Pen-testing, Law and National Boundaries
Presentation Outline
Online security breaches are presenting serious challenges
for Australian business. To mitigate this, firms are
increasingly using “penetration testing” or “vulnerability
assessments” as a tool to assess the security of their
computer systems from unauthorised intrusions. This
seminar examines the role of penetration testers in contrast
to hackers, along with the domestic and international legal
issues associated with penetration testing.
Speaker Profile
Michael is a senior lecturer in law at
Edith Cowan University and a member
of the Western Australian and New
South Wales Bar Associations holding
an unrestricted practicing certificate.
He was admitted as a solicitor in New
South Wales in 1989 and as a barrister
in 1991 practicing extensively as
defence counsel in criminal law jury
trials and conducting appellate work.
Prior to joining ECU, Michael was a lecturer in Criminal Law
and Procedure for the Law Extension Committee within
the University of Sydney and up to 2005 was a Revising
Examiner for the Legal Practitioner’s Admission Board of
New South Wales. In 2004, Michael was a Visiting Lecturer
in Law at Chongqing Technology and Business University,
Chongqing, People’s Republic of China.
This Security Forum is organised by the
ECU Security Research Institute.
The forums are open to the industry, public and private
persons with an interest in the security domain.

Michael is the Forensic Investigation Course Coordinator
and between June 2012 and July 2013 he was the Law
Course Coordinator at ECU. Michael lectures in a number
of law units including the law of evidence, advanced criminal
law, public international law and terrorism and the law.
His research interests are in terrorism and international
humanitarian law.
