Step 1: Initial Processing of Accounts
S & S Recovery, Inc. will accept for collection all accounts referred by your Company without
regard to geographical area, amount, or age of the account. Our collection efforts fully comply
with all federal, state or local laws and regulations. S & S Recovery, Inc. maintains ethical and
lawful collection practices with every account. Threats, intimidation and harassment will never
be a means of collection. Persistent, firm attempts deliver positive results for your Properties. All
members of our staff act as an extension of your Company while recovering delinquent
payments. We act in full compliance of the Fair Debt Collection Practice Act as well as all state
and federal laws.
After S & S Recovery, Inc. receives your account placement, accounts will be entered into our
collection system, placed in the proper department to start collection efforts. Your Company will
receive a written acknowledgement from S & S Recovery, Inc. within ten (10) calendar days.
S & S Recovery, Inc. shall use its best efforts to achieve maximum recovery of the accounts
referred for collection. These efforts will include, but are not limited to, a pre-collection process,
skip tracing programs, telephone calls, and mail efforts
Step 2: Collection Processing
S & S Recovery, Inc. will make as many calls as necessary, as allowed by law, to collect past
due amounts from borrowers, and we will explore all possible avenues to obtain the funds, or to
determine if the account is uncollectible.
All borrowers and loan cosigners will be sent a series of debt collection letters informing them
that the account has been placed for collection and how to resolve the matter. All debt
collection activities are initiated within three (3) working days after placement of an account.
Samples of our correspondence are provided in Exhibit B. Letter #11, the “Validation of Debt
Letter”, is the first notice to the borrower that the account has been placed for collection. It is
sent to the borrower when the account rolls to active collections. As indicated on the letter, the
borrower is given 30 days to dispute the validity of the debt.
The borrowers and loan cosigners will also be sent confirmation letters when payments have
been received. As shown, we do provide a toll-free number that borrowers can use to contact
S & S Recovery, Inc.
S & S Recovery, Inc. notifies the borrower by mail that a debt is owed at least 3 times. We also
attempt to contact the borrower via phone call on a monthly basis.
We discuss several different options with the defaulted borrower, and we ask them to try for a
loan to recover all our clients’ past-due debt. If this is not possible, then we negotiate a down
payment with the agreement of monthly payments. If, after we have verified all information and

gone over budgets with defaulted borrowers, we will try to work out whatever is possible to put
the defaulted borrower on the right path to take care of their delinquent obligations with our
clients.
Step 3: Phone Collections and Skip Tracing
The collection manager will assign accounts with phone numbers to our skilled professional
telephone collectors. S & S Recovery, Inc. will make as many calls as necessary, as allowed
by law, to collect and will explore all possible avenues for the consumer to obtain the funds, or
to determine if the account is uncollectible. S & S Recovery Inc understands a different voice or
approach can sometimes make a difference. Every 90 days accounts are placed in different
collector’s queues to ensure the accounts are worked by different techniques and individual
strengths of that collector. S & S Recovery Inc will continue to rotate accounts until the account
has been resolved and all efforts are fully exhausted.
Accounts without phone numbers will be sent to our research/skip tracing department for new
location information. We utilize several skip tracing services to locate any borrowers that are not
easily found. For more information please call.
Step 4: Reporting to Credit Bureaus
We will report to credit bureaus, if and when our clients require us to do so and is
aptabcul by Law. When our clients require reporting, we report all borrowers to a minimum of 3
major credit bureaus (Equifax, Experian and TransUnion) on a monthly basis.
Step 5: Client Reporting and Performance Updates
S & S Recovery, Inc. provides formal monthly statement reporting to our clients, usually by the
10th day of each month, listing all pertinent payment information from the previous month.
Checks to your Company will accompany the monthly reporting.
S & S Recovery, Inc. may also provided monthly debtor status reports, and can provide
quarterly or annual status reporting, if requested by your Company. S & S Recovery, Inc. can
also accommodate any reasonable request to generate reports on individual accounts or
collective accounts by status, balance, date, and almost any feasible data desired. These
reports are available by request without charge.
S & S Recovery, Inc. also provides current borrower address and telephone number information
reporting to our clients.
Step 6: Legal Procedures
S & S Recovery, Inc. views litigation as a last resort, but sometimes it becomes necessary.
S & S Recovery, Inc. is prepared to assist your Company in this area. We have the capability
to file suit and serve papers in all states in the USA and U.S. territories.
Generally, we evaluate and recommend cases for litigation if we determine that a borrower has
a means to pay but refuses to do so. In those instances, the account will be referred to your
Company for Legal Authorization. Once authorized by your Company, S & S Recovery, Inc. has
an in-house legal department, and we also have access to over 48 attorneys nationwide to
assist you with your litigation efforts. We will obtain any judgments that are allowable by
law.

