Farmers Market Participation Rules

Market Operation: Every Friday, 10am-2pm, from November 1 st through February 28 th

All market vendors must apply and be accepted prior to setting up and vending. The

Downtown Jamestown Market Manager will be responsible for selecting market participants.

1.

The term “farmer”, as used herein, means someone who grows at least 75% of what he or she sells at the DJFM, this includes wineries. The term “artisan”, as used herein, means someone who makes and sells handmade items at the market. Other vendors will be approved at the discretion of the market manager.

2.

The market is open to approved farms, wineries, artists, and crafters.

3.

The market will operate every Friday from November 1 st through February 28 th from

10am-2pm in the Dr. Lillian Vitanza Ney Renaissance Center, 119-121 West Third

Street, Jamestown, NY 14701.

4.

All vendors must be ready to sell by 10am. Vendors can set-up between 8am-10am at the discretion of the vendor. It is the responsibility of the vendor to arrive on-time to provide ample set-up time to open at 10am. It is mandatory all vendors stay until the market closes at 2pm, unless all product has been sold.

5.

The doors to the market will open promptly at 10am.

6.

Vendors must notify market manager in advance if unable to attend the next market day.

7.

Spaces for market will be assigned on a first-come first-serve basis at the discretion of the market manager. The market manager reserves the right to refuse any vendor from participating in the market.

8.

The 2013-2014 fee structure is as follows. Season vendors must be pay when agreement is submitted to adequately advertise the market. A season (16 week) commitment is required to participate in the winter market. i.

Season (16 weeks) = $160

9.

Once market agreements have been received, there will be no refunds given.

10.

Vendors supply their own tables, chairs, stand, signage, electrical cords, and/or canopy as needed. Please advise if electricity is required for your operation.

11.

Market and customers will have access to restroom facilities inside the Dr.

Lillian Vitanza Ney Renaissance Center at 119-121 West Third Street, Jamestown,

NY 14701.

12.

All farmers must grow 75% to participate in the market. A participating farmer may purchase from another local grower, but product must be grown locally.

13.

Baked goods (excluding custard, cream, pumpkin pies & pickles), confections, and fruit jellies produced in the home may be sold. No home-canned, non-acid foods such as beans, corn, or meat – due to inherent danger – will be allowed to be served. Those wishing to sell all of the above must obtain the proper licensing. Vendor must obtain a 20c license for all fruit breads.

14.

Food vendors, including those selling baked goods, must provide a copy of their Chautauqua County Health Department Health Permit confirming an inspected kitchen.

15.

Farmers engaged in the sale of plant material are required to be licensed in accordance with Article 14 of the Agriculture and Markets Law. Any vendor growing and selling plants or who buys and sells plants intended for outdoor use is required to be licensed as a nursery grower or a nursery dealer respectively.

16.

Farmers are permitted one (1) vehicle in the market venue at no additional cost. Any additional vehicles brought to the market will be parked in another location at the owner’s expense. One (1) parking space will be reserved for each vendor close to the market.

17.

The market is a SMOKE FREE environment. Smoking is prohibited in and around the market by all market vendors and customers.

18.

All vendors must dress appropriately for the market.

19.

All vendors must maintain a clean and presentable booth at all times. All spaces must be swept clean and debris removed from the sidewalk at the close of the market.

20.

All vendors must provide visible signage distinguishing their farm or business.

21.

All products must be properly marked, priced, and visible to the customers at

2pm when the market opens.

22.

Every vendor represents the integrity of the market. Customers are key to the success of the market. All farm and vendor employees must exhibit quality customer service at all times.

23.

Any participating vendor in the DJFM wishing to make a complaint must do so in writing and submit it to the market manager with a $20 complaint fee before the next market day. The complaint will then be reviewed between the market manager and all parties involved. If a viable complaint has been issued, the farmer who submitted the complaint will be refunded their $20 and necessary action will be taken. If complaint is unjustified, the $20 will then be deposited into the DJFM operating budget.
