“The process by which courts

Congress or state legislatures
are constitutional.”
Legislative Intent

It is nearly impossible for a legislator
to foresee every aspect of where a law
may come into play ( e.g. Regina v. Dudley & Stephens)

Therefore it remains the judges role in
a court case to determine what was the
desire of the legislators when the law was
drafted.
Case Law
To maintain consistently and fairness,
judges will also look to ruling of other
judges that hear cases were the laws and
facts are similar.
 These cases establish precedent : which
cares the weight of law for rendering a
decision.
 The concept of precedent exists within a
Federalism structure.