Step 7: Account Closure
Generally, S & S Recovery, Inc. closes accounts based upon guidelines provided by our clients.
This means that your Company would have the authority to decide if and when they want
accounts closed.
For example, some clients want accounts to be closed after 12 months of nonpayment; other
clients want accounts closed after 18 months of nonpayment. Other clients want accounts to be
retained by S & S Recovery, Inc. until the account is paid in full, the borrower files bankruptcy,
upon the borrower’s death, until the expiration of the contract, or until S & S Recovery, Inc. is
able to verify that a judgment is uncollectible.
When S & S Recovery, Inc. learns that a borrower has filed bankruptcy, we first verify that the
client’s debt was included in the bankruptcy filing.
We then document the following information:

Payment Processing Procedures
Net Fee vs. Gross Pay
The majority of S & S Recovery, Inc.’s clients pay on a net-of-fee basis. Therefore, in most
instances, our commission dollars stay in house.
Others pay on a Net 30 basis. In other words, all funds collected are remitted to the client, and
S & S Recovery, Inc. is paid after invoice. Regarding our gross-pay clients who pay on a Net 30
basis, S & S Recovery, Inc. has a great turnaround rate because our goal is to have our clients’
monthly statements closed out and in the mail by the 5th or 6th of each month. We do not hold
funds or statements 20 or 25 days.
Due to our number of clients and our revenue stream mix, we are able to maintain more than
sufficient working capital, and S & S Recovery, Inc. is able to accept payment on Net 30 terms,
if necessary

S & S Recovery, Inc. accepts all of the following forms of payment:
S & S Recovery Inc uses Western Union Speed Pay for check
by phone. It is not an automated clearinghouse. It is actually
a paper check that we print daily so that we have a paper trail.
We use Western Union Quick Collect, Money Gram, and bank
wire transfers. We accept credit cards (Visa, MasterCard,
American Express), and payments are processed at
S & S Recovery, Inc.’s stand-alone terminal. We do not
collect payments over the Internet for confidentiality and
security reasons, plus we feel we have a better collection rate
because we obtain the following information from borrowers
when we have them on the phone: credit card numbers, their
3-digit credit card SIC code, their billing address, and billing
zip code. This has a secondary benefit as well: we are able
to keep the latest borrower address and phone number
information on file.
Cash Handling Procedures and Funds Security
For control purposes, two (2) individuals in S & S Recovery,
Inc.’s accounting department process all payments. One
individual performs posting and balancing; the other
reconciles manually and deposits the daily payments. A third
person, the administration manager, then reviews all reports.
Deposit slips are made after balancing has been completed,
and deposits go to the bank daily. All of the daily computer
and manual records are reconciled with bank statements and
all other monthly records. They are then turned over to an
independent CPA firm for auditing and reconciling.
Payments are always audited for verification that they have
the correct account number, date, amount and signature.
Funds availability on all payments over a certain dollar
amount (usually $500) is checked before checks are
deposited. In other words, borrowers must prove that there is
money in the account before we will take a large payment.
Payments are posted, tapes are run on the entries, and
payments are balanced to a daily payment trust journal, which
are computer generated.

Technology
Following is a description of the type of systems and tools which S & S Recovery, Inc. will use
for the collection of your Institution’s past due accounts.
Hardware and Software
Our network is monitored and supported 24x7 by
, a managed IT services provider
based in Bartlett, TN. Our data is kept safe and secure by a robust backup and disaster
recovery plan and the latest in information security products, including sophisticated firewall,
intrusion detection, and network access protection services. Patch management and antimalware update services ensure network health and keep our systems up-to-date and secure.
Enforced network polices, as well as physical security measures, keep our company compliant
with industry mandated standards and the Notification of Risk to Personal Data Act (NORPDA).
Continuous, deep monitoring and remote management of critical servers with active notifications
of any problems that may arise ensure constant availability so we can handle your accounts
with no unnecessary downtime.
S&S Recovery, Inc. currently has computer technology that is considered the most reliable in
the industry. We maintain an IBM AS400 mid range computer for our main system server which
has fail proof architecture and a state of the art network computer system attached directly to it.
This provides a double firewall protection and multifunctional capability for our company. The
AS400 is the preferred midrange system being used by major corporations worldwide.
Our own in house software a derivative of the ACS the ‘Control Collection Management System’
which has been serving the collection industry since1980 allows us to process new accounts
and payments on a real time basis. This system has allowed our agency to create any process,
form, report or function on a moment’s notice, thereby allowing us to respond to a clients or our
own internal needs in a timely manner. We do not have to wait for an outside software vendor to
incorporate what we need in to our system. We can receive new accounts placed electronically
in any manner or format you have with our client portal on our website. We are able to generate
reports and statements when you need them and track collections for you so that our results are
available to you at any time. We can produce specialized reports that you may need as well.
Our system also provides:
o Automatic accounts follow up in a real time environment with documentation for auditing.
o All of our skip tracing tools are state of the art and are fully automated and integrated with our
system to ensure maximum results.
o Accounts can be scheduled in a variety of ways allowing the collector flexibility.
o Accounts can be worked by the collector in accordance with our unique Client Adaptor Code
a process that we formulated. For example some institutions will not sue, so the collector
needs know this real time on the individual account and can when he views this code.
o Real time auditing of the collectors daily progress can be viewed by the collection managers.
o Payments that have been promised are automatically monitored.
o Reports and remittances can be tailored to your institutions needs.
o All accounts remain available for review on our system whether they are active or closed.

