Brian Preston SC to head up Land and Environment Court
NSW Attorney General, Bob Debus, has announced the appointment of Mr Brian Preston SC as
the Chief Judge of the NSW Land and Environment.
“I am delighted to announce this appointment,” said Mr Debus.
“Brian Preston is an eminent barrister and expert in environmental law. He is more than qualified to
continue the outstanding reform agenda begun by his predecessor, His Honour Justice McClellan.
“In less than two years Justice McClellan has instituted a range of administrative reforms in his
Court, that have substantially reduced waiting times, and established the Court’s reputation as an
innovative, state-of-the-art judicial body,” said Mr Debus.
“With Mr Preston’s appointment, the Land and Environment Court’s future remains in very capable
hands. “
Mr Preston has developed an impressive practice in environmental and planing law, administrative
law, commercial law, equity, building and construction.
Since 1992 he has taught at the University of Sydney and was involved in the establishment of a
number of post-graduate environmental law courses including environmental dispute resolution
and environmental impact assessment law.
Mr Preston is a member of the Editorial Board, Local Government Planning and Environment
NSW, Lexis Nexis Butterworths and a member of the Advisory Board of TREENET, a national
arboricultural research and education organisation at the University of Adelaide.
He has also worked on several national and international environmental law projects including the
drafting of national parks legislation for Trinidad and Tobago. He was a member of the teaching
faculty for the Indonesian Environmental Law and Enforcement Training Programme for the
Indonesian Judiciary and a member of the Legal Working Group, National Oceans Office, Australia
including providing advice in relation to the development of the National Oceans Policy
