not recommended, especially for valuable and fragile items. Oriental K-Trans Int’l logistics (Beijing) Co., Ltd. cannot be responsible for the consequences associated with improper packing. Exhibits exceeding the following limitations may cause difficulty in transportation, please consult us before shipping: During the exhibition closing, you should also supervise the dismantling and recrating of your exhibits. We suggest you to prepare fresh packing materials for your return exhibits because these materials are not available in China. Therefore you should make certain that all shipments are covered by a full comprehensive policy from the time of dispatch up to your booth, the duration of the show and for the return transportation after the show. Closing operations will commence after visitors leave the hall, Oriental K-Trans Int’l logistics (Beijing) Co., Ltd. will then start to return the empty cases to the booths, assist you in recreating and undergoing Customs formalities. 4.14 Return of Exhibits All exhibits which have not been sold, transferred to bonded warehouse, consumed, given away or abandoned must be returned overseas after closing of the exhibition. Customs formalities for returned exhibits take time, you must not expect your exhibits to be returned soon after the show finished. All return shipments, will only be arranged when all payments are received by us. 4.15 Payment We will fax our invoice to you and the original copy will be followed by mail, please make payment upon receipt. If shipments are under HAWB or HOBL and consignee of MAWB are not Daysun Express (Beijing) Ltd/ C/O: Oriental K-Trans Int’l Logistics (Beijing) Co., Ltd., the extra cost/freight forwarder’s warehouse will be debited to the exhibitor’s account. 2. For Cargo arriving beyond deadlines, a surcharge amounting to 30% of inbound movement charges and on-site service charges will be levied. If cargo arrives after exhibition opening, 50% surcharges will be added to respective handling charges. 3. All inbound shipment (sea or air freight) must be consigned as per our consignment instruction and on Freight Prepaid basis, otherwise we shall levy 5% commission on freight which we pay on your behalf to the local carrier. 4. Above rates apply for normal working day from Monday to Friday 08:30 a.m. to 12:00 noon; 13:30 to 17:00 p.m., an 80% surcharge will be added for working on Saturday, Sundays and Public Holidays in China. 5. The 80% surcharge, on top of the official tariff, for handling of dangerous cargo, will be charged to the exhibitor’s account if applicable. 6. Return exhibits can only be shipped out after the completion of Customs clearance, which normally takes 8 working days, counting from the first working day after the move-out operation is done, to finish. Should the exhibitor ask for priority or express services to accommodate its needs, 30% additional charge on top of the official tariff will be required to cover the extra effort spent, and the final decision is subject to the Customs’ approval. 7. Oriental K-Trans Int’l Logistics (Beijing) Co., Ltd. does not take any responsibility for a. Exhibits not permitted by the organizers or China Customs to be sold or displayed at fair site. b. Any tax/duty for sold exhibits or give away items. 5.7 CONDITIONS OF BUSINESS All business undertaken, including any advice, information or service provided whether gratuitously or not by ORIENTAL K-TRANS INT’L LOGISTICS (BEIJING) CO., LTD. (hereinafter called “ the Company”) is transacted to the Conditions hereinafter set out and each condition shall deemed to be incorporated in and to be a Condition of any agreement between the Company and its Customers. No agent or employee of the Company has the Company’s authority to after or vary these Conditions. Customers entering into transactions of any kind with the Company warrant that they are the owners or the authorized agents of the owners of any goods to which the transaction relates and further warrant that they are authorized to accept these conditions not only themselves but also as agents for and on behalf of all other persons who are or may thereafter become interested in the goods. The Company may sub-contract all or any part of the services except insofar as the Customer otherwise instructs the Company in writing. The company contracts for itself and as agent of and trustee for its employees and sub-contractors and their employees and any reference in these Conditions to “the Company” shall be deemed to include every such employee and sub-contractor. Subject to express instructions in writing given by the Customer, the Company reserves itself absolute discretion as to the means, route and procedure to be followed in the handling, storage, and transportation of goods. Further, if in the opinion of the Company it is at any stage necessary or desirable in the Customer’s interests to depart from those instructions, the Company shall be at liberty to do so. Pending forwarding or delivery, goods may be warehoused or otherwise held at any places at the sole discretion of the Company and the costs thereof shall be for the account of the Customer. 28 Freight Guideline No insurance will be effected except on instructions given by the Customer and all insurances effected by the Company are subject to the usual exceptions and conditions of the policies of insurance company or underwriters taking the risk. The Company shall only be responsible for any loss of or damage to goods or for any non delivery or miss-delivery if it is proved that the loss, damage, non delivery or miss-delivery occurred whilst the goods were in the actual custody of the Company and under its actual control and that such loss damage non-delivery or miss-delivery was due to the willful neglect or default of the Company or its own employees. The Company shall only be liable for any non-compliance or mis-compliance with instructions given to if it is proved that the same was caused by the willful neglect or default of the Company or its own employee. The Company shall not in any event be liable for any direct or indirect consequential loss howsoever, when so ever and where so ever arising and whether or not attributable to the negligent act or default of the Company. In no case whatsoever shall any liability of the Company howsoever arising and not withstanding any lack of explanation exceed the value of the relevant goods or a sum at the rate of USD$500 per 1000 kilos on the gross weight of the goods whichever is the less. In any event the Company shall be discharged from all liability for loss, damage or mis-delivery unless notice be received in writing within fourteen days after the end of the transit. All agreement between the Company and its Customers shall be governed by the laws of the People’s Republic of China. All disputes in connection with all agreement between the Company and its Customers or the execution thereof shall be settled through friendly negotiation. In case no settlement can be reached through negotiation, the case should be submitted for arbitration to the Foreign Trade Arbitration Commission of the China Council for the Promotion of International Trade, in accordance with the “Provisional Rules of Procedure of the Foreign Trade Arbitration Commission of the Council for the promotion of International Trade”. The arbitration shall take place in Beijing and the decision rendered by the said Commission shall be final and binding upon both parties; neither party shall seek recourse to a law court or authorities for revising the decision. The arbitration fee shall be borne by the losing part. Final power of interpretation to these Conditions shall belong to ORIENTAL K-TRANS INT’L LOGISTICS (BEIJING) CO., LTD.
