___________________________________________, represented by _________________________________________, (hereinafter referred to as

Customer ), on the one hand, and ____________________________________________________ (hereinafter referred to as Contractor ) represented by ____________________________________, on the basis of ________________________________, on the other hand, have concluded the present Contract on the following.
1. Subject of the Contract.
1.1. Under this Contract Contractor is obliged for the payment and on assignment of the Customer to provide a range of services for organization of entertainment event, namely pleasure trip on a river boat/ship in the water area of the Dnepr River near Kiev city.
2. Rights and Obligations of the Parties.
2.1. Pursuant to this Contract Contractor shall provide:
2.1.1. Availability of the boat/ship «__________________________» ___.___.201__ at ___:___ o’clock at the place of embarkation on the wharf type and name of the craft

2.1.2. Execution of the trip on the Dnepr River ___.___.201__. from ___: ___ o’clock to ___ : ___ o’clock.
2.1.3. Disembarkation of passengers ___.___.201__ at ___ : ___ o’clock.
2.2. Pursuant to this Contract Customer is obliged:
2.2.1. During the trip not to allow to the persons on board, who are under the responsibility of Customer (His\Her clients, employees and other persons involved by Him\Her), to use the craft in a manner inconsistent with the purpose of the travel and/or bearing the risk of spoilage or damage to the craft and/or the property on it;
2.2.2. To comply and ensure that persons who are under the responsibility of the Customer on board to comply with the fire safety regulations, labor protection rules, sanitation rules and regulations, other compulsory rules and standards of conduct, as well as special (internal) safety requirements when staying aboard the craft, just as with lawful, rational and justified demands of the senior on board;
2.2.3. To immediately inform the senior on board and the representative of Contractor about all incidents and/or unusual situations, and/or emergencies, threatening human life and health, as well as threatening safety of the property, including third parties, and to take feasible measures to prevent them, without putting oneself at risk herewith.
2.3. Both Parties have the right to claim from each other faithful fulfillment of the commitments agreed.
3. Cost of services and payment terms.
3.1. The total cost of services offered under this Contract is _______ UAH, including:
3.1.1. Ship/boat rent according to pp. 2.1.1-2.1.3 is ________ UAH.
3.1.2. Catering services for ____ persons is ________ UAH.
3.1.3. Provision of M.C. and DJ services with sound equipment is ________ UAH.
3.1.3. Renting the attraction «Sports Equipment» with services of two employees is ________ UAH.
3.2. Payments between the Parties are made as follows:
3.2.1. Payment of _________ UAH is made by Customer not later than ___.___.201__, which is the cost of booking the ship.
3.2.2. The rest of the payment _______ UAH is made by Customer not later than ___.___.201__
4. Responsibilities of the parties and resolving disputes.
4.1. In case of violating the obligations arising from the terms of this Contract Parties bear liability under the current legislation of Ukraine. In this case the Party at fault shall compensate the other Party caused losses.
4.2. All disagreements and disputes arising from this Contract or in connection with it shall be resolved through negotiations by representatives of the
Parties. In case the Parties cannot reach agreement, the dispute shall be referred to the court in accordance with the judicial and administrative jurisdiction rules, established by the current legislation of Ukraine. Compliance with the pre court (claim) procedure about dispute resolution is compulsory for the Parties.
4.3. Customer shall be liable for any damage, caused by HIM/HER or by persons who are on the ship/boat under the responsibility of Customer, to the property of Contractor or third parties.
4.4. In case Customer violates the terms of pp. 3.2 of this Contract and fails (cancels) the trip (tour) on the ship/boat in connection with this, the booking cost shall not be returned. Possibility of further fulfillment of the Contract is agreed between the Parties by signing Supplementary agreement to the Contract.
5. Duration, circumstances, force majeure and other terms of the Contract.
5.1. This agreement comes into force upon signature and shall continue until the completion of the trip on the ship.
5.2. In case the Contract termination is initiated by Customer, the money paid by Customer according to pp. 3.2.1 of this Contract, shall not be returned.
5.3. One sided change of the terms or withdrawal from Contract shall not be permitted.
5.4. Parties are not responsible for violation of the Contract in the case of force majeure circumstances, which occurred beyond their will and which prevent fulfillment of the Contract. Such circumstances are: war and military operations, riots, strikes, lockouts, disorders, embargoes, restricting the supply of electricity and energy sources, epidemics, fires, explosions, natural disasters, traffic accidents,
5.5. This Contract is executed and signed by Parties with full understanding of its terms and conditions in English on a single sheet in two copies of equal legal force, one for each of the Parties.
