REGULATION
On Organization and Operation of
Department of Science and Technology for Economic-Technical Branches
(Issued enclosed herewith Decision No 2835/QD-BKHCN dated December 10,
2009 by the Minister of Science and Technology)
CHAPTER I
FUNCTIONS, TASKS AND RIGHTS
Article 1. Position and Functions
The Department of Science and Technology for Economic-Technical
Branches (in short called CNN Department ) is an agency under the Ministry of
Science and Technology, which fulfills State management functions in terms of
scientific research and technological development in fields of mechanics,
metallurgy, electricity, electronics, chemicals, consuming goods and foods
industry, energy, petroleum, posts and telecommunications, commercial
tourism, materials, constructions, transportation, irrigation, architecture, urbanrural planning, planting, husbandry, veterinary, forestry, marine products,
preservation and processing of agricultural, forestry and aqua-cultural products,
medicines, pharmacy, national defense, security and others assigned by the
Minister.
Article 2. Tasks and Rights
1. Within assigned scope of work, developing and submitting the
Minister:
a) Drafts of legal and regulatory documents; guidelines, policies,
measures, planning, 5-year and annual plans on scientific research and
technological development activities.
b) Target directions, development methods, management mechanisms
for scientific research and technological development activities and the list of
National Science and Technology Research Program.
2. Providing guidelines, examining and organizing the implementation
of legal and regulatory documents; guidelines, policies, measures, planning,
plans, programs; development directions for scientific research and
technological development tasks after they are approved, issued; discovering
and coordinating with relevant functional agencies to submit the Minister for
handling violations as stipulated by laws.
3. Regarding management of scientific research and technological
development activities undertaken by Ministries, branches and localities in the
assigned management fields.
a) Being the focal point of managing, providing guidelines and checking
the implementation of scientific research and technological development
activities undertaken by Ministries and branches; coordinating the management
of those carried out by localities;
b) Estimating budget allocation; checking and monitoring the use of
budget for the science cause allocated for scientific research and technological
development activities undertaken by Ministries and branches;
c) Checking the implementation, assessing before acceptance national
Science and Technology tasks; recommending the list of scientific research and
technological development results which can be applied for production and
daily life.
d) Regularly on the annual basis or suddenly when requested
consolidating the report for the Minister on the status and results of scientific
research and technological development activities undertaken by undertaken by
Ministries and branches.
4. Proposing directions of capital construction, equipment and human
resource development of Ministries and branches under the assigned
management fields;
5. Coordinating to develop economic - technical norms, standards and
technical specifications;
6. Consolidating, developing databases on the list of experts and S&T
organizations under in the assigned management fields;
7. Being a permanent member of the Safety Council for Hoa Binh Dam,
Technology Group of Son La Hydroelectricity project and participating in other
organizations when assigned or delegated by the Minister.
8. Managing the organization, personnel, and assets and documents of
the Department according to the Ministry’s delegation of authority and existing
regulations;
9. Fulfilling other tasks assigned by the Minister.
CHAPTER II
ORGANIZATIONAL STRUCTURE AND WORKING MECHANISM
Article 3. The Department of Science and Technology for EconomicTechnical Branches organizes its work according to a mechanism in which the
leadership integrates with collective discussion.
The Director of the Department of Science and Technology for
Economic-Technical Branches is appointed, dismissed by the Minister of
Science and Technology and responsible to the Minister for the Department’s
entire operation.
Vice Directors are the people who assist the Director with the
Department’s management; entitled to decide on issues under assigned scopes
and be responsible the Director for the assigned tasks. Vice Directors are
appointed, dismissed by the Minister of Science and Technology based on the
Director’s proposal.
In case the Director is absent, one Vice Director is authorized to manage
and deal with the Department’s work on behalf of the Director.
Article 4. The organizational structure
1. The General Department.
2. The Department of Agricultural Science and Technology.
3. The Department of Industrial Science and Technology.
Article 5. The Department of Science and Technology for EconomicTechnical Branches follows regulations in which experts work directly with its
leaders and link with management roles of leaders of units under the
Department. In necessary cases, the Director can establish working groups or
units depending on work requirements and assign specific tasks for those
working groups, teams to implement assigned tasks.
CHAPTER III
WORKING RELATIONS
Article 6. The Director of Department of Science and Technology for
Economic-Technical Branches manages the Department's entire activities
based on the Regulation on Organization and Operation of the Department.
Article 7. The Director of Department of Science and Technology for
Economic-Technical Branches follows the working regulations and relations
with leaders of agencies under the Ministry according to the Ministry's working
regulations and other regulations issued by the Minister.
Article 8. The Department of Science and Technology for EconomicTechnical Branches is responsible for closely coordinating with the Department
of Science and Technology, relevant functional agencies of Ministries,
branches, Department of Science and Technology of localities and local units
in the implementation of assigned tasks.
CHAPTER IV
IMPLEMENTATION PROVISIONS
Article 9. The Director of Department of Science and Technology for
Economic-Technical Branches coordinates with the Director of Department of
Organization and Personnel to implement this Regulation.
Article 10. The amendment and supplementation of this Regulation is
carried out by the Director of Department of Science and Technology for
Economic-Technical Branches in coordination with the Director of Department
of Organization and Personnel to submit to the Minister of Science and
Technology for review and approval.