Client Web Portal
S & S Recovery, Inc. offers a secure online portal to our clients. The capabilities of this online
portal are as follows:
1. Your accounts (via excel placement form) can be uploaded to us thru our Secure FTP Web
Portal or any other means that you prefer.
2. Clients can inquire about the current status of a borrower’s account as well as find up-to-date
information concerning a borrower’s address, phone numbers, etc.
Telephone Systems
The phones used by S & S Recovery, Inc. are Polycom 550. Our phone carrier is Zayo
Managed Hosted Solutions. Our automated attendant system has 48 incoming lines. Each
collector has three phone lines that they can use to take calls. In the event that the collector is
away from her desk, the phone call rolls to a personalized, automated voicemail. There has
never been a situation where our phone system has been near capacity and borrowers have
received a busy signal.
Predictive Dialing Systems
We utilize an auto-dialer (Noble Systems) on occasion, but feel a personalized phone call yields
much better results.
Data Loss Prevention Procedures and Disaster Recovery Plans
S & S Recovery, Inc. has made disaster recovery a priority to aid in an unexpected situation.
Our agency has plans in place to work through and safeguard client data in the case of terrorist
attack, fire, severe weather, technology failure or any other disaster/catastrophe caused by any
unknown source. We have in place contracts with BeneCom Technologies, Powered by Dave,
Zayo Managed Systems and Ware Properties LLC. BeneCom Technologies of New Orleans
has the contract for our main data server IBM AS400 and Ready Teks (Munford, TN) has our
internal PC and network plan. Ware Properties LLC with whom we rent our office space has the
availability for us to move into another of their several locations in the Memphis, Mid-South
area. Our VOIP phone system is a hosted solution from Zayo Managed Services. For any

Miles Harper
Miles is the General Manager of S & S Recovery, Inc. Mr.
Harper’s experience spans over 17 years within the collection
industry. He began as a collector and worked his way to
supervisory and management positions. He then transferred to
sales where he became the Director of Sales and Marketing. He
increased the sales department’s employee force and doubled
the client base. Mr. Harper is now the General Manager and has
an active Location Manager License with the State of Tennessee
Collection Service Board:

employee of S & S Recovery, Inc. since October 1997.
Jennifer has 22 years in the collection industry and has been a
great asset to the growth of our company. She had a dedication
and knowledge that is incomparable in the industry. Since

Jason is S & S Recovery, Inc.’s Director of Client Relations. He
has been with S & S Recovery since 1999. He has worked in the
collection industry for 16 years.

have been in the collection industry. She has been with S & S

Once the training period is complete and the CTS are comfortable that the new associate has
retained the training information, the collection manager oversees a test. This initial test is to
ensure that the new associate clearly understands what is required and expected from a legal
point of view, S & S Recovery’s policies and procedures point of view and from a client specific
point of view.
S & S Recovery Inc understands one time training isn’t enough. From there our collection
associates are provided ongoing training with one on one mentoring, via videos, collectionbased conferences and literature. We also obtain the latest information concerning the everchanging higher education industry from our many sources such as The American Collector's
Association (ACA). This information is immediately distributed to our collection team and a plan
of action, if necessary, is thoughtfully put into place accordingly. We continuously monitor phone
calls, examine tactics and test our collection team to verify our high standards are being upheld.
We are always open and perpetually seek new methods for delivering the best product available
to our clients.

These training methods has proven to be very successful and a benefit to S & S Recovery Inc
with a high degree of employee loyalty by our turn around rate of upper management 0% in the
last 5 years and collection specialists at 15%.

Our quality requirements are set to meet and exceed industry standards. S & S Recovery, Inc.
routinely reviews client accounts to ensure Fair Debt Collection Practice Act, State and Local
Laws as well as client specific work standard compliance standards are met. These

Exhibit D: Legal Proposal
S & S Recovery, Inc. firmly believes that legal action and the possibility of legal action is an
important and necessary part of the collection process.
To simplify the process, S & S Recovery, Inc., proposes the following steps:
1. We will utilize all steps possible and request suit as a final resort.

2. We will attempt to set up a payment plan with the borrower and request suit authorization
only when a repayment plan cannot be agreed to or is not kept.
3. We will utilize the services of only a ACA certified law firm that will try cases in your state.
When a borrower is out of state and thus out of the jurisdiction of the state courts, we will
attempt service to the borrower under the Long Arm Statue, where applicable.
4. This step in the litigation process will be the most important reason to restart the suit
process and to be confident that borrowers are not being sued due to personality conflicts
with a collector or they are attempting to make an example out of one person.
The Process over many years by collection companies has been to advance the court cost and
recover the advance on the client’s next statement. This can amount to “Throwing good money
after bad”.
We only request that you have sufficient records to substantiate the debt and should a borrower
dispute the claim, provide for the court an employee to testify that they are familiar with the
books and records and that the debt is just and owing.
