NOTICE requiring an occupier of premises to place
household waste for collection in specified receptacles

Notice
issued by ……… Council ('the Council') pursuant to Section 46(1) of
the Environmental Protection Act 1990 requiring you as occupier of premises known as
(describe premises and/or attach plan) in the Council's area to place any household
waste for collection from those premises in the receptacles described in [and in
accordance with the conditions specified in] the Schedule.
THIS IS A FORMAL NOTICE

Your right to appeal
You may appeal against the requirements of this notice to a magistrates' court within 21
days of the service of the notice or, where appropriate, within 21 days of the expiry of
any period for compliance with a condition specified in this notice.
3.
What happens if you fail to comply
Subject to your right of appeal, if you fail without reasonable excuse to comply with any
requirements specified in this notice, you may be liable to pay a fixed penalty under
Section 46A(4) of the Environmental Protection Act 1990.
