HANDBOOK FOR VENDORS
2014
1.
All Vendors must be members in good standing of the St. Andrews Farmers’ Market
Association.
2.
All persons selling at the Market agree to abide by the rules and regulations set out by
The Association.
3.
At the beginning of each season each vendor is responsible for filling out an application
with name, address and phone number as well as the products to be sold. Changes,
additions or one-time daily vendor applications may be temporarily approved by the
Market Manager, subject to final approval by the Executive.
4.
Anyone wishing to sell anything not listed below must contact the Market Manager for
prior approval.

5.
All goods sold at the Market must be locally grown, locally prepared or locally produced.
Locally is loosely interpreted as produced within 150 Km of St Andrews. Farmers may
sell only produce which they have grown. With the approval of the Market Manager or
designate, vendors may offer goods for sale that are produced in other areas of New
Brunswick but only when such goods will not adversely affect sales of locally produced
goods.
6.
Recognizing that the Market is a produce market, the sale of home-made articles or crafts
is also allowed, only as long as they do not interfere with the sale of produce and meet
with the approval of the Association.
7.
Vendors will not sell any flea market type items.
8.
Market Hours will be from 8:30 a.m. to 1:00 p.m. on Thursdays from late spring to early
fall, approximately 19 weeks.
9.
On holiday weekends and special events, longer hours and additional days may be
offered to participating vendors.
10.
Drive in vendors shall keep their vehicle(s) and goods within the bounds of the space
allocated.
11.
Vendors must be set up for business by the time the Market opens. Outside stall vendors
must be in position by 8 am. Inside vendors must not commence setting up their stall
before that time.

12.
Stalls, canopies, tables etc. must be secured and in place before the designated opening of
the Market to ensure the safety of customers.
13.
Vendors may start selling as soon as they are set up.
14.
Vendors are encouraged to post their names and addresses prominently on their stalls.
15.
No alcohol will be consumed at the Market.
16.
Smoking is prohibited by vendors within their stall and strongly discouraged within the
Market area.
17.
Radios, CD’s or other electronic sound generators are only permitted at the Market with
the use of personal earphones or with the approval of the Market Manager.
18.
No profanity, shouting or objectionable means of soliciting trade will be tolerated.
19.
Vendors must not regularly practice distress pricing or adversely affect the sales of other
vendors.
20.
No objectionable signage will be tolerated.
21.
No vendor or their staff under the influence of alcohol or illegal drugs will be allowed to
be present at any Market related functions.
22.
Every vendor shall be responsible for the condition of the space around their stall during
Market operation hours and shall leave the same in a condition as clean as when he
arrived.
23.
Vendors shall not block walkways or fire exits or other vendors’ stalls.
24.
Vendors must place their own refuse in a suitable container at their stall and remove it
when they leave.
25.
Vendors must place their own product-related refuse in a suitable container within their
stall and remove it when they leave. General garbage containers are for the use of
customers only.
26.
If, in the opinion of the Market Manager or designate, a space is not clean, the Market
Manager or designate may have the space cleaned and bill the vendor.
27.
Compliance with Provincial Harmonized Sales Tax Regulations, including collection and
reporting, is the responsibility of the vendor.
28.
Vendors are responsible for adhering to any required regulations in the production and
sale of their goods.
29.
Live animals must be confined and kept separate from any food.
30.
Prompt and proper disposal of animal waste is compulsory.
31.
No person shall display, sell or offer for sale any kind of food that cannot conveniently be
washed, unless the food is covered for protection from flies, dust, vermin and other
contamination.
32.
Only clean wrapping paper shall be used for wrapping meat, fish and cheese sold at the
Market.

33.
At least one person at each food vending booth must have participated at least a food
handling course within the past five years.
34.
An annual association fee must be paid before any other fee. Seasonal fees must be paid
by cheque, or cash, at, or within 7 days of, the AGM unless prior arrangements have been
made. Monthly fees to be paid in advance or on first day of attendance. All daily
vendors must pay in cash upon arrival, or when requested during that Market. The
vendor’s right to operate at the Market shall be for the periods stated on the receipt issued
at the beginning of the term. The receipt marked paid will constitute the permit to
operate at the Market.
The Annual Association fee which must be paid by ALL vendors is $20.

Fees will be reviewed annually and may be subject to change.
35.
Vendor spaces shall be allocated by the Executive or its designate as follows:
Space will be reserved for paid up members only.
Renewing seasonal vendors have the undisputed choice of the stall they occupied the
previous season.
Monthly and daily vendors will be assigned a stall by the Market Manager and will be
allowed to keep the same space if at all possible.
36.
Children, 14 years and under, are exempt from membership fees but are subject to regular
stall fees.
37.
If a seasonal or monthly vendor has not notified the Market Manager of a late arrival and
is not present by 9:00 a.m., the stall may be assigned to a daily vendor.
38.
If a seasonal or monthly vendor does not show up for two consecutive Market dates
without informing the Market Manager in advance in writing, the vendor may have to
forfeit their designated space(s) and any fees for the unexpired portion of the term shall
be forfeited.
39.
No vendor may transfer, assign or sublet their stall to another person, except a member of
their immediate family, without the approval of the Market Manager and the Executive.
40.
In the event of the death of a vendor, the fees for the unexpired portion of the term may
be refunded to the family once the Treasurer has been informed in writing.
41.
Any vendor who wishes to forfeit or cancel their permit may request a refund for the
unexpired portion of the fees, provided that adequate notice (seven days) is given in
writing.

42.
Upon approval of the Executive, a year's absence may be granted to a vendor.
43.
If two or more businesses are sharing a stall (cooperative), they each must pay the yearly
Association Membership fee; however, they are only required to pay for the stall used.
44.
Each vendor may hold a maximum of two stalls and, where possible, they will be side by
side.
45.
Non-profit organizations may be allocated a free space for fund raising purposes. To
ensure a space, bookings must be made with the Market Manager well in advance.
46.
Raffles are allowed only when permission has been received from the Town of St.
Andrews.
47.
Vendors, who repeatedly violate any of the guidelines in this handbook, shall be
informed in writing by the Executive that their membership is under review and that it
could be revoked, if the situation is unchanged. If a membership is revoked by the
Executive any pre-paid fees are non-refundable.
48.
When voting is required, each Association Member in good standing is allowed one (1)
vote, e.g. two (2) stalls, one (1) member = one (1) vote.
49.
Although the St. Andrews Farmers' Market Association carries basic insurance coverage
for personal injury, vendors are responsible for injuries caused by their negligence or
losses due to damages to their products/wares.
50.

51.
Any complaints or grievance must be put in writing and addressed to the Executive. All
decisions by the Executive are final.
52.
Any items not covered above will be dealt with at the discretion of the Executive.
