On September 20, 2011, the Court sustained Nominal Defendant Yahoo! Inc.’s demurrer

to Plaintiff Miguel A. Leyte-Vidal’s Third Amended Shareholder Derivative Complaint without
4
leave to amend, on the ground that Plaintiff failed to allege sufficient facts to establish his
5
standing. For the reasons set forth in the Court’s Order, and for good cause appearing therein, IT
6
IS HEREBY ORDERED, ADJUDGED, AND DECREED that:

1.
Judgment of dismissal is entered in favor of Defendants, and against Plaintiff;
8
2.
Plaintiff shall take nothing; and
9
3.
Defendants shall recover from Plaintiff their costs of suit incurred herein pursuant

to applicable law, and according to proof.
