TERMS OF REFERENCE
INDIVIDUAL CONSULTANCY
Training Course on the topic
”Communication and Conflict Mediation”
1.
PROJECT BACKGROUND
The general objective of the Complementing EU Support for Agricultural Restructuring
project is to facilitate market-based farm restructuring through enhancing the ability of farmers, farm
family members and farm workers to manage their assets and income. Under this overarching
objective, the project will assist the Government of Romania (GOR) in completing the property title
registration of land assets in rural areas to improve the security of land property rights and reduce
transaction costs on rural land markets.
The objectives of the Project include:
Assist the GOR in improving the delivery of guidance services that enable the agricultural
population to more sustainably manage its income and assets and thus contribute to the absorption of
available national and EU support programs;
Improve the property rights security;
Endow owners and users of rural land with legal proof of ownership or operatorship;
Contribute to an enhanced functioning of rural land markets;
Standardize the processes for sporadic and mass registration.
The Project has three components: (1) a land administration component supporting capacity
building to conduct systematic adjudication in selected areas, upgrade and register land records in the
existing registration and cadastre system; (2) a component supporting the development of socioeconomic guidance services and their provision to the agricultural population, and (3) a policy,
strategy and management component, supporting project management and policy analysis activities.
The Land Administration Component will be implemented by the National Agency for
Cadastre and Land Registration (ANCPI).
ANCPI will also implement part of the Policy, Strategy and Management Component.
The specific target of the Land Administration Component is to achieve the systematic
registration of the immovable properties from the selected administrative-territorial units. The main
activities of the process include:
- the identification, description and registration of the immovable properties in the land
registration documents, their measurement and representation on cadastral plans and the data
recording in digital formats;
- the identification and registration of all immovable holders, for the registration in the land
books.
The systematic registration process seeks to include all property owners in Romania
regardless of social status, ethnicity, gender, age, etc. Therefore ANCPI will launch a national public
awareness and education campaign at the time of the systematic registration to inform and education
all Romanians about the systematic registration process and goals. In the pilot UATs there will be a
concentrated campaign organized by the surveying contractors to inform and educate residents in
more detail about the process and consult with them actively. There will also be targeted efforts to
include vulnerable groups.

