TENDER NOTICE
The Tenders are invited for supply & installation of split air conditioners, lift,
fire safety systems and computer hardwares, softwares for New Delhi
showroom of UPEC under ASIDE Scheme. The details of requirements, terms
and conditions are available with the tender form which can be obtained from
Lucknow or 5-B, Baba Kharak Singh Marg, New Delhi (Ph- 011-23742011)
office on payment of Rs. 250/- or can be downloaded from the web site of
UPEC in which case Rs. 250.00 will be paid alongwith earnest money of Rs.
10000.00 by demand draft payable in fovour of U.P.Export Corporation Ltd,
Lucknow. The proposals shall be received upto 18 August 2007 (2pm) at
Lucknow office and shall be opened on the same day at 3.00pm. The Managing
Director reserves the right to reject one/all proposals without assigning any
reason.

General Terms and Conditions
1. Sealed tenders are to be submitted in the O/O the Managing Director, U.P.
Export Corporation Ltd., 2, Rana Pratap Marg, Motimahal, Lucknow-226001.
2. Copies of the Tender Form can be obtained from Lucknow/New Delhi offices
of the U.P. Export Corporation Ltd.(5 B, Baba Kharak Singh Marg,New
Delhi) during working hours on payment of Rs.250/- by cash or demand draft
in favour of U.P. Export Corporation Ltd payable at Lucknow. The form can
also be downloaded from the website of the Corporation www.upexport.in. In
case the form is downloaded from the website the fee of Rs.250/- shall be
deposited by way of bank draft payable at Lucknow alongwith the tender
form.
3. The last date of submission of tender form in two sealed covers is -----------upto 2 p.m. No tender form will be received after the aforesaid date and time
under any circumstances whatsoever.
4. Tenders are to be submitted in two parts i.e. Part I and Part II and are to be
submitted in the manner as described below :a) Tenderers should put Part I of tender form duly filled and signed in a
sealed cover super scribed as Envelope No.1.
b) Earnest Money Deposit of Rs.10,000.00 in the form of demand draft in
favour of U.P. Export Corporation Ltd. payable at Lucknow should be
put alongwith Part I of the tender. The tender which is not
accompanied by Earnest Money Deposit in prescribed form will not be
considered.
c) Part II of the tender i.e. Bill of Quantities duly priced and signed should
be put in sealed cover superscribed as Envelope no.2. No conditions
should be put in Envelope No.2.
d) Tenderers are advised to refrain giving any clues in regard to their
tendered rates/price amount in Envelope No.1.
e) Envelop No.1 will be opened on ------------ at 3 p.m. in the office of
U.P. Export Corporation Ltd, Lucknow in the presence of Architect and
authorized representative of the Tenderer.
f) Envelope No.2 containing rates will be opened immediately after
opening the envelope No.1 subject to decorum being met.

5. Managing Director, U.P. Export Corporation Ltd reserves the right to reject
any or all the tenders without assigning any reason thereof.
6. The EMD of the contractor whose tender is accepted shall be forfeited in full
in case he does not remit the security deposit @ 3% of the value of tender
(including EMD) within 7 days of issue of work order. The security deposit
will be refunded to the supplier 14 days after the end of defect liability period
provided all the work has been executed satisfactorily and attended to all
defects .No interest is allowed on security deposit.
7. The defect liability period will be six months. The supplier shall make good at
his own cost and to the satisfaction of Corporation all defects , and other faults
which may appear within six months after completion of work. In default the
UPEC may employ and pay other persons to amend and make good such
defects and faults and expenses incurred thereon shall be made good and borne
by the supplier and such amount shall be recoverable/ deductible from any
amount due to the supplier.
8. The rates trade tax should be quoted separately. All other taxes (including
Works Contract Tax, Service Tax, VAT, Turnover Tax, Trade Tax etc.) ,if
any, shall be payable by the contractor and U.P. Export Corporation will not
entertain any claim whatsoever in this respect.
9. The tender for supply shall remain open for acceptance for a period of 15 days
from the date of opening of Envelope No. 2 of tenders. If any tenderer
withdraws his tender before the said period, then U.P. Export Corporation
shall be at liberty to forfeit Earnest Money paid along with the tender.
10. Time shall be considered as the essence of this contract and the supplier
hereby agrees to commence the work soon after the site is handed over to him
or from 7th day after the date of issue of formal work order as provide for in
the said Conditions whichever is later and to complete the entire work within ------------, subject to nevertheless to the provisions for extension of time.
11. All disputes and differences arising out of or in any way touching or
concerning the supply shall be referred to the sole arbitrator appointed by the
Board of Directors of UPEC and whose award shall be final and binding on
both the parties.
12. All payments by the Employer under this Contract will be made only at
Lucknow.
13. All dispute arising out of or in any way connected with this Agreement shall
be deemed to have arisen at Lucknow and only the Courts in Lucknow shall
have jurisdiction to determine the same.

