Guidance 3 Worker Classification • Should the service provider/worker be classified as an employee or an independent contractor? • Applies to all service providers on campus (consultants, project assistants, lecturers, editors, dancers, translators, etc.) • Determination must take place prior to any services being performed • IRS is focusing many resources on worker classification issues because a significant economic incentive exists for employers to classify workers as independent contractors as opposed to employees • Misclassification may result in substantial assessments of delinquent taxes and potential interest and penalties 4 Worker Classification • Three tests to assess the employer’s degree of control, right to direct and the worker’s independence • Behavioral control • Focuses on the type of instructions given and the training provided to perform the job • Financial control • Addresses the right to control the business and financial aspects of the worker’s job • Relationship of the parties • Considers how the parties perceive their relationship • Speaks to the parties’ intent with regard to direction and control of the work • No “bright line” test or measure to make the determination • • Collect information and weigh to make the determination None of the tests are conclusive in and of themselves 5 Worker Classification • Identify the person as a service provider • Complete Independent Contractor/Employee checklist prior to the services being performed and prior to any submission for payment (new web based form to complete and submit) • Submit to Tax Office • IRS Form SS-8 may be filed by either a worker or a business to request an IRS determination of worker status • Checklist is not necessary if the services are for 1 day or for a couple “parent” agency is required prior to services being performed – “Borrowing” agency completes form and payment is made through “parent” agency – IC/Employee checklist is not necessary • of 4% on payments of more than $1,500 during a calendar year for certain personal services performed in NC by nonresidents and for services performed in NC by ITIN holders • foreign limited liability companies, partnerships, and corporations • “Personal Services” compensation is any compensation paid for providing a service For purposes of the 4% withholding, the personal services subject to withholding are limited to the following personal services in connection with: • A performance • An entertainment or athletic event • A speech, or • A “speech” is one that amuses, entertains, or informs and includes instructors at seminars that are open to the public for an admission fee • The creation of a film, radio, or television program • 10 Services Performed in NC by ITIN Holders • An ITIN (Individual Taxpayer Identification Number) holder is a person who is not eligible for a social security number and whose taxpayer identification number is an ITIN • Only applicable to individuals • “Services” is any service performed in NC for compensation other than wages 11 Reportable Payments • Form 1099-MISC issued for each non-employee person paid at least $600 in the calendar year for “reportable payments” • Rents • Fees • Commissions • Services performed as a nonemployee • Prizes and awards to nonemployees • Expense reimbursements • Gross proceeds to an attorney 12 Reportable Payments • The following payments are not required to be reported on Form 1099-MISC: • Payments to corporations • Payments for merchandise • Employee business expense reimbursements • Scholarships or fellowships 13 Fringe Benefits • A form of pay in addition to stated pay for the performance of services • Examples: travel and meal reimbursements, subscriptions to business periodicals, employee picnics, sporting or theater tickets • General rule: Additional pay is taxable unless specifically excluded by the Internal Revenue Code • Common exclusions: • Accountable plan • Working condition fringe benefits • De minimis fringe benefits • Qualified tuition reductions • Meals or lodging for employer’s convenience • Qualified moving expense reimbursements Nonresident Alien for Tax Purposes 15 Nonresident Aliens General Rule • Must withhold federal income tax from all income payments made to or on behalf of a nonresident alien • Withhold at 30% unless – An exception is available (IRS code, treaty, 14%, wage withholding), and – The requirements for exceptions are met • If the withholding agent does not withhold the appropriate amount of tax at the time of payment, the withholding agent will be liable for the tax, plus any penalties and interest – regardless of whether the individual pays the tax on his or her tax return 16 Foreign National Information Form – Visitor Version 17 Royalties • Payment for the use of intellectual property • Examples include: • Rights to music, movies, literature • Licenses • Need to determine the residency status of the payee • Treaty benefits may be available, depending on the country, if recipient has a US TIN (Taxpayer Identification Number) 18 Gross-up • Increase of gross payment due to recipient to