The OCPI, ANCPI, City Halls and Contractors employees have the technical expertise to
carry out the project activities, but this expertise must be completed by specific skills in
communication and conflict mediation. They must communicate a correct message to the land
owners and for winning their confidence in view of participating to the project activities. They may
encounter citizens who do not want to participate, are fearful, confused or angry regarding their
property issues and for this cause they may encounter some conflicts that may exist within families or
between neighbors. The members of the field teams must deal with these issues and for that they
must have skills in communication and conflict mediation.
2.
OBIECTIVES
The main objective of the course is to enable participants to acquire knowledge and develop
the necessary skills in of communication and mediation in dealing with rural inhabitants and
vulnerable groups, within CESAR Project.
The Consultant is to organize the training course of 5 days duration. The training course will
be attended by 52 participants, 9 from OCPI Arad, Cluj, Harghita, 12 employees from ANCPI and 31
from City Halls.
Total number of participants: 52
Number of days of training for each participant: 5
Total duration of training: 3 weeks.
Estimated date: November-December, 2012.
Location: Brasov.
The participants will be from the following counties: Alba, Arad, Arges, Bihor, Brasov,
Calarasi, Cluj, Dolj, Galati, Harghita, Mures, Olt, Suceava, Teleorman, Timis and Bucuresti.
Training will cover two main aspects:
 Communication;
 Conflict mediation;
 Communication with vulnerable groups.
The Consultant will use during the course at least the following training methods:
 presentations;
 workshops;
 case studies;
 role play.
Will be created interactive modules, with accent on the practical dimension that will represent
60% from the course time (practice and exercises will represent 60% from the course time, basic
information and concepts skills will represent 40%).
The training should be more case study and role play based on scenarios rather than lectures
and that the participants should have the skills and tools needed to diffuse and manage conflicts that
may occur during the field works and to communicate a correct message to the land owners and for
winning their confidence in view of participating to the project activities.
Special emphasis will be placed on the subject communication with vulnerable groups which
are part of the project target group. The contractor should prepare a separate section in which
communication with vulnerable groups will refer to: understanding their special needs, identify the
tools and messages that can reach them, identify the correct stakeholders and opinion leaders they
thrust and which can be used as communication channels.
Expected results of the course:
 acquiring basic information on the communication process;
 to provide the methods and practical tools needed in communication with
vulnerable groups;
 simulation of situations possible faulty communication and providing necessary
knowledge and abilities for manage them;
 correct interpretation of the verbal and nonverbal language of the communication
partners with a view to obtaining the desired behavior and to avoiding conflicts;
 acquiring basic skills and tools to diffuse and manage conflicts that may occur
during the field works between family members or neighbors or with the field
teams;
 acquiring basic information on the sources, types, cycles and phases of conflict;
 acquiring basic information on strategies, methods, technical approach and resolve
conflict;
 acquiring basic information on conflict mediation.
3.
SCOPE OF WORK AND TASKS
3.1
Preparation of the program and material for the professional training course
3.1.1 The Consultant will prepare the program and the course support detailing the subjects list for
each day of training, and will set the training methods for the professional training course to ensure
communication and conflict mediation skills needed for the specific objectives.
The courses will take place according to a program proposed by the Consultant and approved
by ANCPI.
The Consultant will request the participants to sign the presence list for the course day. A
copy of this list will be submitted to ANCPI with the Final Report.
The result of this task will be the course program and the presence list.
3.1.2 The Consultant will prepare the PowerPoint Presentation and course support detailing the
subjects for the training, and will set the training methods.
The Consultant will ensure on its own costs production of the training materials.
The result of this task will be the course support and the PowerPoint Presentation.
3.1.3 Delivering the training course.
The consultant will have to train 52 persons. The course per person should be
approximately 5 days with a maximum 8 hours/day. The total number of courses should be
completed within 3 weeks.
The division of the 52 participants in the courses and the number of participants per course
will be proposed by consultant and will be approved by ANCPI.
3.2
Evaluation of the professional training course and of the trainees
The training will end with an evaluation of the delivered course material and of the trainees.
To this effect, The Consultant will prepare the evaluation structure and form.
For the evaluation of the course and of the materials, at the end of each training session the
consultant will request the trainees to fill in a questionnaire previously agreed with ANCPI and
including at least the following:
 subjects (quality and quantity);
 training methods;
 the trainer (professionalism, communication abilities, experience etc.).
The result of this task will be the evaluation questionnaires.
The Trainees evaluation will be done on the last day of the course, for each courses, based on
a questionnaire previously agreed with ANCPI. The evaluation will not exceed 2 hours.
The consultant will deliver ANCPI, at the end of each course a report which will include all
evaluation questionnaires completed by participants (see para.5).
3.3
Preparation of training facilities
The Consultant will ensure on its own costs:
 production and multiplying the training materials;
 production and multiplying the evaluation materials.
4.
WORK PRODUCTS
During performance and after completion of tasks mentioned above under 3. SCOPE OF
WORK AND TASKS, the Consultant will produce the following reports:
a) Preliminary Report:
 proposed course program and methodology;
 course support;
 role plays;
 case studies;
 template for presence list;
 template of questionnaires for course and participants evaluation;
 Power Point presentation, other training materials.
The Preliminary Report will be submitted to ANCPI within 10 working days from contract
signing.
b) The Report for each of the courses will describe the results of the respective activity and
will include:
 general information on the course development;
 evaluation questionnaires completed by participants;
The Reports will be submitted to ANCPI within 5 working days from the end of each course.
c) Final Report:
 general information on course flow;
 conclusions (positive and negative aspects);
 proposals and recommendations for other trainings;
 presence list, for each course day, signed by the participants.
The Final Report will be submitted to ANCPI within 10 working days from course
completion.
5.
LANGUAGE
The language used for the course will be Romanian.
All course materials produced by the consultant under this contract shall be made available to
the Client in Romanian, in hard copy and digitally in MS word or Power Point format by the case.
All the reports produced by the consultant under this contract shall be made available to the
Client in Romanian and English, in hard copy and digitally in MS word format.

* represents the total number of days allocated for all reports, since there will be three course
sessions following which will be presented reports for each finalized session.
The courses will start at the beginning of November, 2012 at ANCPI written request and will
be ended after the training activity and the Final Report are delivered.
7.
REQUESTED EXPERIENCE
In order to fulfill the assignment it is necessary to hire the services of an individual
consultant with the following background:
 University and/or post-university degree in communications, sociology,
psychology or other relevant field;
 Experience as trainer – at least 5 years
 Professional experience in communication - at least 5 projects;
 Professional experience in conflict mediation - at least 5 projects;
 Fluent in spoken and written English, Romanian and possess excellent writing
skills.
8.
CLIENT PROJECT MANAGER
Mr. Victor GRIGORESCU, Director, Project Management Directorate (DMP) will act as Project
Manager for ANCPI and Ms. Gabriela DUMITRU, Training Specialists – Project Management
Directorate will act as contract responsible.

The reports will be approved by the contract responsible in maximum 5 working days

10.
MISSION PLACE
The course will take place in Brasov. The location will be communicated after contract
signing.
11.
OTHER PROVISIONS
ANCPI will provide all the logistical arrangements (training room, coffee breaks, etc.), will
invite participants and make follow up to ensure their participation.
Payment will be done as follows:




20% after approval of the preliminary report and invoice registration at ANCPI
premises;
30% after delivery of the first training course and invoice registration at ANCPI
premises for the delivered services;
30% after delivery of the final training course;
20% after approval of the Final Report and invoice registration at ANCPI premises
for the delivered services.
