Box 970994, Waipahu, Hawaii, 96797-0994 Phone No. 677-3224 UVC RENTAL POLICIES AND PROCEDURES 1. POLICE SECURITY: A uniformed Honolulu Police Department (HPD) officer is required at all functions. This Special Duty Officer will be contracted for the duration of the function or until all guests have left and the parking lot is cleared. HPD can be arranged by UVC but the renter is liable for payment on the day of the function. Minimum police requirements: 4 hours for evening events from 6:30 p.m. to 10:30 p.m. On Sunday’s daytime schedule from 11:30 a.m. to 2:30 p.m. U.V.C. reserves the right to cancel the event if no police protection is provided. 2. DEPOSITS: Renter will pay U.V.C. a non-interest bearing deposit at the time of the signing of this agreement. Deposit will be refunded within (7) seven days following the date of the activity provided there are no unsettled accounts, i.e.. charges due to unsuitable clean-up, losses and damages. U.V.C. will let the renter know at the end of the rental activity if deposit will be refunded, totally partially or withheld. If the deposit is withheld partially or totally, U.V.C. will give the reasons for such action. 3. PAYMENT: Rental fees, in full, must be paid no later than 30 days for non-members and 15 days for members prior to the date of the activity. Non receipt of rental fees by deadline will be construed as a “cancellation” and the deposit retained. All payments, including deposits must be either in Cash, cashier’s check or money order. Stop Payment/Returned Checks: A $35 fee will be charged for any returned checks. UVC reserves the right to refuse any reservation due to any returned check for stop payment and/or insufficient funds. 4. ADDITIONAL INSURANCE: It is required that Renters purchase a $1,000,000.00 General Liability Insurance Policy for all events held at the UVC facility. 5. CONFIRMATION: Reservation is not confirmed until an application is approved by U.V.C. 6. CANCELLATION: If cancellation is made within 31 to 60 days before the use of the HALL, fifty percent (50%) of the rental fees and deposit will be refunded. Cancellation made 30 days or less by non members or 15 days or less by members before the use of the HALL will not be refunded (exceptions are cancellations caused by hurricanes, earthquakes and other calamities by acts of God or beyond our control). 7. RENTER: Renter must be present throughout the activity, including setting up and clean up, until the last guest have vacated the HALL and premises. Exception will be made only if prior coordination and approval have been made from U.V.C. 8. SETTING UP: Setting up for decorations and other arrangements must not start earlier than 2:00 p.m. for Evening rental and 6:00 a.m. for Sunday daytime rentals. If earlier set up times are needed, they must be fully coordinated and approved by U.V.C. An additional charge of $10.00 will be assessed for each additional hour or fraction thereof. 9. CLEAN UP: Renter will be responsible for cleaning up the rented premises of/and all trash, rubbish and other materials resulting from the renter’s activity. U.V.C. will explain the standard of cleanliness expected. Trash and rubbish are to be disposed of by renter by placing in garbage dumpster/bin situated inside the parking lot near the main gate. Clean up involves all areas and facilities used (kitchen, stage, sidewalks, parking lot). All decorations must be removed and all chairs, tables, and other equipment must be properly placed in their original manner and designated area. Floor must be swept and wet mopped. If clean-up is not done as required, U.V.C. reserves the right to withhold the deposit. Unless otherwise arrange for, U.V.C. will not be responsible for any personal property left on the premises by the renter after the renter has vacated the premises at the end of their activity. 10. SERVING OF ALCOHOLIC BEVERAGES: Renter agrees to release and save harmless the United Visayan Community of Hawaii. Inc. from and against any and all expenses, claims, and damages arising out of the serving of alcoholic beverages. Under Hawaii State Laws, alcoholic beverages will not be served to anyone under the age of 21 years. The Renter is the “Responsible Party” and will be held liable and shall indemnify and defend UVC in any enforcement action or claim arising from the consumption of liquor by persons under 21 years of age. The Renter will be held accountable for all and any cost for attorney and legal fees involved in any action. If liquor will be served, renter understands that two (2) Police Officer’s security is required and additional charges may be charged. (2) 11. MUSIC: (especially disco and dancing) The Renter must control the music and noise level so as not to disturb or annoy surrounding residents and comply with the State Health Department Noise Code Regulations. All music must stop by 10:00 p.m. 12. PARKING: Parking spaces next to the HALL (within the fenced area) are limited. Renter’s guests must be advised not to park on reserved parking stalls nor block entrances or driveways of nearby residential units. Church parking is available for a $30.00 donation per night. 13. USE OF KITCHEN FACILITIES/SUPPLIES: Renter must not use U.V.C. kitchen utensils, and equipment. (ie. stove, oven, microwave , or refrigerator). Renter is responsible to furnish their own garbage bags for the trash. U.V.C. will furnish toilet tissues and paper towels for the restrooms. 14. NO SMOKING SIGNS: Renter must insure “NO SMOKING” is absolutely enforced inside the HALL, including the rest rooms, storage rooms, stage, and kitchen areas by guests. 15. TERMINATION OF AGREEMENT: U.V.C. reserves the right to cancel a reservation at anytime for just cause; (i.e. renter conducting activity in a manner dangerous or damaging to persons or party. Renter fees and deposit will be withheld. 16. INDEMNIFICATION: Renter shall save harmless and indemnify U.V.C., its members, successors and assigns from and against all claims, demands and actions for personal injury, property loss, and damages occurring by reason of rental and use of HALL, its premises and parking lot.
