TERMS & CONDITIONS
General
1.
These are the Terms and Conditions upon which Burwood Council agrees to supply services.
2.
The “Customer” means any person who enters into a contract with Burwood Council for the purchase
of waste collection services.
3.
A quotation or price given by Burwood Council is valid for 30 days, but no contractual relationship
shall rise until the Customer’s order has been accepted by Burwood Council.
4.
Burwood Council reserves the right to vary, modify, or revoke this Agreement at any time, providing
notification to the Customer in writing and taking effect from the date of notification.
5.
Commencement of service shall commence upon payment of 1st Monthly Service Charge.
Price
6.
All prices shall be those referred to in Burwood Council’s Schedule of Fees & Charges and/or
arrangements current at the date of invoice and prices shall be subject to change without notice.
7.
In the event of non-payment for the service without notice, Council will remove the bin from the
property after having given notice, and the applicant will be liable for the payment of an administration
fee ($58) and a bin removal fee ($70).
8.
Any service that is terminated can only be recommenced if all outstanding fees are paid in full. The
resumption of the service may incur a bin return fee ($70).

Terms of Payment
9.
Payment for the service must be monthly in advance, or part thereof.
10.
The service must be paid for before the commencement of the month. Burwood Council may
commence legal proceedings for recovery of any debt, including costs.
Termination of Agreement
11.
This Agreement may be terminated by the Customer giving notice in writing to Burwood Council.
Such notice is to be received at least one month prior to termination date. No refund will be offered
for monies already paid.
12.
This Agreement may be terminated by Burwood Council if accounts are not paid by the due date, or
if it is deemed the Customer has breached any other clauses in this Agreement.
Property & Risk
13.
The Customer shall be responsible for any loss or damage to waste receptacles for any reason
whatsoever except loss or damage caused by reasonable wear and tear. It is agreed that the repair
or replacement of waste receptacles shall be paid for by the Customer. The charge shall be the
value of the receptacle at any time plus delivery charges. The receptacles shall always remain the
property of Burwood Council.
14.
The Customer agrees to store waste receptacles on their property, however, shall present
receptacles as required at the designated collection point. Receptacles are to be returned to the
property by the Customer after collection.
15.
The Customer agrees to insure the integrity of the waste receptacles at all times. This includes
ensuring the drainage plug is in place and the lid is shut preventing the waste receptacles filing up
with rainwater and contaminants leaching into the stormwater system.
16.
If the Customer commits any breach of this Agreement, for the purpose of repossessing waste
receptacles, Burwood Council may enter into or upon any premises where waste receptacles may
be, without prejudice to the rights of Burwood Council to recover from the Customer any monies due
and the Customer indemnifies Burwood Council in respect of any claims, damages or expenses
arising out of any action under this clause.
Waste Not Collected
17.
The Customer will not place in the waste receptacles any waste that is classified by the Environment
Protection Authority (EPA) as industrial or hazardous. Further information on the classification of
industrial or hazardous waste is available from the EPA.
However, as a guide this includes the following:  paint, paint solvents and cleaners  chemicals or
empty chemical containers  pesticides (poison or baits)  pharmaceuticals and poisons 
asbestos  radioactive waste  liquid waste  toxic or corrosive substances  flammable liquids
and solids  explosives  gases  sharps waste  clinical waste  cytotoxic waste.
18.
The Customer acknowledges that should industrial or hazardous waste be placed in waste
receptacles, then those receptacles will not be emptied. Should, however, this not be evident until
after the emptying of a receptacles, then the Customer will be liable for the cost of the tipping of all

the waste so far collected in the waste collection vehicle at the appropriate tipping fee at an
authorised industrial/hazardous waste site.
19.
The Customer acknowledges they are entitled to a set number of services as agreed to in this
agreement and are not entitled to refund for non-presentation of bins.
PRIVACY STATEMENT
If you are applying for consent as an individual, you may be providing Council with personal information
(such as your name and address) within the meaning of the Privacy and Personal Information Protection
Act 1998.
You are obliged by law to provide your name and address. If you do not provide the personal information
requested Council may be unable to process your application.
Council is collecting this personal information from you in order to identify and process your application.
You may make application for access or amendment to information held by Council. You may also make a
request that Council suppress your personal information from being made publicly available. Council will
consider any such application in accordance with the relevant legislation.