3. The last date of submission of tender form in two sealed covers is -----------upto 2 p.m. No tender form will be received after the aforesaid date and time
under any circumstances whatsoever.
4. Tenders are to be submitted in two parts i.e. Part I and Part II and are to be
submitted in the manner as described below :a. Tenderers should put Part I of tender form duly filled and signed in a
sealed cover super scribed as Envelope No.1.
b. Earnest Money Deposit of Rs.10,000.00 in the form of demand draft in
favour of U.P. Export Corporation Ltd. payable at Lucknow should be
put alongwith Part I of the tender. The tender which is not
accompanied by Earnest Money Deposit in prescribed form will not be
considered.
c. Part II of the tender i.e. Bill of Quantities duly priced and signed should
be put in sealed cover superscribed as Envelope no.2. No conditions
should be put in Envelope No.2.
d. Tenderers are advised to refrain giving any clues in regard to their
tendered rates/price amount in Envelope No.1.
e. Envelop No.1 will be opened on ------------ at 3 p.m. in the office of
U.P. Export Corporation Ltd, Lucknow in the presence of Architect and
authorized representative of the Tenderer.
f. Envelope No.2 containing rates will be opened immediately after
opening the envelope No.1 subject to decorum being met.

5. Managing Director, U.P. Export Corporation Ltd reserves the right to reject
any or all the tenders without assigning any reason thereof.
6. The EMD of the contractor whose tender is accepted shall be forfeited in full
in case he does not remit the security deposit @ 3% of the value of tender
(including EMD) within 7 days of issue of work order. The security deposit
will be refunded to the supplier 14 days after the end of defect liability period
provided all the work has been executed satisfactorily and attended to all
defects .No interest is allowed on security deposit.
7. The defect liability period will be six months. The supplier shall make good at
his own cost and to the satisfaction of Corporation all defects , and other faults
which may appear within six months after completion of work. In default the
UPEC may employ and pay other persons to amend and make good such
defects and faults and expenses incurred thereon shall be made good and borne
by the supplier and such amount shall be recoverable/ deductible from any
amount due to the supplier.
8. The rates trade tax should be quoted separately. All other taxes (including
Works Contract Tax, Service Tax, VAT, Turnover Tax, Trade Tax etc.) ,if
any, shall be payable by the contractor and U.P. Export Corporation will not
entertain any claim whatsoever in this respect.
9. The tender for supply shall remain open for acceptance for a period of 15 days
from the date of opening of Envelope No. 2 of tenders. If any tenderer
withdraws his tender before the said period, then U.P. Export Corporation
shall be at liberty to forfeit Earnest Money paid along with the tender.
10. Time shall be considered as the essence of this contract and the supplier
hereby agrees to commence the work soon after the site is handed over to him
or from 7th day after the date of issue of formal work order as provide for in
the said Conditions whichever is later and to complete the entire work within ------------, subject to nevertheless to the provisions for extension of time.
11. All disputes and differences arising out of or in any way touching or
concerning the supply shall be referred to the sole arbitrator appointed by the
Board of Directors of UPEC and whose award shall be final and binding on
both the parties.
12. All payments by the Employer under this Contract will be made only at
Lucknow.
13. All dispute arising out of or in any way connected with this Agreement shall
be deemed to have arisen at Lucknow and only the Courts in Lucknow shall
have jurisdiction to determine the same.
